Promoting Responsible Oversight To Eliminate Communist Teachings for Our Kids Act or the PROTECT Our Kids Act This bill prohibits federal education funding for any elementary or secondary school that (1) has a partnership in effect with a cultural or language institute funded by the Chinese government, including a Confucius Institute; (2) operates a learning center supported by the Chinese government (commonly referred to as a Confucius Classroom); or (3) receives support from an individual or entity acting on behalf of the Chinese government, including support in the form of teaching materials, personnel, funds, or other resources. The bill directs the Department of Education to provide notice of the bill's requirements to schools, as well as guidance for achieving compliance with the requirements.

Rectifying Undefined Descriptions of Abusive Acts and Practices Act or the Rectifying UDAAP Act This bill restricts the Consumer Financial Protection Bureau’s (CFPB’s) authority to deem a financial practice abusive for purposes of enforcement activities. Currently, under the Dodd-Frank Wall Street Reform and Consumer Protection Act, the CFPB may take enforcement action against a financial product or service provider in connection with any transaction with a consumer for a consumer financial product or service that is unfair, deceptive, or abusive. Specifically, the bill prohibits the CFPB from including discrimination as an abusive practice. Further, the bill revises what an abusive practice is, including by additionally requiring the act or practice to intentionally interfere with the ability of a consumer to understand a term or condition. The bill also establishes additional criteria for abusive actions. For example, conduct is considered abusive if (1) it causes or is likely to cause substantial injury to consumers which is not reasonably avoidable by consumers, (2) the substantial injury is not outweighed by countervailing benefits to consumers or to competition, or (3) the conduct is otherwise prohibited under federal consumer financial law. The bill also eliminates the CFPB’s ability to seek monetary relief for unfair, deceptive, or abusive acts or practices if the provider establishes a good faith effort to comply with requirements. The bill establishes rulemaking requirements, including requiring a cost-benefit analysis for a rule relating to unfair, deceptive, or abusive acts or practices. Finally, the bill establishes the right for providers to cure violations if they self-report and limits the CFPB’s use of alternative claims in court.

Main Street Growth Act This bill allows for the registration of national venture securities exchanges for the purpose of trading the securities of certain small companies, such as startups and emerging growth companies. Individuals and existing national securities exchanges may apply to the Securities and Exchange Commission for approval to register such an exchange, or to register a listing tier within an existing exchange. The bill sets forth requirements for these venture exchanges, including required disclosures, trading limits, and trading privileges.

This joint resolution nullifies the final rule issued by the Securities and Exchange Commission titled Cybersecurity Risk Management, Strategy, Governance, and Incident Disclosure and published on August 4, 2023. The rule requires standardized disclosures from public companies regarding material cybersecurity incidents and standards and processes to manage cybersecurity risks.

This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

Iran-China Energy Sanctions Act of 2023 This bill requires the President to periodically determine whether any Chinese financial institution has engaged in the purchase of petroleum or petroleum products from Iran. U.S. financial institutions shall not open or maintain certain accounts with such Chinese financial institutions.

Thwarting Regional Adversary Investments Now Act or the TRAIN Act This bill requires the U.S. Agency for International Development to make training available to appropriate government officials of non-adversarial countries in South and Central Asia on analyzing, assessing, and mitigating any legal or financial risk of accepting investment or lending from a foreign adversary that is in the region.

Build Responsible Infrastructure Development for the Global Economy Act or the BRIDGE Act This bill requires the Department of State to report to Congress on China's Belt and Road Initiative and U.S. efforts to counter the initiative. (The initiative is a Chinese government effort to boost infrastructure development and expand China's influence across most of the globe.) Within one year of the bill's passage, the State Department must also report to Congress a plan to implement a detailed strategy for the State Department, the U.S. Agency for International Development, and the Department of Commerce to coordinate resources to counter the initiative.

