Summary

Ms. Sylvia Pinel questions the Minister of Ecological Transition on the legitimate concerns of the fresh vegetables, fruits and condiments sector regarding the ban on packaging made entirely or partly of plastic for the sale of batches of less than 1.5 kg not processed in retail stores. These provisions, resulting from the law relating to the fight against waste and the circular economy, generate real difficulties for certain professionals in the sector. In fact, the latter find themselves without any alternative solution, particularly for filleting or placing in trays requiring vision of the products. Their entry into force on January 1, 2022 does not leave enough time for the national sector to structure itself (in particular to renew all the machines used for packaging). As an example, for the garlic sector, the transition on January 1, 2022 from an offer consisting of 70% prepackaged to a 100% bulk offer is not economically feasible. For lack of alternatives, French players risk being marginalized, this sector being very competitive at European and international level. One of the solutions would consist of granting the sector the possibility of packaging fruit and vegetables in materials certified to comply with the French standard currently in force (NF T 51-800). This would make it possible to protect these foodstuffs, while respecting the objectives set by the Government in the fight against food waste and the circular economy. Also, she would like to know the measures that the Government intends to take to adapt, in consultation with the stakeholders concerned, the rules relating to packaging to the realities on the ground and thus guarantee the sustainability of the fresh fruit, vegetable and condiment sector.
