Constitutional Amendment - Requires the concurrence of two-thirds of the Members of each house of Congress for final adoption of any legislation changing the internal revenue laws, unless such legislation is determined not to increase the internal revenue by more than a de minimis amount. Permits a waiver of this requirement when a declaration of war is in effect or when the United States is engaged in military conflict which causes an imminent and serious threat to national security and is so declared by a joint resolution which becomes law. Prohibits any increase in the internal revenue enacted under such a waiver from lasting more than two years.

Lists the appropriate levels of new budget authority and outlays for specified major functional categories for FY2010-FY2020. Sets forth reconciliation instructions for the House Committees on: (1) Agriculture; (2) Education and Labor: (3) Energy and Commerce; (4) Financial Services; (5) the Judiciary; (6) Natural Resources; (7) Oversight and Government Reform; and (8) Ways and Means. Requires the House Committee on the Budget to report a reconciliation bill that slows the growth in mandatory spending and achieves deficit reduction. Requires each House Committees to identify savings amounting to 1% of total mandatory spending under its jurisdiction from activities determined to be wasteful, unnecessary, or lower-priority. Prohibits House legislation that would require advance appropriations, except for certain FY2012-FY2013 programs, projects, activities, or accounts. States that Rule XXVII (Disclosure by Members and Staff of Employment Negotiations) [ sic ] of the Rules of the House of Representatives shall not apply with respect to adoption by Congress of a budget resolution for FY2011. Prescribes requirements for legislation reported out of committee and designated as an emergency requirement. Requires the Joint Committee on Taxation to calculate the impact of any proposal to change federal revenues on Gross Domestic Product (GDP), total domestic employment, and other specified economic variables. Prohibits the chairman of the House Committee on the Budget from taking into account the provisions of any piece of legislation which propose to increase revenue or offsetting collections if the net effect of the bill is to increase the level of revenue or offsetting collections beyond the level assumed in this concurrent resolution. Makes it out of order in the House to consider direct spending legislation increasing a specified on-budget deficit or decreasing an on-budget surplus for any applicable time period. Requires the chairman of the House Committee on the Budget to maintain a Budget Protection Mandatory Account and a Budget Protection Discretionary Account. Requires the Majority Leader to introduce rescission bills quarterly. Prescribes legislative procedures for their floor consideration. Expresses the sense of the House regarding: (1) baseline revenue projections; and (2) long-term budget projections. Establishes an earmark moratorium for FY2011 for legislation providing or authorizing discretionary budget authority, credit or other spending authority, providing a federal tax deduction, credit, or exclusion, or modifying the Harmonized Tariff Schedule in FY2011. Prohibits the House Committee on Rules from reporting a rule or order waiving such moratorium. Declares it is the policy of this resolution that: (1) the Patient Protection and Affordable Care Act (P.L. 111-148) and the Health Care and Education Reconciliation Act of 2010 (P.L. 111-152) should be repealed; and (2) in their place, health care reform that empowers patients should be enacted.

Student Veteran Counseling Improvement Act - Directs the Secretary of Veterans Affairs (VA) to establish a toll-free telephone number to provide mental and behavioral health professionals with information related to the treatment and counseling of a veteran reporting symptoms of: (1) post-traumatic stress disorder (PTSD); (2) traumatic brain injury; (3) anxiety; (4) depression; (5) sexual assault; (6) sexual trauma; (7) readjustment disorder; or (8) other service-connected mental health conditions. Requires that a licensed mental health counselor employed by the VA operate the hotline and provide such information. Directs the Secretary to notify each institution of higher learning of the hotline and provide hotline information on the VA's Internet website. Requires the Secretary to provide mental and behavioral health professionals at each institution of higher learning with training on such information.

