Craft Beverage Modernization and Tax Reform Act of 2017 This bill amends the Internal Revenue Code, with respect to the tax treatment of certain alcoholic beverages, to: exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; modify the small wine producer tax credit to increase the amount of the credit, expand the producers that are covered, and specify an adjustment for hard cider; modify the alcohol content limitations that apply to certain wines for tax purposes; specify definitions for "mead" and "low alcohol by volume wine;" modify requirements for records, statements, and returns for certain breweries; and permit the transfer of beer between bonded facilities without payment of tax. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages.

Standard Merger and Acquisition Reviews Through Equal Rules Act of 2017 This bill amends the Clayton Act with respect to notice to a state by the Department of Justice (DOJ) about federal actions brought for violations of antitrust laws. The Federal Trade Commission (FTC) shall exercise the same authority and procedures as DOJ under the Clayton Act if the FTC has brought an action under such Act with respect to the prohibition against acquisition by one corporation of the stock of another (merger) that may substantially lessen competition or tend to create a monopoly. The Federal Trade Commission Act (FTCA) is amended to exclude proposed mergers, acquisitions, joint ventures, or similar transactions from ordinary FTC proceedings, except in cases where the FTC approves an agreement with the parties to the transaction that contains a consent order. U.S. district courts shall have jurisdiction to issue writs of mandamus commanding compliance with the FTCA or any FTC order, if the FTC applies to such courts with respect to any activity related to consummation of a merger, acquisition, joint venture, or similar transaction that may result in an unfair method of competition.

Social Security Fraud Prevention Act of 2017 This bill prohibits federal departments and agencies from including the Social Security account number of any individual on any document sent by mail unless the department or agency determines that inclusion of that Social Security number on the document is necessary. Departments and agencies must issue regulations within one year of this bill's enactment that specify the circumstances under which the inclusion of Social Security account numbers on mailed documents is necessary.

This bill revises the requirements for passenger vessels that are exempt from fire-retardant materials standards. Vessels in operation before January 1, 1968, that operate within inland waterways are exempt from the new requirements until December 1, 2028. Exempt vessel operators must follow certain requirements including notifying prospective passengers in writing prior to the sale of any ticket for boarding and making annual structural alterations to at least 10% of areas of the vessel that are not constructed of fire-retardant materials. Additionally, the Department of Transportation (DOT) must conduct an annual inspection of any vessel that is exempted from fire-retardant materials standards. DOT may withdraw a certificate of inspection for any vessel that does not comply with requirements under this bill.

Conscience Protection Act of 2017 This bill amends the Public Health Service Act to codify the prohibition against the federal government and state and local governments that receive federal financial assistance for health-related activities penalizing or discriminating against a health care provider based on the provider's refusal to be involved in, or provide coverage for, abortion. Health care providers include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers. The Office for Civil Rights of the Department of Health and Human Services, in coordination with the Department of Justice (DOJ), must investigate complaints alleging discrimination based on an individual's religious belief, moral conviction, or refusal to be involved in an abortion. DOJ or any entity adversely affected by such discrimination may obtain equitable or legal relief in a civil action. Administrative remedies do not need to be sought or exhausted prior to commencing an action or granting relief. Such an action may be brought against a governmental entity.

Before issuing a Medicaid subregulatory policy, CMS must determine the extent to which the policy is projected, with respect to each year in a 10-year period, to increase state or federal expenditures under the Medicaid program. If the policy is projected to increase expenditures by an amount exceeding a specified threshold, CMS may implement the policy only through notice and comment rulemaking.

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide each veteran who submits a claim for VA benefits with an opportunity to permit a covered congressional employee in the office of the veteran's Member of Congress to have read-only access to all of the veteran's records in the Veterans Benefits Administration databases. A Member may designate up to two such covered congressional employees. A covered congressional employee may not be recognized as an agent or attorney with respect to veterans' benefit claims. Funds under this bill may not be used to design or administer any training for covered congressional employees. The bill makes funds available for FY2018 through FY2021 for such congressional employee access program.

