Summary
Mr. Nicolas Ray draws the attention of the Minister of State, Minister of National Education, Higher Education and Research, to the difficulties encountered by students from certain territories in integrating school sports sections when they are not part of the educational sector of the selected establishment. Since 1994, school sports sections (SSS) have offered volunteer students the opportunity to benefit, after agreement from their legal representatives, an additional volume of practice in one or more sporting or artistic disciplines offered by educational establishments, while following ordinary schooling. Thus, these sports sections actively contribute to achieving a good level of sports practice for students as well as promoting the values of sport, leading to a positive impact on results. schools. This is the reason why, by circular No. MENE2334358C of December 15, 2023 relating to the school development arrangements allowing the strengthening of student sports, the ministries in charge of national education and sports wanted to densify the local SSS offer for students and improve their visibility for families. If the democratization of these education projects through sport indeed deserves to be supported, in practice, the number of establishments offering school sports sections remains limited. Thus, very often, the establishment in which the SSS is implemented does not fall within the sector of the students who wish to benefit from it. Their legal representatives are then forced to submit a request for exemption from the school permit to the academic director of education services. national (DASEN). However, in application of paragraph 4 of Article D. 211-11 of the Education Code, each DASEN sets the order of priority for examining the exemptions that it is required to study. This lack of national harmonization is a source of territorial inequality in terms of student access to sports sections which is not acceptable. The development and loyalty of sporting practices in the heart of territories, particularly rural ones, deserve a better adapted regulatory framework. In order to remedy the all-too-frequent number of refusals of exemptions, it asks it what measures it intends to take to allow students who request it and who demonstrate real sporting motivation to be able to integrate as a priority the establishments in which the school sports sections are located. He also wants to know if an improvement in process of examining exemptions from the school card is envisaged in order to inform families as soon as possible of the outcome of their requests. Indeed, this change in the timetable for examining exemptions appears necessary in order to allow families and sports clubs to better anticipate academic decisions and adapt their organization accordingly for the following school year.
