Summary
Mr. Paul Christophe draws the attention of the Minister, to the Minister for Europe and Foreign Affairs, responsible for European affairs, to the difficulties caused by the repatriation of the bodies of French nationals who died in Belgium. The technical requirements applicable to coffins used for the repatriation of the bodies of French nationals who died abroad are covered by international conventions ratified by France. Article 3 of the Berlin Agreement of 1937 and Article 6 of the Strasbourg Agreement of 1973 provide for the use of a hermetically and metal-sealed coffin for reasons of hygiene. However, French regulations, and more particularly article R. 2213-20 of the general code of local authorities, consider that the closing of the coffin is definitive after the completion of the prescribed formalities. The translation from a zinc coffin to a wooden coffin is not permitted. In addition to the administrative complications and the additional cost generated by the repatriation of the coffin to France, relatives who would like to do so cannot see the body of the deceased. Regulations in this area have already evolved through bilateral agreements between France and its European neighbors. Thus, in 2017, France signed an agreement with Spain relating to transport of bodies by land, no longer requiring the use of airtight metal coffins. Negotiations with Belgium have been underway since 2015 with a view to a similar agreement. Consequently, almost four years after the start of negotiations, he wishes to draw the Government's attention to the need to conclude this agreement very quickly so that, in an already particularly painful period, families French women do not have to face an additional obstacle.
