Summary
The existence of unions is necessary for social democracy. It is therefore essential to guarantee their legitimacy. This is why Law No. 2014-288 of March 5, 2014 relating to professional training, employment and social democracy established a new financing system for trade union and employer organizations, which clarifies, simplifies and consolidates the resources of these organizations linked to the design and management of a certain number of policies, either directly by the social partners themselves, or in strong association with public authorities. The State subsidy, in an annual amount of 32.6 million euros in accordance with the 2018-2020 agreement signed between the State and the joint fund management association (AGFPN), is intended to finance the last two missions. The mission of participation in the design of public policies benefits from 3 million of the 32.6 million euros. The rest of the subsidy, which pools credits which were until then paid directly to trade union organizations for the material organization of economic, social and unions, corresponds to financial assistance from the State for the economic, social and union training of employees called upon to exercise union responsibilities provided for in article L. 2145-3 of the labor code. Before the 2014 reform of the financing of jointism, two types of structures organizing this training benefited from state credits: training centers attached to trade union organizations whose statutory vocation has a national and interprofessional character and twelve regional labor institutes. Since the law of March 5, 2014 relating to professional training, employment and social democracy, the State subsidy intended for trade union organizations for economic, social and union training passes through the national joint fund. Furthermore, the State pays, according to unchanged terms, direct financial assistance to twelve labor institutes, ten of which are attached to universities. Training centers attached to trade union organizations and internal university institutes are approved each year by the Ministry of Labor. Employees who wish to participate in these training courses benefit, under Article L. 2145-5 of the Labor Code, from leave allowing them to follow this training. Finally, for the sake of transparency and controlling the proper use of jointism credits, the trade union organizations submit annual reports to the AGFPN which serve as the basis for the report submitted each year to the Government and Parliament by this association. Thus, the financing of the contribution of trade unions and employers' organizations to the missions of general interest that they carry out now rests on clear and transparent bases, recognizing the role of social dialogue and its necessary financial support, in addition to the base that memberships and contributions must constitute.
