Antisemitism Awareness Act of 2023 This bill provides statutory authority for the requirement that the Department of Education’s Office for Civil Rights take into consideration the International Holocaust Remembrance Alliance's (IHRA's) working definition of antisemitism when reviewing or investigating complaints of discrimination based on race, color, or national origin in programs or activities that receive federal financial assistance. According to the IHRA's working definition, antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews.

This resolution condemns the support of Hamas, Hezbollah, and other terrorist organizations at institutions of higher education, which may lead to the creation of a hostile environment for Jewish students, faculty, and staff. It also urges the Department of Education to direct the Office for Civil Rights to investigate and, where appropriate, take immediate action.

To provide that members of the Armed Forces performing services in Niger, Mali, Burkina Faso, and Chad shall be entitled to tax benefits in the same manner as if such services were performed in a combat zone.

Strengthening Tools to Counter the Use of Human Shields Act This bill extends the authority of the President to impose sanctions on foreign persons using human shields through 2030 and requires the President to impose such sanctions on each foreign person determined to be a member of Palestine Islamic Jihad and orders, controls, or otherwise directs the use of human shields. Currently, such sanctions are (1) required for users of human shields who are members of Hamas or Hezbollah or supporters of those groups, and (2) authorized for other users of human shields. The President must also determine if a person named in certain congressional requests meets the criteria for such sanctions and report on whether the President intends to impose sanctions on that person. Additionally, the Department of Defense must report to Congress on the implications of the use of human shields by Hamas, Hezbollah, and Palestine Islamic Jihad.

Pay Our Troops Act

Pay Our Troops Act This bill provides continuing appropriations for military pay for any period during which interim or full-year appropriations for FY2024 are not in effect (i.e., a government shutdown). Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

Helping Ensure Access to Local TeleHealth Act of 2023 or the HEALTH Act of 2023 This bill modifies requirements relating to Medicare coverage of telehealth services, including services that are furnished by federally qualified health centers (FQHCs) and rural health clinics (RHCs). Specifically, the bill expands coverage to include audio-only telehealth services. It also permanently allows FQHCs and RHCs to serve as the distant site (i.e., the location of the health care practitioner) for telehealth services and excludes such services from certain geographic restrictions. Payment must be made in the same manner as for non-telehealth services, rather than in accordance with a separate methodology determined by the Centers for Medicare & Medicaid Services.

Patawomeck Indian Tribe of Virginia Federal Recognition Act This bill extends federal recognition to the Patawomeck Indian Tribe. Specifically, the bill makes the tribe and its members eligible for services and benefits provided to federally recognized tribes, without regard to the existence of a reservation for the tribe. The service area of the tribe is considered to be Stafford and King George Counties, Virginia. Next, the bill sets forth requirements for the tribe regarding its membership roll, governing documents, and governing body. Interior, upon the request of the tribe, may take certain land into trust for the benefit of the tribe. Further, the bill prohibits the tribe from conducting gaming activities.

Bolstering Ecosystems Against Coastal Harm Act

Bolstering Ecosystems Against Coastal Harm Act or the BEACH Act This act modifies the coastal areas belonging to the John H. Chafee Coastal Barrier Resources System (CBRS) and which are, therefore, ineligible to receive federal financial assistance for land development. It also expands exceptions to this restriction, establishes additional requirements for agencies administering the CBRS, and requires a study relating to coastal barrier ecosystems. Specifically, the act updates and replaces existing CBRS maps with maps recommended by the Fish and Wildlife Service (FWS) in a 2022 report to Congress titled John H. Chafee Coastal Barrier Resources System Hurricane Sandy Remapping Project.  Affected coastal areas are located in 13 states: Connecticut, Delaware, Florida, Louisiana, Maryland, Massachusetts, New Hampshire, New Jersey, New York, North Carolina, Rhode Island, South Carolina, and Virginia. In addition, the act creates new exceptions to the limitation on federal financial assistance for certain (1) aquaculture operations (e.g., shellfish production) and (2) U.S. Army Corps of Engineers coastal storm risk management projects. The act also provides that insurable structures (i.e., walled and roofed buildings) that are on the ground in areas added to the CBRS within one year of enactment remain eligible for federal financial assistance.  The act directs FWS to issue regulations requiring owners or lessors of real property in communities affected by the CBRS to disclose this information to prospective buyers or lessees. Additionally, the act provides that FWS shall develop and finalize guidance relating to the expenditure of federal funds in emergency situations that threaten life, land, and property immediately adjacent to a system unit. The act also generally requires agencies that are involved with the CBRS to revise or issue regulations or guidance as necessary within one year of enactment. Finally, the act directs FWS and the U.S. Geological Survey (USGS) to conduct a scientific evaluation of the dynamics of coastal barrier ecosystems. FWS and USGS must provide related recommendations for the CBRS to Congress.

