Territorial Health Parity Act of 2009 - Amends title XI of the Social Security Act (SSA) to sunset at the end of FY2009 the limitation on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Amends SSA title XIX (Medicaid) to: (1) repeal, as of the end of FY2011, the federal medical assistance percentage (FMAP) of 50% that applies to such territories; and (2) set the new FMAP for such territories at one determined by the Secretary of Health and Human Services (Secretary) in consultation with the Secretary of the Interior. Specifies a transitional FMAP for such territories for FY2010-FY2011. Requires the Secretary to report to Congress on the per capita income data used to promulgate the FMAP in the territories and how such data differ from the per capita income data used to promulgate FMAPs for the 50 states and the District of Columbia. Requires the report to include recommendations on how FMAPs can be calculated for the territories to ensure parity with the 50 states and the District of Columbia. Amends the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 to extend the Medicaid program to the citizens of the Freely Associated States (Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau). Amends SSA title XIX to set a 100% FMAP for otherwise qualified services rendered to such citizens.

Help Veterans Own Franchises Act - Amends the Internal Revenue Code to allow business franchisors and veterans who purchase a franchise tax credits for a specified percentage of the fees paid to purchase the franchise. Requires the Administrator of the Small Business Administration and the Secretary of Veterans Affairs to provide information about the tax credits in this Act to veterans service organizations and advocacy groups.

Positive Behavior for Safe and Effective Schools Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to allow states to allocate school improvement funds under title I of the ESEA for coordinated, early intervention services for all students. Includes among such services, schoolwide positive behavior supports, defined as a systematic approach to embed proven practices for early intervention services in order to achieve important social outcomes and increase student learning, while preventing problem behaviors. Requires improvements in schoolwide learning climates, including schoolwide positive behavior supports, to be a target of: (1) technical assistance provided by states to local educational agencies (LEAs) and schools, and by LEAs to schools identified as needing improvement; (2) schoolwide programs that allow LEAs to consolidate educational funds to upgrade the entire educational program of schools that serve a high proportion of low-income families; (3) professional development funding; (4) funding under the Safe and Drug-Free Schools and Communities program; and (5) elementary and secondary school counseling programs. Amends the Department of Education Organization Act to establish, within the Department of Education, an Office of Specialized Instructional Support Services to oversee, implement, and ensure adequate evaluation of, the provision of specialized instructional support services in schools by school counselors, social workers, psychologists, and other qualified professionals.

Help Student Soldiers Act - Amends title IV (Student Assistance) of the Higher Education Act of 1965 to waive the application of the requirement that students return title IV funds which were unearned due to their withdrawal from school to students whose withdrawal is necessitated by service in the Armed Forces. Provides loan forgiveness under the Federal Family Education Loan, Direct Loan, and Perkins Loan programs to students for that portion of loan assistance which is unearned due to their withdrawal from school for service in the Armed Forces and which is not returned to such programs by their schools.

Pathways to College Act - Authorizes the Secretary of Education to award competitive five-year grants to local educational agencies that serve mostly high-need high schools for programs to increase the number of students from low-income families who attend college. Defines "high-need high schools" as those where at least one-half of the students are from low-income families. Requires grantees to use such funds to: (1) train teachers and counselors to provide students with advice concerning postsecondary education; (2) implement a comprehensive college guidance program for all students which exposes them to postsecondary information and planning assistance before the end of their first semester of high school; (3) ensure that their schools develop comprehensive, school-wide plans of action to strengthen their college-going culture; (4) create or maintain a postsecondary access center in each school that provides information on colleges and universities, career opportunities, and financial aid options; and (5) provide a setting in which professionals working in college access programs can meet with students. Directs the Secretary to provide technical assistance to grantees in calculating and analyzing their college-going rates and adopting best practices for elevating such rates. Requires grantees periodically to evaluate the success of their grant activities and use the evaluations to refine such activities and their performance measures. Directs the Secretary to conduct an independent evaluation of the grant program which includes an assessment of the program's affect on high school graduation and college-going rates.

Keep America's Waterfronts Working Act of 2009 - Amends the Coastal Zone Management Act of 1972 to direct the Secretary of Commerce, acting through the National Oceanic and Atmospheric Administration (NOAA), to establish a Working Waterfront Grant Program to make a grant, through a regionally equitable, competitive funding process, to any coastal state to implement a plan to preserve and expand access to coastal waters for persons engaged in commercial fishing, recreational fishing, aquaculture, boatbuilding, or other water-dependent coastal-related business. Authorizes the Secretary to award planning grants to coastal states to develop or revise comprehensive working waterfront plans.

