Law on amending the law on law and order

The bill supplements § 38 of the Law on Law Enforcement with a special provision, which regulates the obligation to explain the rights to persons in the event of a so-called "everything blows" operation conducted by the police or other law enforcement agency to identify drunk drivers. This is a situation where, on the basis of § 25 of the law, at a time and place selected by a law enforcement body, drivers are detained without choice and subjected to a test that allows the detection of alcohol intoxication to checking. The amendment represents a special norm with respect to the general obligation to explain and makes the obligation to explain in the case of such aforementioned operations dependent on the declaration of intent of the inspected person.

An Act to amend the Maintenance Act

The bill aims to give children under guardianship the opportunity to receive alimony. This creates equal treatment for children who are raised by one of the parents. According to the current law, child support is paid only on the basis of the corresponding request of the child's parent.

Law on Supplementing the Law on Narrowing the Acquisition of Immovable Property

The purpose of the bill is to enable a natural person who is not a citizen of a contracting state of the European Economic Area, but who at the same time lives in Estonia on the basis of a long-term resident's residence permit, to acquire real estate up to 0.2 ha, which gives the person the opportunity to buy land in horticultural cooperatives.

The Act on Amendments to the Code of Criminal Procedure and Amendments to Other Related Laws, which expands the rights of victims in criminal proceedings

The purpose of the bill is to better protect the rights of victims and strengthen their procedural status. The bill ensures better protection of the victim's rights in criminal proceedings, strengthens the procedural status of the victim and creates a clear and unambiguous regulation for the processing of claims arising from the crime. The corresponding EU directive, which establishes the rights of crime victims and the support and protection provided to them, will be adopted into Estonian law minimum requirements. The procedure for the enforcement of the victim's property claims, i.e. the procedure for proceeding with a civil lawsuit, is specified. The state, as a victim in criminal proceedings, is also enabled to file a public claim in addition to a civil action. With the bill, the EU directive is adopted into Estonian law, which deals with the right to a defense attorney in criminal proceedings and in proceedings related to the European Arrest Warrant, as well as the right to have a third party informed of the deprivation of liberty and communicate with third parties and consular authorities during deprivation of liberty.