Finish It Act

Finish It Act This bill requires the Department of Defense (DOD) to submit a plan (within 15 days after the bill is enacted) to utilize, transfer, or donate to states all existing excess border wall construction materials to construct a permanent physical barrier along the U.S.-Mexico border. If DOD delays in submitting or executing the plan, the travel budget of the Under Secretary of Defense for Policy must be decreased by 1% for every two days of delay. DOD must work with the Defense Logistics Agency to execute the plan until DOD is no longer incurring any costs to maintain, store, or protect the excess materials. Any state requesting border wall construction materials must certify, in writing, that the materials will be used exclusively for the construction of a permanent physical barrier to stop illicit human and vehicle trafficking along the border. If a state does not use all such materials for the specified purpose within two years of receiving the materials, the state must pay the federal government an amount equal to the original purchase price of the materials.

Better CARE for Animals Act of 2023

Better Collaboration, Accountability, and Regulatory Enforcement for Animals Act of 2023 or the Better CARE for Animals Act of 2023 This bill modifies enforcement provisions under the Animal Welfare Act, including by allowing the Department of Justice (DOJ) to bring civil actions against violators of the act for appropriate relief, such as removing animals, revoking violators' licenses, or issuing civil penalties. DOJ must use the penalties to pay for the temporary care for animals pending the disposition of civil or criminal proceedings that allege violations of the act with respect to such animals.

Chesapeake National Recreation Area Act

Chesapeake National Recreation Area Act This bill establishes the Chesapeake National Recreation Area in Maryland and Virginia as a unit of the National Park System (NPS). The Department of the Interior may acquire land and land-based resources within the recreation area boundaries by (1) donation, (2) purchase from a willing seller with donated or appropriated funds, (3) exchange, or (4) transfer from another federal agency. Interior, in consultation with the Chesapeake Executive Council, must prepare a management plan for the recreation area as specified by the bill. Interior must also conduct transportation planning, in coordination with the Department of Transportation and state transportation agencies, to minimize traffic in the surrounding community. Additionally, Interior must establish an advisory board for the recreation area. Finally, the bill directs NPS's Chesapeake Bay office to administer the Chesapeake Gateways and Watertrails Network in coordination with the recreation area.

Stop China’s Continuous Purchase of Land Act or the Stop CCP Land Act This bill requires states that receive certain federal program funds to restrict the purchase of agricultural land by a covered foreign country.  Covered foreign country means a country included in Department of State regulations as subject to certain prohibitions (i.e., Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela), as well as Russia. Specifically, a state may not receive funds for certain programs funded by the Inflation Reduction Act of 2022 (e.g., certain energy efficiency and conservation programs) unless that state has a law prohibiting a covered foreign country (or persons acting on behalf of the country) from purchasing agricultural land in the state. Further, a state must require that a person from a covered foreign country that holds agricultural land in the state prior to the state law's enactment submit an annual report to the state on the agricultural holdings. The Department of Agriculture must submit a report to Congress on how the Agricultural Foreign Investment Disclosure Act of 1978 should be updated to ensure accurate documentation and monitoring of foreign investment in agricultural land. The Government Accountability Office must submit a report to Congress that includes (1) an assessment of this bill's impact on national security, and (2) any measures that can be taken to better secure U.S. real estate from foreign manipulation.

