Expresses the sense of the House of Representatives that: (1) the phrase "one Nation, under God" in the Pledge of Allegiance to the Flag reflects that religious faith was central to the Founding Fathers and to the founding of the Nation; (2) reciting the Pledge, including that phrase, is a patriotic act, not an act or statement of religious faith or belief; (3) that phrase should remain in the Pledge and the practice of voluntarily reciting the pledge in public school classrooms should be encouraged by the policies of Congress, the various States, municipalities, and public school officials; and (4) the Elk Grove Unified School District in Elk Grove, California, should be commended for its continued support of the Pledge. Declares that: (1) the Ninth Circuit Court of Appeals ruling in Newdow v. United States Congress (which held that the inclusion of that phrase in the Pledge unconstitutionally endorses religion) is inconsistent with the Supreme Court's interpretation of the First Amendment; (2) the Attorney General should appeal, and the Supreme Court should review, that ruling; and (3) the President should nominate, and the Senate should confirm, Federal circuit court judges who interpret the Constitution consistent with the Constitution's text.

Establishes the Interagency Committee on Islet Cell Transplantation within the Department of Health and Human Services (HHS). Requires the Committee to study related issues, including Federal research funding, the effect of specified policies on transplantation, and data collection. Instructs the Secretary of HHS to request the Institute of Medicine to provide a study of the impact of islet cell transplantation on juvenile diabetes patients, including their health and the treatment's cost-effectiveness. Directs the Secretary, acting through the Administrator of the Centers for Medicare & Medicaid Services, to establish a demonstration project to assess the efficacy of pancreatic cell islet transplantation for individuals who: (1) have Type I (juvenile) diabetes; and (2) have end-stage renal disease; and (3) are Medicare beneficiaries. Pension Security Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require individual account plans (IAPs), including those with cash or deferred arrangements under Internal Revenue Code (IRC) section 401(k), to furnish quarterly pension benefit statements to plan participants and beneficiaries with rights to direct investments. Provides that employers are not exempt from liability for failing in fiduciary duty with respect to IAP investments during blackout periods if such a period's imposition suspends, limits, or restricts participants' and beneficiaries' ability to direct or diversify their assets. Directs the Secretary of Labor to establish a program to provide informational and educational support for pension plan fiduciaries. Amends ERISA and IRC to set forth diversification requirements for IAPs that hold employer securities readily tradable on an established market. Allows ERISA and IRC prohibited transaction exemptions under specified conditions. Directs the Secretary of Labor to study, and report to specified congressional committees on, the costs and benefits to participants and beneficiaries of requiring independent fiduciary consultants to advise plan fiduciaries in connection with IAPs. Amends the IRC to provide that no amount shall be included in the gross income of any employee solely because the employee may choose between any qualified retirement planning services provided by a qualified investment advisor, and compensation which would otherwise be includible in the gross income of such employee. Amends the Securities Exchange Act of 1934 to prohibit certain insider trading during pension plan transaction suspension periods. Amends the Retirement Protection Act of 1994 to make permanent an exemption from certain funding rules under the General Agreement on Tariffs and Trade (GATT) for retirement plans sponsored by companies in the interstate bus transportation industry (thereby having ERISA funding rules apply instead). Directs the Secretaries of the Treasury and of Labor to allow: (1) one-participant retirement plans which meet certain requirements and have assets of $250,000 or less as of the close of the plan year to not file an annual return for that year; and (2) the filing of a simplified annual return for any retirement plan which covers fewer than 25 employees on the first day of a plan year and meets certain other requirements. Directs the Secretary of the Treasury to continue to update and improve the Employee Plans Compliance Resolution System (or any successor program) giving special attention to specified factors. Amends IRC and the Taxpayer Relief Act of 1997 to extend to all governmental plans a moratorium on the application of certain nondiscrimination rules applicable to State and local plans. Amends ERISA to direct the Secretary of the Treasury to modify specified regulations. Directs the Pension Benefit Guaranty Corporation (PBGC) to issue missing participant rules for multiemployer plans. Reduces PBGC premiums for new plans of small employers. Reduces PBGC additional premiums for new and small plans. Authorizes the PBGC to pay interest on premium overpayment refunds. Revises rules for substantial owner benefits in terminated plans. Directs the Secretary of Labor to study and report on model small employer group plans.

Protection of Lawful Commerce in Arms Act - Prohibits any qualified civil liability action from being brought in any State or Federal court and requires pending actions to be dismissed. Defines such an action to: (1) include an action brought against a manufacturer or seller of a firearm, ammunition, or a component of a firearm that has been shipped or transported in interstate or foreign commerce, or against a trade association of such manufacturers or sellers, for damages resulting from the criminal or unlawful misuse of a firearm; and (2) exclude an action brought against persons who transfer a firearm knowing that it will be used to commit a crime of violence or a drug trafficking crime; an action brought against a seller for negligent entrustment or negligence per se; an action in which a manufacturer or seller of a firearm willfully violated a State or Federal statute applicable to the sale or marketing of the firearm and the violation was a proximate cause of the harm for which relief is sought; an action for breach of contract or warranty in connection with the purchase of the firearm; or an action for physical injuries or property damage resulting directly from a defect in design or manufacture of the firearm when used as intended.

