Federal Prison Industries Competition in Contracting Act of 2003 - Amends the Federal criminal code to replace provisions regarding the purchase of prison-made products by Federal departments with provisions establishing a Government-wide procurement policy relating to purchases from Federal Prison Industries (FPI), which shall generally require the use of competitive procedures. Requires that an analysis of the probable impact of a proposed expansion of sales within the Federal market by FPI on private sector firms and their non-inmate workers be made whenever FPI proposes to authorize the sale of a new specific product or service or to expand production of a current product or service. Authorizes FPI to enter into a contract with a Federal contractor to produce products as a subcontractor or supplier in the performance of a Federal procurement contract. Establishes within the Bureau of Prisons: (1) the Enhanced In-Prison Educational and Vocational Assessment and Training Program; and (2) the Cognitive Abilities Assessment Demonstration Program. Directs: (1) the Chief Operating Officer of FPI to develop proposals to have FPI donate products and services to eligible entities that provide goods or services to low-income individuals who would likely otherwise have difficulty purchasing such products or services; (2) the Director of the Bureau to afford to inmates opportunities to participate in programs and activities designed to help prepare such inmates to obtain employment upon release; (3) the Attorney General to establish the Federal Reentry Center Demonstration Project; and (4) the Comptroller General to undertake to have an independent study conducted on the effects of eliminating FPI's mandatory source authority.

Job Protection Act of 2003 - Amends the Internal Revenue Code to repeal the foreign sales corporation/extraterritorial income (FSC/ETI) exclusion, with an exemption for certain binding contracts in effect before the date of enactment of this Act. Permits a foreign corporation that elected to be treated as a domestic corporation to revoke such election and be treated as a domestic corporation transferring its property to a foreign corporation with no gain recognized on such transfer. Provides: (1) a transitional 2004 through 2008 sliding-scale deduction for an FSC/ETI beneficiary based on the corporation's 2001 FSC/ETI benefit; and (2) special rules for 2003 and for fiscal year taxpayers. Defines "FSC/ETI benefit." Allows a deduction for income attributable to U.S. production activities equal to ten percent of qualified production activities. Provides a 2006 through 2009 phase-in period. Defines "qualified production activities" as: (1) the portion of the modified taxable income attributable to domestic activities; and (2) the domestic/foreign fraction. Sets forth related provisions with respect to: (1) determination of income attributable to domestic production activities; (2) domestic production gross receipts; (3) qualifying production property; (4) domestic/foreign fraction; and (5) special rules.

Requires the Secretary to establish a formula for determining the allocation of payments, with priority consideration to the relative unemployment rate, median income, population, and poverty rate. Permits the use of funds received by States and local governments only for: (1) ordinary and necessary maintenance and operating expenses for education; public safety; public health; social services; roads, transportation, and water infrastructure; and housing; and (2) ordinary and necessary capital expenditures authorized by law.

Pension Benefits Protection Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code of 1986 (the Code) to protect pension benefits of employees in defined benefit (DB) plans, and to ensure that age discrimination laws are applied to conversions to cash balance plans and other such plans that are hybrids of DB's and defined contribution plans. Requires ERISA, the Code, and the Age Discrimination Act of 1967 to be applied and administered without regard to certain proposed regulations of the Secretary of the Treasury that relate to reductions of accruals and allocations because of the attainment of any age, and to application of nondiscrimination cross-testing rules to cash balance plans. Amends ERISA and the Code to protect certain DB plan participants from forced conversions to hybrid DB plans by plan amendments which change the way the accrued benefit to participants or beneficiaries are expressed and which reduce the rate of future benefit accrual of one or more participants. Requires employers, at the time such amendment takes effect, to provide employees who have attained 40 years of age or 10 years of service with certain notices and an election upon retirement to receive benefits as determined either under the plan in effect at time of retirement or under the plan in effect immediately before the plan amendment. Sets forth a formula to determine when a plan amendment adopted by a large (100 or more participants) DB plan shall be treated as wearing away accrued benefits.

