Northern Marianas Delegate Act - Prescribes a procedure for election to the House of Representatives as a nonvoting Delegate of the Resident Representative to the United States authorized under the Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America.

Amends the Immigration and Nationality Act to give family- or employment-based immigrant visa priority to the otherwise eligible children, sons, or daughters of Filipino World War II veterans who were naturalized as U.S. citizens under the Immigration Act of 1990.

Compassionate Visitor Visa Act - Amends the Immigration and Nationality Act to create a presumption that certain aliens seeking temporary entry into the United States in connection with the serious illness or death of a specified U.S. citizen or lawful permanent resident family member (or other emergency or compelling circumstances involving such family members as the Secretary of Homeland Security may establish) are entitled to nonimmigrant status unless a consular or immigration officer determines that the applicant: (1) is inadmissible; or (2) does not intend to depart the United States following the period of authorized admission.

Provides immigration relief for aliens who are determined by the Secretary of Homeland Security to have: (1) obtained nonimmigrant status on or after January 1, 1980, and who at that time were nationals of the Republic of Korea; (2) applied before January 1, 1999, through one or more immigration brokers for adjustment of status to that of a lawful permanent resident (LPR) through the Immigration and Naturalization Service (INS) office in San Jose, California; (3) obtained approval for adjustment as the result of bribery by such brokers of an INS supervisor; and (4) had no actual knowledge of the fraud at the time of adjustment. Extends relief to the spouse and children of eligible aliens granted derivative LPR status. Prohibits the immigration fraud reflected by such bribery from being considered in determining the admissibility or removability of eligible aliens. Requires the Secretary to: (1) restore an eligible alien's status as if the original adjustment had been lawful, including where LPR status and naturalization were rescinded on the basis of the fraud; and (2) parole into the United States eligible aliens who were removed or who voluntarily departed in connection with charges relating to the fraud for purposes of filing an application for relief under this Act. Prohibits the Secretary of State from reducing the number of available immigrant visas as the result of the approval of such an application for relief.

Wartime Parity and Justice Act of 2005 - Allows certain individuals of Japanese ancestry who were brought forcibly to the United States from countries in Latin America and interned during World War II or who lost other specified rights or privileges due to their ancestry to be provided restitution under the Civil Liberties Act of 1988. Urges the President to transmit a letter of apology to each such individual. Makes the Attorney General responsible for identifying and locating individuals eligible for restitution. Authorizes judicial review of a denial of compensation. Permits an individual covered by this Act who has accepted payment on a related claim before this Act's enactment to receive an appropriately reduced payment. States that certain individuals covered by this Act shall not be considered to have been unlawfully present in the United States during the evacuation, relocation, or internment period. Directs: (1) each U.S. agency to correct any records indicating otherwise; (2) agencies to disclose all information relating to the removal and internment of such individuals; and (3) the President to share such information with other countries and encourage those countries to make that information available. Reestablishes in the Treasury the Civil Liberties Public Education Fund, establishes a board of directors for the Fund, and sets forth permissible uses for Fund disbursements, including sponsorship of research and public education activities.

Bipartisan Commission on Medicaid Act of 2005 - Establishes the Bipartisan Commission on Medicaid to review: (1) each of Medicaid's major functional responsibilities; (2) issues that either threaten or improve the long-term financial condition of Medicaid; (3) Federal and State policies for Medicaid and Medicare enrollment (including enrollment sites), income eligibility, outreach, and documentation; (4) the operation and effectiveness of Medicaid premium assistance programs; and (5) Medicaid payment policies.

Annie Fox Act - Amends the Public Health Service Act to require the Director of the National Institute of Environmental Health Sciences to expand, intensify, and coordinate Institute activities regarding breast cancer in younger women, including the conduct and support of: (1) basic and clinical research on the causes, prevention, detection, treatment, and long-term effects of breast cancer in young women; and (2) information and education programs for health professionals and the public.

Commends the outstanding efforts in response to the earthquake and tsunami of December 26, 2004, by members of the Armed Forces and civilian employees of the Department of State and the U.S. Agency for International Development. Expresses the sense of Congress that: (1) the Federal Government should urge the Government of the People’s Republic of China (PRC) in the strongest possible terms not to enact into law the so-called “anti-secession” legislation or any other legislation that threatens Taiwan or in any way jeopardizes peace between China and Taiwan, continue to encourage a regional high-level dialogue on the best means to ensure stability, peace, freedom of the seas, and deterrence in East Asia, and reaffirm its unwavering commitment to the Taiwan Relations Act as the cornerstone of U.S. relations with Taiwan; (2) the President should seek from the PRC leaders an immediate and unequivocal public renunciation of any threat or use of force against Taiwan, encourage further dialogue between democratic Taiwan and the PRC, direct all appropriate Federal officials to raise these concerns with the appropriate PRC officials, and seek a public, immediate, and unequivocal renunciation from the PRC leaders of any threat or use of force against Taiwan; and (3) Taiwan's future should be determined peacefully and with the express consent of its people.

