Improving Child Care for Working Families Act of 2021 This bill increases the limitation on the exclusion from employee gross income for employer-paid dependent care assistance from $5,000 to $10,500.

Creating a Respectful and Open World for Natural Hair Act of 2021 or the CROWN Act of 2021 This bill prohibits discrimination based on a person's hair texture or hairstyle if that style or texture is commonly associated with a particular race or national origin. Specifically, the bill prohibits this type of discrimination against those participating in federally assisted programs, housing programs, public accommodations, and employment. Persons shall not be deprived of equal rights under the law and shall not be subjected to prohibited practices based on their hair texture or style. The bill provides for enforcement procedures under the applicable laws.

Help Extract Animals from Red Tape Act of 2021 or the HEART Act of 2021 This bill modifies notice requirements in a civil forfeiture proceeding that involves the seizure of an animal involved in animal fighting. Specifically, the government must notify interested parties of an animal's seizure within 30 days (currently, 60 days). The notice period may be extended only if a delay is warranted after considering certain factors, including the cost to the government of providing shelter for the animal, the health of the animal and the effect of a delay on its rehabilitation, any increased risk that a delay could necessitate the euthanasia of the animal, and any psychological harm incurred by the animal's owner due to the delay in disposition. Additionally, the bill authorizes amounts in the Department of Justice Assets Forfeiture Fund to be used to pay for costs associated with a seized animal, including transportation, shelter, care, veterinary services, and humane euthanasia.

Restored, Equitable, Coronavirus Adjusted Lodging Act of 2021 or the RECAL Act This bill prohibits the General Services Administration (GSA), when determining the FY2022 and FY2023 per diem reimbursement rates for locations within the Continental United States (CONUS), from setting lodging allowances below the FY2020 levels. CONUS per diem reimbursement rates are the maximum allowances that federal employees are reimbursed for official travel expenses. The rates consist of lodging, meals, and incidental expense allowances; the GSA sets rates annually based on data from the prior 12-month period.

Protecting Older Workers Against Discrimination Act This bill revises the evidentiary standard for age discrimination by establishing an unlawful employment practice when the complaining party demonstrates that age or participation in an investigation, proceeding, or litigation related to an age discrimination claim was a motivating factor for an adverse practice, even though other factors also motivated the practice (thereby allowing what are commonly known as mixed motive claims). The bill (1) permits the complaining party to rely on any type or form of admissible evidence, which need only be sufficient for a reasonable trier of fact to find that an unlawful practice occurred; and (2) declares that the complaining party shall not be required to demonstrate that age or retaliation was the sole cause of the employment practice (thereby rejecting the Supreme Court's decision in Gross v. FBL Financial Services, Inc. , which requires the complainant to prove that age was the but-for cause for the employer's decision). The bill applies this evidentiary standard to other employment discrimination and retaliation claims, including claims under the Civil Rights Act of 1964, the Americans With Disabilities Act of 1990, and the Rehabilitation Act of 1973. In a claim in which age discrimination is shown, but where the employer demonstrates that it would have taken the same action absent the motivating factor of age, the bill authorizes courts to grant declaratory and injunctive relief, but prohibits the court from awarding damages or issuing an order requiring any admission, reinstatement, hiring, promotion, or payment. This limitation also applies to claims of discrimination based on disability.

Secure and Fair Enforcement Banking Act of 2021 or the SAFE Banking Act of 2021 This bill generally prohibits a federal banking regulator from penalizing a depository institution for providing banking services to a legitimate cannabis-related business. Prohibited penalties include terminating or limiting the deposit insurance or share insurance of a depository institution solely because the institution provides financial services to a legitimate cannabis-related business and prohibiting or otherwise discouraging a depository institution from offering financial services to such a business. Additionally, proceeds from a transaction involving activities of a legitimate cannabis-related business are not considered proceeds from unlawful activity. Proceeds from unlawful activity are subject to anti-money laundering laws. Furthermore, a depository institution is not, under federal law, liable or subject to asset forfeiture for providing a loan or other financial services to a legitimate cannabis-related business. The bill also provides that a federal banking agency may not request or order a depository institution to terminate a customer account unless (1) the agency has a valid reason for doing so, and (2) that reason is not based solely on reputation risk. Valid reasons for terminating an account include threats to national security and involvement in terrorist financing, including state sponsorship of terrorism.