American Self-Defense Protection Act of 2010 - Expresses the sense of Congress that: (1) the United States should not ratify, nor should the President submit for ratification, the Rome Statute of the International Criminal Court (ICC); (2) the President and the Secretary of State should not undertake actions that could legitimize the ICC; (3) the President and the Secretary should lead a diplomatic effort to encourage additional countries to enter into agreements with the United States preventing the ICC from proceeding against U.S. personnel present in such countries; (4) the President and the Secretary should lead a diplomatic effort to defend the right to self-defense of the United States and other democracies, including Israel, against efforts such as the Goldstone Report that seek to deny democracies that very right via entities like the ICC; and (5) the President and the Secretary should explore alternative forums to combat impunity for war crimes and other atrocities while respecting the sovereignty and right to self-defense of democracies. Prohibits funds made available to any U.S. government, state, or local department, agency, or entity, including any court, from being used for U.S. participation in the ICC or its attendant activities, including any review conference or meeting of the Assembly of States Parties.

Declares that this Act does not preempt or interfere with: (1) any authority to consider the climate change effects or greenhouse gas emissions effects of proposed legislation or regulations specifically addressing greenhouse gas emissions; or (2) requirements to consider the potential climate change effects or greenhouse gas emission effects of proposals for agency action during planning or design processes under provisions of law other than NEPA.

Unborn Child Pain Awareness Act of 2010

Unborn Child Pain Awareness Act of 2010 - Amends the Public Health Service Act to require an abortion provider who knowingly performs an abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks or more after fertilization), to first: (1) inform the woman of the probable age of the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt); (3) provide information that pain medicine administered to the mother may not prevent pain in the child, but in some cases anesthesia or pain-reducing drugs can be administered directly to the child; (4) give the woman the provider's best medical judgment of the risks and costs of such anesthesia or analgesic; and (5) obtain the woman's signature on the Unborn Child Pain Awareness Decision Form and her explicit request for or refusal of the administration of drugs to the child. Requires the Secretary of Health and Human Services (HHS) to develop the Unborn Child Pain Awareness Brochure that includes a statement that there is substantial evidence that the process of being killed in an abortion will cause the unborn child pain and that the mother has the option of having pain-reducing drugs administered directly to the child. Creates an exception to save the life of the mother. Establishes civil penalties for willfully failing to comply with this Act. Authorizes: (1) the U.S. Attorney General to bring a civil action under this Act; and (2) private rights of action for violations of this Act.

Defense Sexual Trauma Response Oversight and Good Governance Act (Defense STRONG Act) - Establishes within the Department of Defense (DOD) a Director of the Sexual Assault Prevention and Response Office to serve as the single point of authority, accountability, and oversight for DOD policy regarding prevention of and response to sexual assault, and to provide oversight to ensure that the sexual assault programs of the military departments comply with DOD policy. Requires the assignment within each military department of at least one full-time Sexual Assault Response Coordinator and one full-time Sexual Assault Victim Advocate, allowing the Secretary of the military department concerned to assign additional coordinators and/or advocates based on the demographics or needs of the unit. Allows only members of the Armed Forces (members) or DOD civilian personnel to be assigned as coordinators or advocates. Directs the Secretary of Defense to establish a professional training and certification program for such coordinators and advocates, and requires performance evaluations of all coordinators and advocates. Entitles any member, or dependent of a member, who is the victim of a sexual assault to legal assistance provided by a military legal assistance counsel and Victim Advocate service, regardless of whether the member or dependent elects unrestricted or restricted (confidential) reporting of the assault. Makes privileged any communications between a member or dependent and a Victim Advocate. Directs the Secretary to provide for the inclusion of a sexual assault prevention and response training module at each level of professional military education.

