Preserving Access to Healthcare (PATH) Act of 2008 - Declares that between October 1, 2008, and March 31, 2009, specified regulations regarding the formula for determining the federal rate for inpatient hospital capital-related costs under the Medicare prospective payment system (PPS) shall apply without the mandatory phase out of the indirect medical education adjustment factor. Directs the Secretary of Health and Human Services to delay for six months following enactment of this Act any implementation of the Medicaid outpatient hospital services regulation proposed on September 28, 2007. Prohibits the Secretary from phasing out or eliminating the Medicare hospice wage index budget neutrality adjustment factor before April 1, 2009. Directs the Secretary, acting through the Administrator of the Centers for Medicare and Medicaid Services and upon the request of the state of California, to extend approval, and full federal financial participation, of the state's Medicaid family planning demonstration project until June 30, 2009, under the eligibility requirements and processes that were in place before the project's first extension period. Amends title XVIII (Medicare) of the Social Security Act to increase funding for the Medicare Improvement Fund.

Protecting Hospital Outpatient and Community Clinic Services Act of 2008 - Prohibits the Secretary of Health and Human Services from taking any action before April 1, 2009 (including promulgation of regulations, issuance of regulatory guidance, use of federal payment audit procedures, or other administrative action, policy, or practice, including a Medical Assistance Manual transmittal or letter to state Medicaid directors), to impose any restrictions relating to a specified proposed regulation, if such restrictions are more restrictive in any aspect than those that applied to the subject matter of the proposed regulation as of September 27, 2007. Identifies the proposed regulation as the one published on September 28, 2007, relating to the outpatient clinic and hospital facility services definition and upper payment limit under title XIX (Medicaid) of the Social Security Act.

James Zadroga 9/11 Health and Compensation Act of 2008 - Amends the Public Health Service Act to establish within the National Institute for Occupational Safety and Health the World Trade Center Health Program (WTC program) to provide: (1) medical monitoring and treatment benefits to eligible emergency responders and recovery and cleanup workers who responded to the World Trade Center terrorist attacks on September 11, 2001; and (2) screening and treatment benefits to residents and other building occupants and area workers who were directly impacted and adversely affected by such attacks. Requires the WTC program administrator to: (1) implement a quality assurance program; (2) establish the WTC Health Program Scientific/Technical Advisory Committee; (3) establish the WTC Responders Steering Committee and the WTC Community Program Steering Committee; (4) provide for education and outreach on services under the WTC program; (5) provide for the uniform collection of data related to WTC-related health conditions; (6) conduct research on physical and mental health conditions that may be related to the September 11 terrorist attacks; and (7) extend and expand arrangements with the New York City Department of Health and Mental Hygiene to provide for the World Trade Center Health Registry. Authorizes the administrator to make grants to the Department to address mental health needs relating to the terrorist attacks. Amends the Air Transportation Safety and System Stabilization Act to: (1) make individuals eligible for compensation under the September 11 Victim Compensation Fund of 2001 for harm as a result of debris removal; and (2) extend the deadline for making a claim for compensation. Sets forth provisions governing the application of the economic substance doctrine to transactions.

Act to Save America's Forests - Amends the Forest and Rangeland Renewable Resources Planning Act of 1974 to revise eligibility criteria for members of the land and resource management scientific committee. Revises the committee termination date. Directs the Chief of the Forest Service, the Director of the U.S. Fish and Wildlife Service, and the Director of the Bureau of Land Management to each prepare a continuous inventory of forest land administered by each agency head and to document whole-system measures that will be taken as a result of the inventory. Requires the Secretary of Agriculture to provide for conservation and restoration of native biodiversity in forested areas. Prohibits clearcutting or other even-age logging operations on any stand or watershed on certain federal land, National Forest System land, and National Wildlife Refuge System land. Provides for federal enforcement and a private right of action. Designates special areas which shall be subject to restrictions on road construction and logging in Alabama, Alaska, Arizona, Arkansas, Colorado, Georgia, Idaho, Illinois, Michigan, Minnesota, Missouri, Montana, New Mexico, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Vermont, Virginia, Wisconsin, and Wyoming. Requires the Secretaries concerned to appoint a committee of independent scientists to recommend additional special areas. Restricts road construction and logging on federal land in ancient forests, special areas, roadless areas, and watershed protection areas. Provides for federal enforcement and a private right of action. States that this Act and the amendments made by this Act shall not apply to federal wilderness areas designated under the Wilderness Act. Adds specified land to the Giant Sequoia National Monument. Transfers administrative jurisdiction over the Monument from the Secretary to the Secretary of the Interior. Establishes the Giant Sequoia National Monument Advisory Board. Adds specified parts of Sequoia National Forest that are not included in the Monument to: (1) Sierra National Forest; and (2) Inyo National Forest. Directs the Secretary of the Interior to conduct reconnaissance surveys of areas classified as Level III ecoregions of the continental United States by the Environmental Protection Agency (EPA) to determine if there are resources that possess national significance and to evaluate their suitability for inclusion as units of the National Park System. Requires the appointment of a committee of scientists to provide the Secretary and Congress with advice and counsel on such surveys.

