Helping Medicaid Offer Maternity Services Act of 2019 or the Helping MOMS Act of 2019 This bill allows states to provide one year of postpartum coverage under Medicaid and the Children's Health Insurance Program (CHIP). (Current law requires 60 days of postpartum coverage.) Additionally, the Medicaid and CHIP Payment and Access Commission must report on specified information relating to coverage of doula services under state Medicaid programs, including coverage barriers and recommendations for improvement.

Excellence in Maternal Health Act of 2019 This bill expands initiatives to address maternal health in rural areas and promote innovation in the field. Specifically, the bill requires the Health Resources and Services Administration (HRSA) to establish rural obstetric networks for improving outcomes in birth and maternal morbidity through collaboration, training, and program evaluation. HRSA also must award demonstration program grants to (1) train physicians, medical residents, and other practitioners to provide maternal and obstetric services in rural communities; and (2) support academic programs that develop or provide training to improve maternal care in rural areas. Further, the bill adds maternal health services as part of the telehealth network and telehealth resource centers grant programs. The bill also makes a series of changes to the research and reporting requirements of the Department of Health and Human Services and the Government Accountability Office with respect to data on maternal health outcomes. Additionally, the bill establishes grants to (1) develop best practices to reduce preventable maternal mortality; (2) train health care professionals about reducing and preventing discrimination when providing maternal health services; (3) support the collaboration of professionals across health settings with respect to maternal health; (4) establish evidence-informed, integrated health care services for pregnant and postpartum women and their infants. HRSA also must contract with an independent research organization to study and make recommendations to accredited school training programs about discrimination and implicit and explicit biases.

This joint resolution eliminates the deadline for the ratification of the Equal Rights Amendment, which prohibits discrimination based on sex. The amendment was proposed to the states in House Joint Resolution 208 of the 92nd Congress, as agreed to in the Senate on March 22, 1972. The amendment shall be part of the Constitution whenever ratified by the legislatures of three-fourths of the states.

Protecting Benefits for Disabled Veterans Act of 2019 This bill authorizes the Department of Veterans Affairs (VA) to assign, for purposes of the disability compensation program, a disability rating of total to a veteran who meets certain parameters and is unable to secure or maintain substantially gainful employment due to a service-connected disability. Specifically, the VA may make such a disability determination if a veteran has a service-connected disability rated at least 60%, or has two or more service-connected disabilities with one being at least 40% and a combined total of at least 70%. The VA may also make a determination on the disability rating in circumstances where a veteran meeting the specified parameters maintains marginal employment (income is less than the poverty threshold), or if the veteran maintains substantially gainful employment (exceeds the poverty threshold) and the VA determines that the rating is appropriate. The bill prescribes what disabilities may be considered as one disability (e.g., disabilities incurred or aggravated as a prisoner of war). The VA may not consider the age of a veteran or eligibility for retirement benefits when making any determination related to disability rating.

Fair and Clear Campaign Transparency Act This bill directs the Federal Communications Commission to require certain online public inspection files to be made available to the public in a machine-readable format that supports automated searching, bulk downloading, aggregation, manipulation, sorting, and analysis. Online public inspection files (including political files that contain records of requests to purchase broadcast time by or on behalf of candidates for public office or to communicate a message relating to a political matter of national importance) are files that must be uploaded to the internet by television broadcast stations, AM or FM radio broadcast stations, cable operators, direct broadcast satellite service providers, or satellite digital audio radio service providers.

Honest Campaigns Act of 2019 This bill directs the Federal Communications Commission (FCC) to revise its sponsorship identification rules. Specifically, the FCC must require a disclosure announcement for broadcast or origination cablecasting matter that is political or that involves the discussion of a controversial issue of public importance to include the names of significant donors to the person whose identity is required to be disclosed in such an announcement.

State-Based Universal Health Care Act of 2019 This bill establishes the option for states, or groups of states, to apply to waive certain federal health insurance requirements and provide residents with health insurance benefits plans through a state-administered program. Such programs must cover 95% of the residents in the state within five years and plan benefits must be at least as comprehensive and affordable as the coverage under the equivalent federal program. State programs are supported with funds from the federal programs the state programs replace, which may include Medicare, Medicaid, the Children's Health Insurance Program, the Federal Employee Health Benefits program, certain federal tax credits, and premium-assistance funds, among others. The bill requires the Department of Health and Human Services to appoint an Independent Assessment Panel for Comprehensive Care to review and recommend whether to approve state applications. Each approved state program must be independently reviewed every five years to evaluate changes in health benefits access, quality, and coverage, including whether the state has met the 95% coverage requirement. The federal government must pay all health insurance costs for American Indians and Alaska Natives who enroll in a plan through a state insurance program.

