Summary

The Government is attentive to the question of access to credit for all consumers (whether residents in France or French expatriates) from establishments operating on the national territory. He wishes to point out that there is no “right to credit”, taking into account the principle of commercial freedom and prudential and financial stability imperatives. Subscribing to a loan constitutes a commitment whose consequences must be fully measured. Thus, obtaining credit depends on the solvency and repayment capacity of the future borrower. Lending institutions being responsible for the risks they accept, they are therefore masters of their decisions regarding the granting of credit, based on their assessment of the personal and financial situation of their clients as well as on the guarantees offered by them. If lending establishments have ample freedom to assess the quality of a commercial relationship, initiate it, continue it or terminate it, this freedom cannot disregard the limits set by the law in matters of discrimination and in particular articles 225-1 and 225-2 of the penal code. The Government remains attentive to the conditions of credit distribution and continues to work to allow consumers to access credit under the best conditions.
