SAVE Act

Save Our Industries Act of 2009 or the SAVE Act - Grants duty-free treatment, subject to specified conditions, to certain apparel wholly assembled in the United States or the Philippines, or both, and components of such apparel consisting entirely of: (1) fabric components cut in the United States or the Philippines, or both, from fabric wholly formed in the United States from yarns wholly formed in the United States; (2) components knit-to-shape in the United States from yarns wholly formed in the United States; or (3) any combination of such components. Grants: (1) a reduction of duty for such apparel, provided the same criteria are met; and (2) duty-free treatment to apparel that meet both the requirements for duty-free treatment and reduction of duty. Requires the Comptroller General to evaluate the effectiveness of the preferential duty treatment afforded under this Act to apparel imported from the Philippines. Prohibits preferential duty treatment of apparel imported from the Philippines unless the President certifies to Congress that it is meeting certain trade enforcement conditions with respect to such apparel. Terminates preferential duty treatment under this Act: (1) 10 years after the effective date of this Act; and (2) when the Philippines becomes ineligible for designation as a beneficiary country under the Generalized System of Preferences.

Disabled Military Retiree Relief Act of 2009 - Extends through 2010 specified authorities currently scheduled to expire at the end of 2009 with respect to certain special pay and bonus programs within the regular and reserve Armed Forces. Provides for the: (1) recomputation of retired pay and adjustment of the retired grade of reserve retirees to reflect post-retirement service; (2) election to receive retired pay for non-regular service for service in an active reserve status performed after attaining eligibility for regular retirement; and (3) expansion of eligibility for the concurrent receipt of military retired pay and veterans' disability compensation to include certain disability retirees regardless of their disability rating percentage or years of service. Provides, with respect to federal employees: (1) credit for certain unused sick leave; (2) a limited expansion of the class of individuals eligible to receive an actuarially reduced annuity under the Civil Service Retirement System (CSRS); (3) a computation of certain annuities based on part-time service; (4) the authority to deposit refunds under the Federal Employee Retirement System (FERS); and (5) retirement credit for certain employees transferred from District of Columbia service to federal service. Non-Foreign Area Retirement Equity Assurance Act of 2009 or Non-Foreign AREA Act of 2009 - Revises federal employee locality-based comparability payments provisions to include U.S. territories and possessions, including the Commonwealth of Puerto Rico and the Commonwealth of the Northern Mariana Islands, within a pay locality. Sets forth maximum rates of pay for Senior Executive Service (SES) personnel in such areas. Revises the calculation of allowances based on living costs and conditions of environment for pay of employees stationed outside the continental United States or in Alaska to apply it only to areas designated as of December 31, 2009. Provides a formula for adjustment of such rate using a transition schedule for calendar years 2010 and thereafter. Requires adjustment of special rates of pay determined to be necessary to obtain or retain the services of persons specified by statute in such a cost-of-living area in accordance with regulations to be prescribed by the Director of the Office of Personnel Management (OPM) under this Act. Allows a temporarily raised limitation on the amount of special rates during the transition period of January 1, 2010, to January 1, 2012. Expresses the sense of the Congress with respect to pay disparities and locality areas for federal positions located in Alaska, Hawaii, or a U.S. territory. Allows an employee subject to this Act's transition schedule who retires from service during the period from January 1, 2010, through December 31, 2012, to elect to have any COLA paid during that period considered as basic pay for purposes of annuity computation. Amends the Energy Policy Act of 2005 to repeal provisions relating to the Ultra-Deepwater and Unconventional Natural Gas and Other Petroleum Research Fund.

Cure and Understanding through Research for Alzheimer's Act of 2009 or La Cura Act of 2009 - Amends the Public Health Service Act to require the Director of the National Institutes of Health (NIH) to ensure sufficient resources for activities relating to Alzheimer's disease and Hispanic communities, including by: (1) increasing efforts in epidemiological work in Hispanic subgroups; (2) allocating resources to the National Institute on Aging Alzheimer's disease research centers and other academic centers involved in such research to increase participation of Hispanics and other underrepresented ethnic groups in research and clinical trials in sufficient numbers to draw valid conclusions; and (3) conducting social, behavioral, and health services research to understand the underlying reasons why Hispanic individuals delay diagnosis and underutilize services, to identify culturally and linguistically appropriate approaches to address such delays and underutilization, and to identify approaches for providing, and improving the quality of, culturally competent care. Requires the Director to expand and intensify NIH efforts to educate communities about the importance of research relating to Alzheimer's disease and to respond effectively to cultural concerns about participation in such research. Authorizes appropriations for a program of grants to states to carry out demonstration programs related to Alzheimer's disease. Requires the Secretary of Health and Human Services (HHS), acting through the Centers for Disease Control and Prevention (CDC), to conduct an aggressive, evidence-based education and outreach program to promote public awareness and risk reduction with respect to Alzheimer's disease, particularly to Hispanic populations.

