New Frontier Congressional Gold Medal Act - Authorizes the President to present gold medals, on behalf of Congress, to: (1) the astronauts of the Apollo 11 mission to the surface of the moon, Neil A. Armstrong (the first human to walk on the moon), Edwin E. "Buzz" Aldrin Jr. (pilot of the lunar module Eagle and second person to walk on the moon), and Michael Collins (pilot of their command module Columbia) in recognition of the first lunar landing, on July 20, 1969; and (2) John Herschel Glenn, the first American to orbit the Earth, on February 20, 1962.

Condemns the transport of nuclear mixed-oxide (MOX) materials by ship in international waters. Encourages the International Atomic Energy Agency (IAEA) and the United Nations to prohibit the shipment or transfer of any nuclear waste material through international waters. Requests that countries using nuclear power plants for producing electricity and related community needs should store and reprocess the nuclear waste within their own territorial boundaries.

Health Empowerment Zone Act of 2009 - Authorizes the Secretary of Health and Human Services (HHS), at the request of a broad-based community partnership, to designate a community that experiences disproportionate disparities in health status and health care as a health empowerment zone. Requires federal officials to give priority in awarding competitive grants to grants used in or benefiting a health empowerment zone. Directs the Secretary to provide: (1) technical assistance (or grants) to entities seeking to form a community partnership or obtain a health empowerment zone designation for a community; and (2) grants to community partnerships for implementation of the strategic plan for a health empowerment zone.

Recognizes the 60th anniversary of the Berlin Airlift (humanitarian airlift operation) and commends all of the operation's U.S. veterans for their valor and determination. Honors the veterans of the Airlift who lost their lives during the operation. Commends the spirit of collaboration which characterized the operation, involving both military and civilian aircraft and crews. Honors the men and women of the military whose dedication upholds the legacy of the U.S. Armed Forces.

Recognizes the special legal and political relationship the Indian tribes have with the United States and the solemn covenant with the land we share. Commends and honors the Native Peoples for the thousands of years that they have stewarded and protected this land. Recognizes that there have been years of official depredations, ill-conceived policies, and the breaking of covenants by the U.S. government regarding Indian tribes. Apologizes on behalf of the people of the United States to all Native Peoples for the many instances of violence, maltreatment, and neglect inflicted on them by U.S. citizens. Expresses the regret of the United States for the ramifications of former wrongs and its commitment to build on the positive relationships of the past and present to move toward reconciliation. Urges the President to acknowledge the wrongs of the United States against Indian tribes in U.S. history. Commends the state governments that have begun reconciliation efforts with recognized Indian tribes located in their boundaries, and encourages all state governments to do the same. Prohibits anything in this Joint Resolution from authorizing or supporting any claim against the United States or serving as a settlement of any claim against the United States.

Expresses support for the goals and ideals of National Hurricane Preparedness Week. Encourages the staff of the National Oceanic and Atmospheric Administration (NOAA), especially the National Weather Service and the National Hurricane Center, and other appropriate federal agencies to continue their outstanding work of educating people about hurricane preparedness. Urges the people of the United States to recognize such week as an opportunity to learn more about the Center's work in forecasting hurricanes and educating citizens about the potential risks of the storms.

Initiating Foreign Assistance Reform Act of 2009 - Directs the President to develop and implement: (1) a National Strategy for Global Development to further the U.S. foreign policy objective of reducing poverty and contributing to economic growth in developing countries, including responding to humanitarian crises; and (2) a system to monitor and evaluate the effectiveness of U.S. foreign assistance. Expresses the sense of Congress that American taxpayers and foreign assistance recipients should have, to the maximum extent practicable, full access to U.S. foreign assistance information.

Star-Spangled Banner Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins in commemoration of the bicentennial of the writing of the Star-Spangled Banner . Requires a coin design emblematic of the War of 1812, and in particular of, the Battle for Baltimore that formed the basis for the Star-Spangled Banner. Limits the period for coin issuance to calendar year 2012. Imposes a surcharge of $35 per coin for the $5 coins and $10 per coin for the $1 coins, which shall be distributed to the Maryland War of 1812 Bicentennial Commission for the purpose of supporting bicentennial activities, educational outreach activities, and preservation and improvement activities pertaining to the sites and structures relating to the War of 1812.