Commemorates the 10th anniversary of the establishment of the Minority AIDS Initiative. Commends the efforts of community organizations and health care providers in minority communities to deliver HIV/AIDS care and services. Encourages minorities to educate themselves about the HIV/AIDS prevention and treatment and to reduce HIV related stigma. Expresses support for the continued funding of the Initiative and other federal programs to stop the spread of HIV/AIDS and provide treatment to those affected.

Encourages the Administrator of the United States Agency for International Development (USAID) to establish and administer the Global Autism Assistance Program to: (1) support activities by nongovernmental organizations and other service providers, including advocacy groups, focused on autism in developing countries; and (2) establish a "teach the teachers" program to train health and education professionals working with autistic children in developing countries.

Stephanie Tubbs Jones Gift of Life Medal Act of 2008 - Makes any organ donor, or the family of any organ donor, eligible for a Stephanie Tubbs Jones Gift of Life Medal. Requires the Secretary of Health and Human Services to direct the Organ Procurement and Transplantation Network to establish an application procedure, determine eligibility, and arrange for the presentation of medals. Allows only one medal per family. Requires that such medal be presented to the donor or, in the case of a deceased donor, the family member who signed the consent form authorizing the organ donation. Authorizes the Network to collect funds to offset expenditures relating to the issuance of medals. Requires the Secretary of the Treasury to design and strike the Stephanie Tubbs Jones Gift of Life Medals using certain specifications. Provides that a medal under this Act shall not be treated as valuable consideration for purposes of prohibiting transferring human organs for valuable consideration.

Humanitarian Relief to Cuba Act - Prohibits for 180 days from the enactment of this Act: (1) the President from prohibiting or regulating travel to or from Cuba, or certain transactions incident to such travel, by a U.S. citizen or any person subject to U.S. jurisdiction with family residing in Cuba; (2) the President from limiting the size, quantity or frequency, or the carrying or shipping of, personal gift items and relief supplies by any person subject to U.S. jurisdiction that are eligible to be so shipped or delivered; and (3) the Secretary of the Treasury from limiting the amount of remittances to Cuba that may be made by any person subject to U.S. jurisdiction.

Securing Eligibility for Needed Donations Act of 2008 or the SEND Act of 2008 - Prohibits Department of Commerce funds from being used to implement, administer, or enforce specified amendments to Department regulations restricting gift parcels and humanitarian donations to Cuba. (The amendments prohibit: (1) the sending of gifts of clothing, personal hygiene items, seeds, fishing equipment, soap-making equipment, and veterinary medicine and supplies; and (2) more than one gift parcel of certain permitted items a month per household.)

Health-e Information Technology Act of 2008 - Amends the Public Health Service Act to establish: (1) an Office of the National Coordinator for Health Information Technology; and (2) an HIT Advisory Committee. Requires the National Coordinator to develop a Health Information Technology Resource Center and to recommend health information technology standards for adoption by the Secretary of Health and Human Services. Directs agencies to utilize, where available, health information technology systems and products that meet adopted standards. Requires the Director of the National Institute for Standards and Technology (NIST) to test adopted standards to assure the efficient implementation and use of such standards. Amends XVIII (Medicare) of the Social Security Act to provide for incentive payments to physicians and inpatient hospitals that meaningfully use a certified health information technology system. Authorizes the National Coordinator to award grants to purchase qualified health information technology and to implement regional or local health information plans. Provides for grants to develop academic curricula integrating qualified health information technology in the clinical education of health professionals. Revises provisions governing the privacy and security of health information, including to: (1) extend requirements to business associates of a covered entity; (2) require notification in the event of a breach of protected health information; (3) limit disclosure of such information to the minimum necessary to accomplish the intended purpose; and (4) revise penalties for violations. Requires the Secretary to appoint a Chief Privacy Officer of the Office of National Coordinator to assist in carrying out duties related to the privacy and security of health information.