National Fish Habitat Conservation Act - Establishes a National Fish Habitat Board to: (1) promote, oversee, and coordinate the implementation of this Act and the existing National Fish Habitat Action Plan; (2) establish aquatic habitat conservation goals and priorities; and (3) review and recommend fish habitat conservation projects. Authorizes the Board to designate Fish Habitat Partnerships to: (1) coordinate Plan implementation at a regional level; (2) identify strategic priorities; (3) recommend habitat projects; and (4) develop and carry out fish habitat conservation projects. Establishes Partnership approval criteria, including that a Partnership: (1) include representatives of a diverse group of public and private partners focused on conservation of aquatic habitats to achieve results across jurisdictional boundaries and public and private land; and (2) is able to address issues and priorities on a nationally significant scale. Directs the Secretary of the Interior to fund, from amounts appropriated under this Act, up to 50% of the cost of approved fish habitat conservation projects on nonfederal and 100% of projects on federal land or water. Requires the Director of the U.S. Fish and Wildlife Service to: (1) establish the National Fish Habitat Conservation Partnership Office within the Service; and (2) develop the Office's interagency operational plan. Requires the Director, the Assistant Administrator of the National Oceanic and Atmospheric Administration (NOAA), and the Director of the United States Geological Survey (USGS) to provide technical and scientific assistance to the Partnerships, the project participants, and the Board.

Atomic Veterans Service Medal Act - Directs the Secretary of Defense (DOD) to: (1) design and produce a military service medal, to be known as the Atomic Veterans Service Medal, to honor retired and former members of the Armed Forces who participated in a radiation-risk activity while serving on active duty; and (2) issue the Medal to such veterans or their next-of-kin.

Native Hawaiian and Other Pacific Islander Health Survey Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to award a contract or grant to an entity to develop and conduct a health survey regarding Native Hawaiians and other Pacific Islanders in the United States, U.S. territories, and affiliated Pacific jurisdictions in order to: (1) identify their unmet health and health care needs; and (2) establish baseline health information to achieve equity in health information for the Native Hawaiian and other Pacific Islander community. Requires such data collection efforts to be targeted to areas with the highest concentrations of Native Hawaiians and other Pacific Islanders based on the 2010 decennial census. Directs the Secretary to award a contract or grant to an entity to: (1) analyze and prepare the data collected under this Act for distribution; and (2) submit the data, analysis, and any corresponding documents to the National Center for Health Statistics for internal review. Requires the Secretary to make such information public.

Women Veterans Access to Care Act - Directs the Secretary of Veterans Affairs (VA), in providing health care services to women veterans, to emphasize: (1) with respect to physical health, conditions including reproductive health, preventive medicine and early detection, sexual trauma, special needs of women with prosthetics, and rehabilitation; (2) with respect to mental health, issues including stress reduction, services for depression, anxiety, post-traumatic-stress-disorder (PTSD), and substance abuse, and conflict resolution; (3) improving health-related telecommunications technologies; (4) providing care to women veterans who served in Operations Enduring Freedom or Iraqi Freedom, live in a rural area, or are homebound or elderly; and (5) with respect to health professionals employed by the VA, hiring health professionals who are specialist in fields related to women's health, and offering additional training on special issues regarding women veterans. Requires the Secretary to: (1) conduct a study on health care for women veterans; and (2) carry out an information outreach program for women veterans and their families.

Authorizes the award of a single Congressional Gold Medal to collectively honor the American soldiers who were prisoners of war at Bataan/Corregidor/Luzon during World War II, in recognition of their personal sacrifice and service to their country. Provides for the Medal's display at the Smithsonian Institution. Expresses the sense of Congress that the Medal should be made available for display elsewhere, particularly at locations associated with those who fought in defense of Bataan/Corregidor/Luzon and the prisoners of war.

Fairness and Transparency in Contracting Act of 2009 - Amends the Small Business Act to exclude as a small business, for purposes of meeting federal agency contracting goals with small businesses, any small business (or subsidiary thereof) that is publicly traded, or any business (or subsidiary thereof) with more than 50% non-U.S. citizen ownership. Requires the Administrator of the Small Business Administration (SBA) to notify the head of each federal department or agency regarding this Act and its amendments, and the department or agency head to then notify its contractors. Directs the Administrator to: (1) publish a report regarding federal prime contracts awarded to businesses identified as small businesses for purposes of achieving small business contracting goals; and (2) establish procedures to ensure that the Central Contractor Registration database provides an adequate warning regarding criminal penalties for misrepresenting the status of a small business or person in order to obtain federal contracts. Provides for enforcement of complaints about the classification of a business for such purposes.

