Medicaid Saves Lives Act This bill requires and provides funds for the Department of Health and Human Services to establish a program that provides health benefits to the Medicaid expansion population in states that have not expanded Medicaid. Specifically, the program must provide coverage for individuals who are newly eligible for Medicaid under the Patient Protection and Affordable Care Act (i.e., the Medicaid expansion population) without premiums and in accordance with Medicaid cost-sharing and other requirements. The bill also extends and increases the temporarily enhanced Federal Medical Assistance Percentage (i.e., federal matching rate) for states that elect to participate in Medicaid expansion if they have not already done so.

United States Call Center Worker and Consumer Protection Act of 2021 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Health Insurance Marketplace Affordability Act of 2021 This bill modifies the refundable tax credit for health care premium assistance to require an age rate adjustment to the applicable percentage used to determine the amount of such credit. The age rate adjustment for any individual shall be determined using a single national age rating curve specified in guidance by the Department of Health and Human Services and shall reflect market patterns in the individual health care market.

Bioeconomy Research and Development Act of 2021 This bill directs the Office of Science and Technology Policy (OSTP) to implement a National Engineering Biology Research and Development Initiative to advance societal well-being, national security, sustainability, and economic productivity and competitiveness. Among other activities, the initiative must include sustained support for research centers, individual investigators, technologies, and training. The initiative shall include outreach to primarily undergraduate and minority-serving institutions about initiative opportunities, and shall encourage the development of research collaborations between research-intensive universities and such institutions. The OSTP shall designate an interagency committee to coordinate initiative activities as appropriate. The interagency committee shall submit triennial reports to Congress through FY2028 in support of the initiative. The National Science Foundation (NSF) shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a review of, and make recommendations with respect to, the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology research and development. The NSF, National Institute of Standards and Technology, National Oceanic and Atmospheric Administration, Department of Energy, National Aeronautics and Space Administration (NASA), Department of Agriculture, Environmental Protection Agency, and Department of Health and Human Services shall carry out related activities as part of the initiative.

Daniel Anderl Judicial Security and Privacy Act of 2021 This bill generally prohibits federal agencies and private businesses from publicly posting the personally identifiable information (e.g., home addresses) of federal judges and their immediate family members. It also (1) requires information to be removed upon written request from the federal judge concerned, (2) prohibits data brokers from purchasing or selling such information, and (3) establishes programs to protect such information at the state and local level and to enhance security for judges.

Supporting Medicaid in the U.S. Territories Act of 2021 This bill extends, increases, and otherwise modifies Medicaid funding for U.S. territories. Specifically, the bill extends (1) the temporarily increased Federal Medical Assistance Percentage (i.e., federal matching rate), and (2) a higher cap on Medicaid funding. Such provisions apply to Puerto Rico through FY2026 and to other territories through FY2029. The bill also requires Puerto Rico to implement an asset verification program and to report on its ability to comply with certain reporting requirements, procurement standards, and other Medicaid program integrity measures.

Technical Reset to Advance the Instruction of Nurses Act or the TRAIN Act This bill modifies the methodology and application of Medicare Advantage nursing and allied health education payments for hospitals. Specifically, for 2010-2019, the bill eliminates the annual cap on total payments and excludes any resulting increase from factoring into calculations for graduate medical education payments for such hospitals. (The Centers for Medicare & Medicaid Services recently issued guidance providing for the recalculation and correction of certain payments to account for the annual payment cap.)

Safe Schools Improvement Act of 2021 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex, sexual orientation, gender identity, disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Department of Homeland Security Reform Act of 2021 or the DHS Reform Act of 2021 This bill makes extensive changes to the structure of the Department of Homeland Security (DHS) and to the responsibilities of DHS components. Specifically, the bill, among other things creates a new Associate Secretary responsible for overseeing DHS's law enforcement functions; modifies the responsibilities of the Office for Civil Rights and Civil Liberties, including to require engagement with individuals and communities whose civil rights and liberties may be affected by DHS programs and activities; establishes within DHS's Office of Intelligence and Analysis an analytic unit to serve as a focal point for intelligence and analysis of domestic terrorism threats; directs DHS to establish an employee engagement steering committee to identify factors that have a negative impact on employee engagement, morale, and communications within DHS; establishes within DHS a school security coordinating council; directs DHS to develop and disseminate a strategy with respect to biometric technology and identity management enterprise pilot programs and programs; requires DHS to develop, disseminate, and implement a DHS-wide directive to update or replace the strategic framework relating to countering terrorism and targeted violence; requires that DHS's use-of-force policy be updated to emphasize de-escalation; and requires DHS to issue a DHS-wide strategy to enhance partnerships with historically Black colleges and universities and minority-serving institutes that includes yearly goals.

