Volunteer Protection Act of 1989 - Prescribes circumstances under which volunteers working for nonprofit organizations or government entities shall be immune from personal financial liability for acts on behalf of the organization or entity. Sets forth exceptions to and conditions on the granting of such immunity that a State may impose. Requires the Secretary of Health and Human Services to increase by one percent the fiscal year allotment which would otherwise be made to a State to carry out the Social Services Block Grant Program under title XX of the Social Security Act if such State has, within two years, certified to the Secretary that it has enacted a State law which provides such immunity. Provides for the continuation of such increase based on an annual recertification.

States the sense of the Congress that the President or the Congress should immediately abrogate the Panama Canal Treaties of 1977 and the Treaty Concerning the Permanent Neutrality and Operation of the Panama Canal and that the Congress should repeal the Panama Canal Act of 1979.

Directs the Comptroller General to conduct an annual audit of the Federal Reserve Board, the Federal Advisory Council, the Federal Open Market Committee, and all Federal Reserve banks and their branches. Requires the Comptroller General, within six months after the end of each fiscal year, to report to the Congress on the results of such audit.

Establishes the Medicare Geographical Classification Review Board to decide on a rural hospital's application for classification as an urban hospital for Medicare payment purposes. Amends the Omnibus Budget Reconciliation Act of 1987 to alter the Rural Health Care Transition Grant Program to extend and increase authorized appropriations for such program through FY 1992, and permit the Secretary to waive the hospital grant limit. Expands, from four to ten hospitals, a Medicare demonstration program covering additional costs incurred by teaching hospitals in sending their residents to rural hospitals for training. Requires the Secretary to establish five-year Medicare demonstration programs covering costs incurred by five hospitals in providing clinical training to undergraduate nurses. Extends the regional referral center classification of hospitals so classified as of September 30, 1989, and the payment rates applicable to such hospitals under the Medicare program, through FY 1994.

Amends Federal law regarding stock-raising homesteads to require a written notice to the surface owner before a person may enter lands for prospecting purposes. Authorizes the search for outcrop or surface exposure or mineral deposits by non-mechanized means, but precludes road construction, or the use of explosives or earth-moving equipment. Sets forth conditions under which plans of operation for mineral exploration and development may be pursued. Authorizes a surface owner to petition the Secretary of the Interior for compensation for damages. Requires the Secretary of the Interior to suspend or revoke the approval of a mining or prospecting plan of operations if the mine operator fails to remedy any plan violations. Sets forth conditions under which treble damages may be awarded to an aggrieved surface owner.

National Observance Advisory Act - Establishes the President's Advisory Commission on National Observances to: (1) establish criteria for recommending to the President that a proposed national observance be approved or disapproved; (2) review proposals for national observances submitted in accordance with procedures published by the Commission; and (3) issue recommendations to the President concerning each proposal reviewed.

Smoking Cost Recovery and Education Tax Act of 1989 - Amends the Internal Revenue Code to increase all existing Federal excise taxes on tobacco products. Imposes a new tax of $1.17 per pound on cigarette tobacco manufactured in or imported into the United States. Establishes in the Treasury the Smoking Cost Recovery and Education Trust Fund, to be available to finance educational programs (including paid advertising) concerning the hazards of cigarette smoking, with emphasis on discouraging smoking by youth. Appropriates to the Fund ten percent of the increase in tobacco tax revenue generated as a result of this Act. Directs the Secretary of the Treasury to conduct an ongoing study and to report biennially to specified congressional committees on: (1) the effects of smoking on health care costs; and (2) the incidence of cigarette smoking by youth, including the relationship between cigarette tax rates and youth smoking.

Amends the Internal Revenue Code to allow an income tax deduction for interest on any indebtedness incurred to pay the educational expenses of the taxpayer, spouse, or dependent. (Under current law, such a loan must be secured by an interest in real property.)

Protect Medicare 90 Concurrent Resolution - Expresses the sense of the Congress that Medicare (title XVIII of the Social Security Act) hospital payments for FY 1990 should not be reduced below levels set by current law for such fiscal year.

