SHINE for Autumn Act of 2023

Stillbirth Health Improvement and Education for Autumn Act of 2023 or the SHINE for Autumn Act of 2023 This bill authorizes grants and establishes other programs to improve data collection on stillbirths. Specifically, the Department of Health and Human Services (HHS) may award grants for surveillance and data collection on stillbirths, and HHS must issue guidelines for health departments and vital statistics units concerning the collection of stillbirth data. HHS must also develop educational awareness materials about stillbirths and make them publicly available. Furthermore, HHS must implement a fellowship program to provide training in perinatal autopsy pathology and otherwise support research on stillbirths and fetal autopsies. The bill also requires HHS to issue a report with educational guidelines on stillbirths and stillbirth risk factors.

Condemning the Government of the Islamic Republic of Iran for the massacre of political prisoners in 1988 and the uprisings of recent years, including the 2018, 2019, and 2022 uprisings, and calling for justice for its victims.

Consumer Safety Technology Act

Consumer Safety Technology Act This bill establishes a pilot program to explore the use of artificial intelligence to support the Consumer Product Safety Commission (CPSC). Specifically, the CPSC must consult with relevant stakeholders, such as data scientists and product manufacturers, and use artificial intelligence for a least one of the following purposes: (1) tracking trends in injuries involving consumer products, (2) identifying consumer product hazards, (3) monitoring the sale of recalled consumer products, or (4) identifying consumer products that do not meet specified importation requirements related to product safety. The bill also requires (1) the Department of Commerce to report on the use of blockchain technology in commerce and for consumer protection, and (2) the Federal Trade Commission to report on its efforts to prevent unfair or deceptive practices relating to digital tokens.

Accelerating Kids’ Access to Care Act

Accelerating Kids' Access to Care Act This bill requires state Medicaid programs to establish a process through which qualifying out-of-state providers may enroll as participating providers for five years without undergoing additional screening requirements, unless the state has an agreement with other states that governs coverage of children with medically complex conditions that is in accordance with specified guidance from the Centers for Medicare & Medicaid Services (CMS). Among other requirements, a qualifying provider must (1) serve individuals under the age of 21; (2) have previously been screened for Medicare participation or for participation in the Medicaid program of the state in which the provider is located; and (3) have been determined by the CMS or state Medicaid program to pose a limited risk of fraud, waste, or abuse.

Support for Patients and Communities Reauthorization Act

Support for Patients and Communities Reauthorization Act This bill reauthorizes through FY2028 and modifies various grants, programs, and activities that address substance use and misuse. This includes reauthorizing (1) data collection, education, and surveillance activities; (2) grants and other support for substance use disorder prevention, treatment, and recovery; (3) student loan repayment and other programs for the substance use disorder workforce; and (4) programs for addressing trauma, particularly for children, youth, and their families. Generally, the modifications expand programs. Additionally, the bill modifies provisions related to the scheduling of controlled substances, including by incorporating illicit xylazine (a compound used in veterinary medicine as a nonopioid tranquilizer) into schedule III of the Controlled Substances Act. Further, the bill makes permanent a requirement that Medicaid programs cover medication-assisted treatment for individuals with substance use disorders.

Medicare Patient Access to Cancer Treatment Act

Medicare Patient Access to Cancer Treatment Act This bill requires payment for cancer care services to be made in the same manner under Medicare regardless of whether they are provided in a hospital outpatient department or physician's office (i.e., site-neutral payment). ( Cancer care services are services that are furnished in relation to cancer diagnosis or treatment and that may be provided in either a hospital outpatient department or physician's office for purposes of Medicare payment.)

To amend title XI of the Social Security Act to clarify manufacturer transparency reporting requirements for certain transfers used for educational purposes.