Improving Access to Mental Health Act of 2021 This bill increases the Medicare reimbursement rate for clinical social worker services. The bill excludes clinical social worker services from the prospective payment system in which predetermined amounts form the basis for payment under Medicare. Additionally, the bill alters the definition of clinical social worker services as it relates to Medicare. Under current law, such services (1) include services performed for the diagnosis and treatment of mental illnesses, and (2) exclude services furnished to an inpatient of a skilled nursing facility as a condition of the facility's participation in the Medicare program. The bill repeals these provisions and instead specifies that such services include certain types of health behavior assessment and intervention.

Huntington's Disease Disability Insurance Access Act of 2021 This bill expedites payment of Social Security Disability Insurance (SSDI) benefits and eligibility for Medicare coverage for those with Huntington's disease. This is an inherited disorder that causes brain cells to die, including in areas of the brain that help to control voluntary movement. Specifically, the bill eliminates the 5-month waiting period for SSDI benefits and the subsequent 24-month waiting period for Medicare coverage for individuals with Huntington's disease. Under current law, individuals generally must wait five months after the onset of disability to begin receiving SSDI benefits and an additional 24 months to become eligible for Medicare.

Jumpstart Our Businesses by Supporting Students Act of 2021 or the JOBS Act of 2021 This bill expands student eligibility for Pell Grants by establishing the Job Training Federal Pell Grant program. Specifically, the bill requires the Department of Education to award a job training Pell Grant to a student who does not have a degree; attends an institution of higher education (IHE); is enrolled in a career and technical education program at an IHE that provides 150 to 600 clock hours of instructional time over a period of 8 to 15 weeks and provides training aligned with high-skill, high-wage, or in-demand industry sectors (i.e., job training programs); and meets all other eligibility requirements for a Pell Grant. It also specifies that any period during which a student receives a job training Pell Grant counts toward that student's Pell Grant eligibility period.

Fair Care for Vietnam Veterans Act of 2021 This bill provides a presumption of service-connection for hypertension and monoclonal gammopathy of undetermined significance (MGUS) for veterans who served in Vietnam between January 9, 1962, and May 7, 1975. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Increasing Access to Quality Cardiac Rehabilitation Care Act of 2021 This bill accelerates and expands certain changes that are scheduled to take effect relating to the coverage of cardiac, intensive cardiac, and pulmonary rehabilitation programs under Medicare. Currently, such programs require physician supervision. Effective January 1, 2024, physician assistants, nurse practitioners, and clinical nurse specialists may also supervise these programs. The bill expedites the effective date of these changes to January 1, 2022, and also allows these practitioners to administer programs in their offices, prepare and sign treatment plans, and prescribe exercise.

Work Opportunities and Resources to Keep Nonprofit Organizations Well Act or the WORK NOW Act This bill requires the Department of the Treasury to establish a grant program to provide emergency relief to certain nonprofit organizations, prioritizing organizations that provide services related to the COVID-19 (i.e., coronavirus disease 2019) pandemic. Organizations receiving funding must use not less than 60% of these funds to hire former and new employees.

VA Employee Fairness Act of 2021 This bill repeals provisions excluding any matter or question concerning professional conduct or competence; peer review; or the establishment, determination, or adjustment of employee compensation from the applicability of collective bargaining rights for Veterans Health Administration employees.

Japanese American Confinement Education Act This bill establishes a museum program on the historical importance of Japanese American confinement during World War II and permanently reauthorizes the Japanese American Confinement Sites preservation program. The bill directs the Department of the Interior to establish a program of grants to a Japanese American museum to educate individuals in the United States on the historical importance of such confinement and the commitment of the United States to equal justice.

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment of congenital anomalies and birth defects, such as reconstructive services and items. Coverage must include services and items that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician. Coverage limits and cost-sharing requirements for such services and items may not be more restrictive than those applicable to all medical and surgical benefits under the plan.

Water Quality Protection and Job Creation Act of 2021 This bill creates, reauthorizes, and revises several grant programs for infrastructure to treat water pollution, such as wastewater or stormwater. Specifically, the bill reauthorizes through FY2026 and revises the Clean Water State Revolving Fund program, which provides communities low-cost financing for water quality infrastructure projects. It also reauthorizes through FY2026 grants for programs to control water pollution; pilot projects related to watershed management of wastewater discharges (e.g., sewer overflows or stormwater discharges) during wet weather; alternative water source projects, including projects to reclaim stormwater; or measures to manage, reduce, treat or recapture stormwater, such as sewer overflows. In addition, the Environmental Protection Agency must award grants to owners of publicly owned treatment works (i.e., sewage treatment plants) for the treatment of contaminants of emerging concern, such as perfluoroalkyl or polyfluoroalkyl substances, commonly referred to as PFAS. These substances are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing.

