School Guardian Act of 2023 This bill requires the Department of Justice (DOJ) to make grants for states to assign armed law enforcement officers to provide security at elementary and secondary schools. The bill also requires specified unobligated Internal Revenue Service funds to be transferred to DOJ to implement this bill.

This joint resolution nullifies the Environmental Protection Agency rule relating to Federal "Good Neighbor Plan" for the 2015 Ozone National Ambient Air Quality Standards (88 Fed. Reg. 36654) and published on June 5, 2023. The rule ensures that 23 states meet "Good Neighbor" standards required by the Clean Air Act by reducing pollution that significantly contributes to problems attaining and maintaining health-based air quality standards for ground-level ozone in downwind states.

Protecting Small Business Information Act of 2023 This bill requires the Department of the Treasury to ensure all rules issued under the Corporate Transparency Act have the same effective date. Any final rules already issued must not take effect until all final rules under the act have been issued. The act requires companies to report beneficial ownership information (i.e., the identity of individuals behind a corporate entity) to the Financial Crimes Enforcement Network (FinCEN).

U.S.-Israel Partnership and Abraham Accords Enhancement Act of 2023 This bill modifies and extends certain authorities related to Israel. For example, the bill extends the authorization for the Department of Defense (DOD) to transfer certain defense items to Israel; extends the authorization to finance cooperative projects among the United States, Israel, and developing countries related to water resources, agriculture, and energy storage; extends energy cooperation and authorizes the Department of Energy to make grants to Israel to support advanced nuclear technologies, as well as for carbon capture, utilization, and storage; requires the U.S. Agency for International Development to ensure that applicants from Abraham Accord countries are eligible for Middle East Regional Cooperation grants; and requires the Department of State to report to Congress on U.S. diplomatic efforts to oppose politically motivated investigations against the United States and Israel at the International Criminal Court.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Widening Opportunities to Recapture Key Energy Roles Act or the WORKER Act This bill directs the Department of Energy (DOE), when considering awards for existing grant programs, to prioritize education and training for energy and manufacturing-related jobs. Further, DOE must prioritize the education and training of underrepresented groups in such jobs. In carrying out the bill, DOE must establish a clearinghouse to (1) maintain and update information and resources on training and workforce development programs for such jobs; and (2) provide technical assistance for states, schools, and other specified entities. DOE must also conduct outreach to minority-serving institutions of higher education and dislocated energy and manufacturing workers.

Love Lives On Act of 2023 This bill extends entitlement for various benefit programs and services for surviving spouses of deceased members of the Armed Forces or veterans. First, the bill removes the expiration on a surviving spouses' entitlement to educational assistance through the Marine Gunnery Sergeant John David Fry Scholarship (Fry Scholarship). The bill also provides that the remarriage of a surviving spouse must not bar the furnishing of dependency and indemnity compensation to such spouse. Next, the Department of Defense may not terminate the payment of an annuity for a surviving spouse under the Survivor Benefit Plan solely because the surviving spouse remarries. Additionally, the bill provides commissary store and MWR retail facility (e.g., exchange store) access to surviving spouses regardless of the martial status of the spouse. Such spouses must be entitled to use such stores and facilities to the same extent and on the same basis as surviving spouses who did not remarry. The bill expands the definition of a dependent under TRICARE to include a remarried widow or widower whose subsequent marriage has ended due to death, divorce, or annulment. Finally, the bill modifies the definition of a surviving spouse for purposes of veterans benefits to include same sex marriages.

Promoting Access to Treatments and Increasing Extremely Needed Transparency Act of 2023 or the PATIENT Act of 2023 This bill expands hospital price transparency requirements and establishes additional reporting requirements with respect to prescription drugs and pharmacy benefit managers (PBMs). The bill also extends funding for various programs such as the Teaching Health Center Graduate Medical Education program, Community Health Center program, and National Health Service Corps. Specifically, the bill provides statutory authority for the requirement that hospitals publish an annual list of shoppable services they provide, including specified pricing information. Beginning in 2025, a hospital may not use an internet-based price estimator tool to meet the publication requirement for shoppable services. The bill also modifies the health insurance plan disclosure requirements to include the rates for certain in-network services and prescription drug payment information. The bill further requires providers of diagnostic laboratory tests under Medicare to publish online certain price information. Medicare Advantage (MA) organizations must report information about payments made to providers in which the MA organization has an ownership interest. Medicare prescription drug plan sponsors must report certain price information for covered drugs. Additionally, the bill requires health insurance plan issuers (or the PBM providing services on behalf of the plan) to report to the plan sponsor specified information about prescription drugs dispensed under the plan. This includes rebates, fees, alternative discounts, or other remuneration the plan receives from drug manufacturers. Finally, the bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with PBMs under Medicaid.