FAIR Act

Federal Assistance to Initiate Repayment Act or the FAIR Act This bill makes various changes to the federal student loan system, including by establishing a new income-driven repayment plan and limiting the authority of the Department of Education (ED) to propose or issue regulations and executive actions related to federal student aid programs. The bill directs ED to provide at least 12 notices to each borrower of a federal student loan indicating (1) the date on which the borrower is required to make monthly loan payments; (2) the borrower's options for repayment; and (3) the options available to a borrower who is in default, including the option to consolidate or rehabilitate loans. ED must also conduct additional outreach to at-risk borrowers. Additionally, the bill replaces existing federal student loan repayment plans with one standard 10-year repayment plan and one income-driven repayment plan. The bill outlines the terms of this new income-driven repayment plan. The bill provides deferment options for borrowers with loans made on or after July 1, 2024. The bill prohibits ED from authorizing additional deferment options or periods of deferment other than those authorized by this bill. The bill allows borrowers to rehabilitate a defaulted loan twice (currently, only once). The bill also prohibits ED from issuing a proposed rule, final regulation, or executive action related to federal student aid programs if ED determines that the rule, regulation, or action (1) is economically significant, and (2) would result in an increase in a subsidy cost.

Fair and Open Skies Act This bill amends the policy considerations the Department of Transportation (DOT) must take into account when issuing a foreign air carrier permit. (This allows foreign air carriers to operate in U.S. air space.) DOT must consider preventing the undermining of labor standards when determining whether the foreign air transportation will be in the public interest. Further, the bill amends the requirements for the Department of State and DOT in formulating U.S. international air transportation policy. Under current law, the State Department and DOT must develop a negotiating policy emphasizing the greatest degree of competition compatible with a well-functioning international air transportation system and include specific considerations; this is amended to also include preventing the undermining of labor standards.

Improving Mental Health and Drug Treatment Act of 2023

The bill also extends the maximum length of stay over a 12-month period from 30 days to 45 days and requires state Medicaid programs to review IMD compliance with relevant standards of care.

It also expands BARDA's authorized strategic initiatives to include advanced research, development, and procurement of countermeasures and products to address viruses with pandemic potential.

KIDS Health Act of 2023

Kickstarting Innovative Demonstrations Supporting Kids Health Act of 2023 or the KIDS Health Act of 2023 This bill requires the Centers for Medicare & Medicaid Services (CMS) to implement a demonstration program that supports a whole child health model for children under Medicaid and the Children's Health Insurance Program (CHIP). Specifically, the CMS must award grants to up to 15 states to plan and implement a health care model that supports the physical, behavioral, social, and other needs of children who qualify for Medicaid or CHIP through care coordination and integrated supportive services. States must implement models for 4-6 years. The CMS must provide technical assistance and guidance to states for the demonstration program. The bill also provides for an 80% federal matching rate for program costs. The Government Accountability Office must report on program outcomes.

Providers and Payers COMPETE Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to report annually on the impact of Medicare regulatory changes on provider and payer consolidation (e.g., vertical or horizontal integration among providers, suppliers, and other health care entities). The CMS must also solicit public comment on the projected impact of a proposed rule with respect to provider and payer consolidation. The bill also requires the Center for Medicare and Medicaid Innovation to evaluate the impact of tested models on provider and payer consolidation.

CABLE Competition Act

Consumer Access to Broadband for Local Economies and Competition Act or the CABLE Competition Act This bill limits the authority of state and local entities that regulate certain aspects of cable operators (franchising authorities) over the sale or transfer of franchises for cable systems. Under current law, cable operators must typically obtain franchises authorizing them to provide services in a given area, and franchising authorities may place conditions on sales or transfers of franchises for cable systems. Under the bill, franchising authorities may neither (1) prohibit a cable operator from transferring its franchise to another operator, nor (2) require an operator to obtain approval when transferring its franchise to another operator that accepts all of the franchise terms. However, a franchising authority may require a cable operator to notify it of a transfer.

PREEMIE Reauthorization Act of 2023

PREEMIE Reauthorization Act of 2023 This bill reauthorizes through FY2028 and otherwise modifies research and education programs for preventing premature births. In particular, the bill expands the scope of education programs for health care providers and the public to address the importance of screening for and treatment of chronic conditions as part of preconception and prenatal care. Additionally, the bill requires the Department of Health and Human Services (HHS) to establish an interagency working group to improve the coordination of programs and activities to prevent preterm birth, infant mortality, and related adverse effects. (Current law permits HHS to establish such a working group.) The bill also requires HHS to support a study carried out by the National Academies of Sciences, Engineering, and Medicine on matters related to premature births, such as the financial costs and factors that affect preterm birth rates.