Schedules That Work Act This bill provides employees with the right to request changes to their work schedules related to the number of hours they are required to work or be on call, the location of the work, the amount of notification about work schedule assignments, and fluctuations in work hours. Employers must negotiate in good faith with employees who make such requests and comply with certain work schedule notice and split shift pay requirements for retail, food service, cleaning, hospitality, or warehouse employees.

Green Climate Fund Authorization Act of 2019 This bill authorizes U.S. contributions to the Green Climate Fund, a fund established under the United Nations Framework Convention on Climate Change to finance projects to address climate change. Specifically, the bill authorizes contributions as necessary to (1) achieve the greenhouse gas emissions reduction goals under the Paris Agreement, and (2) exceed the commitment by developed countries to jointly mobilize $100 billion for climate financing each year.

Family First Transition Act This bill provides additional funding for, and otherwise modifies, implementation of the Family First Prevention Services Act, which provides state, tribal, and territorial child welfare agencies with certain spending flexibilities to support substance abuse services, mental health services, and other services that prevent children's entry into foster care. Specifically, the bill provides one-time funding to jurisdictions to reduce adverse fiscal impacts associated with transitioning funding sources in relation to the new spending flexibilities. The bill also provides additional funding for FY2020 and FY2021 for jurisdictions with certain waivers (currently set to expire at the end of FY2019) that allow them to provide services not authorized under the traditional foster care program. In addition, the bill temporarily delays a requirement that at least 50% of certain funds be spent on programs and services that meet the criteria for well-supported practices. For FY2020 and FY2021, this requirement shall not apply, and for FY2022 and FY2023, programs and services that meet the criteria for supported practices shall be considered well-supported practices.

Medication Access and Training Expansion Act of 2019 or the MATE Act of 2019 This bill requires prescribers of controlled substances, as a condition of obtaining or renewing their registration with the Drug Enforcement Administration, to complete specified education or training on the prevention, treatment, and management of opioid-use and other substance-use disorders. This education and training shall also satisfy the training requirements currently needed to obtain waivers to prescribe certain medication-assisted treatments for opioid-use disorders in settings other than opioid treatment programs.

Safeguarding Medicare Access to Respiratory Therapy Act of 2019 This bill establishes certain requirements relating to Medicare coverage of ventilators. Specifically, the bill (1) excludes ventilators and other covered respiratory items, as specified, from Medicare's competitive acquisition program (in which rates are set through a competitive bidding program rather than by an established fee schedule); and (2) requires the Centers for Medicare & Medicaid Services to establish a technical expert panel to review, and make recommendations regarding, national coverage determinations with respect to Medicare coverage of ventilators and other specified respiratory devices.

Creating Opportunities Now for Necessary and Effective Care Technologies for Health Act of 2019 or the CONNECT for Health Act of 2019 This bill expands coverage of telehealth services under Medicare. Among other things, the bill allows the Centers for Medicare & Medicaid Services (CMS) to waive certain restrictions, such as geographic restrictions, for services provided in high-need health professional shortage areas; excludes mental health and emergency medical services, as well as services provided at rural health clinics, federally qualified health centers, and Indian Health Service facilities, from such geographic restrictions; and allows the CMS to generally waive coverage restrictions during national emergencies. Additionally, the Medicare Payment Advisory Commission must report on information relating to the access of Medicare beneficiaries to telehealth services at home. The Center for Medicare and Medicaid Innovation may also test alternative payment models relating to expanded telehealth services.

Smoke Planning and Research Act of 2019 This bill requires the Environmental Protection Agency (EPA) to research and mitigate the impacts of smoke emissions from wildland fires. Specifically, the EPA must establish (1) four Centers of Excellence for Wildfire Smoke at institutions of higher education, and (2) a grant program to support community mitigation efforts.