Bankruptcy Judgeship Act of 2003 - Amends the Federal Judicial Code to mandate appointments for additional temporary bankruptcy judgeships in designated States. Prescribes additional consumer credit disclosures, including open end credit plans and introductory rates.

Fuels Security Act of 2003 - Amends the Clean Air Act to require that gasoline contain a specified volume of renewable fuel. Provides for annual increases in the applicable volume through 2012. Establishes a ratio for determining the volume required from 2013 onward. Defines renewable fuel to include motor vehicle fuel produced from biomass (e.g. grain) or natural gas produced from a biogas (e.g. landfill) source. Establishes a system of credits for gasoline which contains more renewable fuel than required. Requires studies concerning these renewable fuel requirements, specifically: (1) seasonal variations in renewable fuel availability; (2) the impact on consumers; and (3) the impact on small refineries. Establishes a system of waivers for States claiming and proving economic or environmental hardship. Establishes a Federal agency ethanol-blended gasoline and biodiesel purchasing requirement. Establishes a commercial byproducts from municipal solid waste loan guarantee program. Requires data collection concerning the monthly consumption of renewable fuels. Federal Reformulated Fuels Act of 2002 - Amends the Solid Waste Disposal Act to permit the use of the Leaking Underground Storage Tank Trust Fund for methyl tertiary butyl ether (MBTE) remediation purposes. Amends the Clean Air Act to revise guidelines pertaining to: (1) water quality protection from fuels; (2) oxygen content requirements for reformulated gasoline; (3) public health and environmental impacts of fuels and fuel additives; (4) analyses of motor vehicle fuel changes; (5) additional opt-in areas under the reformulated gasoline program; and (6) Federal enforcement of State fuels requirements. Requires a joint study of Federal, State and local requirements concerning motor vehicle fuels. Requires a review of Federal procurement initiatives relating to use of recycled products and fleet and transportation efficiency.

Partial-Birth Abortion Ban Act of 2003 - Amends the Federal criminal code to prohibit any physician or other individual from knowingly performing a partial-birth abortion, except when necessary to save the life of a mother that is endangered by a physical disorder, illness, or injury. Defines a "partial-birth abortion" as an abortion in which the person performing the abortion: (1) deliberately and intentionally vaginally delivers a living fetus until, in the case of a head-first presentation, the entire fetal head is outside the mother's body, or, in the case of a breech presentation, any part of the fetal trunk past the navel is outside the mother's body; and (2) performs the overt act, other than completion of delivery, that kills the partially delivered living fetus. Authorizes the father, if married to the mother at the time of the abortion, and the maternal grandparents of the fetus, if the mother is under 18 years of age, to obtain specified relief in a civil action, unless the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion. Authorizes a defendant accused of an offense under this Act to seek a hearing before the State Medical Board on whether the physician's conduct was necessary to save the life of the mother. Prohibits the prosecution of a woman upon whom a partial-birth abortion is performed for conspiracy to violate this Act or under provisions regarding punishment as a principal or an accessory or for concealment of a felony.

Child Modeling Exploitation Prevention Act - Amends the Fair Labor Standards Act of 1938 to prohibit an employer from employing a child model in exploitive child modeling. Defines "exploitive child modeling" as modeling involving the use of a child under 17 years old for financial gain without the purpose of marketing a product or service other than the child's image, regardless of whether the employment relationship of the child is direct or indirect, contractual or non-contractual, or is termed that of an independent contractor. Provides that such term does not apply to an image which, taken as a whole, has serious literary, artistic, political, or scientific value. Sets penalties for violations. Includes employment of a minor in violation of such provision within the definition of "oppressive child labor." Amends the Federal criminal code to prohibit displaying or offering to provide the image of an individual engaged in exploitive child modeling, in or affecting interstate or foreign commerce, with the intent to make a financial gain, except with respect to an image which has serious literary, artistic, political, or scientific value.

