Senior Accessible Housing Act

Senior Accessible Housing Act This bill amends the Internal Revenue Code to create a nonrefundable personal tax credit for senior citizens who modify their residences to enhance their ability to remain living safely, independently, and comfortably in the residences. The credit applies to up to $30,000 of the expenses that individuals who are at least 60 years old incur over their lifetime to make modifications to their residences, including: the installation of entrance and exit ramps, the widening of doorways, the installation of handrails or grab bars, the installation of non-slip flooring, and other modifications that the Internal Revenue Service (IRS) includes on a list of modifications that would enhance the ability of the individuals to remain living safely, independently, and comfortably in their residences. The IRS must establish and maintain the list of acceptable modifications after consulting with the Department of Health and Human Services and receiving input from the public

WINGMAN Act

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide an accredited, permanent congressional employee with read-only remote access to the electronic Veterans Benefits Administration (VBA) claims records system of a represented veteran, regardless of whether the employee is acting under a power of attorney executed by the veteran. The VA shall ensure that access does not allow the employee to modify system data. An employee must complete the VA certification process required of agents or attorneys in order to have system access. Each Member of Congress who elects to have an employee participate in the system shall bear the certification cost, which shall be paid from the Member's representational allowance. Information access by an employee shall be deemed: (1) a covered disclosure requiring prior consent, with specified exceptions; and (2) a permitted disclosure relating to the privacy of individually identifiable health information. The VA may not recognize an employee for purposes of preparation, presentation, and prosecution of VA claims by reason of such system access. "Accredited, permanent congressional employee" means an employee of a Member of Congress who assists constituents with issues regarding federal departments or agencies. "Electronic VBA claims records system" means the VA system that provides claim status information, including information about medical records, compensation and pension exams records, rating decisions, a statement of the case and a supplementary statement of the case, a notice of disagreement, and Form-9.

Clarify Workers Misclassification in the Construction Industry Act This bill requires the Department of the Treasury to initiate an enforcement initiative to increase tax compliance in the construction industry. The initiative must include: consultations with industry experts and leaders on its scope and priorities, targeted tax audits of major construction contractors that may not be in compliance with federal tax laws, civil and criminal tax enforcement actions under existing authorities, and educational efforts aimed at increasing voluntary tax compliance in the construction industry. Treasury must promulgate rules and issue guidance to reclassify individuals who are not currently being treated as employees consistent with the proper classification of employees under common law standards within the construction industry. In implementing this bill, Treasury must: (1) reassign personnel and resources from other activities to carry out this bill, and (2) report to Congress on the implementation and recommendations for further congressional action. The Government Accountability Office must study the various forms of tax fraud (including employee misclassification) in the construction industry, efforts to combat fraud, and recommendations for further action.

Federal Disaster Notification and Payment Protection Act of 2016 This bill prohibits the use of federal funds to recoup a debt owed to the United States related to assistance provided to an individual or household under the Robert T. Stafford Disaster Relief and Emergency Assistance Act with respect to a major disaster declared by the President on or after January 1, 2011, if: the assistance was distributed based on an error by the Federal Emergency Management Agency (FEMA), the collection of the debt would be against equity and good conscience, and the debt is not the result of fraud or other fault of the debtor or any party having an interest in the assistance distributed. The Stafford Act is amended to require the President to establish a process to ensure that each individual and business that applies for a category of federal disaster assistance is provided written notice that describes: the various categories of federal disaster assistance that may be available, the impact that receiving or declining such assistance will have on eligibility for other categories of assistance, and repayment requirements or penalties that may apply if multiple categories of assistance are accepted. An individual or business that is not provided such notice may not be held responsible for any repayment requirement or penalty that would otherwise result from the receipt of such assistance.

