Conscience Protection Act of 2017

Conscience Protection Act of 2017 This bill amends the Public Health Service Act to codify the prohibition against the federal government and state and local governments that receive federal financial assistance for health-related activities penalizing or discriminating against a health care provider based on the provider's refusal to be involved in, or provide coverage for, abortion. Health care providers include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers. The Office for Civil Rights of the Department of Health and Human Services, in coordination with the Department of Justice (DOJ), must investigate complaints alleging discrimination based on an individual's religious belief, moral conviction, or refusal to be involved in an abortion. DOJ or any entity adversely affected by such discrimination may obtain equitable or legal relief in a civil action. Administrative remedies do not need to be sought or exhausted prior to commencing an action or granting relief. Such an action may be brought against a governmental entity.

Modern Employment Reform, Improvement, and Transformation Act of 2017 or the MERIT Act of 2017 This bill establishes an alternative mechanism for the expedited removal by agency heads of federal employees for performance or misconduct by: (1) limiting an appeal to the Merit Systems Protection Board (MSPB) to appeals made not later than 7 days after the date of such removal; and (2) making inapplicable to removals employee protections affording employees at least 30 days advance written notice of the proposed action and a reasonable time to answer the proposal orally and in writing, representation by an attorney, and a written decision. Upon receipt of an appeal, the MSPB shall issue a decision not later than 30 days after the date of the appeal. In any case in which an MSPB judge cannot issue a decision in accordance with such 30-day requirement, the removal is final. The MSPB: (1) shall uphold the decision of the agency head to remove an employee if the decision is supported by substantial evidence; and (2) may not stay any removal unless the basis for the appeal of such removal is related to certain prohibited personnel practices.

United States Commission on the Organization of Petroleum Exporting Countries Act of 2017 This bill establishes the United States Commission on the Organization of Petroleum Exporting Countries (OPEC) to investigate and address any practices on the part of OPEC that prevent or reduce competition in the global oil market. The Commission shall be composed of a bipartisan group of 16 experts on energy and related matters chosen by the leadership of both parties in Congress and appointed by the President. All members of the Commission must be U.S. citizens. The bill requires the Commission to: determine whether the anti-competitive behavior of OPEC is designed to disadvantage U.S. oil producers; assess the impact of OPEC's policies on U.S. economic and energy security interests; assess how federal agencies are working to alleviate the potential negative impacts of OPEC's behavior; and produce policy recommendations for tax, trade, defense, diplomacy, and other areas where OPEC's behavior is found to cause adverse impacts. The Commission must submit a report of its findings and recommendations to Congress and the President within 12 months. The Commission shall terminate within 90 days after submission of its report. On receipt of the Commission's report, the President will have 90 days to submit Congress a proposal to implement or respond to the recommendations.

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide each veteran who submits a claim for VA benefits with an opportunity to permit a covered congressional employee in the office of the veteran's Member of Congress to have read-only access to all of the veteran's records in the Veterans Benefits Administration databases. A Member may designate up to two such covered congressional employees. A covered congressional employee may not be recognized as an agent or attorney with respect to veterans' benefit claims. Funds under this bill may not be used to design or administer any training for covered congressional employees. The bill makes funds available for FY2018 through FY2021 for such congressional employee access program.

Heartbeat Protection Act of 2017 This bill amends the federal criminal code to make it a crime for a physician to knowingly perform an abortion: (1) without determining whether the fetus has a detectable heartbeat, (2) without informing the mother of the results, or (3) after determining that a fetus has a detectable heartbeat. It provides an exception for an abortion that is necessary to save the life of a mother whose life is endangered by a physical (but not psychological or emotional) disorder, illness, or condition. A physician who performs a prohibited abortion is subject to criminal penalties—a fine, up to five years in prison, or both. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Iraq and Syria Genocide Relief and Accountability Act of 2017 This bill directs the Department of State to provide assistance to entities taking specified criminal and judicial actions against individuals who are suspected of committing genocide, crimes against humanity, or war crimes in Iraq since January 2014 or in Syria since March 2011. The State Department shall encourage foreign governments to identify and prosecute individuals who are suspected of committing such crimes, including members of foreign terrorist organizations operating in Iraq or Syria. The Department of Justice shall review existing criminal statutes concerning genocide, crimes against humanity, and war crimes to determine: the extent to which U.S. courts have jurisdiction over such crimes where the perpetrators or victims are U.S. nationals, residents, or persons present in a U.S. territory; current statutes that would apply to such conduct and whether additional statutory authorities are necessary; and the extent to which the absence of criminal statutes defining the crimes or granting jurisdiction impede their prosecution in U.S. courts. The State Department shall identify: threats of persecution, genocide, crimes against humanity, and war crimes against members of Iraqi or Syrian religious or ethnic groups that are minorities in Iraq or in Syria with respect to whom the Islamic State of Iraq and Syria (ISIS) has committed such crimes in Iraq or Syria since January 2014, or who are members of other persecuted religious or ethnic groups; humanitarian, stabilization, and recovery needs of these individuals; and assistance provided by the United States, the U.N., and other entities, including faith-based entities. Aliens who are, or were, a national and a resident of Iraq or Syria, and who share common characteristics that identify them as targets of persecution on account of membership in a religious or ethnic minority in that country: (1) are deemed to be of special humanitarian concern to the United States; and (2) shall be eligible for priority-2 processing under the refugee resettlement priority system. The Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1990 is amended to extend: (1) refugee set-asides for nationals of the former Soviet Union, Estonia, Latvia, or Lithuania; and (2) the period of eligibility for status adjustment from a parolee who was denied refugee status to a lawfully admitted permanent resident for certain aliens from the former Soviet Union, Estonia, Latvia, Lithuania, Vietnam, Laos, or Cambodia.