Heartbeat Protection Act of 2017 This bill amends the federal criminal code to make it a crime for a physician to knowingly perform an abortion: (1) without determining whether the fetus has a detectable heartbeat, (2) without informing the mother of the results, or (3) after determining that a fetus has a detectable heartbeat. It provides an exception for an abortion that is necessary to save the life of a mother whose life is endangered by a physical (but not psychological or emotional) disorder, illness, or condition. A physician who performs a prohibited abortion is subject to criminal penalties—a fine, up to five years in prison, or both. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Stolen Identity Refund Fraud Prevention Act of 201 7 This bill amends the Internal Revenue Code to require the Department of the Treasury and the Internal Revenue Service (IRS) to take several actions to prevent and respond to tax-related identity theft and tax fraud. Treasury or the IRS must: establish a centralized point of contact for identify theft victims; provide notifications, instructions, and forms to suspected victims of identity theft; provide various reports to Congress regarding identity theft, tax refund fraud, and related prevention programs; use information available from the Do Not Pay Initiative established by the Improper Payments Elimination and Recovery Improvement Act of 2012 to help prevent identity theft tax refund fraud; establish an information sharing and analysis center to centralize, standardize, and enhance data compilation and analysis to facilitate sharing actionable data and information with respect to identity theft; establish within the IRS Criminal Investigation Division the position of Local Law Enforcement Liaison to interact with state and local law enforcement authorities with respect to tax-related identity theft; and provide specified identity theft prevention information to taxpayers who are on hold during a taxpayer service telephone call. The Inspector General for Tax Administration must report to Congress regarding identity theft phone scams under which individuals attempt to obtain personal information over the phone from taxpayers by falsely claiming to be calling from or on behalf of the IRS. No additional funds are authorized to carry out this bill.

Fairness for High-Skilled Immigrants Act of 2017 This bill amends the Immigration and Nationality Act to: (1) eliminate the per-country numerical limitation for employment-based immigrants, and (2) increase the per-country numerical limitation for family-based immigrants from 7% to 15% of the total number of family-sponsored visas. The Chinese Student Protection Act of 1992 is amended to eliminate the provision requiring the reduction of annual Chinese immigrant visas to offset status adjustments under such Act. The bill establishes a transition period during which a percentage of employment-based second and third preference (EB-2 and EB-3) immigrant visas are reserved as follows: for FY2017, 15% of such visas are allotted to natives of countries other than the two countries with the largest aggregate numbers of natives obtaining such visas in FY2011; for FY2018, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2012; and for FY2019, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2015. During the transition period, not more than 25% of the total number of the reserved EB-2 and EB-3 visas shall be allotted to natives of a single country. For FY2015-FY2017, not more than 85% of the unreserved EB-2 and EB-3 visas shall be allotted to natives of a single country. Amendments made by this bill shall apply beginning in FY2017.

Stop Dangerous Sanctuary Cities Act This bill prohibits a sanctuary jurisdiction from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program. A sanctuary jurisdiction is a state or political subdivision that has a statute, policy, or practice in effect that prohibits or restricts: (1) information sharing about an individual's immigration status, or (2) compliance with a lawfully issued detainer request or notification of release request. A state or political subdivision that complies with a detainer is deemed to be an agent of the Department of Homeland Security and is authorized to take actions to comply with the detainer. The bill limits the liability of a state or political subdivision, or an officer or employee of such state or political subdivision, for actions in compliance with the detainer.

Default Prevention Act This bill requires the Department of the Treasury to continue to borrow to pay the principal and interest on certain obligations if the debt of the United States exceeds the statutory limit. If the debt limit is exceeded, Treasury must issue obligations solely for the payment of the principal and interest on debt held by the public or the Social Security trust funds. Obligations issued under this bill may not be used to compensate Members of Congress. If Treasury exercises authority provided by this bill, it must submit to Congress a report that includes an accounting of: (1) the principal on mature obligations and interest that is due or accrued, and (2) obligations issued under this bill.