Unemployment Benefits Extension Act - Amends the Temporary Extended Unemployment Compensation Act of 2002 (TEUCA) to: (1) extend the TEUC program; (2) provide for additional weeks of TEUC benefits; (3) revise unemployment rate triggers for TEUC benefit periods; and (4) provide for regular unemployment compensation for certain individuals based on part-time work or an alternative base period. Extends the TEUC program through weeks of unemployment ending before December 28, 2003. Provides a phaseout period for individual payments up to weeks beginning after July 31, 2004. Increases to 26 weeks an eligible individual's TEUC payments. Provides for an additional seven weeks of payments, for a total of 33 weeks, for individuals in high-unemployment States (TEUC-X). (Current law provides 13 weeks of regular TEUC payments, with an additional 13 and total 26 in TEUC-X States.) Revises requirements for determining TEUC-X States, using certain triggers based on insured unemployment rates and on total unemployment rates. Establishes a program of payments to States to provide regular unemployment compensation benefits for individuals who otherwise would be ineligible because: (1) the base period does not count wages earned in the most recently completed calendar quarter; or (2) the individuals seek or are available for less than full-time work.

R.S. 2477 Rights-of-Way Act of 2003 - Permits the filing of claims asserting the existence and validity of right-of-ways pursuant to a repealed section of the Revised Statutes (R.S. 2477) to build highways across public land not reserved for public uses. Declares that claimants shall have the burden to prove that the grant of a right-of-way was validly accepted and not abandoned. Presumes abandoned claims involving lands within a conservation system unit, an inventoried roadless area, or a wilderness study area or that are former Federal lands, unless use was open and notorious. Directs an authorized Federal officer to review the evidence put forth by a claimant that: (1) a R.S. 2477 right-of-way contains sufficient evidence to prove prior construction and use of a highway over unreserved public lands; and (2) if there is evidence of such a highway, that the right-of-way was not abandoned. Subjects the administrative record of a final decision of an authorized Federal officer to judicial review. Allows the United States to retain exclusive possession or control of the lands traversed by a valid right-of-way or any part thereof, upon payment to the claimant of an amount set by the relevant district court. Recognizes the prior adjudication of claimed right-of-ways by courts of competent jurisdiction. States that nothing in this Act shall be construed to alter provisions of: (1) the Federal Land Policy and Management Act of 1976 regarding right-of-ways with respect to public lands and National Forest System lands; or (2) the Alaska National Interest Lands Conservation Act pertaining to Alaska's transportation and utility network.

Quality Cancer Care Preservation Act - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act (SSA) to revise the payment amount for covered drugs and biologicals furnished during a calendar quarter that are not paid on a cost or prospective payment basis. Changes such amount from 95 percent of the average wholesale price to 120 percent of the average sales price of the drug or biological for the second preceding calendar quarter. Requires drug manufacturers to report average sales prices each calendar quarter for covered drugs and biologicals. Directs the Secretary of Health and Human Services to: (1) revise the practice expense relative value units for drug administration services (including chemotherapy administration services) in accordance with this Act to determine the units to be used in determining the fee schedule amounts paid for drug administration services under the Medicare program; (2) recognize and make payments under Medicare for chemotherapy support services furnished incident to physicians' services; (3) recognize and establish a payment amount for the service of cancer therapy management to account for the greater pre-service and post-service work associated with visits and consultations conducted by physicians treating cancer patients compared to typical visits and consultations; and (4) develop a revised methodology for determining the payment amounts for services that are paid under the Medicare fee schedule and that do not have physician work relative value units, including radiation oncology services. Amends SSA title XVIII to provide that if the Secretary requires direct supervision of a service by a physician, that supervision requirement may be fulfilled by one or more physicians other than the physician who ordered the service.