Southeast Alaska Native Land Entitlement Finalization Act - Authorizes Sealaska Corporation, the Regional Corporation for southeast Alaska, notwithstanding specified provisions of the Alaska Native Claims Settlement Act (ANCSA) and subject to conditions and restrictions, to select and receive conveyance of its remaining land entitlement under the ANCSA from federal land in southeast Alaska from each of the following categories: (1) specified economic development land; (2) sites with sacred, cultural, traditional, or historical significance; and (3) Alaska Native futures sites with traditional and recreational use value. Authorizes the Director of the National Park Service to enter into a cooperative management agreement with Sealaska, other village corporations and urban corporations, and federally recognized Indian tribes with cultural and historical ties to Glacier Bay National Park to recognize and perpetuate National Park Service values, including those associated with the Tlingit homeland and culture, wilderness, and ecological preservation. Requires the Secretary of the Interior to complete the conveyance of lands to Sealaska within one year of selection. Prohibits Sealaska from selecting or receiving any conveyance of lands under this Act from within any conservation system unit, federally designated wilderness area, or certain land use designation areas. Amends the National Historic Preservation Act to add to the definition of "tribal lands" land held under the ANCSA by incorporated Native groups, regional corporations, and village corporations.

Restitution for the Exonerated Act of 2009 - Authorizes the Attorney General to award grants and supplemental funds to nonprofit organizations to be used only to provide support services (e.g., employment training, health care services, and legal assistance) to exonerees. Prohibits services for exonerees who have not demonstrated financial need or for a period of more than 24 months. Defines "exoneree" as an individual who has been convicted of a crime carrying a prison sentence of one year or more, has served at least six months of such prison sentence, and has been determined to be factually innocent of the crime.

Honouliuli Internment Camp Special Resources Study Act of 2009 - Directs the Secretary of the Interior to conduct a special resource study of the national significance, suitability, and feasibility of including the Honouliuli Gulch and associated sites within Hawaii in the National Park System. Requires such study to evaluate the Honouliuli Gulch, associated sites on Oahu, and other islands in Hawaii respecting: (1) their significance as a component of World War II; (2) their significance as related to the forcible internment of Japanese Americans, European Americans, and other individuals; and (3) historic resources at those sites.

Post-Deployment Health Assessment Act of 2009 - Directs the Secretary of Defense to issue guidance for the provision of an in-person mental health screening for each member of the Armed Forces deployed in connection with a contingency operation, in order to identify post-traumatic stress disorder (PTSD), suicidal tendencies, and other behavioral health issues for which additional care and treatment may be necessary. Excludes from such screenings members not subjected or exposed to combat stress during their deployment. Requires the Secretary to share screening results with the Secretary of Veterans Affairs in order to ensure continuity of mental health care and treatment for such members during their transition from health care and treatment provided by the Department of Defense (DOD) to health care and treatment provided by the Department of Veterans Affairs (VA).

Pacific Salmon Stronghold Conservation Act of 2009 - Establishes the Salmon Stronghold Partnership as a cooperative, incentive-based, public-private partnership working across political boundaries and land ownerships to identify and conserve salmon strongholds. Requires that its board include representatives of Alaska, California, Idaho, Oregon, and Washington state, as well as representatives from specified entities. Requires the Assistant Administrator for the National Marine Fisheries Service of the National Oceanic and Atmospheric Administration (NOAA) to carry out specific information and assessment functions associated with salmon strongholds. Establishes a salmon stronghold watershed grants and technical assistance program. Authorizes the sharing of status and trends data, innovative conservation strategies, conservation planning methodologies, and other information with North Pacific countries, including Canada, Japan, Russia, and South Korea, and appropriate international entities to promote salmon conservation and habitat. Prohibits acquiring private property without the owner's consent.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Tribal Law and Order Act of 2009 - Amends the Indian Law Enforcement Reform Act to make a variety of changes to increase Native American tribes' law enforcement powers and increase federal powers and responsibilities regarding crimes on Indian land, including: (1) allowing federal officials, with the consent of the tribe, to investigate offenses against tribal criminal laws; (2) providing technical assistance and training to tribal law enforcement officials regarding use of the National Criminal Information Center (NCIC) database; (3) requiring federal and local officials, when they decline to investigate crimes on Indian land, to report to Native officials and requiring such officials, when they decline to prosecute, to turn over evidence to Native officials; (4) establishing in the criminal division of the Department of Justice (DOJ) the Office of Indian Country Crime to develop, enforce, and administer federal criminal laws in Indian country; (5) authorizing, at the request of a tribe, concurrent federal-tribal jurisdiction; (6) authorizing grants to state, tribal, and local governments that enter into cooperative agreements, including agreements relating to mutual aid, hot pursuit of suspects, and cross-deputization; (7) requiring the Attorney General to allow tribal and Bureau of Indian Affairs (BIA) law enforcement agencies to directly access and enter information into federal criminal information databases (under current law, such access is limited); and (8) increasing the criminal sentences tribal courts may impose.