America's Cultivation of Hope and Inclusion for Long-term Dependents Raised and Educated Natively Act of 2021 or the America's CHILDREN Act of 2021 This bill provides lawful permanent resident status to certain college graduates who entered the United States as children and addresses other immigration-related issues. Specifically, this bill allows an alien to apply for lawful permanent resident status if the alien (1) was lawfully admitted into the United States as a dependent child of an alien on a temporary worker visa, (2) was in the United States with such status for at least four years, (3) has graduated from an institution of higher education in the United States, and (4) is not deportable or otherwise inadmissible. In addition, the alien must have been lawfully present in the United States for at least 10 years at the time of the application. The bill also modifies various provisions related to the calculation of an alien's age for immigration purposes and the priority date of certain immigration-related applications.

Protect Reporters from Exploitative State Spying Act or the PRESS Act This bill prohibits the federal government from compelling journalists and providers of telecommunications services (e.g., phone and internet companies) to disclose certain protected information, except in limited circumstances such as to prevent terrorism or imminent violence. Specifically, the bill protects from disclosure any information identifying a source, as well as any records, contents of a communication, documents, or information obtained or created by journalists in the course of their work. Further, the bill protects specified third parties, such as telecommunications carriers or social media companies, from being compelled to provide testimony or any document consisting of a record, information, or other communication that relates to a business transaction between the third party and a journalist.

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

Keeping Gun Dealers Honest Act of 2021 This bill modifies the requirements and penalties applicable to an individual who engages in the business of dealing, importing, or manufacturing firearms (i.e., a federal firearms licensee, or FFL). Among other things, the bill does the following: increases the allowable number of annual compliance inspections; authorizes the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to hire at least 80 additional personnel to conduct additional inspections; increases the maximum prison term for an FFL or licensed collector who knowingly makes a false statement or representation in required firearms records; allows the ATF to require an FFL to conduct physical inventories if the FFL unlawfully transfers a firearm or if 10 or more crime guns are traced back to the FFL; allows the ATF to deny an application for a federal firearms license if it would endanger public safety or if the applicant is unlikely to comply with the law; and modifies the liability standard for an FFL who fails to comply with laws or regulations.

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation or gender identity; and (2) the designation of LGBTQ Equality Day on June 26 to commemorate Supreme Court decisions handed down on that day in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation or gender identity.

LGBTQ Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to review existing data sets to determine in which data sets information about sexual orientation and gender identity is not included, and to assess needed changes in survey methods related to asking questions on sexual orientation and gender identity. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity.

Even Playing Field Act This bill addresses pay equity for amateur athletes and other personnel. It allows recognition, or continued recognition, of a national governing body of an amateur sports organization only if it provides equal investment, promotional support, working conditions (including staff support and facilities and equipment for training and competition), and wages and other compensation to all amateur athletes, without discrimination based on sex. National governing bodies must report periodically to Congress regarding pay equity. Each report shall include (1) the median compensation for amateur athletes, coaches, trainers, managers, administrators, and officials, disaggregated by race, gender, and employment category; and (2) the minimum and maximum compensation paid to such personnel, disaggregated by race, gender, and employment category.

Break the Cycle of Violence Act This bill establishes federal grant programs and related entities to support violence intervention initiatives. Specifically, the bill directs the Department of Health and Human Services (HHS) to award grants for coordinated community violence intervention initiatives in communities disproportionately impacted by homicides and community violence. HHS must also establish several related entities, including an Office of Community Violence Intervention to administer programs and activities related to violence intervention; the Community Violence Intervention Advisory Committee to advise and assist the office and HHS; and the National Community Violence Response Center to provide training and technical assistance, coordinate research, and develop data collection policies. Additionally, the bill directs the Department of Labor to award grants for job training and workforce programs in communities disproportionately affected by gun violence to connect youth ages 16 to 24 to in-demand occupations.

