Small Business Health Care Relief Act of 2016

Small Business Health Care Relief Act This bill amends the Internal Revenue Code, the Patient Protection and Affordable Care Act (PPACA), and other laws to exempt qualified small employer health reimbursement arrangements (HRA) from certain requirements that apply to group health plans. A qualified small employer HRA is offered by employers that have fewer than 50 full-time employees and do not offer group health plans to any of their employees. A qualified small employer HRA must: be provided on the same terms to all eligible employees of the employer; be funded solely by the employer without salary reduction contributions; provide, after an employee provides proof of coverage, for the payment or reimbursement of medical expenses of the employee and family members; and limit annual payments and reimbursements to specified dollar amounts. HRAs that meet these requirements are not considered group health plans and are exempt from various requirements that apply to group health plans, including coverage and cost-sharing requirements. (Under current law, employers that sponsor group health plans that do not meet specified requirements are subject to an excise tax.) Coverage and payments under a qualified HRA are excluded from gross income, unless the employee does not have minimum essential coverage for the month in which the medical care was provided. Employers offering a qualified HRA must notify employees in advance regarding permitted benefits and report benefit information on W-2 forms and to health exchanges. The bill sets forth requirements for determining whether an employee covered under an HRA is also eligible for premium subsidies under PPACA.

Harbor Maintenance Trust Fund Reform Act of 2016 This bill amends the Internal Revenue Code to make certain amounts in the Harbor Maintenance Trust Fund available, without appropriation, for expenditures to pay: 100% of the eligible operations and maintenance costs of specified portions of the Saint Lawrence Seaway as well as those assigned to commercial navigation of all U.S. harbors and inland harbors; rebates of certain tolls or charges on the Seaway; and all expenses of administration relating to harbor maintenance tax incurred by the Department of the Treasury, the Army Corps of Engineers, and the Department of Commerce. The Water Resources Reform and Development Act of 2014 is amended to: require allocation to certain donor ports and energy transfer ports of at least 20% of amounts made available each fiscal year from the Trust Fund, and authorize the Department of the Army to make the allocations equally between these kinds of ports. A "donor port" is a port, subject to the harbor maintenance fee, located in a state in which more than 2 million cargo containers were unloaded from or loaded on to vessels in FY2012, whose total amount of collected harbor maintenance taxes comes to less than $15 million annually, and which received less than 25% of the total amount of harbor maintenance taxes collected at that port in the previous five fiscal years. An "energy transfer port" is one, also subject to the harbor maintenance fee, through which more than 40 million tons of cargo were transported in FY2012, and at which energy commodities constituted more than 25% of all commercial activity by tonnage in that fiscal year.

LGBT Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to establish data standards that require: a determination of which existing data sets exclude information about sexual orientation and gender identity; an identification, and a use, of appropriate methods to include questions on sexual orientation and gender identity in surveys that facilitate categorization and voluntary participation and that preserve privacy and confidentiality; and a routine assessment of needed changes in survey methods related to asking such questions. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity. Individuals shall not be: (1) required by this bill to disclose their sexual orientation or gender identity to an agency; or (2) subjected to fines or penalties for refusing to answer, or providing a false answer to, any survey question regarding gender identity or sexual orientation. Nothing in this bill shall be construed to permit the use of such collected information in a manner that would adversely affect an individual.

Middle Class CHANCE Act

Creating Higher Education Affordability Necessary to Compete Economically Act or the Middle Class CHANCE Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify provisions related to the Federal Pell Grant program. Specifically, it increases the maximum Federal Pell Grant award for academic year 2017-2018 and adjusts it in subsequent award years to account for changes in the Consumer Price Index. Additionally, the bill increases from one to two the number of Pell Grants an eligible student may receive in a single award year (i.e., it restores year-round Pell Grants). An eligible student is a student who: (1) has already received one Pell Grant for an award year, (2) is enrolled in an eligible program for an additional payment period (e.g., a summer term) during the same award year, (3) is enrolled on at least a part-time basis, and (4) has completed a full-time course load prior to receiving an additional Pell Grant. A student's total amount of Pell Grants must not exceed 150% of the maximum Pell Grant for that award year. Also, any period during which a student receives an additional Pell Grant counts toward that student's lifetime Pell Grant eligibility period. Finally, the bill increases from 12 to 15 semesters a student's lifetime Federal Pell Grant eligibility period.