Protecting American Voters Act

Protecting American Voters Act This bill requires the Department of Homeland Security (DHS) and the Social Security Administration (SSA) to provide certain information to a state election official, upon the official's request, to verify citizenship status for the purpose of voting in federal elections. Specifically, the agencies must provide the state election official with such information necessary to verify that an applicant for voter registration or a registrant on the official list of eligible voters is a U.S. citizen. DHS may respond to a request by using the Systematic Alien Verification for Entitlements program, which is used to verify immigration status. DHS may not charge a fee for this information. DHS must comply with any safeguards that the SSA determines are necessary to protect the confidentiality of an individual's Social Security number. Finally, the bill requires states to remove the names of noncitizens from their official lists of eligible voters.

Audit the Pentagon Act of 2023

Audit the Pentagon Act of 2023 This bill requires defense spending reductions during any fiscal year after FY2022 where the Comptroller of the Department of Defense (DOD) fails to certify that a department, agency, or other element of DOD has achieved an unqualified opinion on its full financial statements. The amount of any reductions must be deposited in the Treasury and must be available for deficit reduction. The bill excludes from any reductions accounts related to military personnel, reserve personnel, National Guard personnel, and the Defense Health Program. The President may waive a reduction if the President certifies that a reduction would negatively affect (1) national security or members of the Armed Forces who are deployed in combat zones, or (2) the Defense Health Program account.

PASTEUR Act

Pioneering Antimicrobial Subscriptions To End Upsurging Resistance Act of 2023 or the PASTEUR Act of 2023 This bill authorizes the Department of Health and Human Services (HHS) to enter into subscription contracts for critical-need antimicrobial drugs, provides $6 billion in appropriations for activities under the bill, and contains other related provisions. A manufacturer of a Food and Drug Administration-approved antimicrobial drug may apply to HHS to have the drug designated as a critical-need antimicrobial, and HHS may enter into a subscription contract for such a critical-need antimicrobial. The bill imposes certain requirements related to such contracts, including a mechanism to lower payments under the contract in certain instances to limit the manufacturer's revenue from the drug. Furthermore, HHS and the Centers for Disease Control and Prevention (CDC) shall award grants to support efforts to encourage the appropriate use of antimicrobial drugs and efforts to combat antimicrobial resistance. The CDC shall also track and assess data relating to antibacterial resistance and human antibiotic use and make such data publicly available. HHS shall also establish a Committee on Critical Need Antimicrobials. The committee shall develop a list of prioritized infections for which new antimicrobial drug development is needed, among other duties. Within six years of the bill's enactment, the Government Accountability Office shall report to Congress a study on the bill's effectiveness in developing priority antimicrobial drugs.

Stop Institutional Child Abuse Act

Stop Institutional Child Abuse Act This bill establishes an interagency Federal Work Group on Youth Residential Programs to support and implement best practices regarding the health and safety, care, treatment, and appropriate placement of youth in youth residential programs. The work group must develop recommendations about a national database to aggregate information about processes and outcomes for youth in such programs. The work group also must support the education and training of professional and paraprofessional personnel in fields that service such youth. Further, the Department of Health and Human Services must contract with the National Academies of Sciences, Engineering, and Medicine to study and make recommendations about various aspects of federal and state oversight of youth residential programs.

Association Health Plans Act

Association Health Plans Act This bill provides statutory authority for the treatment of association health plans (AHPs) as single, large employers for purposes of the Employee Retirement Income Security Act (ERISA). Under AHPs, groups of individuals or small employers join together to purchase health insurance coverage. AHPs were historically subject to the market requirements for individual and small group health plans. In 2018, the Department of Labor issued regulations that allowed an AHP to be considered a single, large employer under ERISA if certain conditions are met. The regulations have been subject to litigation, which is still ongoing. The bill provides that an AHP qualifies as a single, large employer if it (1) among other listed criteria, has been in existence for at least two years and was formed for a purpose other than offering health insurance; (2) meets any criteria set by Labor in a prior advisory opinion; or (3) meets any other criteria set by Labor through regulations. Additionally, the bill establishes rules for AHPs to set premium rates and prohibits AHPs from discriminating in coverage based on health status-related factors or denying coverage based on preexisting conditions.

