Promotes, posthumously, Nancy P. Gilbert, formerly of Marietta, Georgia, to the position of supervisory investigator in the Atlanta District Office of the Equal Employment Opportunity Commission, effective as of July 2, 2001. Prohibits this promotion from being taken into account for any pay or other personnel management purposes.

Constitutional Amendment - Marriage Protection Amendment - Declares that marriage in the United States shall consist only of the union of a man and a woman. Prohibits the Constitution or any State constitution from being construed to require that marital status or its legal incidents be conferred upon any union other than that of a man and a woman.

Recognizes that National POW/MIA Recognition Day is one of the six days specified by law as a day on which the POW/MIA flag is to be flown over specified Federal facilities and national cemeteries, military installations, and post offices. Extends the gratitude of the House of Representatives and the Nation to those who have served their nation in captivity to hostile forces as prisoners of war. Recognizes and honors the more than 88,000 members of the U.S. Armed Forces who remain unaccounted for and their families. Recognizes the untiring efforts of national POW/MIA organizations to ensuring that America never forgets the contribution of the Nation's prisoners of war and unaccounted for military personnel.

Provides that marriage in the United States shall consist only of the union of a man and a woman. Gives the U.S. Supreme Court original jurisdiction to hear and determine a claim arising under this Act. Prohibits any other Federal court or any State court from having jurisdiction to hear or determine such a claim.

Declares that the steel import licensing and monitoring program established by the Secretaries of the Treasury and of Commerce shall remain in effect and be established by the Secretary of Commerce as a permanent program. Requires the Secretaries to expand the program to include all iron and steel, and all articles of iron and steel, specified in this Act. Requires release of the import and licensing data made available to the public as part of this program, based upon classifications at the tenth digit level of the Harmonized Schedule of the United States. Grants the Secretaries authority to maintain the program and to expand it as necessary and appropriate in accordance with this Act.

Agricultural Business Security Tax Credit Act of 2004 - Amends the Internal Revenue Code to allow a retailer of agricultural products or a manufacturer, formulator, or distributor of food-use pesticides a business tax credit for up to 50 percent of the cost of protecting certain hazardous chemicals or food-use pesticides from unauthorized access. Sets an annual limit on such credit of $2 million and a per facility limitation of $50,000 (reduced by credits received for the five prior taxable years).

Terrorism Insurance Backstop Extension Act of 2004 - Amends the Terrorism Risk Insurance Act of 2002 to define: (1) the term "Program Year 4" as the period from January 1, 2006, through December 31, 2006; and (2) the term "Program Year 5" as the period from January 1, 2007, through December 31, 2007 (thereby extending the terrorism risk insurance program from 2005 through 2007). Sets a deadline for the Secretary of the Treasury to make a final determination regarding: (1) the availability of group life insurance to both insurers and consumers; and (2) whether certain provisions of the Act shall be applied to providers of group life insurance. Sunsets the Terrorism Risk Insurance Program after December 31, 2007.

Directing Community Integration Act - Amends the National Security Act of 1947 to require the Director of Central Intelligence (DCI) to serve as head of the U.S. intelligence community (IC) "acting through the Central Intelligence Agency" (CIA), while continuing to head the CIA and serve as principal adviser to the President for national security-related intelligence matters. (Currently, requires the DCI to serve as head of the IC, head of the CIA, and serve as principal adviser to the President for national security-related intelligence matters.) Eliminates the position of Deputy Director of Central Intelligence for Community Management. Creates eight associate directorships and five assistant directorships to assist the DCI with IC responsibilities and lists their duties. Gives certain directors overlapping CIA or cross-agency duties. Establishes the positions of General Counsel of the IC, Inspector General of the IC, and Executive Director of the CIA. Strikes a statutory provision that allows the National Security Council and the President to circumscribe the DCI's access to national security-related intelligence. Requires the DCI to prepare budgets of IC elements within the National Foreign Intelligence Program and to guide budget development for other IC elements. Removes time limits applicable to personnel transfers among IC elements. Makes the DCI responsible to the President for ensuring positive IC relationships with the intelligence or security services of foreign governments. Authorizes the DCI to exercise his or her CIA authority with respect to any IC element upon written request of the element head. Requires: (1) greater coordination between the Secretary of Defense and the DCI; and (2) the DCI's concurrence in additional agency appointments. Repeals the sunset provision applicable to limits on the establishment or operation of diplomatic intelligence support centers.

