Law on the Amendment of the Law on the Implementation of the Defense Service Act and the Police and Border Guard Act

The bill amends the Law on the Implementation of the Law on Defense Forces Service and the Law on Police and Border Guards, the current version of which affects defense forces who retired before 01.04.2013 and police officers who retired before 01.01.2010, as well as by then the principles of legal certainty and legitimate expectations of former military personnel who have acquired the right to a pension. The purpose of the changes proposed in the bill is for officials who have fulfilled their duty to the state ensuring uniform and equal treatment in pension schemes so that it is also consistent with the principle of legitimate expectation. The current situation is unfair and, according to the authors of the bill, also unconstitutional, because among all the persons receiving a reduced pension in Estonia today, only before 01.04.2013. military personnel who have completed their service are the only ones whose pension base level before switching from the recalculation system to indexation is in effect left due to the economic crisis, the reduced salary level.

Kohaliku omavalitsuse korralduse seaduse täiendamise seadus

Eelnõuga soovitakse luua võimalus riikide-ülese kohaliku omavalitsuse üksus moodustamiseks nimetusega „kreis“. Tingimuseks on, et nendel kohaliku omavalitsuse üksustel peab naaberriigiga olema ühine piir, need riigid peavad kuuluma NATO-sse ja Euroopa Liitu, kasutama sama valuutat ning omama identset viisarežiimi.

Sports Law Amendment Act

The draft provides for establishing in the sports law a formula for the national support of the Olympic champion, which takes into account the change in the cost of living over time. The content of the bill is to link the coefficient of state support for Olympic champions to the average salary of the previous year, according to Statistics Estonia. Considering the above, the rate of state support for an Olympic champion is set at 1.3 times the average gross monthly salary, which, according to Statistics Estonia, was paid in Estonia in the year prior to the payment of the support in the year. The principle remains that the new rate of support cannot be lower than the current rate. In addition, the allowance rate for the Paralympic champion is set at 0.65 times the average gross monthly salary of the third quarter of the previous year. The explanatory letter states that since the adoption of the Sports Act, the Olympic champion's support rate has remained at the same level as the original. When the subsidy came into effect, the national subsidy for the Olympic champion was approximately one and a half times the Estonian average equal to the monthly salary. To date, the support rate has fallen well below the average monthly wage in Estonia. The purpose of the national support of the Olympic champion is to create an additional social guarantee for those people who have brought recognition to Estonia and a lot of positive emotions to society with their high sporting achievements.

Eelnõu näeb ette kokkuleppevedude osutamiseks vajaliku regulatsiooni. Eelnõuga tagatakse kokkuleppevedude turvalisus ja usaldusväärsus. Kehtestatakse vastavad minimaalsed nõuded kokkuleppevedude teostajatele ja elektroonilistele kokkuleppevedude süsteemile. Eelnõu koostamisel on arvestatud, et kokkuleppeveod peaksid toimuma võimalikult suures ulatuses ilma riikliku sekkumiseta ja vastavalt turutingimustele. Kokkuleppevedude regulatsiooni toomine ühistranspordiseadusesse on põhjendatud asjaoluga, et hetkel tulenevad piirangud kokkuleppevedude teostamisele ühistranspordiseadusest. Samuti viitab autoveoseadus, et sõitjate tasulist autovedu reguleerib ühistranspordiseadus. Samas ei näe käesolev eelnõu ette, et kokkuleppeveod oleksid käsitletavad ühistranspordina või sellega samastatud. Paralleelselt kokkuleppevedude seadustamisega lihtsustab eelnõu taksojuhtidele seatud nõudeid, delegeerib vastutust ja järelevalvet rohkem taksoveo korraldajale. Eelnõu avab ka taksoteenuse turu konkurentsile, mis on vähem seotud nõuetega, mille täitmine ja järelevalve on ka praktikas osutunud äärmiselt problemaatiliseks.

Riigikogu decision "Establishment of a problem committee of the Riigikogu to analyze Estonian drug policy and HIV prevention activities and to enhance prevention activities"

According to the draft, the task of the problem committee is to analyze the current state of drug addiction and HIV prevention development plans and corresponding national strategies, including analysis of the planning and use of financial resources. The task of the problem commission is to propose solutions to radically reduce the number of drug deaths and the spread of HIV, to put an end to drug crime and to ensure effective addiction treatment.

Eelnõu täpsustab vastavalt kooseluseadusest tulenevast regulatsioonist õiguste realiseerimise korda. Kooseluseadus on vastu võetud eelmise Riigikogu koosseisu poolt, kuid enne jõustumist tuleva aasta algul on vaja Riigikogul vastu võtta rakendusaktid ehk sätted, millega saab kooseluseadust ka igapäevastes praktilistes olukordades rakendama hakata. Rakendamissätete ühtselt eraldi seaduses välja toomine on vajalik eelkõige seetõttu, et rakendusnormid on omavahel tihedalt seotud. Ühtne rakendusseadus võimaldab vältida erinevates seadustes seotud küsimusi reguleerivate normide ja neis sisalduvate viidete vahelisi ebakõlasid ning tagada selguse, arusaadavuse ja terminoloogilise ühtsuse. Eelnõu lähtub kooseluseaduse vastuvõtmisel esitatud sooneutraalsest regulatsioonist, mis hõlmab kooselulepingu sõlminud isikute (registreeritud elukaaslaste) omavahelisi õigussuhteid ja õigussuhteid kolmandate isikutega. Õigussuhte olemus ning sellest tulenevad õigused ja kohustused on sisustatud juba kooseluseaduses. Eelnõu eesmärk on kooseluseaduses toodud põhimõtetest lähtudes täpsustada, milline on kooseluseadusest tekkivate õiguste ja kohustuste realiseerimise kord ja tagada kooseluseaduse rakendumise võimalikkus. Eelnõuga muudetakse mitmeid seadusi. Rakendusseadus on suuresti tehniline tekst, mis reguleerib varasuhteid, pärimist, registritega seotud küsimusi jne.