Travel Promotion Act of 2009 - Establishes the Corporation for Travel Promotion as a nonprofit corporation that is not an agency or establishment of the U.S. government. Makes the Corporation subject to the provisions of the District of Columbia Nonprofit Corporation Act. Expresses the sense of Congress that the Corporation should not engage in lobbying activities. Requires the Corporation, among other things, to provide useful information to people interested in traveling to the United States, identify and address perceptions regarding U.S. entry policy, and promote U.S. travel. Establishes in the Treasury the Travel Promotion Fund. Amends the Immigration and Nationality Act to require (under current law, authorize) the Secretary of Homeland Security to establish and collect a fee for the use of an electronic data sharing system concerning the admissibility of certain aliens into the United States that will ensure recovery of the full costs of providing and administering such system. Terminates such fee following FY2014. Authorizes the Corporation to impose an annual assessment on U.S. members of the travel and tourism industry. Amends the International Travel Act of 1961 to: (1) revise the membership of the Tourism Policy Council; and (2) require the Council to provide the Corporation with certain information concerning U.S. admission procedures and travel promotion strategies. Directs the Government Accountability Office (GAO) to conduct a study to assess barriers to entry into the United States by foreign travelers.

Requires the Attorney General to develop a list of all self-certified individuals and make it publicly available on the website of the Drug Enforcement Administration (DEA). Prohibits distributors of listed chemical products from selling such products to individuals not currently registered with the DEA. Impose civil penalties for negligent failure to self-certify as required by this Act.

Methamphetamine Education, Treatment, and Hope Act of 2009 - Amends the Public Health Service Act to require the Director of the Center for Substance Abuse Treatment to collaborate with professionals in the addiction field and primary health care providers to raise awareness about how to: (1) recognize the signs of a substance abuse disorder; and (2) apply evidence-based practices for screening and treating individuals with, or at-risk for developing, an addiction. Revises provisions governing a grant program for substance abuse residential treatment for pregnant and parenting women (currently, for postpartum women), to: (1) include treatment for addiction to methamphetamine, outpatient treatment services, and referrals for dental services; and (2) require programs to be accessible to pregnant and parenting women in low-income households and in health disparity populations. Requires the Director to give grant priority to a program serving an area that: (1) is a rural area, an area with a shortage of mental health professionals, or an area with a shortage of family-based substance abuse treatment options; and (2) has high rates of addiction to methamphetamine or other drugs. Directs the Secretary of Health and Human Services (HHS) to expand, intensify, and coordinate efforts to provide pregnant and parenting women treatment for addiction to methamphetamine or other drugs. Requires the Director of the Office for Substance Abuse Prevention to develop a clearinghouse that provides information and educational materials to employers and employers about drug testing policies and programs. Authorizes amounts made available for methamphetamine or inhalant prevention programs in schools and communities to be used to develop a student-driven methamphetamine awareness project.

Breastfeeding Promotion Act of 2009 - Amends the Civil Rights Act of 1964 to include lactation (i.e., breastfeeding or the expressing of milk from the breast) as protected conduct under such Act. Amends the Internal Revenue Code to allow employers a business-related tax credit for 50% of their qualified breastfeeding promotion and support expenditures, up to $10,000 for any taxable year. Defines "qualified breastfeeding promotion and support expenditures" as business expenses incurred for breast pumps and other equipment specially designed to assist mothers who are breastfeeding their children and for consultation services relating to breastfeeding. Expands the tax deduction for medical expenses to include expenses for breastfeeding equipment and consultation services. Safe and Effective Breast Pumps Act - Directs the Secretary of Health and Human Services (HHS) to: (1) effect a performance standard for breast pumps without regard to their classification under the Federal Food, Drug, and Cosmetic Act; and (2) issue a compliance policy guide to provide women with information about breast pumps. Amends the Fair Labor Standards Act to require employers with 50 or more employees to provide their breastfeeding employees with break time and private areas to express breast milk for their nursing children.