Air Traffic Controller Hiring Improvement Act of 2016

Air Traffic Controller Hiring Improvement Act of 2016 This bill directs the Federal Aviation Administration (FAA), in appointing air traffic controllers, to give preferential consideration to qualified individuals maintaining 52 consecutive weeks of experience involving the active separation of air traffic after receipt of an air traffic certification or facility rating within 5 years of application while serving at an FAA air traffic control facility, a civilian or military air traffic control facility of the Department of Defense, or a tower operating under contract with the FAA. The FAA shall consider additional applicants by referring an approximately equal number of employees for appointment among two applicant pools. The number referred from each group shall not differ by more than 10%. Pool one shall consist of applicants who: have successfully completed air traffic controller training and graduated from an institution participating in the Collegiate Training Initiative program and have received an appropriate recommendation or endorsement from such institution, are eligible for a veterans recruitment appointment and provide a Certificate of Release or Discharge from Active Duty within 120 days of the announcement closing, are veterans eligible for veterans' benefits who maintain aviation experience obtained in the course of the individual's military experience, or are preference eligible veterans. Pool two shall consist of applicants who apply under a vacancy announcement recruiting from all U.S. citizens. The FAA: (1) may not use a biographical assessment when hiring, (2) must provide an individual who applied in response to a specified 2014 vacancy announcement and was disqualified as the result of a biographical assessment an opportunity to reapply under the revised hiring practices, and (3) must waive any maximum age limit for such reapplying applicants who met such requirement when they applied under such announcement. Otherwise, the maximum age limit for an original appointment as an air traffic controller under this bill shall be 35 years of age. The FAA shall consider directly notifying secondary schools and institutes of higher learning of a vacancy announcement for pool one applicants.

Dust Off Crews of the Vietnam War Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to make appropriate arrangements for the presentation of a single gold medal in honor of the Dust Off crews (helicopter air ambulance crews) of the Vietnam War in recognition of their heroic military service. It is the sense of Congress that the Smithsonian Institution should also make such medal available for display elsewhere, particularly at appropriate locations associated with the Vietnam War, and that preference should be given to locations affiliated with the Smithsonian.

Opioid and Heroin Abuse Crisis Investment Act of 2016 This bill appropriates funding for the activities in the bill. This bill amends the Public Health Service Act to require the Department of Health and Human Services to enter into cooperative agreements with states to expand opioid treatment capacity, make services more affordable to those who cannot afford them, and help individuals seek treatment, successfully complete treatment, and sustain recovery. (Opioids are drugs with effects similar to opium, such as heroin and certain pain medications.) Funding must be allocated to states based on the severity of the opioid epidemic in the state and the strength of the state's strategy to respond. The Office of the National Coordinator for Health Information Technology must expand efforts to support prescription drug monitoring programs and health information technology interoperability. The Bureau of Prisons must support drug treatment programs. The bill amends the Second Chance Act to require the Department of Justice (DOJ) to help justice-involved individuals successfully reintegrate into the community. The bill amends the Controlled Substances Act to permit DOJ to support the development of residential and aftercare services for substance-involved inmates. DOJ must establish new heroin enforcement groups within the Drug Enforcement Administration to target, disrupt, and dismantle heroin trafficking organizations.

Promoting Life-Saving New Therapies for Neonates Act of 2016 This bill amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to award the sponsor of a new drug or biological product for the treatment of newborns a neonatal drug exclusivity voucher upon approval of the medication. A neonatal drug exclusivity voucher is a transferable voucher for a one-year extension of all existing patents and marketing exclusivities for a brand name medication. For a sponsor to be eligible for a voucher, the new medication must: (1) treat a condition identified in the Priority List of Critical Needs for Neonates required under this bill, and (2) have been studied in newborns. A voucher may be revoked if the new medication is not marketed in the United States within one year of approval. A voucher may not be used: (1) to extend the marketing exclusivity period for a drug for which the FDA requires an assessment of the safety and effectiveness in newborns, or (2) on the same product as a priority review voucher. A sponsor intending to use a voucher must notify the FDA at least 15 months before the expiration of the patents or exclusivity to be extended. The Government Accountability Office must study the effectiveness of this voucher program.

WINGMAN Act

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide an accredited, permanent congressional employee with read-only remote access to the electronic Veterans Benefits Administration (VBA) claims records system of a represented veteran, regardless of whether the employee is acting under a power of attorney executed by the veteran. The VA shall ensure that access does not allow the employee to modify system data. An employee must complete the VA certification process required of agents or attorneys in order to have system access. Each Member of Congress who elects to have an employee participate in the system shall bear the certification cost, which shall be paid from the Member's representational allowance. Information access by an employee shall be deemed: (1) a covered disclosure requiring prior consent, with specified exceptions; and (2) a permitted disclosure relating to the privacy of individually identifiable health information. The VA may not recognize an employee for purposes of preparation, presentation, and prosecution of VA claims by reason of such system access. "Accredited, permanent congressional employee" means an employee of a Member of Congress who assists constituents with issues regarding federal departments or agencies. "Electronic VBA claims records system" means the VA system that provides claim status information, including information about medical records, compensation and pension exams records, rating decisions, a statement of the case and a supplementary statement of the case, a notice of disagreement, and Form-9.