Insurance Data Protection Act This bill limits the ability of federal entities to compel insurance companies to share information. Specifically, the bill eliminates the subpoena power of the Federal Insurance Office. Under current law, the office has the power to subpoena information from insurers to, among other purposes, identify issues that could contribute to a systemic crisis in the insurance industry or the U.S. financial system. The bill also eliminates the ability of the Office of Financial Research to subpoena insurance companies. When seeking to collect insurance company data under specified consumer protection laws, a financial regulator must obtain the data from other regulators or from publicly available sources if possible. Otherwise, the financial regulator may only collect this data directly from the insurance company if it complies with the Paperwork Reduction Act.

CBDC Anti-Surveillance State Act This bill prohibits a Federal Reserve bank from offering products or services directly to an individual, maintaining an account on behalf of an individual, or issuing a central bank digital currency (i.e., a digital dollar) directly or indirectly to an individual. Further, The Board of Governors of the Federal Reserve System and the Federal Open Market Committee are prohibited from using a central bank digital currency to implement monetary policy.

Crucial Communism Teaching Act This bill directs the Victims of Communism Memorial Foundation to develop a civic education curriculum and oral history resources for high school students to promote understanding of certain political ideologies (e.g., communism and totalitarianism) that conflict with principles of U.S. democracy.

Promotion and Expansion of Private Employee Ownership Act of 2023 This bill accelerates to the enactment date of this bill the deferral of tax (currently, after December 31, 2027) on sales of employer stock to employee stock ownership plans (ESOPs) sponsored by S corporations. It also eliminates the limitation on the amount that may be deferred. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The office must provide education and outreach about the benefits of employee ownership of S corporations and technical assistance to assist S corporations in sponsoring ESOPs. The bill directs the Department of Labor to appoint an Advocate for Employee Ownership.

This bill increases the authorization of appropriations for the Dairy Business Innovation (DBI) Initiatives for each fiscal year. Under the Agricultural Marketing Service, the DBI Initiatives support dairy businesses in the development, production, marketing, and distribution of dairy products. The DBI Initiatives provide direct technical assistance and subawards to dairy businesses, including for niche dairy products and dairy products derived from cow milk, sheep milk, and goat milk.

Community News and Small Business Support Act This bill allows certain small businesses and employers of journalists tax credits for advertising in local media and for the wages of not more than 1,500 local news journalists in any calendar quarter. Specifically, the tax credit for advertising in local media allows small businesses with less than 50 full-time employees a limited credit for the expense of advertising in a local newspaper, or in any licensed broadcast radio or television station that serves a local community. The credit for the wages of a local news journalist is a payroll tax credit that takes into account wages not exceeding $12,500 in any calendar quarter.

Stopping Teachers Unions from Damaging Education Needs Today Act or the STUDENT Act This bill revises the federal charter for the National Education Association. The bill specifies that the corporation and its state and local affiliates may only accept payment of membership dues or fees from a state or local government employee if the employee (1) has been notified of the employee's right under the First Amendment to refrain from membership and payment of associated dues or fees, (2) has clearly and affirmatively consented to membership and payment of associated dues or fees, and (3) has authorized the transmittal of membership dues or fees without the use of payroll deduction. Further, the corporation and its state or local affiliates must process and honor cancellation requests for membership or payment of dues as soon as practicable following receipt of the request. The bill also outlines requirements for the corporation, such as prohibiting the corporation or its directors or officers from contributing to, supporting, or participating in political activities; requiring each officer of the corporation to be a U.S. citizen; requiring the corporation to submit annual reports to Congress; prohibiting the corporation and its affiliates from requiring staff, officers, affiliates, or members to affirm, adopt, or adhere to certain principles related to race or sex; and prohibiting the corporation and its affiliates from calling or participating in a strike, work stoppage, or slowdown affecting a state or local government. The bill repeals the corporation's exemption from District of Columbia property taxes.

Main Street Tax Certainty Act This bill makes permanent the tax deduction for qualified business income. (Under current law, the deduction expires after December 31, 2025.) Qualified business income is defined as the net amount of qualified items of income, gain, deduction and loss with respect to any trade or business, excluding capital gains or losses, dividends, interest income, or income earned outside the U.S.