Defund Planned Parenthood Act of 2017 This bill prohibits, for a one-year period, the availability of federal funds for any purpose to Planned Parenthood Federation of America, Inc., or any of its affiliates or clinics, unless they certify that the affiliates and clinics will not perform, and will not provide any funds to any other entity that performs, an abortion during such period. This restriction does not apply in cases of rape or incest or where a physical condition endangers a woman's life unless an abortion is performed. The Department of Health and Human Services and the Department of Agriculture must seek repayment of federal assistance received by Planned Parenthood Federation of America, Inc., or any affiliate or clinic, if it violates the terms of the certification required by this bill. Additional funding for community health centers is provided for the one-year period described above.

National Clinical Care Commission Act This bill amends the Public Health Service Act to establish within the Department of Health and Human Services (HHS) a National Clinical Care Commission to evaluate and recommend solutions regarding better coordination and leveraging of federal programs that relate to supporting clinical care for individuals with complex metabolic or autoimmune disease, diabetes, or complications caused by such diseases. The duties of the commission include: evaluating HHS programs regarding the utilization of preventive health benefits, identifying current activities and gaps in federal efforts to support clinicians in providing integrated care, making recommendations regarding the development and coordination of federally funded clinical practice support tools, recommending clinical pathways for new technologies and treatments, evaluating and expanding education and awareness activities provided to health care professionals, and reviewing and recommending methods for outreach and dissemination of educational resources. The commission must submit an operating plan to HHS and Congress within 90 days of its first meeting. The commission is terminated after it submits a final report, but not later than the end of FY2021.

American Health Care Reform Act of 2017 This bill repeals the Patient Protection and Affordable Care Act and the health care provisions of the Health Care and Education Reconciliation Act of 2010, effective January 1, 2018. The bill restores provisions amended by the repealed provisions. This bill amends the Internal Revenue Code to allow an income tax standard deduction for health insurance. Provisions regarding health savings accounts (HSAs) are revised, including to raise contribution limits and to expand the products and services that may be paid for using an HSA. Group health plans may vary premiums and cost-sharing based on participation in a wellness program. This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to provide grants to states for high risk health insurance pools. Individual health insurance coverage is governed by the laws of a state designated by the health insurance issuer. The Center for Medicare and Medicaid Services must publish Medicare claims and payment data. This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for association health plans, which are group health plans sponsored by certain business associations. Veterans with certain service-related disabilities or who have been awarded a medal of honor must be provided access to medical services though specified entities other than the Department of Veterans Affairs. Independent medical review panels must review health care lawsuits in which the defendant alleges adherence to clinical practice guidelines. Federal courts have jurisdiction over health care lawsuits. This bill amends the Balanced Budget and Emergency Deficit Control Act of 1985 to revise non-security discretionary spending limits.

Concealed Carry Reciprocity Act of 2017 This bill amends the federal criminal code to allow a qualified individual to carry a concealed handgun into or possess a concealed handgun in another state that allows individuals to carry concealed firearms. A qualified individual must: (1) be eligible to possess, transport, or receive a firearm under federal law; (2) carry a valid photo identification document; and (3) carry a valid concealed carry permit issued by any state or be eligible to carry a concealed firearm in his or her state of residence. Additionally, the bill specifies that a qualified individual who lawfully carries or possesses a concealed handgun in another state: (1) is not subject to the federal prohibition on possessing a firearm in a school zone, and (2) may carry or possess the concealed handgun in federally owned lands that are open to the public.

Pain-Capable Unborn Child Protection Act This bill amends the federal criminal code to make it a crime for any person to perform or attempt to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, up to five years in prison, or both. The bill provides exceptions for an abortion: (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Regulations from the Executive in Need of Scrutiny Act of 2017 This bill revises provisions relating to congressional review of agency rulemaking. A federal agency promulgating a rule must publish information about the rule in the Federal Register and include in its report to Congress and to the Government Accountability Office: (1) a classification of the rule as a major or nonmajor rule, and (2) a copy of the cost-benefit analysis of the rule that includes an analysis of any jobs added or lost.  A "major rule" is any rule that the Office of Information and Regulatory Affairs of the Office of Management and Budget finds results in: (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. A joint resolution of approval must be enacted within 70 session days or legislative days after the agency proposing a major rule submits its report on such rule to Congress in order for the rule to take effect. A major rule may take effect for 90 days without such approval if the President determines it is necessary because of an imminent threat to health or safety or other emergency, for the enforcement of criminal laws, for national security, or to implement an international trade agreement. The bill sets forth the congressional approval procedure for major rules and the congressional disapproval procedure for nonmajor rules. A joint resolution addressing a report classifying a rule as a major rule must be introduced within three legislative days in the House of Representative and three session days in the Senate. The bill prohibits any amendments to, and provides for expedited consideration of, such a joint resolution. A court may review whether an agency has completed the necessary requirements under this bill for a rule to take effect. The bill limits the effect of a joint resolution of approval of a major rule. The Balanced Budget and Emergency Deficit Control Act of 1985 is amended to provide that any congressional approval procedure set forth in this bill affecting budget authority, outlays, or receipts shall be assumed to be effective unless it is not approved in accordance with this bill.