Medicare Hospice Protection Act of 2008 - Prohibits the Secretary of Health and Human Services from phasing out or eliminating the budget neutrality adjustment factor in the Medicare hospice wage index before October 1, 2009. Directs the Secretary to recompute and apply the final Medicare hospice wage index for FY2009 as if there had been no reduction in the budget neutrality adjustment factor.

Home Health Care Planning Improvement Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to revise conditions of and limitations on payment for home health care services. Allows payment for home health services to Medicare beneficiaries by: (1) a nurse practitioner; (2) a clinical nurse specialist working in collaboration with a physician in accordance with state law; (3) a certified nurse-midwife; or (4) a physician assistant under a physician's supervision.

National Cancer Fund Act of 2008 - Amends the Internal Revenue Code to: (1) establish in the Treasury the National Cancer Fund for programs to fight cancer, including for expenditures for cancer research, early detection and treatment, and tobacco cessation; (2) increase the excise tax rate on tobacco products and dedicate increased tax revenues to the Fund; and (3) impose permit, reporting, and recordkeeping requirements on manufacturers of processed tobacco. Amends the Public Health Service Act to: (1) revise the membership and duties of the President's Cancer Panel; and (2) require the Panel to study the feasibility of additional funding sources for the National Cancer Fund.

Securing Our Borders and Our Data Act of 2008 - Sets forth rules for the search or seizure at a U.S. border of digital electronic devices or digital storage media. Prohibits a search of the digital contents of such devices or media unless such search is based on: (1) a reasonable suspicion regarding the owner of such devices or media; and (2) an independent constitutional authority to make a seizure (other than the authority for border searches). Requires officers at U.S. borders to receive appropriate training to make searches of digital devices or media to minimize the possibility of irreparable damage to such devices or media. Allows the owners of such devices and media to request that searches be conducted out of public view. Requires the Secretary of Homeland Security to: (1) make rules regarding border searches of digital devices and storage media, including rules to protect the integrity of digital data, for the retrieval of seized devices or media by owners, and for sharing such data with other governmental agencies; and (2) publish such rules on the Department of Homeland Security (DHS) website. Requires the Commissioner of U.S. Customs and Border Protection to conduct an annual study of searches and seizures of digital devices and storage media at U.S. borders and report to Congress on such study.

Oncology Quality Care Improvement Act of 2008 - Directs the Secretary of Health and Human Services to establish budget neutral demonstration projects to test and evaluate methods that: (1) improve the quality of care provided to eligible beneficiaries with certain cancer diagnoses; and (2) reduce expenditures that would otherwise be made under the Medicare program on behalf of such individuals for such diagnoses. Authorizes the participation of oncology care groups of physicians, or of physicians and oncology nurse practitioners, in such demonstration projects, subject to certain conditions.

Civil Rights Quarter Dollar Coin Act of 2008 - Requires quarter dollars to have designs on the reverse emblematic of prominent civil rights leaders and important events that have advanced civil rights in America. Instructs the Secretary of the Treasury to select such leaders and events. Requires five coin designs in each year of the period of issuance. Instructs the Secretary to strike and make available for sale silver bullion coins that are exact duplicates of such quarter dollars.

Nurses' Higher Education and Loan Repayment Act of 2008 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration (HRSA), to enter into an agreement with eligible individuals for the repayment of education loans in exchange for working as a full-time member of the faculty of an accredited school of nursing.

Employee Verification Amendment Act of 2008 - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to extend the employment eligibility confirmation pilot programs (which includes the E-Verify basic pilot program) for five years. Directs the Commissioner of Social Security and the Secretary of Homeland Security, for fiscal years beginning on or after October 1, 2008, to enter into a fiscal year agreement which shall: (1) provide funds to the Commissioner for such programs' full costs in quarterly advances; and (2) require an annual accounting and reconciliation of costs incurred and funds provided. Provides for interim funding continuation (based upon the latest agreement) if an agreement has not been reached by October 1 of a fiscal year. Requires that the Government Accountability Office (GAO) conduct studies regarding: (1) erroneous tentative nonconfirmations under the E-Verify program; and (2) such program's effects on small entities.