Help Independent Tracks Succeed Act or the HITS Act This bill permits taxpayers to treat as currently deductible expenses the cost of qualified sound recording productions not exceeding $150,000 in a taxable year. The bill defines qualified sound recording production as certain sound recordings produced and recorded in the United States.

Improving Access to Indian Health Services Act This bill permanently extends certain Medicaid flexibilities relating to Indian health care providers. Specifically, the bill permanently expands coverage to include clinical services that are furnished outside of a clinic by an Indian Health Service (IHS) facility, a tribe or tribal organization, or an Urban Indian Organization (UIO). Current guidance from the Centers for Medicare & Medicaid Services allows IHS and tribal facilities to receive payment for clinical services provided outside of clinics through October 31, 2021; facilities are expected to work with their state Medicaid programs to transition to other, more permanent payment options for these services. The bill also permanently establishes a 100% federal matching rate, also known as the Federal Medical Assistance Percentage (FMAP), for UIO services. Current law provides a 100% FMAP for UIO services during the eight fiscal quarters after March 11, 2021.

Save Oak Flat Act This bill repeals the requirement for the Department of Agriculture to convey the 2,422 acres of Forest System land located in Tonto National Forest in Pinal County, Arizona, known as Oak Flat, to Resolution Copper Mining, LLC, in exchange for various parcels of land owned by Resolution Copper. Oak Flat is withdrawn from (1) entry, appropriation, or disposal under the public land laws; (2) location, entry, and patent under the mining laws; and (3) disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.

State Health Care Premium Reduction Act of 2021 This bill establishes and provides funding for the Improve Health Insurance Affordability Fund. States must use allocated funds to (1) issue reinsurance payments to health insurers (i.e., reimbursements to protect insurers against exceedingly high claims) for individual health insurance coverage, or (2) provide other assistance to reduce out-of-pocket costs (e.g., copayments, coinsurance, and deductibles) for qualified health plans offered in the individual market through an exchange. Reinsurance payments using such funds may not be applied to (1) grandfathered health plans in place on March 23, 2010, (2) non-grandfathered transitional plans meeting specified requirements identified by the Centers for Medicare & Medicaid Services (CMS), or (3) student health insurance plans provided by institutions of higher education. The bill appropriates $10 billion per year for the fund, which the CMS must distribute to states in accordance with a specified methodology based on the estimated amount of reinsurance payments for individuals in a state during the given year, subject to specified deductions. Additionally, states must submit applications explaining how they will use such funds. In the event that a state does not submit an application, the bill directs the CMS to allocate the calculated funding amount to reinsurance programs in that state.

Harriet Tubman Bicentennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the legacy of Harriet Tubman as an abolitionist. The Secretary may issue coins under this bill only during the period of January 1, 2024, through December 31, 2024. All surcharges received by Treasury from the sale of such coins must be paid equally to the National Underground Railroad Freedom Center in Cincinnati, Ohio, and The Harriet Tubman Home, Inc. in Auburn, New York, for the purpose of accomplishing and advancing their missions.

Assault Weapons Ban of 2021 This bill makes it a crime to knowingly import, sell, manufacture, transfer, or possess a semiautomatic assault weapon (SAW) or large capacity ammunition feeding device (LCAFD). The prohibition does not apply to a firearm that is (1) manually operated by bolt, pump, lever, or slide action; (2) permanently inoperable; (3) an antique; or (4) a rifle or shotgun specifically identified by make and model. The bill also exempts from the prohibition the following, with respect to a SAW or LCAFD: importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments; importation, sale, transfer, or possession related to securing nuclear materials; and possession by a retired law enforcement officer. The bill permits continued possession, sale, or transfer of a grandfathered SAW, which must be securely stored. A licensed gun dealer must conduct a background check prior to the sale or transfer of a grandfathered SAW between private parties. The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD. Newly manufactured LCAFDs must display serial number identification. Newly manufactured SAWs and LCAFDs must display the date of manufacture. The bill also allows a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender a SAW or LCAFD under a buy-back program.

CHAMPVA Children's Care Protection Act of 2021 This bill provides that a child shall be eligible for medical care under the Civilian Health and Medical Program of the Department of Veterans Affairs (CHAMPVA) until the child's 26th birthday, regardless of the child's marital status.

Hate Crimes Commission Act of 2021 This bill establishes the United States Commission on Hate Crimes. The commission must investigate and report on whether hate crimes have increased; factors that contributed to an increase in hate crimes, if one is determined to exist; policies or actions by law enforcement agencies to reduce the commission of hate crimes; the impact of underreporting on hate crimes statistics and prevention; and successful community bias prevention responses.

