Summary

The contribution of 0.15% from employers in the craft sector comes from the extended agreement of December 12, 2001 relating to the development of social dialogue in the craft sector negotiated by employee and professional employer union organizations representative at the national level (Professional Craft Union, General Confederation of Labor, French Democratic Labor Confederation, Force Ouvrière, Confederation French Christian Workers, French Confederation of Management - General Confederation of Executives). It is therefore a contribution made by the social partners who represent the interests of companies and employees in the craft sector for the improvement of social dialogue. The contribution to social dialogue of 0.016% of employers comes from the 2014 reform of the financing of jointism, of which the objective was precisely to make the financing circuits of employee unions and professional employers' organizations transparent. Indeed, this reform is part of the movement to strengthen social democracy carried by the law of August 20, 2008 and aims to avoid any confusion between the financing of social partners and that of public policies for which the social partners are responsible. This contribution is not a new burden for companies because it replaces the sums which were previously paid as part of contributions for professional training and returned in the form of preciputs to the social partners. If this financing was previously difficult to identify, the allocation of credits to trade union and employer organizations now meets objective criteria and depends on recognition of representativeness, as well as audience measurement for professional employer organizations (PO). Joint funding only benefits representative professional organizations which therefore represent the collective interests of companies. As a reminder, to be representative, a professional organization must meet a certain number of criteria: seniority, respect for republican values, independence, financial transparency, influence, balanced territorial presence (for professional branches) and audience. The criterion of audience, essential in determining representativeness, is assessed with regard to the capacity of the POs to certify that they have as members at least 8% of the companies belonging to POs satisfying criteria 1° to 4° of Article L. 2151-1 of the Labor Code and having applied, at the relevant level (branch or national and inter-professional) or that their member companies employ at least 8% of all employees employed by all companies belonging to POs satisfying the aforementioned criteria and having applied. The implementation of all of these reforms corresponds to the Government's desire to strengthen negotiation collective by further legitimizing professional organizations which can now justify their representativeness and as such, receive credits from jointism allocated according to objective rules and transparent circuits. These reforms are therefore also part of the approach undertaken in favor of transparency in public life. The management association of the national joint fund must, moreover, each year, submit a report to the Government and Parliament justifying the proper use of funds.