Fairness for High-Skilled Immigrants Act of 2017 This bill amends the Immigration and Nationality Act to: (1) eliminate the per-country numerical limitation for employment-based immigrants, and (2) increase the per-country numerical limitation for family-based immigrants from 7% to 15% of the total number of family-sponsored visas. The Chinese Student Protection Act of 1992 is amended to eliminate the provision requiring the reduction of annual Chinese immigrant visas to offset status adjustments under such Act. The bill establishes a transition period during which a percentage of employment-based second and third preference (EB-2 and EB-3) immigrant visas are reserved as follows: for FY2017, 15% of such visas are allotted to natives of countries other than the two countries with the largest aggregate numbers of natives obtaining such visas in FY2011; for FY2018, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2012; and for FY2019, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2015. During the transition period, not more than 25% of the total number of the reserved EB-2 and EB-3 visas shall be allotted to natives of a single country. For FY2015-FY2017, not more than 85% of the unreserved EB-2 and EB-3 visas shall be allotted to natives of a single country. Amendments made by this bill shall apply beginning in FY2017.

State Sponsors of Terrorism Review Enhancement Act This bill amends the Foreign Assistance Act of 1961, the Arms Export Control Act, and the Export Administration Act of 1979, with respect to the rescission of a determination of a country as a state sponsor of terrorism, to require that the President has submitted to Congress a report justifying such rescission 90 days (currently 45 days) prior to the rescission taking effect, which certifies that the government concerned has not provided support for international terrorism during the preceding 24 months (currently 6 months). No such rescission under the Foreign Assistance Act of 1961 or the Export Administration Act of 1979 may be made if Congress, within 90 days after receipt of such a presidential report, enacts a joint resolution pursuant to the Arms Export Control Act prohibiting such rescission.

Default Prevention Act This bill requires the Department of the Treasury to continue to borrow to pay the principal and interest on certain obligations if the debt of the United States exceeds the statutory limit. If the debt limit is exceeded, Treasury must issue obligations solely for the payment of the principal and interest on debt held by the public or the Social Security trust funds. Obligations issued under this bill may not be used to compensate Members of Congress. If Treasury exercises authority provided by this bill, it must submit to Congress a report that includes an accounting of: (1) the principal on mature obligations and interest that is due or accrued, and (2) obligations issued under this bill.

Email Privacy Act This bill amends the federal criminal code to revise provisions that limit an electronic communication service (ECS) or remote communication service (RCS) provider from disclosing the contents of a wire or electronic communication that is in electronic storage. Additionally, it revises the standards for the government to compel an ECS or RCS provider to disclose contents of a wire or electronic communication or noncontent records or information pertaining to a subscriber or customer. An ECS or RCS provider may notify a subscriber or customer of the receipt of a warrant, court order, subpoena, or request, unless the government obtains an order for delayed notification. The bill revises the process for obtaining a delayed notification order and lengthens the maximum duration of a delayed notification order.