Homeowners' Insurance Availability Act of 2005 - Instructs the Secretary of the Treasury to implement a reinsurance coverage program available only through contracts for reinsurance coverage purchased at regional auctions. States that the purpose of the program is to improve: (1) the availability of homeowners' insurance for the purpose of facilitating the pooling, and spreading the risk, of catastrophic financial losses from disasters; and (2) the solvency of the homeowners' insurance markets. Prescribes implementation guidelines that include establishment: (1) in the Treasury of the Disaster Reinsurance Fund; and (2) of a National Commission on Catastrophe Risks and Insurance Loss Costs.

Expresses the sense of Congress that the government of Japan should: (1) issue an apology for the sexual enslavement of young women (known as "comfort women") during the colonial occupation of Asia and the Pacific Islands during World War II; (2) pay reparations to the victims; (3) educate future generations about this crime against humanity; and (4) publicly refute claims that the subjugation and enslavement of such women never occurred.

Methamphetamine Remediation Research Act of 2005 - Requires the Assistant Administrator for Research and Development of the Environmental Protection Agency to establish: (1) voluntary guidelines, based on the best currently available scientific knowledge, for the remediation of former methamphetamine laboratories, including guidelines regarding preliminary site assessment and the remediation of residual contaminants; and (2) a program of research to support the development and revision of such guidelines. Directs the Assistant Administrator to: (1) periodically convene a conference of appropriate State agencies, as well as individuals or organizations involved in research and other activities directly related to the environmental or biological impacts of former methamphetamine laboratories; and (2) enter into an arrangement with the National Academy of Sciences for a study of the status and quality of research on the residual effects of methamphetamine laboratories. Requires the Director of the National Institute of Standards and Technology to support a research program to develop: (1) new methamphetamine detection technologies, with an emphasis on field test kits and site detection; and (2) appropriate standard reference materials and validation procedures for methamphetamine detection testing.

Amends the Immigration and Nationality Act to confer automatic citizenship on aliens residing in the United States in lawful permanent resident status pursuant to a classification petition approved under a provision that gives preferential treatment to persons born in Korea, Vietnam, Laos, Kampuchea, or Thailand after 1950 and before October 22, 1982, who were fathered by U.S. citizens.

Military Surviving Spouses Equity Act - Repeals, as of the later of October 1, 2005, or the date of enactment of this Act, certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military pay or who would be entitled to retired pay except for being under 60 years of age. Provides for the recoupment of certain amounts previously paid to SBP recipients in the form of a retired pay refund.

Diabetic Retinopathy Prevention Act of 2005 - Amends Title XVIII (Medicare) and Title XIX (Medicaid) of the Social Security Act to expand Medicare and Medicaid coverage to include remote assessment of diabetic retinopathy (a diagnostic examination that is provided no more than annually to an individual who has been diagnosed with diabetes, that meets technical standards set forth by the Secretary of Health and Human Services, that is furnished via a telecommunications system to an eligible patient, and that is conducted under the supervision of a board-certified ophthalmologist with retinal fellowship training). Requires the Secretary to study and report to Congress on the costs incurred by health care providers to provide such assessment. Amends the Public Health Service Act to direct the Secretary to: (1) establish the Mobile Diabetic Retinopathy Screening Pilot Program to make five grants to eligible entities to establish mobile diabetic retinopathy screening programs; (2) give priority to entities with relevant experience who propose to serve rural, impoverished, unserved, minority, and remote populations; and (3) convene an advisory committee to evaluate the Program.

Animal Fighting Prohibition Enforcement Act of 2005 - Amends the Federal criminal code to prohibit: (1) sponsoring or exhibiting a bird in a fighting venture in a State where it would not otherwise be in violation of the law, only if the person knew that any bird in the venture was knowingly bought, sold, delivered, transported, or received in interstate or foreign commerce for such purpose; or (2) knowingly sponsoring or exhibiting in an animal fighting venture any other animal that was moved in interstate or foreign commerce. Prohibits knowingly: (1) selling, buying, transporting, delivering, or receiving, for purposes of transportation in interstate or foreign commerce, any dog or other animal to participate in an animal fighting venture; (2) using interstate mail service for commercial speech promoting an animal fighting venture except as performed outside the limits of the States (with an exception for bird fights in States whose laws allow them); or (3) selling, buying, transporting, or delivering in interstate or foreign commerce a knife, gaff, or other sharp instrument to be attached to the leg of a bird for use in an animal fighting venture. Increases the penalties to a fine and up to two years' imprisonment for violations.

