Summary

Decree No. 2015-74 of January 27, 2015 attributes new acts qualified as exclusive to state-certified operating theater nurses (IBODE), in particular assistance with exposure, hemostasis and suction during a surgical procedure in the presence of the surgeon. Following a contentious appeal, the Council of State nevertheless deferred the entry into force of these three exclusive acts and consultation was conducted with the different stakeholders which made it possible to arrive at a solution to guarantee the competence of nurses carrying out functions in the operating room without compromising the continuity of operating activities. Thus, Decree No. 2019-678 of June 28, 2019 sets up a transitional system allowing non-IBODE nurses to continue this activity subject to registering and passing a verification test of knowledge before a regional commission. While preserving the principle of IBODE exclusivity, this transitional system maintains the possibility for experienced nurses, as an exception, to continue to carry out these acts in accordance with their skills and to preserve the safety and continuity of care. Furthermore, work will soon be undertaken with all partners, employers and representatives of operating room nurses, concerning questions of demography and training of the IBODE profession.