Provides for an exception from current requirements for adjustment of the proportion of the diagnostic-related group (DRG) PPS rates representing hospital costs attributable to wages and wage-related costs. Declares that, for adjustments made for different area wage levels for discharges occurring in FY 2004 and thereafter for disproportionate share hospitals for which the adjustment factor established by the Secretary of Health and Human Services for the fiscal year is less than 1.0, the Secretary shall substitute for the proportion of hospital costs otherwise estimated a proportion of 62 percent.

Medicare Rx Now Act of 2003 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to provide for outpatient prescription drug coverage under Medicare part B (Supplementary Medical Insurance), along with an annual deductible, adjusted for inflation, with a three-tiered copayment structure (with reduced copayments for generic drugs). Allows for high-deductible outpatient prescription drug coverage under such new program with the provision of benefits through Medicare approved prescription drug plans, including a Medicare+Choice plan under Medicare+Choice (Medicare part C). Directs the Secretary to solicit bids from entities to offer prescription drug discount card plans to individuals enrolled under part B as long as the entity offering a prescription drug discount card plan does not offer benefits to designees of the plan in addition to high-deductible prescription drug coverage, access to negotiated prices, and other required benefits under this Act. Outlines benefits for low-income beneficiaries, including eligibility for low-income subsidies under the Medicaid program (SSA title XIX). Provides for changes under Medicaid with respect to the enrollment process, including providing for automatic reenrollment without need to reapply.

Safe School Food Act of 2003 - Amends the Richard B. Russell National School Lunch Act to revise and increase food safety requirements for the school lunch program under such Act and the school breakfast program under the Child Nutrition Act of 1966 (school meals programs). Revises requirements for State or local food safety inspections for school meals programs to increase their frequency to at least twice a year (currently once), and to require State audits and reports on such inspections. Requires school meals programs to include food safety requirements in their procurement contracts. Directs the Secretary of Agriculture (the Secretary) to require: (1) each vendor providing food to school meals programs to supply the Secretary with contact information on each school food supplier of that vendor; and (2) as appropriate, pathogen testing during production of foods purchased for school meals programs. Requires food safety planning by school meals programs, and provides training and technical assistance by the Department of Agriculture for such planning. Directs the Secretary to give appropriate persons an opportunity for voluntary actions to recall and collect food products served in school meals that may present a threat to the public, or, if such actions are not carried out in the required period and manner, require such persons to carry out specified actions, including immediate cessation of distribution of the food product to schools. Directs the Secretary to coordinate such actions with the Secretary of Health and Human Services in case of such actions with respect to food products regulated under the Federal Food, Drug, and Cosmetic Act. Directs the Secretary to establish an advisory committee to help implement an information-sharing database or other method to provide State food safety coordinators and other appropriate persons with up-to-date information regarding food safety concerns relating to food manufacturing, processing, and packing facilities that produce any food purchased or acquired for school meals programs, including recalls by and enforcement actions against the facilities. Provides for designation of State food safety coordinators. Requires the Secretary to carry out certain procedures and take certain actions under the commodities distribution program to ensure the safety of commodities that are to be donated to school meals programs.

Requires such assistance, to the maximum extent feasible, to be provided through nongovernmental organizations (NGOs), and, as appropriate, through governments to establish appropriate norms, standards, and policies related to rehabilitation and issues affecting such individuals. Authorizes the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, to: (1) conduct programs in foreign countries related to individuals with disabilities, including victims of landmines and other victims of civil strife and warfare; and (2) provide grants to NGOs to carry out research, prevention, public awareness, and assistance programs in foreign countries related to such individuals. Requires any such programs in foreign countries to be carried out only in coordination with the Administrator of the United States Agency for International Development (USAID), and upon approval by the Secretary of State. Authorizes the Secretary of Veterans Affairs to provide: (1) advice and expertise on prosthetics, orthotics, physical and psychological rehabilitation and treatment, and disability assistance to other Federal agencies for implementation of assistance programs under this Act; and (2) technical assistance on a reimbursable basis to private voluntary organizations for planning, development, operation, and evaluation of such landmine assistance, research, and prevention programs.