Recognizes that it is imperative that this nation strengthen its public health system to provide all persons with the resources they need to make healthier choices and live healthier lives and to protect people from health threats beyond their control. Commits to creating public health strategies to eliminate health disparities and improve the health of all people in the United States. Expresses support for prioritizing public policies focusing on the prevention of disease and injury and calls for community-based programs to support healthy lifestyles. Urges the expansion of the prevention strategies of daily aspirin therapy, smoking cessation, colorectal cancer screening, annual flu immunizations, and breast cancer screening. Declares that the congressional budget process should reflect the savings associated with investments in the prevention of disease and injury. Encourages the Congressional Budget Office (CBO) to consider the savings associated with a reduced chronic disease burden due to preventive services and programs when formulating its health care cost estimates. Pledges support for increasing the investment in federal public health programs to at least 1% of total federal spending within five years.

Prevention of Equine Cruelty Act of 2008 - Amends the federal criminal code to impose a fine and/or prison term of up to three years for possessing, shipping, transporting, purchasing, selling, delivering, or receiving any horse, horse flesh, or carcass with the intent that it be used for human consumption. Reduces the prison term to one year if the offense involves less than five horses or less than 2,000 pounds of horse flesh or carcass and the offender has no prior conviction for this offense.

Provides for cost-sharing with workers' compensation and health insurance plans, but not with eligible individuals. Requires the WTC program administrator to: (1) implement a quality assurance program; (2) review the program's health care expenditures to detect fraudulent or duplicate billing and payment for inappropriate services; (3) establish the WTC Health Program Scientific/Technical Advisory Committee; (4) establish the WTC Responders Steering Committee and the WTC Community Program Steering Committee; (5) institute a program that provides education and outreach on the existence and availability of services under the WTC program; and (6) provide for the uniform collection of data related to WTC-related health conditions. Authorizes the Secretary of Health and Human Services to establish similar programs with respect to the terrorist attack at the Pentagon on September 11, 2001. Requires the administrator to conduct or support research on physical and mental health conditions that may be related to the September 11 terrorist attacks. Requires the administrator to extend and expand arrangements with the New York City Department of Health and Mental Hygiene to provide for the World Trade Center Health Registry. Authorizes the administrator to make grants to the Department to address mental health needs relating to the terrorist attacks. Amends the Air Transportation Safety and System Stabilization Act to provide, under certain circumstances, for an extension of time for filing claims under the September 11 Victim Compensation Fund of 2001.

Local Officials Tax Relief Act of 2008 - Amends the Internal Revenue Code and Title II (Old Age, Survivors, and Disability Insurance) of the Social Security Act to exempt from social security taxes remuneration paid to any elected or appointed member of any general governing board, commission, or committee of any political subdivision of a state if such remuneration is not more than $1,300 and is paid for service performed on or after January 1, 2008.

Tom Lantos Pulmonary Hypertension Research and Education Act of 2008 - Expresses the sense of the Congress that: (1) the Secretary of Health and Human Services, acting through the Director of the National Institutes of Health (NIH) and the Director of the National Heart, Lung, and Blood Institute, should continue aggressive work on pulmonary hypertension; and (2) the Director of the Institute should continue research to expand the understanding of the causes of, and to find a cure for, pulmonary hypertension. Requires inclusion of information on the status of pulmonary hypertension research at NIH in biennial reports to Congress. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to carry out an educational campaign to increase public awareness of pulmonary hypertension. Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration (HRSA) and the Director of CDC, to carry out an educational campaign to increase awareness of pulmonary hypertension among health care providers. Directs the Comptroller General to study and report to Congress on Medicare and Medicaid coverage standards that apply to patients with pulmonary hypertension, including standards for all therapies approved by the Food and Drug Administration (FDA) for the treatment of pulmonary hypertension.