Miners Protection Act of 2017 This bill amends the Surface Mining Control and Reclamation Act of 1977 (SMCRA) to transfer certain funds to the Multiemployer Health Benefit Plan and the 1974 United Mine Workers of America (UMWA) Pension Plan to provide health and pension benefits to retired coal miners and their families. The bill expands the group whose retiree health benefits are taken into account in determining the amount that the Department of the Treasury must transfer from the Abandoned Mine Reclamation Fund and the General Fund of the Treasury to the Multiemployer Health Benefit Plan. A voluntary employees' beneficiary association (VEBA) established as a result of certain bankruptcy proceedings must transfer to the plan any amounts received as a result of the bankruptcy proceeding, reduced by the amount of the VEBA's administrative costs. Transfers by Treasury are reduced by the amount of the VEBA transfers. Treasury must also transfer additional funds to the 1974 UMWA Pension Plan to pay pension benefits required under that plan if the amounts available for transfer under SMCRA's $490 million annual limit exceed the amounts required to be transferred for other purposes (including to the UMWA Health Plans). The bill also: (1) prohibits the pension plan from making certain changes to benefits during any year in which a transfer is received, and (2) establishes additional reporting requirements for the plan. The bill repeals requirements for current and former signatories to labor agreements with the UMWA to pay unassigned beneficiaries premiums or backstop premiums if transfers under SMCRA are less than the amount required to be transferred.

Muhammad Ali Expansion Act This bill amends the Professional Boxing Safety Act of 1996 to: (1) establish definitions for "fighter," "combat sport competition," and "mixed martial arts"; and (2) include individuals who fight in a professional mixed martial arts competition or other professional combat sport competition, such competitions, and the professional combat sports industry within the scope of such Act. The bill requires the Association of Boxing Commissions, within two years after enactment of this bill, to establish: (1) guidelines for minimum contractual provisions that should be included in bout agreements and mixed martial arts and other combat sport contracts, and (2) guidelines for objective and consistent written criteria for the ratings of mixed martial arts and other combat sports. The bill applies conflict of interest provisions that prohibit a promoter from having a financial interest in the management of a boxer, or a manager from having a financial interest in the promotion of a boxer, to fighters participating in a mixed martial arts or other combat sport competition scheduled for 11 minutes or more.

ENLIST Act

Encourage New Legalized Immigrants to Start Training Act or the ENLIST Act This bill authorizes the enlistment in the Armed Forces of aliens unlawfully present in the United States on December 31, 2012, who: (1) have been continuously present in the United States since such date; (2) were younger than 15 years of age when they initially entered the United States; and (3) are otherwise eligible for original enlistment in a regular component of the Army, Navy, Air Force, Marine Corps, or Coast Guard. The Department of Homeland Security shall adjust the status of an alien enlisted under such authority to the status of an alien lawfully admitted for permanent residence under provisions of the Immigration and Nationality Act applicable to aliens who entered the United States prior to January 1, 1972. The bill rescinds such lawful permanent resident status if the alien is separated from the Armed Forces under other than honorable conditions before serving the term of enlistment.