Medicare Fracture Prevention and Osteoporosis Testing Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Improvements for Patients and Providers Act of 2008, to direct the Secretary of Health and Human Services to establish a national minimum payment amount for CPT code 77080 (relating to dual energy x-ray absorptiometry, or DXA, the most widely accepted method of measuring bone mass to predict fracture risk) and CPT code 77082 (relating to vertebral fracture assessment, or VFA), and any successor to such codes as identified by the Secretary (bone mass scans). Directs the Secretary to arrange with the Institute of Medicine of the National Academies to study and report to the Secretary and Congress on: (1) the ramifications of Medicare reimbursement reductions for DXA and VFA on beneficiary access to bone mass measurement benefits; and (2) the methods to increase use of bone mass measurement by Medicare beneficiaries.

Amends the Safe Drinking Water Act to increase (from .33 to .5) the percentage of the aggregate amount made available for state drinking water treatment revolving loan funds in a fiscal year that shall be allotted to American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands.

Amends the Digital Television Transition and Public Safety Act of 2005 to extend through FY2012 (under current law, through FY2010) the requirement that the Assistant Secretary for Communications and Information of the Department of Commerce make payments from the Digital Television Transition and Public Safety Fund for a grant program to assist public safety agencies in the the acquisition of, deployment of, or training for the use of interoperable communications equipment that utilizes reallocated public safety spectrum for radio communication.

Breast Cancer Education and Awareness Requires Learning Young Act of 2009 or EARLY Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct a national evidence-based education campaign: (1) to increase public awareness regarding the threats posed by breast cancer to young women, including the particular risks faced by certain ethnic and cultural groups; and (2) focusing on awareness of risk factors and achieving early detection through community-centered informational forums, public service advertisements, and media campaigns. Directs the Secretary to award grants to entities to establish national multimedia campaigns that: (1) will encourage young women to be aware of their personal risk factors, strategies for increasing early detection and self awareness, evidence based preventative lifestyle changes, and other appropriate breast cancer early detection and risk reduction strategies; (2) will encourage young women of specific higher-risk populations to talk to their medical practitioners about those risks and methods for appropriate screening and surveillance; and (3) may include advertising through specified media. Requires the Secretary, acting through the Director, to: (1) establish an advisory committee to assist in creating and conducting the public education campaign; (2) conduct an education campaign to increase awareness among health care professionals; and (3) conduct prevention research. Directs the Secretary to award grants to organizations and institutions to provide to young women diagnosed with breast cancer substantive assistance and health information from credible sources on: (1) education and counseling regarding fertility preservation; (2) social, emotional, psychosocial, financial, lifestyle, and caregiver support; (3) familial risk factors; and (4) risk reduction strategies to reduce recurrence or metastasis.

Establishes the U.S. Office for Native Hawaiian Affairs (Office) within the Office of the Secretary of the Interior. Requires the Attorney General to designate a Department of Justice official to assist the Office in the implementation and protection of the rights of Native Hawaiians and their political, legal, and trust relationship with the United States. Establishes the Native Hawaiian Interagency Task Force to: (1) coordinate federal policies or actions that may significantly or uniquely affect Native Hawaiian resources, rights, or lands; (2) assure that each federal agency develops a policy on consultation with Native Hawaiians; and (3) assure the participation of such agencies in the development of an annual report on the Task Force. Establishes a process for development of a membership roll for organizing a Native Hawaiian Interim Governing Council and for election of a Native Hawaiian government. Recognizes the right of the Native Hawaiian people to adopt organic governing documents. Extends federal recognition to the government as the representative governing body of the Native Hawaiian people upon election of officers and certification by the Secretary. Permits the United States, upon federal recognition of the Native Hawaiian government, to enter into an agreement with the state of Hawaii and such government regarding the transfer of lands, resources, and assets dedicated to Native Hawaiian use. Prohibits the Native Hawaiian governing entity and Native Hawaiians from conducting gaming activities as a matter of claimed inherent authority or under any federal law, regardless of where the gaming is located.

Community Choice Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to require state Medicaid plan coverage of community-based attendant services and supports for certain Medicaid-eligible individuals. Outlines requirements for: (1) an enhanced federal medical assistance percentage (FMAP) for ongoing activities of early coverage states that enhance and promote the use of community-based attendant services and supports; and (2) increased federal financial participation for certain expenditures incurred by the state for the provision of such services and supports. Directs the Secretary of Health and Human Services to: (1) award grants to eligible states which have established a Consumer Task Force to assist the state in its development of real choice systems change initiatives; and (2) conduct a demonstration project for the purpose of evaluating service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to dually eligible individuals.