Defund Planned Parenthood Act of 2017 This bill prohibits, for a one-year period, the availability of federal funds for any purpose to Planned Parenthood Federation of America, Inc., or any of its affiliates or clinics, unless they certify that the affiliates and clinics will not perform, and will not provide any funds to any other entity that performs, an abortion during such period. This restriction does not apply in cases of rape or incest or where a physical condition endangers a woman's life unless an abortion is performed. The Department of Health and Human Services and the Department of Agriculture must seek repayment of federal assistance received by Planned Parenthood Federation of America, Inc., or any affiliate or clinic, if it violates the terms of the certification required by this bill. Additional funding for community health centers is provided for the one-year period described above.

American Health Care Reform Act of 2017 This bill repeals the Patient Protection and Affordable Care Act and the health care provisions of the Health Care and Education Reconciliation Act of 2010, effective January 1, 2018. The bill restores provisions amended by the repealed provisions. This bill amends the Internal Revenue Code to allow an income tax standard deduction for health insurance. Provisions regarding health savings accounts (HSAs) are revised, including to raise contribution limits and to expand the products and services that may be paid for using an HSA. Group health plans may vary premiums and cost-sharing based on participation in a wellness program. This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to provide grants to states for high risk health insurance pools. Individual health insurance coverage is governed by the laws of a state designated by the health insurance issuer. The Center for Medicare and Medicaid Services must publish Medicare claims and payment data. This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for association health plans, which are group health plans sponsored by certain business associations. Veterans with certain service-related disabilities or who have been awarded a medal of honor must be provided access to medical services though specified entities other than the Department of Veterans Affairs. Independent medical review panels must review health care lawsuits in which the defendant alleges adherence to clinical practice guidelines. Federal courts have jurisdiction over health care lawsuits. This bill amends the Balanced Budget and Emergency Deficit Control Act of 1985 to revise non-security discretionary spending limits.

Concealed Carry Reciprocity Act of 2017 This bill amends the federal criminal code to allow a qualified individual to carry a concealed handgun into or possess a concealed handgun in another state that allows individuals to carry concealed firearms. A qualified individual must: (1) be eligible to possess, transport, or receive a firearm under federal law; (2) carry a valid photo identification document; and (3) carry a valid concealed carry permit issued by any state or be eligible to carry a concealed firearm in his or her state of residence. Additionally, the bill specifies that a qualified individual who lawfully carries or possesses a concealed handgun in another state: (1) is not subject to the federal prohibition on possessing a firearm in a school zone, and (2) may carry or possess the concealed handgun in federally owned lands that are open to the public.

Pain-Capable Unborn Child Protection Act This bill amends the federal criminal code to make it a crime for any person to perform or attempt to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, up to five years in prison, or both. The bill provides exceptions for an abortion: (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Regulations from the Executive in Need of Scrutiny Act of 2017 This bill revises provisions relating to congressional review of agency rulemaking. A federal agency promulgating a rule must publish information about the rule in the Federal Register and include in its report to Congress and to the Government Accountability Office: (1) a classification of the rule as a major or nonmajor rule, and (2) a copy of the cost-benefit analysis of the rule that includes an analysis of any jobs added or lost.  A "major rule" is any rule that the Office of Information and Regulatory Affairs of the Office of Management and Budget finds results in: (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. A joint resolution of approval must be enacted within 70 session days or legislative days after the agency proposing a major rule submits its report on such rule to Congress in order for the rule to take effect. A major rule may take effect for 90 days without such approval if the President determines it is necessary because of an imminent threat to health or safety or other emergency, for the enforcement of criminal laws, for national security, or to implement an international trade agreement. The bill sets forth the congressional approval procedure for major rules and the congressional disapproval procedure for nonmajor rules. A joint resolution addressing a report classifying a rule as a major rule must be introduced within three legislative days in the House of Representative and three session days in the Senate. The bill prohibits any amendments to, and provides for expedited consideration of, such a joint resolution. A court may review whether an agency has completed the necessary requirements under this bill for a rule to take effect. The bill limits the effect of a joint resolution of approval of a major rule. The Balanced Budget and Emergency Deficit Control Act of 1985 is amended to provide that any congressional approval procedure set forth in this bill affecting budget authority, outlays, or receipts shall be assumed to be effective unless it is not approved in accordance with this bill.

Separation of Powers Restoration Act of 2017 This bill modifies the scope of judicial review of agency actions to authorize courts reviewing agency actions to decide de novo (without giving deference to the agency's interpretation) all relevant questions of law, including the interpretation of: (1) constitutional and statutory provisions, and (2) rules made by agencies. No law may exempt such a civil action from the application of the amendments made by this bill except by specific reference to these provisions.

