Summary
Ms. Marina Ferrari draws the attention of the Minister of Ecological Transition and Territorial Cohesion regarding the establishment of the new extended producer responsibility (EPR) sector for construction products and materials in the building sector (PMCB). In order to develop the collection and recovery of the 46 million tonnes of waste produced by the building sector, article L. 541-10-9 of the construction code environment, introduced by law no. 2020-105 of February 10, 2020 relating to the fight against waste and the circular economy, provided for the establishment of a new extended producer responsibility sector, commonly called “REP”, for construction products and materials in the building sector. Its implementation planned for January 1, 2023 nevertheless seems to raise difficulties. Indeed, in less than a month, the “marketers”, i.e. manufacturers of construction products or materials, will have to ensure that waste from construction products and materials in the building sector will be collected and treated to establish a true circular economy. In practice, construction companies should therefore, within less than a month, update their quotes by including an eco-contribution. But to date, the version The final scale of this eco-contribution has not yet been published. This deadline obviously does not allow companies to sufficiently anticipate the price increases which will take place at the start of 2023. Furthermore, still in practice, the network of recycling centers is still very uneven across the national territory and is not adapted to the demands of craft businesses which immediately need approved facilities, near their construction sites, to deposit their waste. Finally, the agreement of community recycling centers with one of the 4 eco-organizations will only be possible after provision of a common standard agreement contract by the coordinating eco-organization, which coordinating eco-organization has, to date, still not been designated. For all these reasons, a request to postpone the application of the eco-contribution to May 1, 2023 was presented on November 28, 2022 to the Secretary of State for Ecology by the 4 eco-organizations. The demands of building professionals are in the same direction. Given the fact that the necessary organization is not yet ready, the MP questions the Minister about the possibility of postponing the implementation of the REP so that it can be implemented in a calm and coordinated manner and can, from its launch, be as efficient as possible. If such a postponement is considered, she asks when a postponement would materialize in order to leave it to the sector to organize itself.