Securing Transportation Energy Efficiency for Tomorrow Act of 2003 - Amends Federal law to authorize the Administrator of General Services to establish a program for the procurement and installation of photovoltaic solar electric systems for electric production in public buildings. Directs the Architect of the Capitol to evaluate the energy infrastructure of the Capitol Complex to determine how it could be augmented to become more energy efficient, using photovoltaic solar energy systems, district-heating, and other unconventional and renewable energy resources. Amends the Public Works and Economic Development Act of 1965 to direct the Secretary of Commerce to carry out a demonstration program for the development of brightfield sites (brownfield sites redeveloped through the incorporation of solar energy technologies). Amends Federal transportation law to: (1) direct the Secretary of Transportation (Secretary) to establish a program of grants to State and local governments for fuel conservation projects; (2) authorize the Secretary to make grants for fuel cell bus technology projects; (3) direct the Secretary to establish a Conserve By Bicycling pilot program for projects to encourage the use of bicycles in place of motor vehicles; (4) require environmental impact statements for Federal-aid highway and transit projects to consider energy impacts as an environmental project consequence; and (5) direct the Secretary to establish a specified public-private research partnership dedicated to advancement of railroad technology, efficiency, and safety owned by the Federal Railroad Administration and operated in the private sector. Amends Federal transportation law to direct: (1) the Secretary to establish a pilot clean airport bus replacement and fleet expansion grant program; and (2) the Administrator of the Federal Aviation Administration to establish a public-private research partnership to develop a clean ground demonstrator engine utilizing specified National Aeronautics and Space Administration-developed technologies. Directs the Secretary to establish a public-private research partnership to develop and demonstrate technologies that increase fuel economy, reduce emissions, and lower costs of marine transportation, as well as the efficiency of intermodal transfers. Directs the Secretary of the Army to study and report to Congress on the potential for reduced fossil fuel consumption through an increase in U.S. hydropower capabilities. Encourages specified adjacent States to continue to prohibit off-shore drilling in the Great Lakes for oil and gas, and other adjacent States and the Canadian Province of Ontario to prohibit such drilling. Amends the Internal Revenue Code to exclude from gross income as a qualifying transportation fringe benefit a commuting allowance of $75 per month for individuals who bicycle, carpool, or car-share to work.

Clean Diamond Trade Act - Directs the President to prohibit the importation into, or exportation from, the United States of any rough diamond, from whatever source, that has not been controlled through the Kimberley Process Certification Scheme (KPCS). Directs the President to require the appropriate Government agency to conduct annual reviews of the standards, practices, and procedures of any entity in the United States that issues Kimberley Process Certificates for the exportation from the United States of rough diamonds to determine whether they accord with the KPCS. Makes the importing authority under this Act the U.S. Bureau of Customs and Border Protection (BCBP) and the exporting authority the Bureau of the Census. Declares that the Congress supports the trade policy that the President take appropriate steps to promote and facilitate the adoption of the KPCS by the international community. Sets forth civil and criminal penalties for violation of this Act. Authorizes the President to direct the appropriate Federal agencies to make available technical assistance, relating to compliance with U.S. trade laws, to countries seeking to implement the Kimberley Process Certification Scheme. Urges the President to work with Participants to strengthen the Kimberley Process Certification Scheme through the adoption of measures for: (1) sharing statistics on rough diamonds production and trade; and (2) monitoring the effectiveness of the KPCS in stemming trade in diamonds whose importation or exportation is not controlled through the KPCS. Urges the executive branch continue to: (1) keep and publish statistics on imports and exports of rough diamonds; (2) make them available for analysis by interested parties and by Participants; and (3) take a leadership role in negotiating a standardized methodology among Participants for reporting such statistics.