Save Our Small and Seasonal Businesses Act - Amends the Immigration and Nationality Act to prohibit an alien counted toward the numerical limitation applicable to H-2B nonimmigrants (temporary nonagricultural workers) during any of the three fiscal years prior to submission of an H-2B petition from being counted toward the limitation in the year of petition approval. Makes this provision effective as if enacted on October 1, 2004. Provides for its expiration on October 1, 2006. Requires the Secretary of Homeland Security to impose a fraud prevention and detection fee on employers filing H-2B petitions. Mandates the deposit of such fees into the Fraud Prevention and Detection Account. Authorizes additional penalties for a substantial failure to meet any condition of an H-2B petition or the willful misrepresentation of a material fact in such a petition. Requires the allocation of the numerical limitation on the issuance of H-2B visas (currently, 66,000) such that the total number of H-2B nonimmigrants entering the United States during the first six months of a fiscal year is not more than 33,000. Directs the Secretary to provide the House and Senate Judiciary Committees with information on: (1) the numbers of aliens granted H-2B status or terminated from H-2B status, on a quarterly basis; and (2) the countries of origin, occupations of, and compensation paid to aliens granted H-2B status, the number of aliens terminated from such status, and the number of aliens provided such status during both the fiscal year reported and the preceding fiscal year, on an annual basis. Requires the Secretary of State to provide information relevant to such reports.

Next Generation Hispanic-Serving Institutions Act - Amends the Higher Education Act of 1965 to revise requirements for Hispanic-serving institutions (HSIs) under title V (Developing Institutions). Establishes a program of competitive grants to eligible HSIs that offer postbaccalaureate certifications or degrees (part B grants). Limits a part B grant award's duration to not more than five years. Prohibits the Secretary of Education from awarding more than one part B grant to an HSI in any one fiscal year. Authorizes appropriations for: (1) the current part A program of grants to HSIs that offer baccalaureate degrees or are junior or community colleges; and (2) the new part B program of grants to HSIs that offer postbaccalaureate certifications or degrees. Eliminates the requirement that an eligible HSI provide assurances that at least 50 percent of its Hispanic students are low-income students. Includes, among authorized activities under part A grants, articulation agreements and student support programs to help transfers from two-year to four-year institutions. Eliminates the two-year wait-out period between any two five-year part A grants to an HSI.

PILT and Refuge Revenue Sharing Permanent Funding Act - Provides permanent funding for the following programs: (1) Bureau of Land Management Payment in Lieu of Taxes (PILT); and (2) the U.S. Fish and Wildlife Service's refuge revenue sharing program.

Resuming Education After Defense Service Act of 2005 - Makes eligible for basic educational assistance under the Montgomery GI Bill a member of the Selected Reserve who (among other qualifications), during the period beginning on September 11, 2001, and ending on December 31, 2006, serves on active duty in the Armed Forces for one or more periods aggregating not less than two years. Entitles such individuals to one month of educational assistance for each month served on active duty. Makes the amount of such assistance equivalent to that provided for active-duty personnel who have served a minimum of two years of active duty. Requires the basic pay of qualifying members to be reduced by $100 for each of first 12 months of such active duty service. Requires the Secretaries of the military departments concerned to inform eligible Selected Reserve personnel of such entitlement.

Reaffirmation of State Regulation of Resident and Nonresident Hunting and Fishing Act of 2005 - Expresses the policy of Congress that it is in the public interest for each State to continue regulating the taking for any purpose of fish and wildlife. Prohibits congressional silence from being construed as imposing a commerce clause barrier to such regulation by a State or Indian tribe. Provides that nothing in this Act shall be construed to: (1) limit the applicability or effect of any Federal law related to the protection or management of fish or wildlife or to the regulation of commerce; (2) limit the authority of the United States to prohibit hunting or fishing on U.S. lands; or (3) abrogate, abridge, affect, modify, supersede, or alter any treaty-reserved or other right of any Indian tribe as recognized by any other means.

