Ms. Monique Limon draws the attention of the Minister of National Education to the subject of transfers of primary school teachers. The organization of the teachers' movement is a difficult exercise which must meet the requirements of balance in the distribution of teaching positions and coverage of needs by tenured positions, including in the least attractive sectors. The teachers of the tenured schools are faced with difficulties in obtaining a transfer, either because they meet a need in a less attractive sector or because the specificity of their situation requires procedures and management deadlines that are too cumbersome, in particular staff on availability to follow their spouse. Ms. Monique Limon draws the attention of the Minister of Solidarity and Health to the limits of inclusion at all costs and for all. If the idea of inclusive schools and classes that would welcome all types of disabilities is interesting in principle, it must be implemented in a concerted and progressive manner. Some young people with disabilities, particularly motor and mental, benefit from it but teachers are too often helpless in front of children with mental disabilities. Children with mild or moderate intellectual disabilities can indeed adapt and thrive in common law systems, but this is not as obvious for children with more profound or associated disorders who need care and reinforced monitoring in a specialized establishment. They need comprehensive support to ensure their education for daily autonomy, social or professional life. Integrated into class or a playground, the hypersensitivity to noise of some people can sometimes generate violence towards others and towards themselves. Inclusion in an ordinary environment cannot replace reception in specialized establishments in a uniform manner and without the will and adaptability of families. Inclusion on the move Forced violence and the transformation of the home into a care center can have detrimental effects on the socialization and development of the child as well as on the balance of the family circle. The ARS reform leads to a reduction in the number of places in IME which is accompanied by an increase in SESSAD places. This process has been initiated without the human and material resources necessary for a policy of generalized inclusion having been sufficiently deployed, particularly with national education. Many young adults are kept in children's establishments for lack of alternative solutions, in the name of the Creton amendment, to the detriment of children on waiting lists. This social subject needs to be treated in its proper measure and not in a top-down manner as we can sometimes deplore. For example, in Isère, withdrawal from AFIPH of a project to create a center for 40 adults with severe autism has been announced. At the same time, nearly 200 IME places will be eliminated within 5 years while figures from the Departmental House of Autonomy of Isère reveal that there are around 600 families waiting for a place in IME; the corresponding credits will be intended for the opening of SESSAD but these mechanisms will only very rarely allow inclusion full-time school. The rest of the time, the children will be looked after by their family at home. This phenomenon will most often force women to stop working. IME and SESSAD do not concern the same audience. Both are responses to different needs. Inclusion in an ordinary environment cannot systematically replace individualized reception in IME, MAS or FAM. The deputy asks the minister whether we should not personalize and adapt responses not only according to the specific needs of the disabled person but also according to the journey, the family context and life projects. She would like to know if the Government intends to carry out a territorialized study in order to provide differentiated responses depending on the local and family context and thus respond to the urgency of creating places in IME, MAS and FAM.

In the coming weeks, it will sadly be a year since we were affected by the coronavirus pandemic and we live daily with its dramatic consequences, both economic, psychological and health. This is why we need an extremely strong response so that they are not the victims of this covid-19 crisis. Ms. Monique Limon draws the attention of the Minister of State, Minister for the Ecological and Inclusive Transition, to the reduction of the TICPE for advanced biofuels based on flotation grease, composed of at least 30% methyl esters of fatty acids, in order to allow them to benefit from the same advantageous taxation already existing for type B100 biofuels. Since the energy transition law for green growth of 2015, it Priority should now be given to the development of advanced biofuels. Advanced biofuels are biofuels using raw materials that do not compete with food markets. They come in particular from waste, such as flotation grease, and their use allows maximum savings in greenhouse gas emissions. This is all the more true as their production uses, as is currently the case in Brittany, only renewable energy (biomass and recovery of waste energy) and recycled water. Currently, the physicochemical parameters required in France for advanced biofuels derived from flotation grease do not allow their use in captive fleets. Indeed, to be placed on the market, a biofuel must not only satisfy the criteria set out by the European standard EN14214, but must also meet national parameters, particularly on physico-chemical bases. The percentage of saturated fatty acids and the limit filterability temperature (TLF) (temperature below which the biofuel freezes) are part of these parameters. Thus, France considers that the biofuel must have a TLF of -10°C in B100. These parameters are only achieved by biofuels from rapeseed, which therefore benefit from tax relief (set out in article 265 of the customs code). This is discriminatory and blocking the production of advanced biofuels for French captive fleets. Indeed, advanced biofuels derived from flotation fats cannot meet the French parameters in TLF or % of saturated fatty acids (because they contain a share of animal fat), and they are therefore automatically excluded from TICPE relief for B100 and any other % of incorporation even though the latter are more costly to produce due to their origin. It would therefore be desirable to obtain the possibility of having a tax advantage also for lower incorporation percentages applicable to advanced biofuels. This advantage must also be accompanied by a relaxation of the decrees setting the values limits of the cold properties of biofuels. In view of these elements, she asks him to please clarify the Government's intentions regarding the possibility of further developing advanced biofuels, particularly from flotation grease, via the implementation of tax and regulatory measures.

However, the business in question (company “A”) being closed, the letter acknowledging receipt is returned and company “B” cannot then assert its rights. In view of the feedback from the field, it would seem that this is becoming a growing practice which could be summarized as follows: companies domiciled at the address of their store which decide to close (completely legally) without leave the slightest provision in accounts to pay sums owed. She therefore wishes to know the measures that the Government intends to propose in order to guarantee creditor companies appropriate legal remedies which ultimately allow them to assert their rights to recovery.

