Summary
Compensation, established by decrees No. 2000-657 of July 13, 2000 establishing a reparation measure for orphans whose parents were victims of anti-Semitic persecution and No. 2004-751 of July 27, 2004 establishing financial assistance in recognition of the suffering endured by orphans whose parents were victims of barbaric acts during the Second World War, is more particularly intended for victims of Nazi barbarity. The latter refers to a very specific pain, that of having lost a father or a mother, or sometimes both, in an extermination camp. It is in fact the extraordinary character of extreme barbarity specific to these disappearances specific to the Second World War, the trauma going beyond the strict framework of a conflict between States, as well as the complicity of the Vichy regime, as recalled by the President of the Republic, who are at the origin of this system reserved for children whose parents, resistant or having been the subject of anti-Semitic or racial persecution, embodying martyrs, died in deportation or were executed in the circumstances defined in articles L. 342-3 and L. 343-5 of the code of military disability pensions and victims of war (CPMIVG). This device, which reflects a certain responsibility of the French State, must remain faithful to its essential justification which is to solemnly consecrate the memory of the victims of Nazi barbarity, through their children who were minors at the time of the events. The Government intends to maintain this specificity so as not to undermine the consistency of these decrees. Beyond this analysis, the examination of several files revealed the difficulty of applying criteria strict rules allowing extremely similar situations to be distinguished. The Ministry of the Armed Forces therefore endeavors to study the files concerned on a case-by-case basis, in order to guarantee equal treatment, while confirming the need to preserve the specific nature of this compensation, the extension of which to all war orphans cannot be envisaged. Finally, it is specified that as provided by the CPMIVG, any war orphan can receive, or was able to receive, a specific pension until his or her 21st birthday. In addition, all war orphans and wards of the nation, whatever their age, are nationals of the National Office for Veterans and War Victims and can benefit, as such, from the assistance of this public establishment, provided in particular in the form of aid or relief in the event of illness, lack of resources or momentary difficulties.