Kevin and Avonte's Law of 2016 Missing Americans Alert Program Act of 2016 This bill amends the Violent Crime Control and Law Enforcement Act of 1994 to revise and rename the Missing Alzheimer's Disease Patient Alert Program as the Missing Americans Alert Program and to reauthorize it through FY2021. It directs the Department of Justice's (DOJ's) Bureau of Justice Assistance to award grants to state and local law enforcement or public safety agencies and nonprofit organizations to prevent wandering and locate missing individuals with dementia or developmental disabilities. DOJ must establish and certain grant recipients must comply with standards and best practices related to the use of tracking technology to locate missing individuals with dementia or developmental disabilities. The bill amends the Missing Children's Assistance Act to specify that, with respect to training and technical assistance provided by the National Center for Missing and Exploited Children, cases involving missing and exploited children include cases involving children with developmental disabilities such as autism.

Securing Aviation from Foreign Entry Points and Guarding Airports Through Enhanced Security Act of 2016 This bill directs the Transportation Security Administration (TSA) of the Department of Homeland Security to conduct a comprehensive security risk assessment of all last point of departure airports with nonstop flights to the United States. The TSA shall submit to Congress and the Government Accountability Office (GAO) a plan: to enhance collaboration, coordination, and information-sharing about international-inbound aviation between the United States and domestic and foreign partners in order to enhance security capabilities at foreign airports; and that assesses TSA ability to enter into a mutual agreement with a foreign government entity to permit TSA representatives to conduct inspections of foreign airports without prior notice. The GAO shall review TSA efforts to enhance security capabilities at foreign airports and secure international-inbound aviation. The TSA shall submit to Congress a comprehensive workforce assessment of all TSA personnel within its Office of Global Strategies or whose primary professional duties contribute to the TSA's global efforts to secure transportation security, including whether they are assigned in a risk-based, intelligence-driven matter. The TSA may donate security screening equipment to a foreign last point of departure airport operator if the equipment can be expected to mitigate a specific vulnerability to U.S. security or U.S. citizens. The TSA may evaluate foreign countries' air cargo programs to determine whether they provide a level of security commensurate with that required by U.S. air cargo security programs.

Firefighter Cancer Registry Act of 2016 This bill requires the Centers for Disease Control and Prevention (CDC) to develop and maintain a voluntary patient registry to monitor, collect, and make available epidemiological information related to cancer incidence and trends among firefighters. The CDC should seek to include specified information in the registry, including the number and type of fire incidents attended by an individual. To collect information for the registry, the CDC may incorporate questions into existing public health surveys, questionnaires, and other databases. The CDC must: (1) encourage the inclusion in the registry of data on minority, female, and volunteer firefighters; and (2) seek feedback on the registry from nonfederal experts. The CDC must develop an approval process for making registry data available for research without a fee if findings or publications derived from the research are made public or available to stakeholders.

Combating BDS Act of 2016 This bill authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit investment of its assets in: (1) an entity that such government determines, using credible information available to the public, engages in a commerce or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with, such an entity. Such government shall provide written notice to such an entity before applying such a measure. Such a measure by a state or local government is not preempted by any federal law or regulation. The bill applies to measures adopted by a state or local government before, on, or after the date of this Act's enactment. The bill amends the Investment Company Act of 1940 to prohibit any person from bringing any civil, criminal, or administrative action against any registered investment company, or any officer or employee thereof, based solely upon such company divesting from, or avoiding investing in, securities issued by persons that such company determines, using credible information available to the public, engage in commerce or investment-related boycotts, divestments, or sanctions activities targeting Israel.

Specifically, VPB measures shall not include measures based on a patient's assessment of: (1) the patient's need for pain medicine during a hospital stay; (2) how often, during the stay, the patient's pain was well controlled; or (3) how often, during the stay, hospital staff did everything they could to help manage the patient's pain.