Medical and Health Stockpile Accountability Act of 2023 This bill requires the Office of the Assistant Secretary for Preparedness and Response, which is a part of the Department of Health and Human Services, to develop an automated application to track the amount of supplies in the Strategic National Stockpile and in similar inventories maintained by states, tribes, territories, and private entities (e.g., hospitals). Additionally, the office must (1) provide for an annual exercise to test the effectiveness of the application, and (2) establish a program to assist health care entities in obtaining automated vendor management systems.

Fiscal State of the Nation Resolution This concurrent resolution requires the congressional budget committees to conduct an annual joint hearing to receive a presentation from the Comptroller General regarding (1) the Government Accountability Office's audit of the financial statement of the executive branch, and (2) the financial position and condition of the federal government.

American Battlefield Protection Program Enhancement Act This bill expands the National Park Service's American Battlefield Protection Program. The bill expands the battlefield acquisition grant program to allow grants to be (1) awarded to Indian tribes and nonprofit organizations, and (2) awarded to acquire certain Revolutionary War or War of 1812 battlefields. The bill expands eligibility for the battlefield restoration grant program to include battlefield land that is owned by a state, tribe, local government, or nonprofit organization. Not later than 2 years after this bill's enactment and every 10 years thereafter, the American Battlefield Protection Program must report to Congress on preservation activities and the condition of battlefields.

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Specifically, this bill applies to motor vehicles manufactured in the United States, imported into the United States, or shipped in interstate commerce after the rule's effective date. The DOT rule must require all such vehicles to have devices that can receive signals and play content transmitted by AM broadcast stations or digital audio AM broadcast stations installed as standard equipment. Prior to the effective date of the rule, manufacturers that do not include devices that can access AM broadcast stations as standard equipment must inform purchasers of this fact through clear and conspicuous labeling. DOT may assess civil penalties against any manufacturer that fails to comply with the mandate. The Department of Justice may also bring a civil action to enjoin a violation. Further, the Government Accountability Office must study and report on whether a reliable alternative communication system exists for delivering emergency alerts and consider the (1) cost to drivers and passengers of receiving communications through an alternative system, and (2) cost and time required to develop and implement an alternative.

National Law Enforcement Officers Remembrance, Support and Community Outreach Act This bill directs the Department of Justice (DOJ) to establish a National Law Enforcement Officers Remembrance, Support, and Community Outreach Program. The bill further directs DOJ to award a grant under the program to the National Law Enforcement Officers Memorial Fund for the expenses associated with community outreach, public education, and officer safety and wellness programs operated by the of the National Law Enforcement Officers Memorial Fund and National Law Enforcement Museum.

Energy Emergency Leadership Act This bill expands the list of functions that the Secretary of Energy must assign to assistant secretaries under the Department of Energy Organization Act to include energy emergency and energy security functions, such as responsibilities with respect to infrastructure and cybersecurity. The Department of Energy must ensure that such functions are performed in coordination with relevant federal agencies.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Access to Credit for our Rural Economy Act of 2023 or the ACRE Act of 2023 This bill excludes from the gross income of certain financial lending institutions, for income tax purposes, interest received on loans secured by rural or agricultural real estate.

This resolution expresses support for recognizing National Police Week. The resolution further recognizes law enforcement officers across the United States in the pursuit of preserving safe and secure communities; the need to ensure that such officers have the equipment, training, and resources necessary to protect their health and safety while they are protecting the public; and the law enforcement community for acts of sacrifice and heroism. The resolution expresses condolences and appreciation to the loved ones of each law enforcement officer who has made the ultimate sacrifice in the line of duty.

Prevent All Soring Tactics Act of 2023 or the PAST Act of 2023 This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

Back the Blue Act of 2023 This bill establishes new criminal offenses for killing, assaulting, and fleeing to avoid prosecution for killing a judge, law enforcement officer, or public safety officer. Additionally, the bill expands the list of statutory aggravating factors in death penalty determinations to also include the killing or attempted killing of a law enforcement officer, judge, prosecutor, or firefighter or other first responder; broadens the authority of federal law enforcement officers to carry firearms; and limits federal court review of challenges to state court convictions for killing a public safety officer or judge.

Deregulating Restrictions on Interstate Vehicles and Eighteen-wheelers Act or the DRIVE Act This bill prohibits the Federal Motor Carrier Safety Administration (FMCSA) from issuing any rule or regulation to require vehicles that have a gross vehicle weight of more than 26,000 pounds and are operating in interstate commerce to be equipped with a speed limiting device set to a maximum speed. The FMCSA issued an advance notice of supplemental proposed rulemaking on this subject on May 4, 2022.

