Make Education Local Act of 2021 This bill creates a framework under which states may receive federal elementary and secondary education funds on a consolidated basis and use such funds for any educational purpose permitted by state law. Specifically, the bill permits each state to submit to the Department of Education a state management decision that, among other requirements, describes how the state will address persistently failing public schools. The bill defines state management decision as a state decision to assume full management responsibility for the expenditure of federal funds to advance the educational policy of the state. The duration of a state management decision shall be between 5 and 10 years. Additionally, each state that operates under a state management decision must establish an accountability system that focuses on the academic achievement of students and includes a system for evaluating the academic achievement and progress of students.

Hong Kong Safe Harbor Act This bill designates certain Hong Kong residents with priority status for refugee consideration and contains other related provisions. An individual and certain family members shall have such priority status if the individual (1) is a Hong Kong resident who suffered persecution or has a well-founded fear of persecution as a result of peaceful political activity; or (2) has been formally charged, detained, or convicted for certain peaceful actions. An individual receiving refugee status under this bill shall not be counted against various numerical limitations. When determining whether an individual shall be admitted as a refugee under this bill, an individual whose citizenship, nationality, or residency was revoked for submitting a nonfrivolous application for a U.S. immigration benefit shall be considered to have suffered persecution on account of political opinion. The general presumption that an alien is seeking immigrant status shall not apply to certain Hong Kong residents seeking asylum into the United States. (Typically, an alien seeking admission as a nonimmigrant must establish that the alien does not intend to immigrate to the United States.) This exception to the presumption shall apply to certain individuals involved in the 2019 and 2020 protests against China's encroachment into Hong Kong's autonomy (Hong Kong is a part of China but has a separate legal and economic system). An individual from Hong Kong may not be denied admission into the United States if the primary reason for the denial is a politically motivated government action against the individual's involvement in protests.

Protecting Access to Post-COVID-19 Telehealth Act of 2021 This bill makes permanent several telehealth flexibilities that were initially authorized during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019), particularly with respect to Medicare coverage of telehealth services. For example, the bill permanently allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner) for telehealth services under Medicare. Payment must be made in the same manner as for non-telehealth services, rather than in accordance with a separate methodology determined by the Centers for Medicare & Medicaid Services (CMS). The bill also permanently allows beneficiaries to receive Medicare telehealth services at any site, regardless of type or location, and grants the CMS general authority to waive any other requirements during any emergency period.

Advancing America's Interests Act This bill limits the ability of certain persons (e.g., patent or trademark holders) to bring complaints before the U.S. International Trade Commission (ITC), and it requires the ITC to consider the public interest when determining whether to exclude articles that are under investigation. A complainant before the ITC must satisfy a domestic industry requirement obliging them to have made significant investment in the United States related to the articles that are the subject of the matter. One method to establish domestic industry is through reliance on licensing activities. The bill requires a complainant attempting to demonstrate domestic industry through licensing activities to show that those activities led to the adoption and development of articles that incorporate the patent, copyright, trademark, mask work, or design at issue. In addition, the bill requires the ITC to determine that any exclusion of articles pursuant to an investigation is in the public interest. The ITC must also identify at the beginning of an investigation whether the matter involves a dispositive issue that is appropriate for expedited initial determination and direct the assigned judge to issue such determination not later than 100 days after the investigation is instituted.
