At the European level, the ILUC (Indirect land use change) directive sets, from 2015 until 2020, a ceiling for the incorporation of the share of conventional biofuels in the final energy consumption of transport at 7% in energy, to combat land use change and prevent the production of energy raw materials from entering into competition with the food use of these same raw materials. Directive 2018/2001 of December 11, 2018 relating to the promotion of the use of energy produced from renewable sources (so-called “RED II” directive) in force does not return to this level. Indeed, in its article 26 relating to the specific rules applicable in particular to biofuels, the directive specifies that fuels derived from biomass consumed in the transport sector, when they are produced from of crops intended for human and animal food, must not exceed by more than one percentage point a maximum of 7% of final energy consumption in the road and rail transport sectors. There is therefore no drastic reduction in the contribution of conventional biofuels to the transport energy mix imposed by the overhaul of the “RED II” directive. Furthermore, the Government remains strongly mobilized on the issues specific to energy sectors based on national agricultural resources, such as cereals and beets for ethanol or rapeseed for biodiesel. For example, the incorporation of biofuels is supported by the incentive tax relating to the incorporation of biofuels (TIRIB) and this incorporation target increased on January 1, 2019 in both diesel and gasoline.