Small Business Health Fairness Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to revise provisions relating to access and choice for small business employers with respect to medical care for their employees. Establishes rules governing association health plans (group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations), including requirements relating to certification, sponsors and boards of trustees, participation, coverage, plan documents, contribution rates, benefit options, applications for certification, notice for voluntary termination, corrective actions, and mandatory termination. Requires association health plans which provide health benefits in addition to health insurance coverage to maintain certain reserves and comply with other solvency provisions. Directs the Secretary of Labor to apply for appointment, and carry out specified duties, as trustee of any such insolvent association health plans which provide health benefits in addition to health insurance coverage. Allows a State to impose a contribution tax on any association health plan commencing operations in such State after the enactment of this Act. Requires association health plans to include in their summary plan descriptions, in connection with each benefit option, a description of the form of any solvency or guarantee fund protection secured under ERISA or applicable State law. Revises provisions relating to treatment of: (1) single employer arrangements; and (2) certain collectively bargained arrangements. Provides for association health plans with respect to: (1) enforcement; (2) cooperation between Federal and State authorities; and (3) treatment of certain existing health benefit programs.

Authorizes persons whose rights under this Act have been violated to bring an action in U.S. district court against the United States, any State, or any person for damages, injunctive relief, and such other relief as the court deems appropriate. Sets forth provisions regarding: (1) the award of attorney's fees; and (2) the statute of limitations.

Military Survivor Benefits Improvement Act of 2003 - Adjusts the basic Survivor Benefit Plan (SBP) annuity amount for surviving spouses, age 62 and older, of former military personnel to: (1) 35 percent of the retired pay of the decedent (current law), for months before October 2004; (2) 40 percent for months during FY 2005; (3) 45 percent for months during FY 2006; (4) 50 percent for months during FY 2007; and (5) 55 percent for months after FY 2007. Adjusts similarly percentage amounts with respect to survivors of reserve personnel and survivors of persons who die while on active duty. Provides a corresponding phased elimination of the SBP supplemental annuity authorized to be provided to such surviving spouses. Requires periodic recomputation of: (1) annuity amounts beginning in October 2004; and (2) retired pay reductions for supplemental survivor annuities. Provides a one-year open enrollment period for SBP participation, commencing October 1, 2004, for those currently not participating, those electing to increase current coverage, and those wishing to participate in the supplemental SBP. Commends the President and the Administration and those countries which joined the United States for objecting to Libya's selection. Expresses dismay at the European Union common position of abstention on the critical vote over Libya's chairmanship. Promises to hold accountable countries who voted in favor of Libya's chairmanship. Calls on countries at various stages of democratization to demonstrate their commitment to human rights, democracy, peace and security, and support efforts to reform the Commission. Calls on the President to instruct the Secretary of State to consult with the appropriate congressional committees regarding the U.S. priorities and strategy for the 59th session of the Commission and strategy and proposals for its reform. Requests the President to object to the continued suspension of sanctions against Libya and call for their full reinstatement until Libya: (1) publicly accepts responsibility for the Pan Am Flight 103 bombing; (2) provides appropriate compensation to the victims; and (3) is in full compliance with all UN sanctions imposed as a result of Libya's orchestration of the Pan Am 103 terrorist attack. Calls on the Secretary of State to engage member countries to support U.S. efforts to ensure that states that are gross violators of human rights, sponsors of terrorist activities, or subject to UN sanctions will not be elected to leadership positions in the UN General Assembly nor will they be elected to membership or leadership positions on the UN Commission on Human Rights, the UN Security Council, or any other UN entity or affiliated agency.

Back to Work Incentive Act of 2003 - Amends the Workforce Investment Act of 1998 to direct the Secretary of Labor to allot grants to States to allocate funds to local areas to establish personal reemployment accounts for individuals identified as likely to exhaust their unemployment compensation. Provides for such accounts to: (1) accelerate reemployment; (2) promote retention in employment; and (3) give individuals more flexibility, choice, and control in obtaining intensive reemployment, training, and supportive services (as well as assistance in purchasing or leasing an automobile when necessary to allow the recipient to accept a long-term employment offer). Allows such services to be purchased through a one-stop delivery system or other providers. Permits certain amounts in accounts to be used for income support. Provides for reemployment bonuses. Requires States to establish a uniform statewide amount, up to $3,000, for each individual account. Limits the time in which amounts in an account may be used to not more than one year after the account's establishment. Prohibits the establishment of any such account beginning two years after the enactment of this Act.

Sets forth new rules for drought designations. Modifies rules for replacement of involuntarily converted livestock, including to extend the replacement period (for both weather-related sales and sales forced by Federal policy) and to prescribe that an heir to an estate may replace such property within the required time frame. Applies this Act to sales and exchanges made after December 31, 2000.

Requires State educational agencies, as a condition for receiving Federal financial assistance under the Individuals with Disabilities Education Act, to develop and implement statewide plans and make contracts with publishers to ensure that instructional materials for classroom use in elementary and secondary schools are made available in specialized formats to individuals who are blind or have other print disabilities at the same time such materials are provided to individuals without such disabilities. Authorizes the Secretary to make grants to eligible entities to provide or improve their capacity to prepare or obtain instructional materials in specialized formats, including the national electronic format. Provides for enforcement of rights of children and parents under this Act.
