Summary

The difficulties encountered in the management of the Trade and Companies Register (RCS) constitute a legitimate source of discontent among businesses and various economic players. This subject has been the subject of particular attention by the Ministry of Justice for several years.  Thus, during the first half of 2014, an inventory highlighted a certain number of RCS dysfunctions in the departments and overseas regions, leading the Ministry of Justice to put in place a vast action plan for their benefit. After experiencing a significant improvement in 2016, the operation of overseas RCS, including those in Reunion, has deteriorated again. Faced with this observation and in order to permanently remedy a situation putting many local businesses in difficulty, it was decided to entrust the management of the court registries mixed commercial courts of Reunion, Mayotte, Martinique, Guadeloupe and Guyana, to the clerks of the commercial courts. Thus, the management of these RCS will be ensured by the same professionals as those who are currently responsible for almost all of the metropolitan commercial and company registers and whose deadlines are particularly short. This decision will be implemented as quickly as possible in order to that specialized registrars can physically take over the management of these RCS before the end of the first half of next year.