Second Amendment Enforcement Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, transporting for legitimate purposes, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Declares that nothing in such prohibitions shall be construed to prohibit the District from regulating the carrying of firearms by a person, either concealed or openly, other than at the person's dwelling place, place of business, or on other land possessed by the person. Amends the Firearms Control Regulations Act of 1975 (FCRA) to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" as any firearm which shoots, is designed to shoot, or can be readily restored to shoot automatically, more than one shot without manual reloading by a single function of the trigger. Includes also the frame or receiver of any such firearm, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a firearm into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; and (2) requirement that licensed firearms dealers keep records of ammunition received into inventory and ammunition sold or transferred. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Permits a licensed firearms dealer to sell or transfer ammunition, excluding restricted pistol bullets, to persons not otherwise prohibited from possessing or receiving ammunition. Declares that, in the case of a sale or transfer of a handgun to a District resident, a federally licensed importer, manufacturer, or dealer of firearms in Maryland or Virginia shall be treated as a dealer licensed under this Act if: (1) the transferee meets in person with the transferor to accomplish the transfer; and (2) the sale, delivery, and receipt fully comply with the legal conditions of sale in both the District and the jurisdiction in which the transfer occurs. Amends FCRA to allow an individual to possess ammunition in the District if the individual owns (currently, holds the valid registration certificate for) a firearm of the same gauge or caliber as such ammunition. (In effect, repeals the handgun ammunition ban.) Repeals the requirement that firearms in the possession of individuals (other than law enforcement personnel) must be kept unloaded, disassembled, or with the trigger locked, unless the firearm is kept at an individual's place of business, or while being used for lawful recreational purposes within the District . Continues current criminal penalties for allowing access of a minor (under age 16) to loaded firearms, except in specified circumstances. Repeals increased penalties for violations of the prohibition against allowing access of a minor to loaded firearms if injury or death results to the minor or another person. Requires the U.S. attorney, however, to consider both the extent of the minor's injuries and the effect of the minor's injury or death on both of the minor's parents when deciding whether to file charges. Prohibits any prosecution in such circumstances unless the person who committed the violation behaved in a grossly negligent manner, or unless similarly egregious circumstances exist. Eliminates criminal penalties for possessing an unregistered firearm. Amends the District of Columbia Code to: (1) allow private persons or entities owning property in the District to prohibit or restrict the possession of firearms on their property (other than authorized law enforcement personnel or lessees occupying residential or business premises); (2) prohibit unauthorized carrying of rifles or shotguns in the District; (3) authorize certain individuals to carry firearms in certain places and for certain purposes; (4) prescribe requirements for lawful transportation of firearms; and (5) prohibit the use of toy and antique pistols to commit a violent or dangerous crime. Authorizes the District of Columbia to prohibit or restrict the possession of firearms (except to lessees occupying residential or business premises) within any building or structure under its control, or in any area of it, which has implemented security measures to identify and exclude unauthorized or hazardous persons or articles. Amends the Office of Administrative Hearings Establishment Act of 2001 to grant jurisdiction to the Office of Administrative Hearings to hear cases pertaining to denial or revocation of firearm dealer licenses. Repeals the Firearms Registration Amendment Act of 2008 and the Inoperable Pistol Amendment Act of 2008. Restores and revives any provision of law amended or repealed by such Acts as if such Acts had not been enacted into law.

UNRWA Humanitarian Accountability Act - Amends the Foreign Assistance Act of 1961 to withhold U.S. contributions to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) or to any successor or related entity unless the Secretary of State certifies to Congress that: (1) no UNRWA official, employee, representative, or affiliate is a member of a foreign terrorist organization, has propagated anti-American, anti-Israel, or anti-Semitic rhetoric, or has used UNRWA resources to propagate political materials regarding the Israeli-Palestinian conflict; (2) no UNRWA facility is used by a foreign terrorist organization; (3) no UNRWA school uses educational materials that propagates anti-American, anti-Israel, or anti-Semitic rhetoric; (4) UNRWA is subject to auditing oversight; and (5) UNRWA holds no accounts or other affiliations with financial institutions deemed by the United States to be complicit in money laundering and terror financing. Haiti Assistance Implementation, Transparency, and Inspection Act or HAITI Act - Establishes, in the Executive Office of the President, the Office of the Special Coordinator for Assistance to Haiti which shall: (1) advise the President on U.S. government programs for the relief and development of Haiti; (2) implement a comprehensive strategy for such programs' coordination and oversight; and (3) directly approve such programs. Terminates the Office two years after enactment of this Act. Establishes the Office of the Special Inspector General for Assistance to Haiti which shall provide for the independent and objective conduct and supervision of audits and investigations relating to U.S. government programs for the relief and development of Haiti. Directs the Special Inspector General to appoint a Special Assistant Inspector General for Auditing and a Special Assistant Inspector General for Investigations. Terminates the Office 180 days after the date on which unexpended amounts appropriated or otherwise made available for U.S. government programs for the relief and development of Haiti are less than $25 million. Directs the President to: (1) ensure that U.S. government programs for the relief and development of Haiti are grounded in an exhaustive U.S. assessment of Haiti's development needs and capacity; and (2) seek to lead efforts to ensure that any pledged international assistance for Haiti is based on defined objectives and includes measures that provide for mutual accountability and oversight.