Keeping Girls in School Act This bill authorizes the U.S. Agency for International Development (USAID) to enter into agreements to address social, cultural, health, and other barriers that adolescent girls face in accessing quality secondary education. The USAID shall seek to ensure that such activities meet various requirements related to monitoring and evaluating outcomes, collecting data, and using specified indicators and methodologies for international basic education. The Department of State shall periodically update and report to Congress a publicly available U.S. global strategy to empower adolescent girls, and the USAID shall periodically report to Congress on the activities initiated under this bill and efforts to monitor and evaluate such activities.

Therapeutic Fraud Prevention Act of 20 21 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

Coastal Habitat Conservation Act of 2021 This bill provides statutory authority for the Coastal Program of the U.S. Fish and Wildlife Service. Among other things, the program identifies the most important natural resource problems and solutions in priority coastal ecosystems in partnership with federal, state, local, and tribal governments, nongovernmental institutions, nonprofit organizations, private individuals, and corporations; and assists in the development and implementation of monitoring protocols to ensure the success of coastal ecosystem restoration and enhancement measures.

Patsy T. Mink and Louise M. Slaughter Gender Equity in Education Act of 2021 This bill requires the Department of Education (ED) to establish an Office for Gender Equity to support state and local educational agencies, institutions of higher education, and elementary and secondary schools in fully implementing title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in federally funded education programs or activities. The office may provide grants and perform activities to reduce or prevent sex discrimination in all areas of education. The office must provide technical assistance and annual training to title IX coordinators and develop a handbook for conducting self-evaluations of title IX compliance. The training must address discrimination based on multiple characteristics, including race, ethnicity, national origin, disability status, religion, age, or actual or perceived sex. The office may award grants to eligible entities and partnerships that apply to carry out programs and activities designed to implement title IX and prevent and reduce sex discrimination, including programs that increase access to resources. ED must coordinate with the Institute of Education Sciences and other federal entities to investigate, identify, and disseminate best practices to (1) reduce and prevent sex stereotyping, bias, and discrimination in educational materials; (2) address sex-based harassment and violence on campuses; (3) develop counseling and career guidance training; (4) mitigate implicit bias in teaching and discipline; and (5) address the needs of students who face discrimination based on multiple characteristics.

Vanessa Guillén Military Justice Improvement and Increasing Prevention Act This bill modifies the process and policy related to the disposition of charges and convening of courts-martial for certain sexual assault cases and other specified offenses under the Uniform Code of Military Justice (UCMJ). Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.

Aviation Funding Stability Act of 20 21 This bill provides continuing appropriations to the Federal Aviation Administration (FAA) from the Airport and Airway Trust Fund if an appropriations bill for the FAA has not been enacted before a fiscal year begins or a joint resolution making continuing appropriations for the FAA is not in effect. The bill provides appropriations at the rate of operations that was provided for the prior fiscal year to continue programs, projects, and activities for which funds were provided in the preceding fiscal year.

Stop Shackling and Detaining Pregnant Women Act This bill prohibits the Department of Homeland Security (DHS) from detaining an individual during pregnancy or postpartum recovery and addresses related issues. DHS must immediately release any detainee found to be pregnant, unless the detainee presents an immediate and serious threat of hurting themselves or others. A DHS detention facility may not use a restraint on a detainee who is known to be pregnant, including during labor, transport to a medical facility or birthing center, and delivery, or during postpartum recovery, except for medical or safety purposes. The bill requires DHS to use the least restrictive restraint necessary and prohibits certain specified restraint types, including four-point restraints and binding hands behind the detainee's back. The bill prohibits DHS detention officers from being present during a detainee's pelvic exam, labor, delivery, or treatment relating to a pregnancy, unless specifically requested by medical personnel. If a detention officer is requested by medical personnel, such officer shall be female, if practicable, and remain at a reasonable distance from the detainee. A pregnant detainee must have access to health care services, including comprehensive services relating to reproductive health care and pregnancy. DHS must provide annual training about this bill's requirements to each employee who has a role in the detention or care of a pregnant detainee or a postpartum parent of a newborn. DHS must also provide each detainee notice of their rights under this bill in the detainee's native language.

