Summary

Mr. André Villiers questions the Minister of Culture about the protection of the surroundings of historic monuments. Since 1837, Historical Monuments have ensured the conservation of churches, buildings and castles which contribute to the richness of French built heritage. While the owner rigorously undertakes to preserve the authenticity of his building, the State provides in return national recognition, technical support, architectural and historical for the maintenance of the building, sometimes financial assistance for renovation work, but also protection of the surroundings of the building within a perimeter of 500 m around the site. In order to protect the environment which contributes to the development of the historic monument, articles L. 621-30 et seq. of the heritage code thus organize particular protection concerning work on buildings carried out near historic monuments. However, the construction of swimming pools near historic monuments has tended to become commonplace for around forty years, notably with the habit adopted by certain competent authorities to study and issue building permits of granting them tacitly, that is to say in the absence of express notification from the town hall during the legal investigation period of two months, including in situations of covisibility. He asks what measures the Government intends to take, and according to what timetable, to better (do) guarantee respect for the letter and spirit of the protection of the surroundings of historic monuments, particularly with regard to the construction of private swimming pools.