Stop Institutional Child Abuse Act This bill establishes an interagency Federal Work Group on Youth Residential Programs to support and implement best practices regarding the health and safety, care, treatment, and appropriate placement of youth in youth residential programs. The work group must develop recommendations about a national database to aggregate information about processes and outcomes for youth in such programs. The work group also must support the education and training of professional and paraprofessional personnel in fields that service such youth. Further, the Department of Health and Human Services must contract with the National Academies of Sciences, Engineering, and Medicine to study and make recommendations about various aspects of federal and state oversight of youth residential programs.

College Transparency Act This bill requires the National Center for Education Statistics to establish a secure and privacy-protected data system that contains information about postsecondary students. Specifically, the data system must evaluate student enrollment patterns, progression, completion, and postcollegiate outcomes, and higher education costs and financial aid; provide complete and customizable information for students and families making decisions about postsecondary education; reduce the requirements for reporting by institutions of higher education; and periodically match with other federal systems of data. The bill also establishes a postsecondary student data system advisory committee.

Protecting Patients Against PBM Abuses Act This bill establishes requirements for Medicare pharmacy benefit managers (PBMs) with respect to remuneration, payments, and fees. Specifically, the bill restricts PBMs that are under contract with plans under the Medicare prescription drug benefit or Medicare Advantage from (1) receiving income for their services other than flat dollar amount service fees; (2) basing any service fees on the prices of covered drugs or any associated discounts, rebates, or other remuneration; (3) charging plan sponsors for ingredient costs or dispensing fees in amounts that are different than what is reimbursed to the pharmacy; or (4) reimbursing network pharmacies for less than that what is reimbursed to PBM-affiliated pharmacies. Such PBMs must also report on the difference between certain costs for drugs on the plan's formulary and those that are not on the formulary but are therapeutically equivalent. PBMs must also report certain information regarding rebates and fees they receive from drug manufacturers; the Centers for Medicare & Medicaid Services must publish this and other information that is currently reported by PBMs online.

Rare Earth Magnet Manufacturing Production Tax Credit Act of 2023 This bill allows a new tax credit for the domestic production of rare earth magnets. The magnets must be manufactured or produced in the ordinary course of the taxpayer's trade or business. The credit is disallowed if any component rare earth material used to produce such magnets is produced in a non-allied foreign nation. The bill defines rare earth magnet as a permanent magnet comprised of an alloy of neodymium, iron, and boron, or an alloy of samarium and cobalt, which may also include other material.

Save Local Business Act This bill provides that a person may be considered a joint employer in relation to an employee under federal labor law only if such person directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline.

Electronic Health Record Program Restructure, Enhance, Strengthen, and Empower Technology Act of 2023 or the EHR Program RESET Act of 2023 This bill establishes within the Veterans Health Administration a program to modernize the electronic health record and other relevant health information technology systems of the Department of Veterans Affairs (VA). The bill also establishes the Electronic Health Record and Health Information Technology Modernization Program Management Office and a position of Deputy Chief Information Officer for Electronic Health Record and Health Information Technology to implement the program. The VA must exceed or meet certain standards at its facilities that are using the Oracle Cerner product before it may initiate new deployments of the product. The bill requires additional information to be included in the quarterly updates on the Electronic Health Record Modernization Program, such as data on retention, morale, and turnover at sites using the new electronic health record. Within 275 days after the enactment of this bill, the VA must terminate all of its contracts with Oracle Cerner for training and change management related to electronic health record modernization and cease to issue task orders for such activities from Oracle Cerner or its subcontractors. The VA must designate one senior official (GS-15 or higher) as the lead negotiator on all current and future contracts relating to the new electronic health record. The Chief Acquisition Officer of the VA must contract with an entity to independently verify and validate the modernization efforts of certain VA programs (e.g., the Electronic Health Record Modernization Program).

Quantum Sandbox for Near-Term Applications Act of 2023 This bill requires the Department of Commerce, in coordination with the National Institute of Standards and Technology, to establish a public-private partnership to accelerate the deployment of quantum applications and algorithms with near-term use cases by supporting demonstration and testing.

