Mr. Thomas Rudigoz questions the Minister of the Interior on the situation of photography professionals approved by the National Agency for Security Documents (ANTS). The term “photography professionals” refers to the photographers and booth operators expressly referred to in article 16 of the LOPPSI and article 3 of the decree of April 10, 2007 relating to the affixing of identity photographs to identity documents and travel documents, driving licenses and residence permits. Thus, according to these texts it is up to photographers and photo booth operators to take photographs intended for the production of passports, national identity cards and other secure documents; to ensure that the photographic system they use for identity photographs has been approved by the Ministry of the Interior; of check that the paper on which the identity photographs are reproduced has certified security guarantees; and to put in place signage at the places where photographs are taken to inform the public about the approval of the photographic system and the products offered.” The sector of photography professionals is today in turmoil faced with the emergence of companies which seek to enable the production of official identity photos taken directly by a “selfie” of the user with a smartphone, and which would replace photography professionals. This new possibility presents risks for the security of users' data who could see their identity photos captured by malicious people for the purposes of identity theft. The Council of State by a judgment rendered on 17 December 2018 rejected requests from the company Smartphone ID which aimed to obtain approval from ANTS for the production of identity photos. Thus, in view of these elements and in particular the few guarantees presented by “selfie” identity photos, he asks him if he intends to protect the category of photography professionals in the face of these new technologies.