National Transportation Objectives Act of 2009 - Establishes: (1) national transportation objectives to provide a 21st century vision for the national surface transportation system, including to promote energy efficiency and achieve energy security, ensure environmental protection and safety for all transportation users, improve economic competitiveness and transportation system conditions, and provide equal access to transportation in urban, suburban, and rural communities; and (2) national transportation performance targets to meet such objectives, including to reduce per capita vehicle miles traveled by 16% and transportation-generated carbon dioxide levels by 40%, triple walking, biking, and public transportation use, increase freight transportation provided by railroad and intermodal services by 20%, and improve public safety and lower congestion costs by reducing traffic crashes by 50%. Directs the Secretary of Transportation to: (1) develop baseline levels and appropriate data collection systems for meeting the national transportation performance targets; and (2) develop and implement a National Surface Transportation Performance Plan.

Conditions the scholarship on the recipient's agreeing to serve in such a capacity for whatever period the Secretary specifies in the agreement. Directs the Secretary, on receipt of a request for counseling from an individual who has been discharged or released from active service, to: (1) provide referrals to assist the individual in obtaining mental health care and services outside the VA; and (2) if pertinent, advise such individual of the individual's rights to apply for review of the discharge or release. Directs the Secretary to award grants to nonprofit organizations that provide emotional support services for survivors of deceased members of the Armed Forces and deceased veterans through the survivors' peers.

Indian Health Care Improvement Act Amendments of 2009 - Amends the Indian Health Care Improvement Act to revise requirements for health care programs and services for Indians, Indian tribes, tribal organizations, and urban Indian organizations. Authorizes grants to urban Indian organizations for health information technology, telemedicine services development, and related infrastructure. Directs the Secretary of Health and Human Services, acting through the Indian Health Service, to provide programs of comprehensive behavioral health, prevention, and treatment. Excludes from gross income: (1) services or benefits provided or purchased by the Service; and (2) services or benefits provided by a tribe or tribal organization, directly or through insurance. Declares that these provisions are not intended as an inference to the tax treatment of governmental benefits provided by tribes to Indians. Reauthorizes the Indian Health Care Improvement Act. Amends the Indian Self-Determination and Education Assistance Act to direct the Secretary to establish the Native American Health and Wellness Foundation. Expands coverage for qualified Indians in the State Children's Health Insurance Program (CHIP, formerly known as SCHIP) under title XXI of the Social Security Act (SSA), as well as under Medicare (SSA title XVIII) and Medicaid (SSA title XIX). Authorizes related payments to Indian Health Programs operating in the state.

Reuniting Families Act - Amends the Immigration and Nationality Act (INA) to establish the fiscal year worldwide level of employment-based immigrants at 140,000 plus: (1) the previous year's unused visas; and (2) the number of unused visas from FY1992-FY2007. Establishes the fiscal year worldwide level of family-sponsored immigrants at 480,000 plus: (1) the previous year's unused visas; and (2) the number of unused visas from FY1992-FY2007. Revises the definition of "immediate relative" to: (1) mean a child, spouse, or parent of a U.S. citizen or lawful permanent resident (and for each family member of a citizen or resident, such individual's accompanying spouse or child), except that in the case of parents such citizens shall be at least 21 years old; (2) permit a widow or widower of a U.S. citizen or resident to seek permanent resident status if married at least two years at the time of the citizen's or resident's death or, if married less than two years, by showing through a preponderance of the evidence that the marriage was entered into in good faith and not solely to obtain an immigration benefit; and (3) include an alien who was the child or parent of a U.S. citizen or resident at the time of the citizen's or resident's death if the alien files a petition within two years after such date or prior to reaching 21 years old. Increases immigration visas for: (1) unmarried sons and daughters of U.S. citizens; and (2) brothers and sisters of U.S. citizens. Provides a 60,000 visa allocation for the unmarried sons and daughters of permanent resident aliens. Increases annual per country (10% of annual total) and dependent area (5% of annual total) limits for employment-based and family-sponsored immigrant visas. Expands specified family-unity exceptions to unlawful presence-based inadmissibility. Provides specified relief for orphans and spouses regarding: (1) petitions for immediate relative status; (2) parole eligibility; (3) permanent resident status adjustment; and (4) processing of immigrant visas. Filipino Veterans Family Reunification Act - Exempts children of naturalized Filipino World War II veterans from worldwide or numerical immigrant limitations. Makes a minor child of an alien fiancee/fiance or of an alien spouse of a U.S. citizen eligible for derivative K-visa status provided that the child's age is determined using such child's age at the date that the petition to classify such child's parent as a K-visa alien is filed with the Secretary of Homeland Security. Authorizes the Secretary or the Attorney General to adjust the status of a finacee/fiance or alien spouse and any minor children (K-visa) to conditional permanent resident status if such alien marries the petitioner within three months after U.S. admission. Redefines "child" for purposes of titles I and II of the Act to include a stepchild under 21 years old. (Current law includes a stepchild who has not reached 18 years old at the time the marriage creating the status of stepchild occurred.) Uniting American Families Act of 2009 - Amends INA to include a "permanent partner" within the scope of such Act. Defines "permanent partner" as an individual 18 or older who: (1) is in a committed, intimate relationship with another individual 18 or older in which both individuals intend a lifelong commitment; (2) is financially interdependent with the other individual; (3) is not married to, or in a permanent partnership with, anyone other than the individual; (4) is unable to contract with the other individual a marriage cognizable under this Act; and (5) is not a first, second, or third degree blood relation of the other individual. Defines "permanent partnership" as the relationship existing between two permanent partners. Defines "alien permanent partner" as the individual in a permanent partnership who is being sponsored for a visa.