Effective Suicide Screening and Assessment in the Emergency Department Act of 2019 This bill establishes a competitive grant program for up to 40 hospitals with emergency departments and certain on-site professionals to help connect patients in emergency departments who are at risk of suicide with treatment and mental health services. Grants may be used to train emergency department providers and establish certain policies and procedures related to the identification, assessment, and treatment of, and care coordination for, individuals who are at risk of suicide. In awarding the grants, the Department of Health and Human Services may give preference to specified types of hospitals, such as critical access hospitals and hospitals in areas with suicide rates higher than the national average.

Global Child Thrive Act of 2019 This bill reauthorizes for FY2020-FY2025 programs to provide assistance to orphans and other vulnerable children in developing countries. The bill also requires the U.S. Agency for International Development to direct relevant executive branch agencies to incorporate early childhood development into current programs and promote inclusive early childhood development in partner countries. Such actions to promote early childhood development shall build on existing U.S. plans and strategies and aim to (1) prevent unnecessary family-child separation, (2) assist families with children with disabilities, and (3) help countries transition from child care protection systems that rely on residential care (such as orphanages and children's homes) to ones focused on family-based care.

Veteran Deportation Prevention and Reform Act This bill modifies immigration and naturalization procedures for noncitizens who are members or veterans of the Armed Forces. Specifically, the bill requires interagency coordination to (1) identify such individuals who are the subject of immigration removal proceedings or who have already been removed; and (2) naturalize them as citizens or otherwise change their status, as appropriate.

For the 99.8 Percent Act This bill imposes increased tax rates on decedent estates, gifts, and generation-skipping transfers. Estates with a value of over $1 billion are taxed at a 77% tax rate. The basic exclusion amount is reduced to $3.5 million. The bill increases (1) to $3 million the reduction in valuations of farmland for estate tax purposes and adjusts such increased amount for inflation, and (2) to $2 million the maximum estate tax exclusion for contributions of conservation easements. The bill requires (1) consistent basis reporting for property acquired by gift and transfers in trust, and (2) executors of estates and donors of gifts required to file a gift tax return to disclose to the Department of the Treasury, and to recipients of any interest in an estate or a gift, information identifying the value of each interest received. The bill sets forth estate valuation rules for certain transfers of nonbusiness assets and limits estate tax discounts for certain individuals with minority interests in a business acquired from a decedent. The bill expands rules for valuing assets in grantor retained annuity trusts to require that (1) the right to receive fixed amounts from an annuity last for a term of not less than 10 years and not more than the life expectancy of the annuitant plus 10 years, and that such fixed amounts not decrease during the first 10 years of the annuity term, and (2) the remainder interest have a value when transferred that is not less than the the greater of 25% of the fair market value of the trust property or $500,000. The bill also sets forth rules for the application of transfer taxes to a grantor trust (a trust in which the grantor retains control over the trust assets and has the right to receive income from the trust). The bill eliminates the generation-skipping transfer tax exemption for any trust whose termination date is not greater than 50 years after its creation. The bill modifies the gift tax exclusion for annual gifts (currently, $14,000).

Break the Cycle of Violence Act This bill authorizes new grant programs to support violence intervention initiatives. Specifically, the Bureau of Justice Assistance must award grants for coordinated violence reduction initiatives in units of local government that are disproportionately impacted by gun and group-related violence. Additionally, the National Institutes of Health must award grants for hospital-based violence intervention programs that reduce the risk of violent injury and retaliation among high-risk patients.

SOS: Sustaining Outpatient Services Act This bill allows for payment under the Medicare prospective payment system for hospital outpatient department services of certain items and services that are furnished at off-campus outpatient departments. Specifically, the bill allows for payment of items and services for which payments to physician specialists (under the Medicare physician fee schedule) did not exceed $2 million during the previous year.

Alice Cogswell and Anne Sullivan Macy Act This bill expands special education and related services for students who are deaf or hard of hearing, for students with visual disabilities, and for children and youth who are deaf-blind. The individualized education program for each child who is visually and/or hearing impaired must include specified components and must provide the child with instruction that meets the child's unique learning needs. In addition, a state's closure of a special school serving deaf or blind children shall count as a reduction of its financial support for special education and related services. Among other provisions, the bill authorizes support, including grants for training special education personnel, to be used in preparing individuals to become qualified teachers and early intervention specialists for children with hearing disabilities. The bill establishes within the Department of Education the Anne Sullivan Macy Center on Visual Disability and Educational Excellence to better support students with visual disabilities.