Indian Development Finance Corporation Act - Establishes the Indian Development Finance Corporation to provide development capital for new and existing Indian businesses and to strengthen tribal economies. Authorizes the Corporation to make loans to or purchase, insure, or discount obligations of Indian businesses if they meet specified financial conditions. Directs the Corporation to provide the credit needed by Indian businesses at the lowest reasonable cost. Authorizes the Corporation to guarantee all or any part of the principal and interest of any loan made to an Indian business by a state or federally chartered lending institution, provided the loan was made on terms permissible for Corporation loans. Authorizes the Corporation to purchase all or any part of the ownership interest in an Indian business and to supervise or participate in the management of such business. Establishes the Advisory Council to the Indian Development Finance Corporation to provide advice on the policies and operations of the Corporation. Authorizes the Corporation to issue stock. Allows shares of stock in the Corporation to be issued to and held by Indian Tribes and the United States only. Authorizes the Corporation to issue a limited amount of bonds and notes. Authorizes appropriations for general operating expenses and for the purchase of Corporation stock by the Secretary.

Authorizes the Secretary of State to provide a specified amount to the Museum to carry out such purposes.

Multinational Species Conservation Funds Semipostal Stamp Act of 2009 - Requires the United States Postal Service to issue and sell, at a premium, a Multinational Species Conservation Funds Semipostal Stamp. Requires proceeds from the sale of such stamp to be: (1) transferred to the United States Fish and Wildlife Service (USFWS) to help fund the operations supported by the Multinational Species Conservation Funds; and (2) divided equally among the African Elephant Conservation Fund, the Asian Elephant Conservation Fund, the Great Ape Conservation Fund, the Marine Turtle Conservation Fund, and the Rhinoceros and Tiger Conservation Fund. Prohibits such proceeds from being taken into account in any decision relating to the level of appropriations or other federal funding to be furnished to the USFWS or such Funds. Requires the stamp to: (1) be made available to the public for at least five years; and (2) depict images of flagship multinational species.

Adds Parkinson's disease (manifested to a degree of disability of 10% or more) to the list of diseases presumed to have been incurred in or aggravated by military service in Vietnam (and therefore compensable under veterans' disability compensation), notwithstanding that there is no evidence of the disease during the period of service, provided a veteran served between specified dates and was exposed to a herbicide used in military operations during that period.

Employee Free Choice Act of 2009 - Amends the National Labor Relations Act to require the National Labor Relations Board (NLRB) to certify a bargaining representative without directing an election if a majority of the bargaining unit employees have authorized designation of the representative (card-check) and there is no other individual or labor organization currently certified or recognized as the exclusive representative of any of the employees in the unit. Sets forth special procedural requirements for reaching an initial collective bargaining agreement following certification or recognition. Revises enforcement requirements with respect to unfair labor practices during union organizing drives, particularly a preliminary investigation of an alleged unfair labor practice (ULP) which may lead to proceedings for injunctive relief. Requires that priority be given to a preliminary investigation of any charge that, while employees were seeking representation by a labor organization, or during the period after a labor organization was recognized as a representative until the first collective bargaining contract is entered into, an employer: (1) discharged or otherwise discriminated against an employee to encourage or discourage membership in the labor organization; (2) threatened to discharge or to otherwise discriminate against an employee in order to interfere with, restrain, or coerce employees in the exercise of guaranteed self-organization or collective bardaining rights; or (3) engaged in any other related ULP that significantly interferes with, restrains, or coerces employees in the exercise of such guaranteed rights. Adds to remedies for such violations: (1) back pay plus liquidated damages; and (2) additional civil penalties.

Military Readiness Enhancement Act of 2009 - Repeals current Department of Defense (DOD) policy concerning homosexuality in the Armed Forces. Prohibits the Secretary of Defense, and the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, from discriminating on the basis of sexual orientation against any member of the Armed Forces or any person seeking to become a member. Authorizes the re-accession into the Armed Forces of otherwise qualified individuals previously separated for homosexuality, bisexuality, or homosexual conduct. Requires such Secretaries to ensure that regulations governing the personal conduct of members of the Armed Forces are written and enforced without regard to sexual orientation.