Prescription Coverage for Now Act of 2009 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act (SSA) to direct the Commissioner of Social Security, through certain information requests to the Secretary of the Treasury, to provide for the identification of individuals potentially eligible for low-income subsidies (LIS) and transmit them low-income subsidy applications if they are also part D eligible. Requires the Secretary of Health and Human Services, jointly with the Commissioner, to develop a model, simplified low-income subsidy application and process. Amends the Internal Revenue Code to require the Secretary of the Treasury, upon the Commissioner's request, to disclose tax return information to facilitate identification of individuals likely to be eligible for Medicare prescription drug program low-income subsidies. Entitles low-income subsidy beneficiaries to retroactive reimbursement for previously incurred covered drug costs. Prescribes requirements for enhanced oversight and enforcement relating to such reimbursements. Establishes an asset standard for LIS eligibility for 2011 of $27,500 (or $55,000 in the case of the combined value of the individual's assets or resources and the assets or resources of the individual's spouse), increased in subsequent years by the annual percentage increase in the consumer price index. Exempts retirement benefits from resources under the LIS programs. Increases the income eligibility to 150% of the federal poverty level (FPL) for full benefits and 200% of the FPL for partial benefits under the LIS program. Authorizes indexing of deductible and cost-sharing above the annual out-of-pocket threshold for individuals with incomes below 200% of FPL. Prohibits the treating of LIS premium and cost-sharing subsidies as benefits, or otherwise taking them into account, in determining an individual's eligibility for, or amount of benefits under, any other federal program. Requires individuals eligible for Medicare Savings Programs to be deemed subsidy eligible individuals under LIS. Establishes a special enrollment period for subsidy eligible individuals under LIS.

Requires that the Enterprise consist of an Interdepartmental Oversight Board, an Interagency Coordinating Committee, and a Climate Operations Office established by this Act, and nonfederal contributors. Requires the Office, subject to appropriations, to develop and implement a quality assurance program to certify climate products and services that satisfy this Act's standards. Defines "climate product and service" as any publicly or commercially available product or service produced by a nonfederal contributor that includes or displays climate data, meta-data, or information. Allows the Enterprise to authorize the use of the emblem or any trademark of the Enterprise on a certified climate product or service. Establishes in the Treasury the Climate Products And Services Account. Requires the Enterprise Advisory Board to provide advice to the Interagency Coordinating Committee on policy implementation by the Climate Operations Office, the effectiveness of data, meta-data, information, products, and services delivered to end-users, priorities for climate research and information needs, the performance of non-federal contributors, and critical climate research needs.

Directs such entity or committee to: (1) review how federal programs and efforts that address issues related to the transition of adolescents and young adults with serious mental health disorders may be coordinated to ensure the maximum benefit for the individuals being served; and (2) provide technical assistance to the states that are planning or implementing programs under this Act.