Bathrooms Accessible in Every Situation (BABIES) Act This bill requires male and female restrooms in a public building to be equipped with baby changing facilities that the General Services Administration determines are physically safe, sanitary, and appropriate. Such requirement shall be subject to any reasonable accommodations that may be made for individuals in accordance with the Americans with Disabilities Act. Such requirement shall be inapplicable to a restroom in a public building that: (1) is not available for public use, or (2) contains clear and conspicuous signage indicating where a male or female restroom is located within the same section or corridor of such building.

Investing in Opportunity Act

Investing in Opportunity Act This bill amends the Internal Revenue Code to authorize the designation of opportunity zones in low-income communities and to provide tax incentives for investments in the zones, including deferring the recognition of capital gains that are reinvested in the zones. Governors may submit nominations for a limited number of opportunity zones to the Department of the Treasury for certification and designation. Governors must give particular consideration to areas that: are currently the focus of mutually reinforcing state, local, or private economic development initiatives to attract investment and foster startup activity; have demonstrated success in geographically targeted development programs such as promise zones, the new markets tax credit, empowerment zones, and renewal communities; and have recently experienced significant layoffs due to business closures or relocations. Treasury must designate zones if a governor fails to submit nominations within a specified period of time. The bill defines opportunity funds as any investment vehicle organized as a corporation or a partnership to invest in opportunity zones that holds at least 90% of its assets in opportunity zone assets. Taxpayers may temporarily defer the recognition of capital gains that are invested in opportunity zones or opportunity funds. Investments that are held for at least five years are eligible for capital gains tax reductions or exemptions, depending on how long the investment is held. Treasury must report to Congress on the opportunity zone incentives enacted in this bill, including an assessment of opportunity fund investments at the national and state levels.

Improving Small Business Cyber Security Act of 2016 This bill requires the Small Business Administration (SBA) and the Department of Homeland Security (DHS) to develop a Small Business Development Center Cyber Strategy after the Government Accountability Office issues a report that reviews federal cybersecurity resources aimed at assisting small businesses. The strategy must include: plans for incorporating small business development centers (SBDCs) into existing cyber programs to assist small businesses; counsel and assistance to improve small businesses' cyber security infrastructure, threat awareness, and training programs for employees, including agreements with Information Sharing and Analysis Centers to gain awareness of actionable threat information that may be beneficial to small businesses; and an analysis of how SBDCs can leverage federal programs and develop partnerships to improve cyber support services to small businesses. The Small Business Act is amended to authorize the SBA to make SBDC grants in furtherance of such strategy. SBDCs shall have access to cyber security specialists to counsel their small business clients. The Homeland Security Act of 2002 and the Small Business Act are amended to authorize DHS and other federal agencies coordinating with DHS to assist SBDCs, through the dissemination of cyber security risk information and other homeland security information, to help small businesses in developing such cyber security infrastructure, threat awareness, and employee training programs.

Emmett Till Unsolved Civil Rights Crimes Reauthorization Act of 2016 This bill permanently reauthorizes the Emmett Till Unsolved Civil Rights Crime Act of 2007 (Emmett Till Act) and expands the responsibilities of the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) to include the investigation and prosecution of criminal civil rights statutes violations that resulted in a death, regardless of when the violations occurred. (Currently, the Emmett Till Act is scheduled to expire at the end of FY2017 and such investigations are limited to violations that occurred before 1970.) The bill expresses the sense of Congress that all authorities with jurisdiction should: (1) coordinate information sharing; (2) hold accountable individuals who were perpetrators of, or accomplices in, unsolved civil rights murders; and (3) comply with Freedom of Information Act requests. In investigating a complaint, DOJ may coordinate activities with entities that DOJ determines to be appropriate. DOJ shall reopen and review cases closed without an in-person investigation conducted by DOJ or the FBI. DOJ must establish a task force to conduct a thorough investigation of Emmett Till Act cases. In an annual report to Congress, DOJ must indicate: (1) the number of cases referred by a civil rights organization, an institution of higher education, or a state or local law enforcement agency; (2) the number of such cases that resulted in federal charges; (3) the date any such charges were filed; (4) whether DOJ has declined to prosecute or participate in an investigation of a referred case; and (5) any activity on reopened cases. DOJ may award grants to civil rights organizations, institutions of higher education, and other eligible entities for expenses associated with investigating offenses under the Emmett Till Act.

