Summary
Mrs. Danielle Simonnet draws the attention of the Minister of Labor, Health, Solidarity and Families to the subject of the redundancies in progress within the Les Galeries Lafayette group. The Galeries Lafayette group is a 130-year-old family group. Ginette Moulin, the 6th richest woman in France, has given way to her grandson Nicolas Houzé, at the head of the large flagship company of French capitalism with a turnover of 3.6 billion euros. In a context of record social plans, Galeries Lafayette has in turn decided to close two stores in Marseille, as well as its online commerce subsidiary BazarChic.com split into two companies: Bazarchic SAS and Bazarchic logistics. Within the two Bazarchic entities, the PSEs which have been under negotiation for two and a half months have just entered the Florange procedure. A takeover offer has just been made by an investment company based in Hong Kong via a subsidiary based in Luxembourg. This company will lay off 44 of the 64 employees of Bazarchic SAS (the headquarters) and 14 of the 39 employees of Bazarchic Logistique. The management of the Galeries Lafayette group has decided to disengage from Bazarchic SAS, where layoffs are the most numerous and the most costly, and to subcontract the social plan to this company after the takeover, while a agreement was about to be reached and that the employees of Bazarchic SAS have been in great suffering since the announcement of the closure and that the psychosocial risks are very high. The aforementioned investment company is supposed to resume PSE negotiations. The difference in treatment between Bazarchic SAS and logistics employees is misunderstood by headquarters employees and generates a lot of anxiety. The employees will lose access to social benefits to which they could claim from Galeries Lafayette, as the law provides for companies with more than 1,000 employees. Gone are the hopes of reclassification leave. Since the announcement of the closure of Bazarchic, negotiations have been particularly difficult with the management of Galeries Lafayette. The latter would claim to evade the obligation to draw up a social plan height of the resources of their group. They were several times called to order by DRIEETS 92 on the means they had to implement: duration of reclassification leave, amount of reclassification allowances, compliance with the collective agreement applicable to the company, support for internal reclassifications within the group. By subcontracting the social plan to the aforementioned investment company, Galeries Lafayette is would remove all these legal obligations and deprive employees of the prospects for which they were preparing. This situation is destined to restart several months of consultations, producing stress and uncertainty for people awaiting dismissal. The DOH firm mandated by the CSE of Bazarchic as part of the info-consultation submitted an alarming report on the state of stress and distress of employees of Bazarchic. In 10 years of expertise, they have never experienced such a level and have raised alarms about the serious risk of a desperate action. Staff representatives are today extremely worried about the mental health of Bazarchic employees, they fear the worst, including the risk of suicide. They are also worried about the social consequences for their future. Thus, the deputy questions the minister on the actions undertaken by the Government to preserve jobs within this large French group. She also questions him about the urgent need to change the definition of economic layoffs, in order to take into account the economic health of large groups, if they continue to distribute dividends and not the subsidiaries taken in isolation. In addition, she questions him in order to find out about any public aid granted to Galeries Lafayette and find out if steps have been taken to request reimbursement due to the PSE procedures initiated. Finally, she questions him on the need to strengthen employee rights and the need to establish a right of veto for employees at the CSE and to guarantee the time necessary so that negotiations are not carried out at a discount for employees. She asks him for answers to these questions.