Education for All Act of 2016 This bill expresses the sense of Congress that: (1) it is in the U.S. national security interest to promote universal basic education in developing countries; and (2) an educated citizenry contributes to economic growth, strengthened democratic institutions, the empowerment of women and girls, and decreased extremism. The Foreign Assistance Act of 1961 is amended to state that it is U.S. policy to work with foreign countries and international and civil society organizations to achieve sustainable quality universal basic education by: (1) assisting developing countries and nongovernmental and multilateral organizations to provide all children with a quality basic education, and (2) promoting education as the foundation for community development. The President, through the U.S. Agency for International Development (USAID), shall develop a comprehensive U.S. strategy to promote quality universal basic education. The President shall give assistance priority to foreign countries in which there is the greatest need and opportunity to expand universal access and to improve learning outcomes, and in which the assistance can produce a substantial, measurable impact on children and educational systems. Priority should also be considered in countries where there are chronically underserved and marginalized populations, or populations affected by conflict or crisis. USAID shall designate a Senior Coordinator of United States Government Actions to Provide Basic Education Assistance, who shall have primary responsibility for the oversight and coordination of all U.S. government resources and international activities to promote quality universal basic education.

A registered EMS agency must be overseen by one or more medical directors. The bill specifies that an EMS practitioner who is employed by a registered EMS agency may administer controlled substances under a standing order issued by a medical director. The standing order does not have to be specific to an individual patient.

Protect America Act of 2015 Preventing Terrorists From Obtaining Firearms Act of 2015 This bill amends the federal criminal code to require the Department of Justice (DOJ), after receiving notice of a request to transfer a firearm to a known or suspected terrorist, to: (1) confirm the identity of the prospective transferee and confirm or rule out a connection to terrorism, (2) notify relevant law enforcement or intelligence agencies, and (3) determine whether the prospective transferee is the subject of an ongoing terrorism investigation. It authorizes DOJ or a U.S. Attorney's Office to delay for up to 72 hours and file an emergency petition to prohibit the firearm transfer. Preventing Terrorists From Obtaining Explosives Act of 2015 If DOJ receives an application for an explosives permit or license from a known or suspected terrorist, it must: (1) confirm the identity of the applicant and confirm or rule out a connection to terrorism, (2) notify relevant law enforcement or intelligence agencies, and (3) determine whether the applicant is the subject of an ongoing terrorism investigation. It authorizes DOJ or a U.S. Attorney's Office to delay for up to 90 days and file an emergency petition to prohibit the approval of the application. The bill requires DOJ to review the terrorist watch and no-fly lists and remove the name of any person whose name was erroneously placed on such lists.

Protecting Our Youth from Dangerous Synthetic Drugs Act of 2015 This bill amends the Controlled Substances Act to include in the definition of a "controlled substance analogue" a substance designated as such by the Controlled Substance Analogue Committee (established by this bill). It directs the Drug Enforcement Administration (DEA) to establish such Committee as an interagency committee headed by the DEA and comprised of scientific experts in the fields of chemistry and pharmacology from the DEA, the National Institute on Drug Abuse, the Centers for Disease Control and Prevention, and any other federal agency determined by the DEA to be appropriate. The Committee may designate, and shall establish and maintain a list of, controlled substance analogues determined to be similar to a schedule I or II controlled substance in either chemical structure or predictive effect on the body in such a manner as to make it likely that the substance will, or can be reasonably expected to, have a potential for abuse. The DEA must publish a description of each designation made by the Committee. The bill amends the Controlled Substances Import and Export Act to prohibit the importation of any controlled substance analogue except pursuant to such notification or declaration as the DEA may prescribe. It directs the U.S. Sentencing Commission to review and, if appropriate, amend the federal sentencing guidelines and policy statements to ensure that they provide adequate penalties for any offense involving the unlawful manufacturing, importing, exporting, or trafficking of controlled substance analogues and similar offenses.