Adolescent Tobacco Education and Prevention Act - Amends the Drug-Free Schools and Communities Act of 1986 to include instruction relating to the use of tobacco products as an activity under drug and alcohol abuse prevention and education programs. Requires such instruction to include: (1) the variety of tobacco products available; (2) the physical and psychological effects on the human body of the inhalation of tobacco smoke, ingestion of tobacco products, and any other use of tobacco products; (3) the addictive nature of such products; and (4) the connection between use of tobacco products and other forms of substance abuse, specifically use of marijuana and alcohol abuse. Prohibits the sale of tobacco products to any person under the age of 18 or such other age as a State may establish. Requires such products to be sold over-the-counter by the legal owner, proprietor, or designated employee of an establishment. Requires the posting of a conspicuous sign in such establishment which states that the sale of cigarettes to minors is prohibited. Establishes fines for violations.

Amends Internal Revenue Code provisions relating to the income tax deduction for the health insurance costs of self-employed individuals to: (1) increase from 25 percent to 100 percent the allowable deduction; and (2) make the deduction permanent (under current law it will expire after tax year 1989).

Expresses the sense of the Congress that the U.S. flag should be treated with respect, that public desecration of the flag is not symbolic speech under the First Amendment of the U.S. Constitution, and that Federal provisions prohibiting the willful and knowing display of contempt for the flag should be enforced.

Aircraft Cabin Air Quality Protection Act of 1989 - Amends the Federal Aviation Act of 1958 to require air carriers to prohibit smoking on any aircraft during any flight involving the carriage of passengers in interstate or overseas air transportation. Directs the Administrator of the Federal Aviation Administration to promulgate regulations to implement this Act. Declares that it is unlawful to smoke during any flight involving the carriage of passengers in interstate or overseas air transportation.

Beverage Container Reuse and Recycling Act - Prohibits the sale of beer, mineral water, soda water, or carbonated soft drinks in beverage containers by retailers and distributors unless such containers carry a refund value of not less than five cents. Requires that retailers and distributors pay the refund on returned containers of brands sold by such retailers or distributors. Prohibits distributors and retailers from selling beverages in metal beverage containers with detachable openings. Preempts inconsistent State or local laws. Prohibits State and local governments from imposing any tax on the collection or return of refund values. Imposes penalties of up to $1,000 for violations.

United States Coast Guard Bicentennial Medal Act - Directs the Secretary of the Treasury to design, strike, and sell a medal in commemoration of the bicentennial of the U.S. Coast Guard in 1990. Requires the design of the medal to be selected by the Secretary of the Treasury after consultation with the Secretary of Transportation and the Commission of Fine Arts.

Amends Federal law to require the reverse side of the first coin redesigned to commemorate the bicentennial of the U.S. Constitution for a two-year period. Provides that the design on the obverse side of U.S. coins shall contain the likenesses of those displayed on current coins and shall be considered for redesign. Requires any such obverse redesigns to conform to the inscription requirements of current law. Requires U.S. coins to be redesigned, at the discretion of the Secretary of the Treasury, over the next six years. Requires the Secretary, in selecting new designs, to consider specified constitutional concepts. Requires the designs to be selected by the Secretary upon consultation with the United States Commission of Fine Arts. Requires that any profits from the sale of uncirculated and proof sets of U.S. coins be deposited in the Treasury and used solely to reduce the national debt.

Catastrophic Coverage Election Act of 1989 - Amends title XVIII (Medicare) of the Social Security Act and the Internal Revenue Code to permit individuals to elect not to receive benefits to which such individuals are entitled as a result of the enactment of the Medicare Catastrophic Coverage Act of 1988 and not to pay premiums imposed pursuant to such Act. Requires that beneficiaries be notified of such option.