Military Sexual Assault Crimes Revision Act of 2005 - Amends the Uniform Code of Military Justice to define as the crime of aggravated sexual abuse engaging in a sexual act: (1) through the use of force; (2) by threatening or placing a person in fear that any person will be subjected to death, grievous bodily harm, or kidnapping; (3) by rendering another person unconscious; (4) by administering to another person an impairing drug or intoxicant; or (5) with a person under 12 years of age whether or not the accused knew the person's age. Defines as the crime of sexual abuse engaging in a sexual act: (1) by threatening or placing a person in fear (other than in a manner that would constitute aggravated sexual abuse); (2) with a person who is incapable of either appraising the nature of the conduct or physically incapable of declining; or (3) with a person who is at least 12 but under 16 who is not the spouse of the accused whether or not the accused knew the person's age. Establishes as an affirmative defense the accused's reasonable belief that the person was at least 16. Defines sexual abuse of a prisoner as knowingly engaging in a sexual act with a person who is: (1) in official detention or confinement; (2) under the custodial, supervisory, or disciplinary authority of the accused; and (3) is not the accused's spouse. Makes the above crimes punishable by court-martial and sets forth interim maximum punishments for each.

Amends the Federal Water Pollution Control Act to require projects receiving sewer overflow control grant assistance to be carried out subject to the requirements applicable to projects receiving assistance from State water pollution control revolving funds, except to the extent that the Governor of the State in which the project is located determines that a revolving fund requirement is inconsistent with the purposes of the sewer overflow control grant program. Reauthorizes appropriations for sewer overflow control grants through FY 2011. Modifies grant funding allocation provisions to reflect new dates of authorization and reauthorized amounts. Eliminates the set-aside for the Administrator of the Environmental Protection Agency (EPA) to make direct grants to municipalities and municipal entities during the second year of authorization. Establishes a December 31, 2008, deadline for the Administrator's report to Congress on recommended funding levels for sewer overflow control grants.

Directs the Consumer Product Safety Commission to prescribe regulations classifying any children's product containing lead as a banned hazardous substance under the Hazardous Substances Act. Defines "children's product containing lead" as any consumer product marketed for use by children under age six (or whose substantial use by such children is foreseeable) that contains more than trace amounts of lead as determined by the Commission and prescribed by regulations. Requires the Commission, if it determines that it is not feasible for certain electronic devices to immediately comply with prescribed regulations, to: (1) issue standards to reduce exposure and accessibility to lead in such devices; and (2) establish a schedule for full compliance.

Prescription Plan Preservation Act of 2005 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to condition the payment of Medicare employer prescription drug subsidies on the maintenance of current prescription drug benefits. Requires the actuarial value of prescription drug coverage to be at least equal to the greater of the actuarial value of: (1) standard prescription drug coverage (as under current law); or (2) the employment-based retiree health coverage in effect as of December 8, 2003.

Notch Fairness Act of 2005 - Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act with respect to the benefit computation formula for individuals affected by the changes in benefit computation rules enacted in the Social Security Amendments of 1977 who reached age 65 after 1979 and before 1989. Sets forth a schedule of additional benefit increases for such beneficiaries (and related beneficiaries), with percentages declining from 55 percent to five percent keyed to the year an individual became eligible for such benefits between 1979 and 1989. Provides for an election to receive such payments in a lump sum.

Amends Federal provisions concerning the National Guard Youth Challenge Program (a civilian youth opportunities program conducted by the Secretary of Defense) to provide a maximum Federal matching funds level of 60 percent of the costs of operating the State program during FY 2005, 65 percent during FY 2006, 70 percent during FY 2007, and 75 percent during FY 2008 and beyond.

Angel Island Immigration Station Restoration and Preservation Act - Authorizes appropriations to the Secretary of the Interior for restoring the Angel Island Immigration Station in San Francisco Bay, in coordination with the Angel Island Immigration Station Foundation and the California Department of Parks and Recreation. Limits Federal funding under this Act to 50 percent of the total funds from all sources spent to restore the Angel Island Immigration Station. Requires funds appropriated by this Act to be used first for restoration of the Immigration Station Hospital on Angel Island.

High School Athletics Accountability Act of 2005 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to direct coeducational elementary and secondary schools, if they participate in any ESEA program, to: (1) report certain information on equality in their school athletic programs to the Commissioner for Educational Statistics; and (2) make such information available to their students and potential students, upon request, and to the public.

Guard and Reserve Readiness and Retention Act of 2005 - Makes an individual eligible for retired pay for non-regular (reserve) military service if such individual: (1) satisfies one of specified combinations of minimum age (between 53 and 60) and years of service (between 20 and 34); (2) performed the last six years of qualifying service in currently authorized categories of military service, but not while a member of a regular component, the Fleet Reserve, or the Fleet Marine Corps Reserve; and (3) is not entitled to any other retirement pay from an armed force or as a member of the Fleet Reserve or Fleet Marine Corps Reserve. Authorizes a member of the Selected Reserve to enroll for self or self and family coverage under the TRICARE program (a Department of Defense managed health care program).