American Jobs Creation Act of 2004 - Amends the Internal Revenue Code to repeal the tax exclusion for extraterritorial income. Reduces corporate tax rates on domestic production activities income and on certain small businesses. Extends until 2008 provisions allowing expensing of small business assets and revises rules for the depreciation of certain leasehold improvements, restaurant property, aircraft, and bonus depreciation property. Revises tax rules for S corporations and rules relating to the foreign source income of U.S. businesses and individuals. Reduces the alternative minimum tax for certain corporations and farmers. Repeals excise tax reductions for certain alcohol fuel mixtures and allows the tax credit for alcohol products used as fuel to reduce excise tax liabilities. Adds tax reporting requirements to regulate the payment of certain fuel excise taxes. Extends certain expiring tax credits and deductions and authorities for the issuance of certain tax-exempt bonds. Permits a taxpayer election to deduct State and local general sales taxes in lieu of State and local income taxes. Sets forth rules relating to the tax treatment of expatriated individuals and corporations. Adds or increases penalties for abusive tax shelter activities. Revises tax rules for the treatment of certain transactions made primarily for the avoidance of U.S. taxation. Revises rules for the tax treatment of certain leases made with tax-exempt entities. Authorizes the Secretary of the Treasury to enter into contracts with private collection agencies for the collection of unpaid taxes. Sets forth rules for the tax deduction for charitable contributions of patents and other similar intellectual properties and for motor vehicles, boats, and aircraft. Fair and Equitable Tobacco Reform Act of 2004 - Eliminates tobacco quota and price support programs and provides for transitional payments to tobacco quota holders and active producers of quota tobacco.

Unborn Child Pain Awareness Act of 2004 - Amends the Public Health Service Act to require an abortion provider, before beginning any abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks after fertilization), to: (1) make a specified statement to the pregnant woman that Congress has determined that there is substantial evidence that the process will cause the unborn child pain, and that the mother has the option of having pain-reducing drugs administered directly to the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt) and an Unborn Child Pain Awareness Decision Form; and (3) obtain on the form the woman's signature and her explicit request for or refusal of the administration of drugs to the child. Directs the Secretary of Health and Human Services to develop the brochure and form. Makes such provisions inapplicable to a provider in the case of a medical emergency. Requires the provider to certify that a medical emergency exists. Sets penalties for false statements. Establishes penalties for willfully failing to comply with this Act, including civil penalties, medical license suspension, or both. Authorizes: (1) specified officials to bring suit in Federal court; and (2) private rights of action by a parent or guardian of a woman who is an unemancipated minor. Requires each State and State medical licensing authority to promulgate procedures for the revocation or suspension of a provider's license upon a court finding that the provider has violated this Act. Subjects a State that fails to implement such procedures to loss of Medicaid funding.

States that Congress: (1) urges the Government of the Socialist Republic of Vietnam to immediately provide to the United States all information relating to Americans unaccounted for from the Vietnam War, including documents relating to Americans unaccounted for in areas of Laos and Cambodia that were under wartime Vietnamese control; (2) welcomes the improvement in military ties between the United States and Vietnam, including the port call of the U.S.S. Vandergrift in November 2003, and urges the Government of Vietnam to respond positively by the end of 2004 to requests to permit a United States Navy vessel to conduct humanitarian underwater recovery missions along the coastline of Vietnam; and (3) will consider statements by President George W. Bush and the response of the Government of Vietnam to the U.S. request to use a United States Navy vessel to conduct humanitarian underwater recovery missions along the coast of Vietnam before taking further steps beneficial to the economic and political objectives of the Government of Vietnam.

Public Servant Retirement Protection Act - Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act (SSA) to repeal the current windfall elimination provisions (which reduce Social Security benefits of retirees who paid into the Social Security system for part of their careers and who also receive a government pension from work in the public sector not covered by Social Security) and to replace them with a formula that treats non-Social Security earnings as if they were Social Security earnings for the purpose of calculating lifetime earnings for certain individuals.

National Fishery Mitigation Coordination Act - Directs a sponsor agency (the U.S. Army Corps of Engineers, the Bureau of Reclamation, or the Tennessee Valley Authority) to enter into an agreement with the U.S. Fish and Wildlife Service to pay the mitigation fishery cost that specified mitigation fishery facilities located in the United States and owned and operated by the Service incur in conducting mitigation activities. Defines mitigation fishery cost as the expenditures necessary to operate, maintain, and rehabilitate facilities to conduct mitigation fishery activities, including the rearing and stocking of native and nonnative fish to replace or maintain harvest levels lost as a result of Federal water resource development projects.

Middle-Class Alternative Minimum Tax Relief Act of 2004 - Amends the Internal Revenue Code to extend the increased alternative minimum tax exemption amounts for individual taxpayers to taxable year 2005 (currently available for 2003 and 2004). Provides for an inflation adjustment to such amounts for taxable year 2005.

