Summary
Mr. Gaël Le Bohec questions the Minister Delegate to the Minister for Ecological Transition, responsible for housing, on the application of article L. 442-5-2 of the construction and housing code. This article establishes that the rules which govern the conditions of occupancy of social housing are re-examined every three years by social landlords with regard to five situations, including that relating to tenants' income. There The frequency of re-examination of files was also reduced from 5 to 3 years thanks to an amendment that he had tabled and which had been adopted to the bill “on the development of housing, development and digital technology” (known as “ÉLAN”). The objective was to allow households who need it the most better access to social housing since, according to article L. 442-5-2, "the lessor carries out with the tenant an examination of his situation and possibilities for development of his residential career. Indeed, waiting lists for access to social housing are often very long and it is not uncommon for households, whose financial situation has improved, to remain in social housing even though they should no longer be entitled to it given their income. The acceleration of the periodicity of re-examination of files should therefore have the effect of effect of streamlining the occupation of social housing by sticking as closely as possible to the real financial situation of tenants. In his role of evaluating public policies, the MP however noted that social landlords did not cumulatively observe the five criteria listed in article L. 442-5-2 of the construction and housing code and that the 5th criterion relating to the income of the occupants was not necessarily therefore not necessarily taken into account. Consequently, he would like to know if the Government intends to take stock of the situation on the occupancy of social housing based on the income of the occupants and if it plans to put pressure on social landlords so that the occupancy of housing is not uncorrelated with the income received by the tenants. In this perspective, he asks him to confirm that the five criteria listed by article L. 442-5-2 of the construction and housing code be examined in full and therefore cumulatively by social landlords to decide on the allocation of social housing to a household or to maintain it there if necessary.