OPEN Government Data Act

Open, Public, Electronic, and Necessary Government Data Act or the OPEN Government Data Act This bill requires government data assets made available by federal agencies (excluding the Government Accountability Office, the Federal Election Commission, and certain other government entities) to be published as machine-readable data. When not otherwise prohibited by law, the data must be available: (1) in an open format that does not impede use or reuse and that has standards maintained by a standards organization; and (2) under open licenses with a legal guarantee that the data be available at no cost to the public with no restrictions on copying, publication, distribution, transmittal, citing, or adaptation. If published government data assets are not available under an open license, the data must be considered part of the worldwide public domain. Agencies may engage with outside organizations and citizens to leverage public data assets for innovation in public and private sectors. The Office of Management and Budget (OMB) must oversee the completeness and public availability of an enterprise data inventory that agencies must develop to account for any data assets that they create, collect, control, or maintain. Agencies must: (1) make their enterprise data inventories available to the public on Data.gov, and (2) designate a point of contact to assist the public and respond to complaints about adherence to open data requirements. For privacy, security, confidentiality, or regulatory reasons, agencies may maintain a nonpublic portion of their inventories. The OMB's Office of Electronic Government is renamed the Office of the Federal Chief Information Officer. Agencies are not required to publish notices in the Federal Register about information collection that is focused on gathering input about the performance of, or public satisfaction with, the agency's service if the collection is: (1) online and electronic, (2) voluntary with no benefit to the provider of the information, and (3) an extremely low burden that is typically completed in five minutes or less. But agencies must publish representative summaries of such information collections. The General Services Administration must maintain a single public interface online as a point of entry dedicated to sharing open government data with the public. The Chief Information Officers Council must work with the Office of Government Information Services and the Office of Science and Technology Policy to promote data interoperability and comparability of data assets across the government. The OMB must assess the extent of each agency's use of data assets to support decisionmaking, cost savings, and performance.

This bill provides FY2016 emergency supplemental appropriations to the Departments of State and Health and Human Services (HHS) to prevent, prepare for, and respond to the Zika virus and other infectious diseases. The bill specifies permissible uses for the funds and designates the funds as an emergency requirement, which exempts the funds from discretionary spending limits. The bill provides appropriations to HHS for: the Food and Drug Administration, the Centers for Disease Control and Prevention, the National Institutes of Health, and the Public Health and Social Services Emergency Fund. The bill amends the Public Health Service Act to permit Project BioShield to be used to support the advanced development and procurement of medical countermeasures to diagnose, mitigate, prevent, or treat harm from any infectious disease that may pose a threat to the public health. (Under current law, Project BioShield supports only countermeasures against specific chemical, biological, radiological, and nuclear terrorist threats.) The bill temporarily increases from 55% to 65% the Medicaid Federal Medical Assistance Percentage in the territories (Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands). The bill provides appropriations to the Department of State for: the Administration of Foreign Affairs, the U.S. Agency for International Development, Bilateral Economic Assistance, International Security Assistance, and Multilateral Assistance. Unobligated balances of specified funds provided for the Ebola virus may be used to respond to the Zika virus and other infectious diseases.

The program must work with state government agencies to enhance and expand the use of the program, while continuing to: provide free commercial-type online individual income tax preparation and electronic filing services to the lowest 70% of taxpayers by income; provide all taxpayers (regardless of income) with a basic, online electronic fillable forms utility; and work with the private sector to provide the free tax preparation and electronic filing services. Treasury must work with the private sector through the program to identify and implement innovative new program features to improve and simplify the taxpayer's experience with completing and filing individual income tax returns. Infant Plan of Safe Care Improvement Act

Improving Safe Care for the Prevention of Infant Abuse and Neglect Act This bill amends the Child Abuse Prevention and Treatment Act to require the Department of Health and Human Services (HHS), through the national clearinghouse for information relating to child abuse, to maintain and disseminate information about the best practices relating to the development of plans of safe care for infants born affected by illegal substance abuse, withdrawal symptoms, or a Fetal Alcohol Spectrum Disorder. A state plan submitted to HHS for a grant to improve its child protective services system must certify that it has a state law or statewide program relating to child abuse and neglect that includes a plan of safe care for such an infant to ensure its safety and well-being following release from the care of healthcare providers. Annual state data reports shall include the total number of such infants for whom a plan of safe care was developed, and for whom referrals are made for appropriate services, including services for the affected family or caregiver. HHS shall monitor the compliance of each grant-receiving state with applicable current law requirements, including required state policies and procedures regarding care of such infants.