Emergency East Chicago Housing Relief Act of 2016 This bill provides an additional allocation of low-income housing tax credits for Indiana by increasing the state housing credit ceiling in 2017 and 2018. The bill requires the state housing credit ceiling for Indiana to be increased for 2017 and 2018 by the lesser of: (1) the aggregate housing credit dollar amount allocated for such calendar year by the state housing credit agency of Indiana to buildings located in Lake County, Indiana; or (2) the additional allocation amount calculated by multiplying $18 by the population of Lake County, Indiana. In the case of 2018, the additional allocation amount taken into account must be reduced by the amount of the increase in the state housing credit ceiling for 2017 that is required by this bill.

Hospital Quality Rating Transparency Act of 2016 This bill delays the date upon which the Department of Health and Human Services (HHS) may make Overall Hospital Quality Star Ratings for hospitals publicly available. With respect to such ratings, HHS shall: (1) make publicly available detailed information on the methodology used, (2) have the validity and accuracy of such methodology independently confirmed, and (3) provide a public comment period of specified duration. HHS may not make the ratings publicly available until the later of July 31, 2017, or the date upon which the bill's requirements are satisfied. In the event that such ratings have already been published on a specified website, HHS shall remove them and not republish them until the bill's requirements have been satisfied.

Subject to budget neutrality requirements, the bill: (1) increases the Medicare payment rate for such ventilators for 2017; and (2) for subsequent years, establishes a new base payment rate based on the percentage change, between 2015 and 2017, in the total number of beneficiaries receiving such ventilators under Medicare.

Protecting Our Veterans From School Closures Act This bill declares that if, as a result of a permanent school closure, a veteran is forced to discontinue a course or did not receive credit, or lost training time, toward completion of the education program, Department of Veterans Affairs educational assistance payments for such discontinued course or program shall not be: (1) charged against the individual's entitlement to educational assistance, or (2) counted against the aggregate period for which such assistance may be provided. The bill applies to courses and programs of education discontinued after August 1, 2016. Certain reporting fees paid to educational institutions furnishing veterans education or training shall be reduced for the 10-year period beginning on January 1, 2017.

Youth Opioid Use Treatment Help Act of 2016 or the YOUTH Act This bill amends the Public Health Service Act to revise and reauthorize through FY2022 grants for substance abuse treatment services for children and adolescents. The grant program is expanded to cover young adults. The Agency for Healthcare Research and Quality (AHRQ) must award grants for demonstration programs to: (1) expand access to medication-assisted treatment for opioid use disorders among adolescents and young adults, or (2) create and distribute for pediatric health care providers resources on medication-assisted treatment training and implementation. AHRQ must report on the demonstration programs and the availability of medication-assisted treatment for adolescents and young adults. The report must include recommendations for ensuring such treatment is accessible. The Government Accountability Office must study how federal agencies are addressing substance use and substance use disorders among adolescents and young adults.

Prohibiting Future Ransom Payments to Iran Act This bill declares that it shall be the policy of the U.S. government not to pay ransom or release prisoners for the purpose of securing the release of U.S. citizens taken hostage abroad. The U.S. government is prohibited from providing promissory notes (including currency) issued by the U.S. government or by a foreign government to the government of Iran. The conduct of a transaction or payment in connection with a claim settlement agreement brought before the Iran-United States Claims Tribunal (established on January 19, 1981) may be made only: (1) on a case-by-case basis pursuant to a specific license by the Department of the Treasury's Office of Foreign Assets Control, and (2) in a manner that does not contradict such promissory note prohibition. The President must publish a list of such transactions or payments. Such promissory note prohibition and licensing requirement shall remain in effect until the President certifies that: (1) a preliminary or final rule providing for Iran's designation as a jurisdiction of primary money laundering concern has been rescinded, and (2) the Department of State has removed Iran from the list of countries that have repeatedly provided support for acts of international terrorism. The President shall: (1) submit, every 180 days for 3 years, a report that evaluates each outstanding claim before the tribunal; and (2) provide notice prior to conducting a transaction or payment from the U.S. government to the government of Iran in connection with a claim settlement agreement. Nothing in this bill shall: (1) apply to activities subject to the non-covert intelligence reporting requirements under title V of the National Security Act of 1947, or (2) be construed to authorize any U.S. government payment to the government of Iran.