Ms. Monique Limon draws the attention of the Minister of Solidarity and Health regarding amendment No. 6 to the National Nurses Convention. Amendment No. 6 to the National Convention, signed by the conventional partners, governs the relationship between nurses and health insurance funds. However, the deputy wonders about one of the provisions of the said convention. Ms. Monique Limon draws the attention of the Minister of Labor to Law No. 2016-1088 of August 8, 2016 relating to work, the modernization of social dialogue and the security of career paths. Indeed, since January 1, 2018, the URSSAF have been in charge of collecting contributions to the professional training of artisans and remitting them to the training insurance funds and in particular the FAFCEA. From the 15th March 2019, it was forced to suspend its funding due to a lack of budget. According to the FAFCEA, this situation results from the quality of the URSSAF collection. Questioned, the URSSAF considers that this financing problem is due to the contestation of the subjugation to the contribution of craftsmen with the status of business manager and employee and who represents almost half of the expected contributors. Ms. Monique Limon draws the attention of the Minister of Labor to the method of financing CFAs from January 1, 2020. The Government wanted to make apprenticeship a major tool of the labor market in the law choosing your professional future of September 5, 2018. Today, the financial situation of certain CFAs remains delicate and worrying. The MP wonders about a possible distortion between the existing CFAs and the newly created CFAs with regard to their financing, given the fact that the calculation bases will no longer be the same. While training is the Government's workhorse in terms of labor policy, it therefore asks it to study this question before certain training centers are penalized.

Mrs. Monique Limon draws the attention of the Minister of Action and Public Accounts to Articles L. 2121-26 and 2313-1 of the CGCT. These articles concern the publicity of municipal budgets and accounts. It appears from the analysis of these articles that not all “local citizen-taxpayers” are treated fairly. Indeed, the number of inhabitants in the municipality intervenes to authorize or not, access to the explanatory annexes of the budget. Provisions concerning only municipalities with 3,500 inhabitants are indicated at the beginning of article L. 2313-1: “In municipalities with 3,500 inhabitants and more, the budgetary documents, without prejudice to the provisions of article L. 2343-2, are included in the annex”. The paragraphs ending these articles open up broader perspectives of information: “for all municipalities, the budgetary documents are matched of statements relating to the heritage and financial situation of the community as well as its various commitments. A brief and synthetic presentation retracing the essential financial information is attached to the initial budget and the administrative account in order to allow citizens to understand the issues at stake. Depending on whether the citizen resides in a municipality of less than 3,500 inhabitants or more, he or she can access these annexes or not. yet essential to understanding these budgets. This discrimination is a source of opacity and inequality in access to information. As France has 2,155 municipalities with fewer than 3,500 inhabitants, an average of 3,880,000 inhabitants have poor access to local budgetary information. In order to remedy this situation, it could be considered that the cited articles be modified so that the restrictions due to the number of inhabitants are removed for access to all the explanatory annexes to the budget. She therefore wishes to know the measures that the Government intends to propose in order to guarantee equal access for citizens to the explanatory annexes of the municipal budget.

Mme Monique Limon attire l'attention de M. le ministre de l'agriculture et de l'alimentation sur l'encadrement du chauffage des serres pour la production de fruits et légumes bio. Le marché bio se développe à un rythme important ces dernières années (+ 17 % en 2017), poussant toujours plus d'agriculteurs à se convertir à ce mode de production, répondant ainsi aux attentes de la société en matière de santé et d'environnement. Dans un entretien accordé à l'AFP le 3 mars 2019, M. le ministre a salué cette évolution, tout en appelant parallèlement à ne pas « industrialiser » la production bio. Le 3 avril 2019, le Gouvernement sera appelé à se prononcer au sein du Comité national d'agriculture biologique sur la question de la production de fruits et légumes bio sous serres chauffées. L'enjeu de cet arbitrage est d'interdire la production de légumes bio à contre-saison (tomates en hiver), utilisant massivement des énergies non renouvelables. Les autres États membres de l'Union européenne encadrent encore peu ces pratiques, c'est donc à la France d'envoyer un signal fort à ses partenaires, en montrant l'exemple et en défendant cet encadrement auprès de la Commission européenne ou de la CJUE. Elle l'interroge pour savoir s'il compte soutenir l'encadrement du chauffage des serres dont les conséquences environnementales néfastes ont été prouvées par l'étude FoodGES de l'ADEME. Ce genre de pratiques, si elles venaient à se développer, risqueraient de porter le discrédit sur toute la filière bio, et d'en compromettre ainsi le développement.

These Jacquaire welcomes are well established since they appear in the guides of gîtes and guest rooms. They welcome more and more pilgrims, tourists, travelers, on a regular basis and for a fee. This hospitality has a price, with a price difference per night with or without breakfast, a price which is of course not displayed. The Jacquaire welcome does not constitute a rental of a guest room within the meaning of article L. 324-3 of the tourism code, is not subject to any obligation to declare to the town hall provided for by article 324-4 of the same code. It thus escapes all control. As this is normally an occasional, free reception, this is not subject to the constraints of upgrading standards. It also escapes any tax regime. Without calling into question the principle of Donativo, she asks him if we should not further regulate the Jacquaire welcome and stop the process of unfair competition which tends to develop.