Fair Access to Banking Act This bill places restrictions on certain banks, credit unions, and payment card networks if they refuse to do business with a person who complies with the law. Restrictions include prohibiting the use of electronic funds transfer systems and lending programs, termination of an institution's depository insurance, and specified civil penalties. Banks and other specified financial institutions are allowed to deny financial services to a person only if the denial is justified by a documented failure of that person to meet quantitative, impartial, risk-based standards established in advance by the institution. This justification may not be based upon reputational risks to the institution. Banks may also deny services to a person who engaged in rude or harassing conduct toward an employee of the bank. The bill establishes the right for a person to bring a civil action for a violation of this bill.

Manufacturing API, Drugs, and Excipients in America Act or the MADE in America Act This bill establishes a tax credit for certain manufacturers of pharmaceuticals or medical products. Specifically, the bill establishes a tax credit for manufacturers of pharmaceuticals, active pharmaceutical ingredients, excipients (i.e., inactive ingredients), medical diagnostic devices, or personal protective equipment, if they are located in a designated distressed zone. The tax credit is equal to 25% of the manufacturer's production expenditures; the credit increases to 30% of expenditures if a substantial portion of the manufacturer's employees reside in a distressed zone. The bill defines distressed zone as an area that has been designated as a qualified opportunity zone by the Internal Revenue Service (i.e., an economically distressed community in which certain new investments may be eligible for preferential tax treatment) and that has a poverty rate of over 30%.

Hershel "Woody" Williams National Medal of Honor Monument Location Act This bill requires the authorized commemorative work honoring Medal of Honor recipients to be attached to, or not more than 1,000 feet from, the Lincoln Memorial. President Lincoln established the Medal of Honor award.

Employee Rights Act This bill generally addresses employer obligations related to unionized workplaces. This bill provides that an employer may be considered a joint employer in relation to an employee under federal labor law only if such employer directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline. The bill also requires a workplace election to approve or reject a union to be conducted by secret ballot. Further, the bill requires an employer to provide limited employee information to union representatives to facilitate a workplace election. An employer that mishandles or fails to provide such information according to the bill's requirements may be liable for an unfair labor practice (i.e., labor law violation). Additionally, the bill requires an employee to authorize in writing any use of the employee's labor organization dues or other contribution for a purpose other than collective bargaining or contract administration. Such authorization must be made upon 35 days' notice and expires after one year. Finally, the bill exempts Indian Tribes, including Indian Tribe enterprises and institutions, from the collective bargaining rights and related provisions of federal labor law.

Fighting Trade Cheats Act of 2023 This bill increases penalties for, and establishes additional enforcement mechanisms related to, fraudulent and grossly negligent violations of U.S. customs laws. Specifically, the bill increases the maximum civil penalty for a fraudulent violation to three times the domestic value of the merchandise. Further, the bill prohibits a person who commits a fraudulent violation from importing merchandise into the United States for a five-year period. Additionally, the bill increases the maximum civil penalty for a grossly negligent violation to the lesser of (1) 3 times the domestic value of the merchandise; or (2) 10 times the lawful duties, taxes, and fees. It also prohibits a person who commits a grossly negligent violation from importing merchandise into the United States for a two-year period. Further, the bill applies these importation bans to an affiliated person (e.g., a family member, partner, or employee) of the person who committed the fraudulent or grossly negligent violation. The bill also establishes a private right of action for customs fraud or grossly negligent violations. In particular, the bill allows manufacturers, producers, wholesalers, labor unions, or trade associations to bring a civil action against a violator or any person that aids or abets a violator. The bill prohibits any person (or an affiliated person) who commits a fraudulent or grossly negligent violation from participating in the U.S. Customs and Border Protection's Importer of Record program, and further requires their importer of record numbers to be revoked.

Collegiate Housing and Infrastructure Act of 2023 This bill allows tax-exempt charitable or educational organizations to make collegiate housing and infrastructure grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) that apply such grants to their collegiate housing property. A collegiate housing and infrastructure grant is a grant to provide, improve, operate, or maintain collegiate housing property that may involve more than incidental social, recreational, or private purposes. The grant must be for purposes that would be permissible for a dormitory or other residential facility of the college or university with which the collegiate housing property is associated. The grant may not be used to provide physical fitness facilities.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Safeguarding Women's and Children's Health Act of 2023 This bill imposes reporting requirements relating to abortion drugs. The Food and Drug Administration (FDA) must require health care practitioners to report (1) any death or adverse event associated with the use of an abortion drug, whether or not the adverse event is considered drug-related; and (2) each time the practitioner prescribes, dispenses, or administers such a drug. The FDA must establish online portals for health care practitioners to report such information and for patients to self-report adverse events. The Centers for Disease Control and Prevention must aggregate the collected information and annually publish data about such drugs, including the number of prescriptions and adverse events occurring within 120 days of use.