Blue Star/Gold Star Flag Act of 2009 - States that a condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent an association member from displaying a Service Flag on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use. (A Service Flag, also known as a "blue star banner," is an official banner authorized by the Department of Defense [DOD] for display by families who have members serving in the Armed Forces during any period of war or hostilities the United States may be engaged in for the duration of such hostilities.) States that nothing in this Act shall be considered to permit any display or use inconsistent with: (1) any DOD regulations regarding rules or customs pertaining to the proper display or use of the Service Flag; or (2) any reasonable restriction pertaining to the time, place, or manner of displaying the flag necessary to protect a substantial interest of the condominium, cooperative, or residential real estate management association.

Service Members Home Ownership Act of 2009 - Amends the Internal Revenue Code to extend until December 1, 2010, the first-time homebuyer tax credit for members of the Armed Forces serving outside the United States for a period in 2009 before December 1, 2009, of not less than 90 days.

Expresses the heartfelt condolences of the House of Representatives to the families and friends of the victims of the May 11, 2009, shooting at the combat stress clinic at Camp Liberty, Iraq. Conveys its ongoing deep gratitude to the brave members of the Armed Forces who risk their lives in service of protecting the nation. Recognizes the important work of the medical professionals and staff members, who provide essential mental health services to our servicemen and women, at Combat Stress Control Center in Camp Liberty, Iraq, and other clinics in theater and at home. Commits the House to: (1) focus on the mental, in addition to the physical, well-being of the nation's military servicemen and women, and veterans; and (2) support the policies, resources, and funding necessary to combat successfully the mental and physical healthcare challenges that they may confront.

Mental Health in Schools Act of 2009 - Amends the Public Health Service Act to revise a community children and violence program to assist local communities and schools in applying a public health approach to mental health services, including by: (1) revising eligibility requirements for a grant, contract, or cooperative agreement; and (2) providing for comprehensive school mental health programs that are culturally and linguistically appropriate and age appropriate. Makes only a partnership between a local educational agency and at least one community program or agency that is involved in mental health eligible for such funding. Sets forth assurances required for eligibility, including that: (1) the local education agency will enter into a memorandum of understanding with relevant community-based entities that clearly states the responsibilities of each partner; (2) the program will include training of all school personnel, family members of children with mental health disorders, and concerned members of the community; and (3) the program will demonstrate the measures to be taken to sustain the program after funding terminates. Requires the Administrator of the Substance Abuse and Mental Health Services Administration to develop a process for evaluating grant program activities, including: (1) the development of guidelines for the submission of program data by recipients; and (2) the development of measures of outcomes to be applied by recipients in evaluating programs, to include student and family measures and local educational measures.

National Infrastructure Development Bank Act of 2009 - Establishes the National Infrastructure Development Bank as a wholly owned government corporation. Makes the Bank's Board of Directors responsible for monitoring and overseeing energy, environmental, telecommunications, and transportation infrastructure projects. Authorizes the Board to: (1) issue public benefit bonds and provide direct subsidies to infrastructure projects; (2) borrow on the global capital market and lend to entities and commercial banks for funding infrastructure projects; and (3) purchase, pool, and sell infrastructure-related loans and securities on such market. Requires the Board to establish criteria for determining project eligibility for financial assistance under this Act. Sets forth the duties of the Bank's executive committee and audit committee. Requires the Bank to establish a risk management committee, which shall: (1) create financial, credit, and operational risk management guidelines for the Bank; (2) set standards to ensure diversification of lending activities by both region and infrastructure project type; and (3) create conforming standards for infrastructure finance securities. Exempts all notes, debentures, bonds or other such obligations issued by the Bank, and the interest on or credits with respect to such bonds or other obligations, from state or local government taxation. Terminates the Bank after 15 years.

Puerto Rico Democracy Act of 2009 - Authorizes the government of Puerto Rico: (1) to conduct a plebiscite giving voters the option to vote to continue Puerto Rico's present political status or to have a different political status; (2) if a majority of ballots favor continuing the present status, to conduct additional such plebiscites every eight years; and (3) if a majority of ballots favor having a different status, to conduct a plebiscite on the options of becoming fully independent from the United States, forming with the United States a political association between sovereign nations that will not be subject to the Territorial Clause of the Constitution, or being admitted as a state of the Union. Prescribes the eligibility requirements for voting in the plebiscite. Requires the Puerto Rico State Elections Commission to certify plebiscite results to the President and Congress.

