Summary

The experimentation of exemptions from labor law in the context of replacement services for the caregiver at home (known as “relaying”) or respite stays is provided for by article 53 of law no. 2018-727, of August 10, 2018, for a State serving a trust society (known as “ESSOC” law). It was due to end on December 31, 2021. The experiment includes 47 supporting structures (including 39 to deliver home services and 8 for respite stays) representing 216 authorized establishments or services, in 53 departments and 13 regions plus an overseas department (Martinique). The health crisis nevertheless affected the smooth running of this experiment and therefore its evaluation. If the initial feedback obtained is positive from caregivers, those receiving assistance and those involved, the expertise must indeed be further consolidated. The financing law social security for 2022 therefore extended this experiment by two years. This extension is a request from the candidates selected for the experiment who are subject to specific support by the services of the ministries responsible for solidarity and labor. It was also a request from the members of the monitoring committee for this experiment established by Decree No. 2018-1325 of December 28, 2018, including representatives of trade union organizations.