Cover Outstanding Vulnerable Expansion-eligible Residents Now Act or the COVER Now Act This bill establishes a demonstration program to allow local governments to provide health benefits to the Medicaid expansion population in states that have not expanded Medicaid. Under the program, local governments may provide coverage for individuals who are newly eligible for Medicaid under the Patient Protection and Affordable Care Act (i.e., the Medicaid expansion population) for a maximum of 10 years, or until their respective states expand Medicaid. The bill provides a 100% federal matching rate for the first three years of program participation. The bill prohibits states from taking certain actions against participating localities, such as withholding funding, increasing taxes, or restricting provider participation. States that violate these requirements are subject to certain funding penalties.

Disarm Hate Act The bill expands the categories of persons who are prohibited from receiving or possessing a firearm. Specifically, it prohibits firearm sale or transfer to and receipt, possession, shipment, or transport by a person (1) who has been convicted of a misdemeanor hate crime, or (2) who has received an enhanced hate crime misdemeanor sentence.

Unsubscribe Act of 20 21 This bill requires that certain consumer protections are included in negative option agreements (i.e., an agreement under which a consumer's failure to take an affirmative action is considered approval to be charged for goods or services). These agreements are prohibited unless the terms provide the consumer with a way to cancel the agreement, in the same manner by which the agreement was entered, before incurring further or increased charges. Further, under free-to-pay conversion contracts, where a consumer is charged a nominal introductory rate and an increased rate after the introductory period ends, the provider of the good or service must require the consumer to perform an additional action, like clicking a confirmation button, before the increased rate takes effect. The bill also requires that certain notifications are provided to consumers in the context of other forms of negative option agreements online, such as notice between two and seven days before an automatic renewal. The bill provides for enforcement of these requirements by the Federal Trade Commission and state attorneys general.

Local Journalism Sustainability Act This bill allows individual and business taxpayers tax credits for the support of local newspapers and media. Specifically, individual taxpayers may claim an income tax credit up to $250 for a local newspaper subscription. The bill also allows local newspaper employers a payroll tax credit for wages paid to an employee for service as a local news journalist and certain small businesses a tax credit for local newspaper and media advertising expenses.

Defending Domestic Produce Protection Act This bill establishes a process by which a core seasonal industry may petition for countervailing and antidumping duties. A core seasonal industry means the producers (1) of a domestic like product that is a raw agricultural product, (2) whose collective output constitutes a majority of the total production in any state or group of states that accounts for a major portion of the total production during a discrete season or cyclical period of time, and (3) that make substantially all of their sales during that season or time period. The bill also provides that this process shall apply with respect to goods from Canada and Mexico.

Pell Grant Preservation and Expansion Act of 2021 This bill makes various changes to the Federal Pell Grant program, including by expanding student eligibility for Pell Grants. The bill also revises student eligibility for federal student-aid programs. Specifically, the bill provides funding to increase the maximum Pell Grant award for each eligible student. Further, the bill requires the award amount to be adjusted for inflation. Next, the bill allows students who receive means-tested federal benefits (e.g., Medicaid) to automatically qualify for the maximum Pell Grant award plus an additional award amount. In addition, the bill moves the Iraq and Afghanistan Service Grant program into the Pell Grant program. Next, the bill raises from 12 to 18 the total number of semesters during which a student may receive a Pell Grant. The bill makes Dreamer students (i.e., students who have been granted Deferred Action for Childhood Arrivals status) who entered the United States before the age of 18 and who meet certain educational criteria eligible for federal financial aid. The bill also revises satisfactory academic progress requirements for federal student-aid programs, including by allowing a student who has not been enrolled in an institution of higher education for two years to regain eligibility for federal student aid.

Every Vote Counts Act This bill requires states to take certain actions to facilitate absentee voting for federal elections. First, the bill requires each state to establish an absentee ballot tracking program to track and confirm receipt of absentee ballots for federal elections. The Election Assistance Commission must make payments to states for establishing these programs. Next, the bill requires each state to provide in each county secured drop boxes at which individuals may drop off their completed absentee ballots for federal elections. These drop boxes must be (1) available beginning 45 days before the election; (2) accessible to individuals with disabilities and individuals with limited proficiency in the English language; (3) accessible by public transit; (4) available during all hours of the day; and (5) located in all communities within the county, including rural communities and on tribal lands. States must also post the requirements for absentee ballots to be counted and tabulated in the election. Further, the bill outlines additional requirements that a state must meet in determining the number and location of drop boxes. The bill also requires the National Institute of Standards and Technology to develop alternatives to signature matching for verifying the identity of an individual who is voting by absentee ballot.