Amends the Whale Conservation and Protection Study Act to rename it as the International Whale Conservation and Protection Act of 2009. Requires the Secretary of Commerce (Secretary), in cooperation with the Secretary of State, to: (1) restate strong U.S. opposition to commercial whaling and to refuse to engage in any negotiation or reinterpretation of the International Convention for the Regulation of Whaling that would weaken the moratorium on commercial whaling, create new categories of whaling, condone lethal scientific whaling, or weaken whale conservation and protection; and (2) support subsistence whaling and the development of the Aboriginal Whaling Management Scheme. Sets forth provisions concerning the International Whaling Commission. Requires the Secretary, in cooperation with the United States Coast Guard, to: (1) pursue the establishment of guidelines for minimizing the introduction of incidental noise from commercial shipping operations into marine environments to reduce the potential adverse affects on whales and other marine life; and (2) promote the use of areas to be avoided by commercial vessels and other navigational measures to minimize the threat of injury to whales. Requires the Secretary, in cooperation with the Secretary of the Interior, to encourage nations that hold any reservations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora to the great whales listed in Appendix I to withdraw such reservations and terminate commercial trade in whale meat and products. Provides for international cooperation and compliance with regulations governing trade in or takings of whales. Requires the Secretary to: (1) negotiate with the government of Canada with the goal of concluding a North Atlantic Whale Conservation Agreement within 18 months; (2) develop international action plans to reduce threats to whales and other cetaceans through the establishment of new International Marine Protected Areas (IMAs) and IMA networks; and (3) establish whale research initiatives to enhance whale conservation efforts. Requires the Secretary and the Secretary of State to support efforts to study and reduce the adverse effects of anthropogenic noise on whales and other marine life.

Mother's Day Centennial Commemorative Coin Act - Instructs the Secretary of the Treasury to mint and issue not more than 400,000 $1 coins emblematic of the 100th anniversary of President Wilson's proclamation designating the second Sunday in May as Mother's Day. Authorizes the Secretary to issue such coins beginning January 1, 2014, except that the Secretary may initiate sales of such coins, without issuance, before such date. Terminates such minting authority after December 31, 2014. Requires coin sales to include a $10 surcharge per coin, with distribution of such surcharges to the Susan G. Komen for the Cure and the National Osteoporosis Foundation for the purpose of furthering research.

Supports increased efforts to allow spouses and family members of veterans, including those killed in combat in Iraq and Afghanistan, to receive needed counseling services at Department of Veterans Affairs (VA) facilities. Encourages the Secretaries of Veterans Affairs and Defense to develop programs for veterans with post-traumatic stress disorder (PTSD) that include and treat the entire family. Calls on the Secretaries and the heads of other appropriate federal agencies to increase resources available for family and friends of veterans suffering from PTSD. Urges the Secretaries to increase access to counseling and other mental health services to family members of veterans as part of the comprehensive plan for the treatment of mental health conditions of members of the Armed Forces required by the National Defense Authorization Act for Fiscal Year 2008. Urges the Secretary of Veterans Affairs to collaborate with the Department of Defense (DOD) center of excellence in the prevention, diagnosis, mitigation, treatment, and rehabilitation of PTSD and other mental health conditions with respect to the education, treatment, and support of family members of veterans with such conditions. Requests the Secretaries to submit to Congress a list of statutory barriers that prevent each department from expanding access to mental health counseling services to family members of veterans. Urges the Secretary to aggressively work with Congress, veterans service organizations, and others to determine how to best meet the needs of veterans and their family members.

Recognizes that mental well-being is as important as physical well-being for people, the economy, and the country. Encourages all organizations and health practitioners to use Mental Health Month as an opportunity to promote mental well-being and awareness, ensure access to appropriate services, and support overall quality of life for those living with mental illness.

Requires the Secretary of Energy, acting through the Assistant Secretary of Energy Efficiency and Renewable Energy, to assemble a team of technical, policy, and financial experts to address the energy needs of Puerto Rico, Guam, American Samoa, the Northern Mariana Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, the Republic of Palau, and the U.S. Virgin Islands to: (1) reduce reliance and expenditures on imported fossil fuels; (2) increase the use of indigenous, nonfossil fuel energy sources; (3) improve the performance of energy infrastructure through projects to improve the energy efficiency of power generation, transmission, and distribution and increase consumer energy efficiency; (4) improve the performance of energy infrastructure through enhanced planning, education, and training; (5) adopt research-based and public-private partnership-based approaches; (6) stimulate economic development and job creation; and (7) enhance the engagement by the federal government in international efforts to address such energy needs. Requires the team to provide assistance to each utility of each island and to each island's government to develop and implement an energy Action Plan to reduce reliance on imported fossil fuels through increased efficiency and use of indigenous clean-energy resources. Requires the Secretary to consider including regional utility organizations in the establishment of the team and providing assistance through regional utility organizations.

Amends the Energy Policy Act of 2005 to: (1) make states (including American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands) that represent or provide pollution reduction or educational services to persons or organizations that own or operate diesel fleets, or that have the promotion of transportation or air quality as their principal purpose, eligible for grants and loans for diesel emission reductions; and (2) require the Administrator of the Environmental Protection Agency (EPA) to allocate to American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands funding for a grant and loan program that is designed to achieve significant reductions in diesel emissions if such states have an approved application for such program.
