Summary
Ms Paula Forteza questions the Minister for Europe and Foreign Affairs on the situation of binational, unmarried couples, separated by travel restrictions linked to the health crisis. This question is at the center of issues raised by many citizens separated from their spouse since the start of the health crisis. Directive 2004/38/EC relating to the free movement of people within the European Union implies that without prejudice to a personal right to free movement and residence of the person concerned, the host Member State promotes, in accordance with its national legislation, the entry and stay [...] of the partner with whom the citizen of the Union has a lasting, duly attested relationship (Art.3). She asks to kindly clarify concretely the position that the ministry understands by the term "lasting relationship", with regard to couples unmarried dual nationals, in particular regarding the modalities of attestation of this relationship for couples living a long-distance relationship. She also questions him on the reading that the ministry wishes to give to the European text, by publishing a clear instruction for the attention of consular authorities.