Rural Hospital Technical Assistance Program Act

Rural Hospital Technical Assistance Program Act This bill provides statutory authority for the Rural Hospital Technical Assistance Program within the Department of Agriculture (USDA). Under the bill, USDA must establish and maintain (directly or by grant, contract, or cooperative agreement) a program to help eligible hospital facilities in rural areas with a population of 50,000 inhabitants or less.  The program must provide tailored technical assistance and training to hospital facilities to identify development needs for maintaining essential health care services and support action plans for financial, operational, and quality improvement projects to meet these needs. Development needs include (1) constructing, expanding, and modernizing health care facilities; (2) increasing telehealth capabilities; and (3) acquiring or upgrading health care information systems (e.g., electronic health records). The program must also provide technical assistance and training to help hospital facilities to better manage their financial and business strategies and identify, and apply for assistance from, USDA loan and grant programs. In selecting eligible hospital facilities to participate in the program, USDA must give priority to borrowers and grantees of certain USDA rural assistance programs.   USDA must also submit an annual report to Congress on the progress and results of the program.

Building Chips in America Act of 2023

Building Chips in America Act of 2023 This bill modifies and limits the review of certain semiconductor (i.e., microchip) projects under the National Environmental Policy Act of 1969 (NEPA) and the National Historic Preservation Act (NHPA). Specifically, the bill exempts from NEPA and NHPA specified semiconductor projects that receive financial assistance under the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021. Next, the bill allows the Department of Commerce to serve as the lead agency for the review of a semiconductor project that receives such financial assistance but is not exempted from review under NEPA. A single environmental document and joint record of decision must be prepared for a semiconductor project. In completing the environmental review, Commerce may adopt a prior study or decision under certain circumstances. The bill also allows a state to assume the responsibility of an environmental review under NEPA for a semiconductor project. Finally, the bill sets a statute of limitations for certain claims under NEPA.

Women in Agriculture Act

Women in Agriculture Act This bill directs the Department of Agriculture (USDA) to establish the position of Women Farmers and Ranchers Liaison within USDA. Among other things, the liaison must advocate on behalf of women who are farmers and ranchers in interactions with USDA employees and promote the advancement of women in USDA leadership roles. The liaison may also enter into a contract or cooperative agreement to conduct various research, training, and other activities with respect to women who are farmers and ranchers. The liaison must submit an annual report to Congress on USDA grants, loans, loan guarantees, and cost-share programs for woman-owned agriculture operations. In addition, the bill expands the USDA high-priority research and extension areas to authorize grants for developing and making widely available agriculture equipment and machinery that is ergonomically designed for use by women. Further, USDA must give priority to certain loans or grants to address the availability, quality, or cost of childcare in an agricultural or rural community.

Restore VA Accountability Act of 2023

Restore Department of Veterans Affairs Accountability Act of 2023 or the Restore VA Accountability Act of 2023 This bill modifies personnel action procedures regarding certain employees and executives of the Department of Veterans Affairs (VA).  The bill authorizes the VA to remove from civil service, demote, or suspend VA employees that are supervisors or managers if the VA determines by substantial evidence that the performance or misconduct of such individual warrants such action. This authority does not apply to certain appointees or individuals in their probationary or trial period. Supervisors or managers who are subject to a removal, demotion, or suspension under this bill are entitled to (1) advance notice of the action and supporting evidence, (2) representation by an attorney or representative, and (3) grieve the action in accordance with an internal grievance process. The bill also provides protections from removal, demotion, or suspension for supervisor or managers who are whistleblowers or are seeking corrective action for an alleged prohibited personnel practice such as discrimination. The bill also modifies the procedures to remove, demote, or suspend VA employees or senior executives based on performance or misconduct, specifically by requiring the VA to determine by substantial evidence that the performance or misconduct of the individual warrants such removal, demotion, or suspension. Such procedures must apply retroactively, beginning on the date of enactment of the Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017 (June 23, 2017).