Performance over Politics Act This bill allows an issuer of securities to exclude a shareholder proposal from its proxy materials if that proposal addresses the same subject matter as a previously offered proposal. The bill provides time frames and voting percentages for the previously offered proposal that, if applicable, allow an issuer to exclude the new shareholder proposal.

Protecting Investors' Personally Identifiable Information Act This bill prohibits the Securities and Exchange Commission (SEC) from requiring a national securities exchange, association, or a member of either to provide a market participant's personally identifiable information to satisfy the reporting requirements of the Consolidated Audit Trail (i.e., data used to track market activity). However, this information must be provided to the SEC upon request if the information is related to a securities investigation. The SEC must destroy the information not later than one day after the conclusion of the matter for which this information was required.

Middle Class Mortgage Insurance Premium Act of 2023 This bill increases the adjusted gross income threshold for the phaseout of the mortgage insurance premium tax deduction and makes such deduction permanent.

Dairy Farm Resiliency Act This bill updates the Dairy Margin Coverage (DMC) program. (The DMC program was enacted in the 2018 farm bill to support dairy operations by allowing producers to buy a guaranteed margin for their milk production. The margin is the difference between the Department of Agriculture's [USDA's] national all milk price and a calculated feed cost, which provides producers optional risk protection on price and feed costs.) The bill requires that a dairy operation's production history for DMC be based on the most recent three-year history and be recalculated every five years. (A participating dairy producer must have an established milk production history with USDA's Farm Service Agency.) The bill also increases Tier 1 margin coverage for annual milk production to 6 million pounds or less (currently 5 million pounds or less) and Tier 2 margin coverage to over 6 million pounds (currently over 5 million pounds).

Disaster Mitigation and Tax Parity Act of 2023 This bill excludes from gross income, for income tax purposes, any qualified catastrophe mitigation payment made under a state-based catastrophe loss mitigation program. A qualified catastrophe mitigation payment means any amount received for making improvements to an individual's property for the sole purpose of reducing the damage that would be done to such property by a windstorm, earthquake, or wildfire.

Protecting Small Business Information Act of 2023 This bill requires the Department of the Treasury to ensure all rules issued under the Corporate Transparency Act have the same effective date. Any final rules already issued must not take effect until all final rules under the act have been issued. The act requires companies to report beneficial ownership information (i.e., the identity of individuals behind a corporate entity) to the Financial Crimes Enforcement Network (FinCEN).

Dillon's Law This bill requires the Department of Health and Human Services to give preference when awarding certain grants for preventive health service programs to states that (1) allow all trained individuals to administer epinephrine, and (2) provide civil liability protections related to that administration.

Milk is Indisputably Liked by Kids Act of 2023 or the MILK Act of 2023 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture. Currently, schools participating in the program may provide lactose-free and flavored and unflavored milk. Under the bill, these schools must offer students flavored milk and maintain the discretion to offer lactose-free milk and unflavored milk.

No Free TRIPS Act This bill prohibits the U.S. government from negotiating or concluding any withdrawal from or modification to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) without explicit authorization from Congress. The TRIPS Agreement is one of several international agreements that led to the creation of the World Trade Organization (WTO). In October 2020, in response to the COVID-19 pandemic, several WTO members proposed a waiver of some TRIPS obligations, including obligations related to national patent laws.

This joint resolution nullifies the final rule issued by the Consumer Financial Protection Bureau titled Small Business Lending under the Equal Credit Opportunity Act (Regulation B) and published on May 31, 2023. The rule requires financial institutions to collect and report to the bureau credit application data for small businesses. On July 31, 2023, the U.S. District Court for the Southern District of Texas ordered the bureau not to implement or enforce the rule until a related pending case is resolved.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Travel Trailer and Camper Tax Parity Act This bill modifies the tax deduction for floor plan financing interest to include in the term motor vehicles eligible for such financing any trailer or camper that is designed to provide temporary living quarters for recreational, camping, or seasonal use and is designed to be towed by, or affixed to, a motor vehicle.
