By decision dated May 18, 2018, the Council of State accepted in principle the existence of regulated electricity sales tariffs in that they make it possible to guarantee a stable price of electricity. However, it judges that this intervention by the State does not respect European law in that it is not proportionate: - taking into account the permanent nature of the regulated prices and the absence of periodic review of their necessity ; - in that they apply to all end consumers whose subscribed power is less than or equal to 36 kVA, in particular small non-residential sites belonging to large companies.