Security Council resolutions, international treaties, conventions, and other agreements prohibiting the import into or export from Iran of such items; (3) measures taken by the United States, or in cooperation with other countries or international organizations, to hold violators accountable; and (4) the interdiction assistance actions taken by foreign governments during the preceding 120-day period.

Cabin Fee Act of 2010 - Requires the payment of an annual "cabin user fee" by a "cabin owner." Defines: (1) "cabin user fee" as the annual fee paid to the United States by a cabin owner pursuant to an authorization for the use and occupancy of a cabin on National Forest System land derived from the public domain; (2) "cabin owner" as a person, heir, trust, or assignee authorized to use, occupy, and dispose of a cabin on National Forest System lands derived from the public domain or an heir or assignee of such a person; and (3) "cabin" as a privately built and owned recreation residence and related improvements on National Forest System land derived from the public domain that is authorized for private use and occupancy and may be sold or transferred between private parties. Directs the Secretary of Agriculture (USDA) to set such fee. Requires a reduction in the cabin use fee to $100 per year if access to a cabin is significantly impaired, whether by catastrophic events, natural causes or governmental actions, such that the cabin is rendered unsafe or unable to be occupied. Requires payment of a "cabin transfer fee" to the United States upon the transfer of a cabin between private parties for money or other consideration. Requires the Secretary to retain revenues from cabin user fees and cabin transfer fees necessary to cover costs incurred by the Forest Service in administering the Recreation Residence Program.

RESTART Act

Rare Earths Supply-Chain Technology and Resources Transformation Act of 2010 or the RESTART Act - Directs the Secretaries of Commerce, of Defense, of Energy, of the Interior, and of State to: (1) appoint an Executive Agent, at the Assistant Secretary level, to serve as a representative on an interagency working group to reestablish a competitive domestic rare earth supply chain; and (2) assess and report to Congress on the chain, determining which rare earth elements are critical to national and economic security. Directs the United States Trade Representative (USTR) and the Office of Science and Technology Policy also to appoint representation to such working group. Requires the Secretary of Defense to commence procurement of critical rare earth materials and place them in a national stockpile, and the Defense Logistics Agency, Defense National Stockpile Center to serve as Administrator of the stockpile. Authorizes the Administrator, if necessary to meet U.S. national security and economic needs, to purchase rare earth materials from the People's Republic of China. Instructs the USTR to: (1) initiate and report to Congress on a comprehensive review of international trade practices in the rare earth materials market; or (2) initiate an action before the World Trade Organization (WTO) as a result of the review. Directs the Secretaries of Commerce, of the Interior, and of State to report to the domestic rare earth industry about mechanisms for obtaining government loan guarantees to reestablish a domestic rare earth supply chain. Directs the Secretaries of Defense and of Energy to issue guidance for the industry related to obtaining such loan guarantees. Expresses the sense of Congress regarding a prioritization of Defense Production Act projects with respect to the domestic rare earth supply chain.