COVID - 19 Hate Crimes Act This bill requires a designated officer or employee of the Department of Justice (DOJ) to facilitate the expedited review of COVID-19 (i.e., coronavirus disease 2019) hate crimes and reports of COVID-19 hate crimes. It defines COVID-19 hate crime as a violent crime that is motivated by two things: (1) the actual or perceived characteristic (e.g., race or ethnicity) of any person, and (2) the actual or perceived relationship to the spread of COVID-19 of any person because of that characteristic. The bill requires DOJ to issue guidance for state and local law enforcement agencies on (1) the establishment of online hate crime reporting processes and the availability of online reporting in multiple languages, and (2) the expansion of culturally competent education campaigns. Additionally, DOJ and the Department of Health and Human Services must issue guidance on best practices for mitigating racially discriminatory language in describing the COVID-19 pandemic.

Accessible, Affordable Internet for All Act This bill reauthorizes through FY2026, revises, and establishes grants and activities to promote access to broadband internet and other telecommunication services. The bill addresses digital equity and inclusion through grants and by requiring studies on barriers to adoption of broadband services and related matters. The bill addresses broadband affordability and access. It (1) reauthorizes and expands various programs that subsidize or otherwise support broadband services for eligible households, schools and libraries, and tribal lands and populations; and (2) establishes a program for expanding broadband service for underserved areas and community support organizations (e.g., schools and religious organizations). Additionally, the Federal Communications Commission (FCC) must award grants and take other actions to expand programs that verify an individual's eligibility for subsidized services. The bill addresses broadband data collection, disclosure, and sharing. The FCC must (1) issue rules regarding the collection of pricing data and labels that disclose information about broadband plans to consumers, and (2) collaborate and share data with federal agencies and other stakeholders. The bill makes financing (e.g., low-interest loans) available to communities and public-private partnerships for broadband infrastructure investments. Additionally, the Department of Transportation must require states to install conduits for broadband cables as part of certain highway projects. The bill also sets up a task force on nationwide dig once requirements (i.e., policies or practices to minimize excavations of highway rights-of-way when installing telecommunications infrastructure). Further, the bill preempts state laws that prohibit certain telecommunications service providers (e.g., public providers) from providing high-speed broadband services.

Information Transparency & Personal Data Control Act This bill requires the Federal Trade Commission (FTC) to establish requirements for certain entities when they collect, transmit, store, process, use, or otherwise control sensitive personal information. Information relating to an identifiable individual is generally considered sensitive personal information. However, information that is publicly available is not considered sensitive. Specifically, these entities must (1) obtain affirmative consent from users for functionality related to the disclosure of sensitive personal information, (2) publish a privacy and data use policy that is readily understandable, (3) provide users the ability to opt-out of the sharing of their nonsensitive information, and (4) obtain at least once every two years a privacy audit that evaluates the sufficiency of the entity's data privacy and security controls. These requirements do not apply to the collection or sharing of sensitive or nonsensitive personal information for certain purposes such as detecting fraud or identity theft. The bill provides authority for the FTC and state attorneys general to enforce these requirements. Additionally, the FTC must hire 500 new employees to focus on privacy and data security.

Women and Lung Cancer Research and Preventive Services Act of 2021 This bill requires the Department of Health and Human Services to conduct an interagency review of the status of women and lung cancer. The review must report on the status of existing research and current knowledge gaps; identify new opportunities for collaborative research to determine the causes of lung cancer and advance prevention, screening, diagnosis, and treatment; and provide recommendations for a national cancer screening strategy and public education campaign.

Funding for Aviation Screeners and Threat Elimination Restoration Act or the FASTER Act This bill repeals the requirement that a portion of aviation security service fees collected from passengers be credited as offsetting receipts and deposited in the general fund of the Treasury. It requires such fees to be deposited into a separate account in the Treasury for expenditure to pay only the costs of activities and services for which the fee is imposed (i.e., aviation security screening).

RTP Full Funding Act of 202 1 This bill revises provisions regarding the recreational trails program of the Department of Transportation (DOT). Specifically, the bill requires DOT to estimate the total amount of nonhighway recreational fuel taxes received by the Department of the Treasury and transferred to the Highway Trust Fund; the Federal Highway Administration to establish financial management information system codes for certain motorized and non-motorized use projects, including single and diverse use projects; DOT to reserve amounts of the state-apportioned funds for administrative, research, technical assistance, and training expenses to carry out the recreational trails program; and states to obligate a specific amount of reserved funds each fiscal year for the recreational trails program.

