Summary

Mr. Pouria Amirshahi draws the attention of the Minister of the Interior to the risks posed, for the safety of users, by the increasing circulation of fatbikes and modified or unapproved electrically assisted bicycles on cycle paths, particularly in Paris. It is now common to come across vehicles on cycle paths that no longer meet the legal definition of an electrically assisted bicycle. Number of them are unrestrained and exceed the maximum authorized speed of 25 km/h, are equipped with motors with a power greater than 250 W, or can move forward without pedaling thanks to a handle of accelerator. Under these conditions, these vehicles are more like mopeds than bicycles and should, as such, not be used on cycle paths. Beyond their non-compliance, the significant weight of these machines, their speed high and the sometimes dangerous behavior of some of their drivers creates a real risk for cyclists, pedestrians and other users. Overtaking at high speed, failure to respect priorities or even sudden maneuvers contribute to significantly degrading the feeling of safety on infrastructures intended to promote soft mobility. This situation also harms cyclists who respect the rules and see their safety compromised by behavior unrelated to normal cycling. The MP therefore asks the Minister what measures the Government intends to take in order to strengthen controls on cycle paths to identify non-compliant vehicles and to carry out information campaigns recalling the regulations applicable to electrically assisted bicycles and mopeds. He asks him what specific instructions the Minister, in charge of road safety, intends to give in order to facilitate the detection of offenses committed with non-regulatory motor vehicles. He would also like to know whether the Government plans to change the applicable regulatory framework in order to better distinguish compliant electrically assisted bicycles from devices comparable to mopeds and thus preserve the safety and purpose of cycling infrastructure.