Amends the Water Resources Development Act of 1996 to eliminate the pilot program status of the Chesapeake Bay environmental restoration and protection program. Permits the nonfederal share of project costs of a local cooperation agreement to include in-kind services. Treats funds provided for a project by a federal agency other than the Corps of Engineers as nonfederal funds for purposes of cost sharing requirements. Authorizes the Secretary of the Army to carry out projects under the program in the Chesapeake Bay watershed, with the goal of carrying out projects in Delaware, New York, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia (currently the Secretary is required to establish at least one project in each of Maryland, Virginia, and Pennsylvania). Directs the Secretary to establish a program, to be administered by the National Fish and Wildlife Foundation, to provide small watershed grants for technical and financial assistance to local governments and nonprofit organizations in the Chesapeake Bay region. Permits the use of grant funds only for implementation of cooperative tributary basin and other Chesapeake Bay-wide strategies that address storm water management or the establishment, restoration, protection, or enhancement of natural habitat associated with the Chesapeake Bay ecosystem. Increases the authorization of appropriations for the Cheasapeake Bay program. Directs the Secretary to develop at federal expense and submit to Congress a comprehensive plan to prioritize projects within the Chesapeake Bay watershed.

Drug Testing Integrity Act of 2008 - Makes it unlawful to knowingly manufacture, market, sell, ship, or otherwise provide to another individual any product with the intent to assist such individual to use such product to defraud a drug test. Defines "defraud a drug test" to mean to: (1) submit a substance that purports to be from an individual other than its actual source, or purports to have been excreted or collected other than when it was actually excreted or collected; or (2) engage in any other conduct with the intent to produce a false or misleading outcome of a test for the presence of a controlled substance. Grants the Federal Trade Commission (FTC) enforcement powers as a violation of an unfair or deceptive act or practice.

Great Lakes Legacy Reauthorization Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to include aquatic habitat restoration activities among activities the Great Lakes National Program Office is authorized to implement for the remediation of sediment contamination in areas of concern. Prohibits the Administrator of the Environmental Protection Agency (EPA) from implementing such a remediation project if any nonfederal sponsor has not entered into a written agreement with the Administrator under which each party agrees to carry out its responsibilities and requirements for the project. Revises provisions concerning the nonfederal share of the project costs. Requires the Administrator to implement at federal expense the initial site characterization of a project for the remediation of contaminated sediment. Repeals a prohibition against implementing a project unless the nonfederal sponsor agrees to maintain aggregate expenditures from all other sources for remediation programs in the area of concern in which the project is located at or above the average level of such expenditures in the two fiscal years preceding the date on which the project is initiated. Authorizes appropriations through FY2013 for: (1) such remediation projects; and (2) the development and use of innovative approaches, technologies, and techniques for such remediation. Recognizes the 25th anniversary of "Black July" and mourns its victims and the victims of the ongoing violence in Sri Lanka. Condemns attacks on civilian populations by the Liberation Tigers of Tamil Eelam (LTTE) and urges the cessation of violence and the recruitment of child soldiers. Urges the government of Sri Lanka to pursue a political resolution, rather than a military solution, to the conflict. Calls upon the President to urge Sri Lanka to accept an international human rights monitoring presence. Supports U.S. efforts to work with the government of Sri Lanka, other relevant stakeholders to the conflict, and the international community to facilitate humanitarian operations, hold accountable violators of human rights and international humanitarian law, and promote conditions for a lasting peace.

Healthy Transition Act of 2008 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to award grants or cooperative agreements to states: (1) to develop plans for the statewide coordination of services to assist adolescents and young adults with a serious mental health disorder in acquiring the skills, knowledge, and resources necessary to ensure their healthy transition to successful adult roles and responsibilities; and (2) for the coordination of such services. Requires the Secretary to designate a federal entity, or establish a Committee of Federal Partners, to coordinate programs providing such services. Directs such entity or committee to: (1) review how federal programs and efforts that address issues related to the transition of adolescents and young adults with serious mental health disorders may be coordinated to ensure the maximum benefit for the individuals being served; and (2) provide technical assistance to the states who are planning or implementing programs under this Act.

Reaffirms the historic commitment of the United States as a nation founded by refugees. Calls on: (1) the Department of State to support the refugee assistance efforts of the United Nations High Commissioner for Refugees and of nongovernmental organizations; (2) the U.S. government to continue its international leadership role in response to the people of the Darfur region of Sudan who have been displaced by Sudan's genocide; and (3) the Department of State and the Department of Homeland Security to facilitate the resettlement of an appropriate number of Darfuris. Urges the parties to the conflicts in and between Chad and Sudan to conclude a cessation of hostilities agreement. Calls upon the Joint African Union-United Nations Special Representative for Darfur to ensure that displaced persons are fairly represented in peace negotiations. Affirms the goals of World Refugee Day and reiterates a strong commitment to protecting the millions of refugees who live without material, social, and legal protections.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.