Keep Our Promise to America's Military Retirees Act - Directs the Secretary of Defense to enter into an agreement with the Office of Personnel Management to provide Federal Employees Health Benefits (FEHB) coverage to the following eligible beneficiaries: (1) a member or former member of the Armed Forces entitled to military retired or retainer pay; (2) an unremarried former spouse who was married to a member for at least 20 years, during which such member performed at least 20 years of retirement-creditable military service; (3) a dependent of a deceased qualifying member or former member; (4) a dependent of a living member or former member; and (5) a family member. Directs the Secretary to reimburse such eligible persons for pharmacy benefits received from a pharmacy that is not a TRICARE (Department of Defense managed health care plan) network pharmacy in the same manner as the Secretary would reimburse such person for such benefits received from a TRICARE network pharmacy. Requires such persons, in order to receive such reimbursement, to submit a certification from their physician stating that the person does not have access to a TRICARE network pharmacy due to physical or medical constraints. Amends title XVIII (Medicare) of the Social Security Act to waive the monthly part B premium (Supplementary Medical Insurance Benefits for the Aged and Disabled) with respect to: (1) an individual who is entitled to military retired or retainer pay based upon service that began before December 7, 1956; and (2) the spouse, widow, or widower of such individuals.

Caribbean National Forest Act of 2005 - Designates the El Toro Wilderness in the Caribbean National Forest/Luquillo Experimental Forest in the Commonwealth of Puerto Rico as a component of the National Wilderness Preservation System. Prohibits anything in this Act from precluding the installation and maintenance of hydrologic, meteorological, climatological, or atmospheric data collection and remote transmission facilities that are essential to the scientific research purposes of the Luquillo Experimental Forest.

Small Business Health Fairness Act of 2005 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for establishment and governance of association health plans (AHPs), which are group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations, and which meet certain ERISA certification requirements. (Thus, through ERISA preemption of State laws, certified AHPs are exempted from State regulation of health insurance providers, including State consumer protection laws and State requirements for health care benefits to be offered by such entities, with certain exceptions.)

Assured Funding for Veterans Health Care Act of 2005 - Requires the Secretary of the Treasury to make available to the Secretary of Veterans Affairs for programs, functions, and activities of the Veterans Health Administration for FY 2007 130 percent of the amount obligated during FY 2005. Adjusts the amount provided for fiscal years after FY 2007 based on the number of enrolled veterans and the number of other persons eligible but not enrolled who are provided care, multiplied by the per capital baseline amount for FY 2005, as increased by the percentage increase in the Consumer Price Index. Prohibits the availability of such funds for: (1) construction, acquisition, or alteration of veterans' medical facilities (other than for repairs provided for before the date of enactment of this Act); or (2) grants for the construction of State home facilities for the furnishing of veterans' domiciliary, nursing home, and hospital care.

Graduation for All Act - Authorizes the Secretary of Education to establish a program that will provide grants to State educational agencies (SEAs) and, through them, subgrants to local educational agencies (LEAs) to establish reading and writing programs to improve overall reading and writing performance among middle and high school students. Limits eligibility for subgrants to LEAs in a State that are among those that have the lowest graduation rates for public secondary school students. Includes among required uses of LEA subgrant funds: (1) hiring and inservice training of literacy coaches; (2) counseling for at-risk students; and (3) professional development for educators that addresses literacy needs of certain student groups. Amends the Elementary and Secondary Education Act of 1965 to include public secondary school graduation rates for all students under requirements for: (1) accountability for adequate yearly progress; and (2) annual State report cards. Amends the Adult Education and Family Literacy Act to require annual reports on the number participants who are 16, 17, or 18 years of age in certain programs and services, disaggregated by certain attributes.

Amends the Internal Revenue Code to allow employers a business tax credit of $1,000 for each of their employees who teaches a course at an accredited community college for which the employee receives no compensation.

United States Seaport Multiyear Security Enhancement Act - Authorizes the Secretary of Homeland Security to make grants to seaports to enhance security if the grant will improve security at the seaport or improve its efficiency without lessening security.

Hybrid Vehicle HOV Access Act - Amends Federal highway law to authorize a State to permit a hybrid vehicle with fewer than two occupants to operate in high occupancy vehicle (HOV) lanes. Defines "hybrid vehicle" as a motor vehicle: (1) that draws propulsion energy from onboard sources of stored energy which are both an internal combustion or heat engine using combustible fuel and a rechargeable energy storage system; and (2) which (in the case of a passenger automobile or light truck) for 2002 and later models meets certain clean air requirements.
