Summary

Mr. Alain Perea draws the attention of Mr. Keeper of the Seals, Minister of Justice, to the difficulties encountered by information centers on the rights of women and families (CIDFF) in the context of the implementation of approvals for victim assistance associations following the law of March 23, 2018 on justice reform and Decree No. 2019-1263 of November 29, 2019. effect, following the law of March 23, 2018 relating to the reform of justice, the majority wanted to strengthen the place and voice of victims in the legal process. In this spirit, a new approval for victim assistance associations has been put in place according to the procedure codified by the aforementioned decree. Associations with these approvals will thus be in particular responsible for carrying out EVVI (personalized assessments of victims) which are tending to become more widespread. By an effect certainly undesirable from the implementation of this policy, the CIDFF were in fact excluded from the approval procedure described in articles D. 1-12-1 et seq. of the code of criminal procedure. Indeed, specialized in supporting and collecting the words of victims of domestic and intra-family violence, the CDIFFs do not meet the criteria requiring “the reception of all victims of a criminal offense”. This leads the judicial institution to deprive itself of certain expertise to collect the words of victims of domestic violence just as it introduces a potential break in the support by the CIDFF of many of the victims forced to carry out their EVVI with a third party structure. Also, he asks if a corrective measure is envisaged to remedy this difficulty by opening approval to certain associations specializing in monitoring and supporting women victims of domestic and family violence.
