Summary
Ms. Perrine Goulet draws the attention of the Minister, to the Minister of State, Minister of Ecological and Inclusive Transition, responsible for transport, to the current situation of the regional express transport network of the French National Railway Company (TER SNCF) which is not subject to the obligations of fixed compensation, reimbursement and financial compensation in the event of train cancellation or delay. Indeed, the European Regulation No. 1371/2007 provides for the possibility for Member States to derogate from certain of its provisions for urban, suburban and regional rail services, including, in particular, the provisions relating to the terms of minimum compensation and reimbursement that it imposes in the event of train cancellation or delay. However, this exemption in no way implies that the regional rail transport service is exempt from any compensation or reimbursement to its travelers in the event of train cancellation or delay. However, as things currently stand, users of the TER SNCF network cannot benefit from any compensation or reimbursement. Consequently, it would like to know whether a framework for these obligations of compensation or reimbursement of travelers in the event of train cancellation or delay is envisaged or provided for in the framework of the regional rail transport service in order to put an end to this unjustified “immunity” of the TER SNCF network.