Limit, Save, Grow Act of 2023 This bill increases the federal debt limit and decreases spending. It also repeals several energy tax credits, modifies the permitting process and other requirements for energy projects, expands work requirements for the Supplemental Nutrition Assistance Program (SNAP) and other programs, and nullifies regulations for the cancellation of federal student loan debt. Specifically, the bill suspends the debt limit through March 31, 2024, or until the debt increases by $1.5 trillion, whichever occurs first; establishes discretionary spending limits for FY2024-FY2033 that include decreases in discretionary spending; rescinds certain unobligated funds that were provided to address COVID-19 and to the Internal Revenue Service; nullifies certain executive actions and regulations for cancelling federal student loan debt and implementing an income-driven repayment plan for student loans; repeals or modifies tax credits for renewable and clean energy, energy efficient property, alternative fuels, and electric vehicles; establishes new work requirements for Medicaid and expands the work requirements for SNAP and the Temporary Assistance for Needy Families (TANF) program; and requires major federal rules (e.g., rules likely to result in an annual economic effect of at least $100 million) to be approved by Congress before they take effect. The bill also includes various provisions related to the development of energy resources such as oil, natural gas, and minerals. For example, the bill requires additional federal oil and gas leasing, reduces or eliminates certain royalties and fees, and expedites the permitting process for various energy projects.

Save Local Business Act

Save Local Business Act This bill provides that a person may be considered a joint employer in relation to an employee under federal labor law only if such person directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline.

EHR Program RESET Act of 2023

Electronic Health Record Program Restructure, Enhance, Strengthen, and Empower Technology Act of 2023 or the EHR Program RESET Act of 2023 This bill establishes within the Veterans Health Administration a program to modernize the electronic health record and other relevant health information technology systems of the Department of Veterans Affairs (VA). The bill also establishes the Electronic Health Record and Health Information Technology Modernization Program Management Office and a position of Deputy Chief Information Officer for Electronic Health Record and Health Information Technology to implement the program. The VA must exceed or meet certain standards at its facilities that are using the Oracle Cerner product before it may initiate new deployments of the product. The bill requires additional information to be included in the quarterly updates on the Electronic Health Record Modernization Program, such as data on retention, morale, and turnover at sites using the new electronic health record. Within 275 days after the enactment of this bill, the VA must terminate all of its contracts with Oracle Cerner for training and change management related to electronic health record modernization and cease to issue task orders for such activities from Oracle Cerner or its subcontractors. The VA must designate one senior official (GS-15 or higher) as the lead negotiator on all current and future contracts relating to the new electronic health record. The Chief Acquisition Officer of the VA must contract with an entity to independently verify and validate the modernization efforts of certain VA programs (e.g., the Electronic Health Record Modernization Program).

Contact Lens Prescription Verification Modernization Act This bill revises the requirements for the verification of prescriptions related to the purchase of contact lenses. Specifically, online sellers of prescription contact lenses must provide consumers with a method to transmit a digital copy of their prescriptions to such sellers. Online sellers also must encrypt protected health information they send by email. Additionally, the bill prohibits any seller of prescription contact lenses from using telephone calls with an artificial or prerecorded voice (i.e., robocalls) to verify a consumer's prescription.

Medicaid VBPs for Patients Act

Medicaid VBPs for Patients Act or the MVP Act This bill provides statutory authority for regulations that allow for the use of varying best price points under value-based purchasing arrangements for purposes of the Medicaid Drug Rebate Program. ( Value-based purchasing arrangements refer to arrangements in which the price of a drug is linked to clinical outcomes; such arrangements are particularly used for new high-cost treatments, such as gene therapies.) The Government Accountability Office must study the impact of value-based purchasing arrangements on federal health care programs, including with respect to the bill's changes. Additionally, the bill (1) exempts sales of drugs that are made under value-based purchasing arrangements from calculations of the manufacturer average sales price for purposes of payments under Medicare medical services, if the manufacturer reports multiple best prices under Medicaid in accordance with the bill's changes; and (2) requires the Centers for Medicare & Medicaid Services to establish a program under which state Medicaid programs may cover drugs in inpatient settings via value-based purchasing arrangements. The bill's changes terminate five years after enactment; any value-based purchasing arrangements that are in effect as of the date of termination continue to apply.