Constitutional Amendment - Proclaims the English language to be the official language of the United States. Prohibits the United States or any State from requiring the use of any other language. States that this article shall not prohibit any law, program, or policy to: (1) provide educational instruction in a language other than English for the purpose of making students proficient in English; (2) teach a foreign language to students who are already proficient in English; (3) protect public health and safety; or (4) allow translators for litigants, defendants, or witnesses. Authorizes the Congress and the States to enforce this article by appropriate legislation.

Coal Pipeline Act of 1989 - Amends the Mineral Lands Leasing Act of 1920 to authorize a person who has secured specified water rights under State law to apply to the Secretary of the Interior for certification that it is in the national interest to construct, operate, or extend a coal pipeline. Conditions such certification upon an applicant's reservation of a specified portion of total pipeline capacity for small, independent producers located in the geographic region served by such pipeline. Makes all Federal and State environmental laws applicable to the issuance or denial of such certification. Proscribes the granting of any right-of-way through lands: (1) designated as wilderness areas; (2) administered as part of the national park system; or (3) which are part of a historic site (unless there is no reasonable alternative and reasonable planning is made to minimize the harm of such site). Prohibits any person or entity (including the United States) from claiming any right or interest in water within any State for a coal pipeline unless such claim takes place under the law of the affected State. Delegates to the States all power regarding water rights for a coal pipeline. States that this Act does not: (1) impair the validity of any State law (or interstate compact) regarding any claim to water rights; (2) alter the rights of any State to its apportioned share of water under past or future allocation or interstate compact; (3) affect any Indian water rights; or (4) preempt or otherwise affect any State or Federal law or interstate compact regarding water quality or disposal. Prohibits any State acting under authority of this Act from restricting the movement through such State of water acquired in another State and within a coal pipeline. Authorizes certain persons who have received a certification from the Secretary that it is in the national interest to operate or extend a coal pipeline to acquire rights-of-way through private lands by the power of eminent domain. States this Act shall not be construed to permit any person (including the United States) to acquire any water rights through the power of eminent domain. Prohibits the acquisition of any right-of-way through the power of eminent domain if such right-of-way is upon land which is part of a historic site unless there is no prudent alternative and reasonable planning is made to minimize harm to such site. Provides for an antitrust review of applications for certification by the Attorney General. Requires each pipeline carrier for which a certification has been issued to provide service on reasonable request. Prohibits such carriers from unreasonably discriminating or refusing to enter into contracts with coal shippers under similar conditions in a contemporaneous period. States that this Act shall not be construed to modify or preempt the ratemaking authority of any State utility regulatory agency. Requires the Secretary to establish uniform Federal standards for coal pipeline safety. Establishes penalties for failure to comply with such safety standards.

Congressional Pay Reform Act of 1987 - Amends the Legislative Reorganization Act of 1946 to specify that pay adjustments for Members of Congress shall become effective on March 1 following the beginning of the next Congress after the Congress during which such adjustment is approved. Amends the Federal Salary Act to require the President to transmit to the Congress, within a specified time period, recommendations for rates of pay of Members of Congress and legislative and judicial employees. (Currently such recommendations are included in the Federal budget.) Prohibits the House of Representatives and the Senate from considering any bill or joint resolution carrying an appropriation for compensation of Members of Congress for any fiscal year if it carries an appropriation, or a limitation of appropriations, for any other purpose. Requires a recorded vote on such bill or resolution.

Relinquishes all U.S. interests under a conservation easement in specified lands in Wood County, Texas, whenever a water resource project that will affect such land is started on or by January 1, 2000.

Fire Safe Cigarette Act of 1989 - Directs the Consumer Product Safety Commission to issue by rule a fire safety standard for cigarettes. Prohibits stockpiling of cigarettes between the issuing and effective dates of the standard. Provides for judicial review of the standard. Prohibits manufacture or importing of cigarettes unless in compliance with a standard issued under provisions of this Act. Declares violation of the prohibition to be a violation of provisions of the Consumer Product Safety Act. States that this Act and the standard issued under it does not preempt any law of a State which prescribes a more stringent fire safety standard for cigarettes. Prohibits, in any civil action for damages, admitting as a defense compliance with the standard.
