Summary
Mr. Roger Chudeau questions the Minister of the Economy, Finance and Industrial, Energy and Digital Sovereignty on the threshold allowing the exceptional redemption of popular retirement savings plans (PERP) of small amounts. Article L. 144-2 of the insurance code allows, under certain conditions relating in particular to the age of the contract or the last payments as well as the income of the tax household, the redemption of a PERP when the transfer value of the contract is less than 2,000 euros. This option, introduced by Law No. 2016-1691 of December 9, 2016, known as “Sapin II”, was intended in particular to allow PERP holders with low outstanding amounts to recover savings whose maintenance until retirement could appear disproportionate in view of the amounts concerned. However, the threshold of 2,000 euros set in 2016 has not been increased since then. The inflation that has occurred over the last decade has thus mechanically led to a reduction in the scope of the system. It can also lead to situations that are difficult to understand for savers: a holder whose transfer value of the contract remains slightly less than 2,000 euros can, subject to satisfying the other legal conditions, obtain redemption, while another whose savings exceeds this amount by a few dozen euros and is deprived of this option and must in principle keep his savings until his retirement rights are liquidated. This difference in treatment appears all the more difficult to justify as the sums involved remain modest and certain holders of these old retirement savings products may have an immediate need for these savings. He therefore asks him if the Government plans to revalue the threshold of 2,000 euros provided for in article L. 144-2 of the insurance code in order to take into account the evolution of prices since its introduction in 2016 and, more broadly, if it intends to study a relaxation of the conditions for repurchase of old PERPs with low outstandings.