Declares that: any future measures taken in international or outside organizations to impose an agreement including the recognition of a Palestinian state will set back the cause of peace, harm the security of Israel, run counter to the enduring bipartisan consensus on strengthening the U.S.-Israel relationship, and weaken support for such organizations; a sustainable peace agreement between Israel and the Palestinians will come only through direct bilateral negotiations between the parties resulting in a Jewish, democratic state living next to a demilitarized Palestinian state in peace and security; the United States should work to facilitate direct negotiations between the parties without preconditions toward a peace agreement; and the U.S. government should oppose and veto future Security Council resolutions that seek to impose solutions to final status issues or that are one-sided and anti-Israel. Declares that the House opposes Security Council Resolution 2334 and will work to strengthen the U.S.-Israel relationship. Calls for such resolution to be repealed or fundamentally altered.

ENLIST Act

Encourage New Legalized Immigrants to Start Training Act or the ENLIST Act This bill authorizes the enlistment in the Armed Forces of aliens unlawfully present in the United States on December 31, 2012, who: (1) have been continuously present in the United States since such date; (2) were younger than 15 years of age when they initially entered the United States; and (3) are otherwise eligible for original enlistment in a regular component of the Army, Navy, Air Force, Marine Corps, or Coast Guard. The Department of Homeland Security shall adjust the status of an alien enlisted under such authority to the status of an alien lawfully admitted for permanent residence under provisions of the Immigration and Nationality Act applicable to aliens who entered the United States prior to January 1, 1972. The bill rescinds such lawful permanent resident status if the alien is separated from the Armed Forces under other than honorable conditions before serving the term of enlistment.

Tax Code Termination Act

Tax Code Termination Act This bill terminates the Internal Revenue Code of 1986 after December 31, 2021, except for self-employment taxes, Federal Insurance Contributions Act (FICA) taxes, and railroad retirement taxes. A two-thirds majority vote in Congress is required to change such termination date. The bill declares that any new federal tax system should be a simple and fair system that: (1) applies a low rate to all Americans, (2) provides tax relief for working Americans, (3) protects the rights of taxpayers and reduces tax collection abuses, (4) eliminates the bias against savings and investment, (5) promotes economic growth and job creation, and (6) does not penalize marriage or families. The new federal tax system must be approved by Congress in its final form by July 4, 2021.

Systemic Risk Designation Improvement Act of 2016 This bill amends the Dodd-Frank Wall Street Reform and Consumer Protection Act to authorize the Financial Stability Oversight Council (FSOC) to subject a bank holding company to enhanced supervision and prudential standards by the Board of Governors of the Federal Reserve System if FSOC makes a final determination that material financial distress at the bank holding company, or the nature, scope, size, scale, concentration, interconnectedness, or mix of its activities, could threaten the financial stability of the United States. This FSOC determination procedure replaces the current process under which bank holding companies with total consolidated assets of $50 billion or more are automatically subject to such enhanced supervision and prudential standards. FSOC's determination must be based upon specified factors, using an indicator-based measurement approach established by the Basel Committee on Banking Supervision to determine systemic importance. A bank holding company designated as a Global Systemically Important Bank by the Financial Stability Board, as of this bill's enactment, shall be deemed to have been the subject of a final determination that it could pose a threat to U.S. financial stability for any of those reasons.

Geospatial Data Act of 2016 This bill establishes: (1) in the Office of Management and Budget (OMB) the Federal Geographic Data Committee (the committee), which shall be the lead entity in the executive branch for the development, implementation, and review of policies, practices, and standards relating to geospatial data; and (2) in the executive branch the National Geospatial Advisory Committee to provide advice and recommendations to the committee. The National Spatial Data Infrastructure (as defined in this bill) shall ensure that geospatial data from multiple sources is available and easily integrated to enhance the understanding of the physical and cultural world. The committee shall prepare a strategic plan for the implementation of the infrastructure consistent with national security, national defense, and emergency preparedness program policies regarding data accessibility. The committee shall operate GeoPlatform, an electronic service that provides access to geospatial data and metadata for geospatial data. Agencies whose functions involve geospatial data shall implement a strategy for advancing geographic information and related geospatial data activities appropriate to that agency's mission in support of the strategic plan for the infrastructure. Such agencies shall disclose each contract, cooperative agreement, grant, or other transaction that deals with geospatial data. Four years after enactment of this bill, federal funding shall not be made available for the collection, production, acquisition, maintenance, or dissemination of geospatial data that does not comply with applicable standards established by the committee. The committee and agencies using geospatial data shall rely upon and use private individuals and entities for the acquisition of commercially available surveying and mapping and the provision of geospatial services, to the maximum extent practical.