Family Smoking Prevention and Tobacco Control Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for the regulation of tobacco products by the Secretary of Health and Human Services through the Food and Drug Administration (FDA), including through disclosure, annual registration, inspection, recordkeeping, and user fee requirements. Directs the Secretary to establish the Center for Tobacco Products to implement this Act. Sets forth criteria by which tobacco products are deemed adulterated or misbranded. Allows the Secretary to require prior approval of all label statements. Authorizes the Secretary to restrict the sale or distribution of tobacco products, including advertising and promotion, if appropriate for the protection of the public health. Sets forth limits on such regulations, including prohibiting establishment of a minimum age greater than 18 for product purchases. Prohibits: (1) cigarettes from containing any artificial or natural flavor (other than tobacco or menthol) or an herb or spice, including strawberry, cinnamon, or coffee; or (2) a tobacco product manufacturer from using tobacco that contains a greater level of pesticide chemical residue than is specified by any tolerance applicable to domestically grown tobacco. Requires the Secretary to establish tobacco product standards to protect the public health. Prohibits the Secretary from: (1) banning all cigarettes, all smokeless tobacco products, all little cigars, all other cigars, all pipe tobacco, or all roll-your-own tobacco products; or (2) requiring the reduction of the nicotine yields of a tobacco product to zero. Requires premarket approval of all new tobacco products. Sets forth standards for the sale of modified risk tobacco products. Requires the Secretary to establish a Tobacco Products Scientific Advisory Committee. Revises tobacco product warning labels and advertising requirements. Thrift Savings Plan Enhancement Act of 2009 - Amends provisions related to the Thrift Savings Plan (TSP), including to provide for: (1) automatic enrollment of new employees; and (2) a Roth contribution program.

Non-Foreign Area Retirement Equity Assurance Act of 2009 or the Non-Foreign AREA Act of 2009 - Revises federal employee locality-based comparability payments provisions to include U.S. territories and possessions, including the Commonwealth of Puerto Rico and the Commonwealth of the Northern Mariana Islands, within a pay locality. Sets forth maximum rates of pay for Senior Executive Service (SES) personnel in such areas. Revises the calculation of allowances based on living costs and conditions of environment for pay of employees stationed outside the continental United States or in Alaska to apply it only to areas designated as of December 31, 2009. Provides a formula for adjustment of such rate using a transition schedule for calendar years 2010-2012. Requires adjustment of special rates of pay determined to be necessary to obtain or retain the services of persons specified by statute in such a cost-of-living area in accordance with regulations to be prescribed by the Director of the Office of Personnel Management (OPM) under this Act. Allows a temporarily raised limitation on the amount of special rates during the transition period of January 1, 2010, to January 1, 2012. Expresses the sense of the Congress with respect to pay disparities and locality areas for federal positions located in Alaska, Hawaii, or a U.S. territory. Defines "covered employees" for purposes of this Act, including employees who were eligible, before enactment, to be paid a cost-of-living allowance (COLA) but not a locality-based comparability payment. Describes application of this Act to postal employees. Allows an employee subject to this Act's transition schedule who retires from service during the period from January 1, 2010, through December 31, 2012, to elect to have any COLA paid during that period considered as basic pay for purposes of annuity computation.

Bone Marrow Failure Disease Research and Treatment Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) develop a system to collect data on acquired bone marrow failure diseases; (2) establish the National Acquired Bone Marrow Failure Disease Registry; and (3) establish the Advisory Committee on Acquired Bone Marrow Failure Diseases to provide recommendations to the Secretary on the Registry. Allows the Secretary, acting through the Director, to award grants to, and enter to contracts and cooperative agreements with, public or private nonprofit entities for the management of the Registry. Requires the Secretary, acting through the Administrator of the Agency for Toxic Substances and Disease Registry, to conduct pilot studies to determine which environmental factors may cause acquired bone marrow failure diseases. Requires the Secretary, acting through the Deputy Assistant Secretary for Minority Health, to: (1) establish outreach and information programs targeted to minority populations affected by such diseases; (2) undertake a coordinated outreach effort to connect Hispanic, Asian American, and Pacific Islander communities with comprehensive services focused on treatment of, and information about, such diseases; and (3) awards grants to, or enter into cooperative agreements with, entities to perform research on such diseases. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality (AHRQ), to award grants to entities to improve diagnostic practices and quality of care with respect to patients with such diseases.

Teaching Geography is Fundamental Act - Amends the Higher Education Act of 1965 to establish a geography education grant program under title II, Teacher Quality Enhancement. Authorizes the Secretary of Education to award a grant to a national nonprofit educational organization or consortium, with 75% to be used for subgrants to institutions of higher education associated with state geographic alliances, nonprofit educational organizations, or state or local educational agencies. Requires various grantee and subgrantee activities designed to expand geographic literacy among kindergarten through grade 12 students by improving their teachers' professional development programs offered through institutions of higher education. Includes among such activities state-based conferences to assess geographic literacy and identify improvement strategies.