This bill makes permanent the Land and Water Conservation Fund (LWCF). Of the appropriations from the LWCF: (1) at least 40% shall be used collectively for federal purposes for certain land and water acquisitions (as currently); (2) at least 40% shall be used collectively to provide financial assistance to states for LWCF purposes and for outdoor recreation, for the Forest Legacy Program, for cooperative endangered species grants, and for the American Battlefield Protection Program; and (3) at least 1.5% or $10 million, whichever is greater, shall be used for projects that secure recreational public access to federal public land for hunting, fishing, or other recreational purposes. The Department of the Interior and the Department of Agriculture shall consider the acquisition of conservation easements and other similar interests in land where it is appropriate and feasible, taking specified considerations into account. The bill establishes a National Park Service Critical Maintenance and Revitalization Conservation Fund in the Treasury for the deposit of specified amounts from revenues due and payable to the United States under the Outer Continental Shelf Lands Act. Amounts deposited in the Fund shall: (1) be used only for the high priority deferred maintenance needs of the National Park Service that support critical infrastructure and visitor services, and (2) be available for expenditure only after amounts are appropriated for such purposes. Flood Insurance Transparency and Accountability Act of 2015 This bill amends the National Flood Insurance Act of 1968 (NFIA) to direct the Federal Emergency Management Agency (FEMA) to declare that the final engineering report of an on-site property inspection conducted by an engineer to assess claims for losses covered by a flood insurance policy: may not be transmitted to any other person, employer, agency, or entity before it is transmitted to the insured; may not include alterations by anyone other than the person responsible for the report; and shall be transmitted to the insured in a manner giving reasonable assurance that it is transmitted directly to the insured by the responsible person in charge. The bill prescribes the manner in which such reports (including any adjustment and field reports) shall be transmitted to the insured. The bill revises the statute of limitations for appealing a disallowed claim for judicial review. The current limit of one year after the mailing date of FEMA's notice of disallowance or partial disallowance is repealed. The statute shall be extended to two years after the occurrence of the losses involved in a claim. If FEMA, or an insurance company denies any claim for losses that is appealed to FEMA, the claimant may institute an action in U.S. district court not later than the later of: (1) the expiration of the 90-day period beginning the date of a final determination upon appeal denying such claim in whole or in part, or (2) the expiration of the 2-year period after the occurrence of the losses. The Homeowner Flood Insurance Affordability Act of 2014 is amended to require the Flood Insurance Advocate to provide a direct point of contact for policyholders under the National Flood Insurance Program to discuss the status of their claim appeals and the basis of the initial decision to deny their claims. The NFIA is further amended to require FEMA to conduct an annual review of each private entity participating in the Program, including any company that has contracted with a Write Your Own insurance company to provide any service related to a policy or claim under the Program, including adjusting, engineering, and legal services, to ensure compliance with FEMA policies and procedures to prevent fraud and protect policyholders. A Write Your Own means the cooperative undertaking between the insurance industry and the Federal Insurance Administration which allows participating property and casualty insurance companies to write and service standard flood insurance policies. FEMA shall also: (1) create and maintain a publically searchable online database that includes specified information regarding claims filed under the Program, and (2) establish guidelines and standards to require that any engineering or litigation cost billed to the Program by a Write Your Own insurance company is justified on a case-by-case basis. A claim for damage to or loss of property shall not be denied based on the exclusion of earth movement (earthquake, volcanic eruption, landslide, sinkhole, mudflow, or shock wave) in the Standard Flood Insurance Policy if the claim is filed as the result of a flood, including a claim for damage to or loss or property caused by earth movement caused by a flood. The Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 is amended to require FEMA to ensure that: (1) the appeals process has clear rules, forms, and deadlines; (2) these are given to a claimant at the time a claim is first denied; and (3) the policyholder's legal options are explained upon denial of appeal. The Department of Homeland Security shall report to Congress on specific actions it will take to: identify individuals and private entities that have engaged in activities to defraud policyholders under the Program following Superstorm Sandy, and prevent those individuals and private entities from continuing to receive federal funding. FEMA shall report to Congress regarding National Flood Insurance Program Transformation Task Force recommendations for reforming the Program, and a timeline for implementing them.
