Summary
Eelnõuga muudetakse kaitseväeteenistuse seaduse rakendamise seadust ning politsei ja piirivalve seadust, mille tänane redaktsioon riivab enne 01.04.2013 pensioneerunud kaitseväelasi ning enne 01.01.2010 pensioneerunud politseiametnikke, samuti selleks ajaks pensioniõiguse omandanud endiste kaitseväelaste õiguskindluse ning õiguspärase ootuse põhimõtteid. Eelnõus kavandatud muudatuste eesmärgiks on riigi ees oma kohustuse täitnud ametnike ühetaolise ja võrdse kohtlemise tagamine pensioniskeemides nii, et see oleks kooskõlas ka õiguspärase ootuse põhimõttega. Praegune olukord on ebaõiglane ja eelnõu koostajate hinnangul ka põhiseadusevastane, sest kõikide tänases Eestis sooduspensioni saavate isikute seas on vaid enne 01.04.2013.a. teenistuse lõpetanud kaitseväelased need ainsad, kelle pensioni baastasemeks enne umberarvutamise süsteemilt indekseerimisele üleminekut on kehtima jäetud seoses majanduskriisiga alandatud palgatase.