Reserve Employers Comprehensive Relief and Uniform Incentives on Taxes Act of 2021 or the RECRUIT Act of 2021 This bill allows employers with less than 500 employees a new tax credit for 40% of the wages paid to a member of the National Guard or a reserve component of the Armed Forces. The employer may elect to claim a payroll tax credit for wages paid to such service members.

Guard Reimbursement for Unhealthy Bites Act or the GRUB Act This bill requires the Department of Defense to pay National Guard members a per diem for each day they performed duty between January 26, 2021, and March 15, 2021, in response to the attacks on January 6, 2021, on the U.S. Capitol building and grounds. The per diem rate must be equal to the proportional meal rate determined by the Defense Travel Management Office for the National Capital Region.

Revitalizing the Economy of Coal Communities by Leveraging Local Activities and Investing More Act of 2021 or the RECLAIM Act of 2021 This bill revises requirements concerning the Abandoned Mine Reclamation Fund, including by expanding the eligible uses of the fund. Specifically, the bill allows the fund to be used to provide support for economic revitalization, diversification, and development in economically distressed mining communities through the reclamation and restoration of land and water resources adversely affected by abandoned coal mines. In addition, it requires specified amounts to be annually distributed from the fund through FY2026 to states and Indian tribes for reclaiming and restoring lands and waters so affected.

National Child Identification Act of 2021 This bill authorizes the Department of Justice to award grants for state attorneys general to distribute in-home fingerprint and DNA identification kits to parents of children who attend kindergarten or elementary school. The kits may be turned over to law enforcement to assist in locating missing or trafficked children.

Improving Access to Nutrition Act of 20 21 This bill repeals certain work requirements for the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program). The requirements apply to able-bodied adults who are ages 18-49 and have no dependent children. Individuals who do not meet certain work requirements are generally prohibited from receiving more than 3 months of SNAP benefits over a 36-month period. Under current law, some of the work requirements under SNAP are temporarily suspended due to COVID-19 (i.e., coronavirus disease 2019).

Hold Congress Accountable Act This bill withholds or eliminates the pay of Members of Congress during a government shutdown. Through the day of the general election in November 2022, any salary earned by Members during a government shutdown must be held in escrow and released on the last day of the 117th Congress. After the November 2022 general election, a Member shall not be paid for any day during which the government is shut down.

Biliteracy Education Seal and Teaching Act or the BEST Act This bill directs the Department of Education to award renewable two-year grants to states to establish or improve, and carry out, Seal of Biliteracy programs to recognize student proficiency in speaking, reading, and writing in both English and a second language. Further, these programs must allow speakers of any official Native American language to use equivalent proficiency in speaking, reading, and writing in such language in lieu of proficiency in English.

Native American Child Protection Act This bill reauthorizes through FY2027 and otherwise revises certain programs related to the prevention, investigation, treatment, and prosecution of family violence, child abuse, and child neglect involving Indian children and families. Specifically, the bill revises the Indian Child Abuse Treatment Grant Program to encourage the use of grants for culturally appropriate treatment services and programs. The bill renames the Indian Child Resource and Family Services Centers as the National Indian Child Resource and Family Services Center. It also requires the center to (1) provide advice, technical assistance, and training to urban Indian organizations; (2) develop certain technical assistance materials for Indian tribes, tribal organizations, and urban Indian organizations; and (3) develop model intergovernmental agreements between tribes and states to prevent, investigate, treat, and prosecute incidents of family violence, child abuse, and child neglect involving Indian children and families. Additionally, the bill revises the Indian Child Protection and Family Violence Prevention Program to allow Indian tribes, tribal organizations, and intertribal consortia to use program funds for additional activities, such as operational costs for child protective services.

COVID-19 Mental Health Research Act This bill requires the National Institute of Mental Health to support mental health research activities related to COVID-19 (i.e., coronavirus disease 2019). The institute must coordinate these activities with other components of the National Institutes of Health.

Jack Reynolds Memory MediGap Expansion This bill expands guaranteed issue rights with respect to Medigap policies (Medicare supplemental health insurance policies) to all beneficiaries with end-stage renal disease. (Guaranteed issue rights require that a policy be offered to any eligible applicant without regard to health status.)

TRICARE Reserve Select Improvement Act This bill expands TRICARE Reserve Select eligibility to include members of the Selected Reserve who are enrolled or eligible to enroll in the Federal Employees Health Benefits Program.

American Patriots of WWII through Service with the Canadian and British Armed Forces Gold Medal Act of 2021 This bill directs the award of a Congressional Gold Medal in honor of the dedicated service of U.S. nationals who voluntarily joined the Canadian and British armed forces during World War II. Following the award, the medal shall be given to the Smithsonian Institution for display and research. The U.S. Mint may strike duplicates in bronze.