American Choice and Innovation Online Act This bill prohibits certain large online platforms from engaging in specified acts, including giving preference to their own products on the platform, excluding or disadvantaging competing products from another business on the platform, or discriminating among similarly situated users. Further, a platform may not materially restrict or impede the capacity of a competing business user to access or interoperate with the same platform, operating system, or hardware or software features. The bill also restricts the platform's use of nonpublic data obtained from or generated on the platform and prohibits the platform from restricting access to platform data generated by the activity of a competing business user. The bill also provides additional restrictions related to installing or uninstalling software, search or ranking functionality, and retaliation for contact with law enforcement regarding actual or potential violations of law. The bill establishes affirmative defenses for the prohibited conduct. The Federal Trade Commission or the Department of Justice must designate whether an entity is a platform covered by the bill, and both must carry out enforcement activities. The bill also provides for civil penalties, injunctions, conflicts of interest, a private right of action, and the forfeit of profits for repeat offenders.

Accounting STEM Pursuit Act of 2021 This bill authorizes states and local educational agencies (LEAs) to use grant funds provided through the Student Support and Academic Enrichment Program for accounting education. In particular, LEAs may use these grant funds to implement programs to teach accounting, including by increasing access to high-quality accounting courses through 12th grade for students who are members of underrepresented groups.

Women's Health Protection Act of 2021 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Specifically, governments may not limit a provider's ability to prescribe certain drugs, offer abortion services via telemedicine, or immediately provide abortion services when the provider determines a delay risks the patient's health. Furthermore, governments may not require a provider to perform unnecessary medical procedures, provide medically inaccurate information, comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions, or carry out all services connected to an abortion. In addition, governments may not (1) require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining such services, or (2) prohibit abortion services before fetal viability or after fetal viability when a provider determines the pregnancy risks the patient's life or health. The bill also prohibits other governmental measures that are similar to the bill's specified restrictions or that otherwise single out and impede access to abortion services, unless a government demonstrates that the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. The bill applies to restrictions imposed both prior and subsequent to the bill's enactment.

America's Red Rock Wilderness Act This bill designates specified lands in the following areas of Utah as components of the National Wilderness Preservation System: (1) Great Basin, (2) Grand Staircase-Escalante, (3) Moab-La Sal Canyons, (4) Henry Mountains, (5) Glen Canyon, (6) San Juan-Anasazi, (7) Canyonlands Basin, (8) San Rafael Swell, and (9) Book Cliffs and Uinta Basin. The bill sets forth administrative requirements for (1) the exchange of state-owned lands within such areas, (2) federal reservation of water rights, (3) measurement of setbacks for roads with adjacent wilderness, (4) authorized livestock grazing, and (5) withdrawal of such lands from disposition under certain public land laws.

Physical Therapist Workforce and Patient Access Act of 2021 This bill makes physical therapists eligible for the National Health Service Corps Loan Repayment Program. This program assists primary care, mental health, and dental providers in repaying eligible student loans in exchange for working in areas with shortages of such providers.

Medical Nutrition Equity Act of 2021 This bill expands coverage under Medicare, Medicaid, other specified federal health care programs, and private health insurance to include foods, vitamins, and individual amino acids that are medically necessary for the management of certain digestive and metabolic disorders and conditions.

Marine Mammal Climate Change Protection Act This bill establishes requirements to protect marine mammals adversely affected by climate change, including by establishing a program within the National Oceanic and Atmospheric Administration (NOAA) to monitor the adverse impacts of climate change on marine mammals. In addition, it also requires NOAA's National Marine Fisheries Service (NMFS) and the U.S. Fish and Wildlife Service (USFWS) to issue regulations that list marine mammal species in waters under U.S. jurisdiction for which climate change is more likely than not to result in a decline in population abundance, an impeded population recovery, or a reduced carrying capacity (i.e., the maximum population of a marine mammal species that an area will support without undergoing deterioration). The NMFS and the USFWS must update the list at least once every five years and issue regulations that include climate impact management plans for species on such list. The bill also directs the NMFS and the USFWS to review agreements with foreign governments concerning the management of marine mammals that are or may be affected by climate change. The Department of State must initiate amendments to such agreements or negotiate the development of such agreements in a manner consistent with the goals of the bill.
