Summary

The profession of psychomotor therapist is regulated in France by article L. 4332-1 of the Public Health Code which provides that "any person who, not a doctor, habitually performs professional acts of psychomotor rehabilitation, defined by decree of the Council of State taken after advice of the National Academy of Medicine, is considered to be exercising the profession of psychomotor therapist." On the other hand, in Belgium, the profession of psychomotor therapist is not regulated and covers two types of activities: educational activities on the one hand, and therapeutic activities on the other. However, this second type of activity can only be carried out by qualified health professionals. Therefore, if therapeutic activities in psychomotor skills do not constitute a regulated profession within the meaning of Directive 2005/36 in Belgium, persons holding only the diploma However, those with a bachelor's degree in psychomotor skills cannot exercise it. The latter can therefore only carry out educational activities in Belgium. In France, the profession of psychomotor therapist covers exclusively therapeutic activities. However, as has been indicated, people holding only a bachelor's degree in psychomotor skills can only carry out educational activities. As a result, people holding this diploma, who are not also qualified health professionals in Belgium and request recognition of their professional qualifications in France, cannot access a profession other than that for which they are qualified in the Member State of origin where they trained. Therefore, their requests are not admissible. This analysis is currently the subject of an exchange with the Commission services European, in order to study the situation resulting from the organization of psychomotor skills in Belgium.