Amends Federal provisions concerning the National Guard Challenge Program (a civilian youth opportunities program conducted by the Secretary of Defense) to: (1) provide a maximum Federal matching funds level of 65 percent of the costs of operating the State program during FY 2005, 70 percent during FY 2006, and 75 percent for FY 2007 and beyond; (2) authorize appropriations for the Program for FY 2005; and (3) rename it the National Guard Youth Challenge Program.

Amends the Internal Revenue Code to permanently extend: (1) the increased standard deduction for married taxpayers filing joint returns or for surviving spouses (twice the deduction for single taxpayers); and (2) the increase in the taxable income level for qualifying married taxpayers filing joint returns or surviving spouses for the 15-percent tax bracket. Provides that the general terminating date under the Economic Growth and Tax Relief Reconciliation Act of 2001 (December 31, 2010) shall not apply to the extensions provided by this Act.

Cockpit Security Technical Corrections and Improvements Act of 2004 - Amends Federal aviation law to revise requirements for the program for deputizing eligible pilots as Federal law enforcement officers (Federal flight deck officers) to defend against acts of criminal violence or air piracy. Shifts responsibility for the program from the Under Secretary of Transportation for Security of the Transportation Security Administration (TSA) to the Secretary of Homeland Security. Revises eligibility requirements for pilots to be a Federal flight deck officer, adding mental standards and firearms training. Makes a special exception from ordinary requirements for certain active or reserve members of the armed forces or a Federal, State, or local law enforcement agency. Revises certain Federal flight deck officer training requirements and adds requalification training requirements. Revises requirements for the carrying of firearms by Federal flight deck officers outside of the United States, including designation as Federal air marshals, and the authority to use force to defend an aircraft against terrorism by a Federal flight deck officer. Extends to entities and individuals the prohibition (currently limited to air carriers) against prohibiting a pilot employed by an air carrier from becoming or threatening retaliatory action against such a pilot for becoming a Federal flight deck officer. Specifies further prohibited disciplinary actions. Authorizes a Federal flight deck officer or pilot who is adversely affected by a failure by the Secretary to comply with any requirements under this Act to file a petition for judicial review with the appropriate U.S. district court. Sets forth requirements to: (1) prohibit the disclosure of information related to a pilot's participation in the Federal flight deck officer program; (2) provide certain adjudication procedures for pilots who have been determined ineligible to be a Federal flight deck officer or has had other adverse action taken against them; (3) provide certain authorities with respect to Federal flight deck officers, including issuance of credentials, use of force to prevent terrorism or defend life, exposure to security inspections, and access to sensitive security information; (4) require certain reports to Congress on the Federal flight deck officer program; and (5) require the Secretary to promote and publicize the Federal flight deck officer program.

Fair and Equitable Tobacco Reform Act of 2004 - Amends, and repeals, specified agricultural Acts to eliminate tobacco quota and price support programs. Provides for: (1) transitional payments (funded by appropriations made by this Act) to tobacco quota holders and active producers of quota tobacco; (2) geographic restrictions on tobacco expansion through penalties for tobacco grown outside traditional tobacco counties; and (3) county committee resolution of payment disputes.

Firearm Commerce Modernization Act - Amends the Brady Handgun Violence Prevention Act to permit a licensed importer, manufacturer, dealer, or collector to: (1) sell or deliver a firearm (currently, a rifle or shotgun) to a resident of a State other than a State in which the licensee's place of business is located or temporarily located if the transferee meets in person with the transferor to accomplish the transfer; and (2) conduct business temporarily at any gun show or event sponsored by any national, State, or local organization, or any affiliate devoted to the collection, competitive use, or other sporting use of firearms (currently, only at such a location in the State specified on the person's license). Provides that nothing in the Act shall be construed to diminish the right of a licensee to conduct firearms transfers (currently, "curious or relics" firearms transfers) with another licensee away from the transferor's business premises.

Congressional Accountability for Judicial Activism Act of 2004 - Authorizes Congress, if two thirds of each House agree, to reverse a judgment of the United States Supreme Court: (1) if that judgment is handed down after the date of the enactment of this Act; and (2) to the extent that judgment concerns the constitutionality of an Act of Congress.

Amends the Internal Revenue Code to designate the provision of qualified homeowner dowpayment assistance as a "charitable purpose" for purposes of income, estate, and gift taxes. Defines "qualified homeowner downpayment assistance" as a gift of cash for the purpose of providing any downpayment for the purchase of a principal residence. Denies an income tax deduction to certain donors of homeowner downpayment assistance who receive a direct financial benefit in connection with the purchase of a principal residence for which the purchaser received downpayment assistance.