White House Accountability for Language Diversity Act This bill requires the White House and each federal agency to establish official websites in the five most commonly used languages in the United States other than English to increase accessibility. The websites must be of a similar scope and content as the English version. The President and each agency shall maintain and update the websites on a regular basis.

Timely ReAuthorization of Necessary Stem-cell Programs Lends Access to Needed Therapies Act of 2019 or the TRANSPLANT Act of 2019 This bill modifies and reauthorizes through FY2025 the C.W. Bill Young Cell Transplantation Program, which provides support to patients who need a potentially life-saving bone marrow transplant or umbilical cord blood transplant. The bill also requires the Department of Health and Human Services to conduct a periodic review of the science of using adult stem cells and birthing tissues in therapeutic treatments.

Safety, Accountability, and Federal Enforcement of Limos Act of 2019 or the SAFE Limos Act This bill establishes safety standards for stretch limousines. Among other requirements, the bill requires safety belts to be installed in stretch limousines with a gross vehicle weight rating greater than 8,500 pounds at each designated seating position, including on side-facing seats; the Department of Transportation (DOT) to develop and issue guidelines, best practices, and recommendations to assist stretch limousine alterers develop and administer a vehicle modifier plan; DOT to complete research into side impact protection, roof crush resistance, and air bag systems for the protection of occupants in stretch limousines given alternative seating positions or interior configurations, including perimeter seating arrangements; stretch limousine operators to disclose (1) the date of the most recent inspection of the limousine required under state or federal law, (2) the results of the inspection, and (3) any corrective actions taken to ensure the limousine passes inspection; and the use of event data recorders in stretch limousines.

Protect Against Conflict by Turkey Act or the PACT Act This bill imposes sanctions and various restrictions related to Turkey's military invasion of northern Syria. The President shall impose visa- and asset-blocking sanctions on specific Turkish officials connected to the invasion, including Turkey's Minister of National Defense. The Department of State shall report to the President and Congress as to (1) other Turkish officials involved with the invasion; and (2) foreign persons that knowingly provided defense articles, services, or technology to Turkey that could be used in the invasion of northern Syria. Such foreign persons shall also be subject to visa- and asset-blocking sanctions. The President shall impose financial sanctions on the large Turkish state-owned bank known as Halk Bankasi or Halkbank and on any financial institutions that the State Department determines to have knowingly facilitated significant transactions for the Turkish Armed Forces or Turkey's defense industry related to the invasion. The President shall impose sanctions on Turkey's government pursuant to the Countering America's Adversaries Through Sanctions Act. A U.S. defense article, service, or technology may not be transferred to Turkey's government if it (1) is covered under the Arms Export Control Act, and (2) may be used by Turkey in military operations in northern Syria. The President may not exercise certain emergency waiver authority related to the Arms Export Control Act in relation to this prohibition. The bill calls for reports on (1) the national security impact of the invasion and, (2) the net worth of Turkish President Tayyip Erdogan and his family.

Health Equity and Access under the Law for Immigrant Women and Families Act of 2019 or the HEAL Immigrant Women and Families Act of 2019 This bill extends Medicaid and Children's Health Insurance Program coverage to individuals lawfully present in the United States who otherwise meet eligibility requirements. Individuals granted federally authorized presence also are required to maintain minimum essential health insurance coverage and are eligible for health insurance exchanges, reduced cost sharing, premium subsidies, and premium tax credits.

End the Limo Loophole Act This bill revises the definition of commercial motor vehicle to include vehicles that are designed to transport 9 or more passengers including the driver (currently, at least 16 passengers including the driver) and requires the Federal Motor Carrier Safety Administration to finalize a rulemaking to require states to implement an annual inspection program for commercial passenger-carrying vehicles.

Sustainable Municipal Access to Resilient Technology in Infrastructure Act or the SMART Infrastructure Act This bill directs a state or locality that receives funds from the Federal Highway Administration, the U.S. Army Corps of Engineers, the Environmental Protection Agency (EPA), or the Department of Agriculture (USDA) to require open and free competition among suppliers of construction materials. The Department of Transportation, the EPA, the Corps of Engineers, and USDA shall establish an interagency task force to issue a comprehensive report on federally funded infrastructure projects.

College Affordability Act This bill reauthorizes and revises the Higher Education Act of 1965, including to revise federal student financial aid programs, consolidate federal student loans and expand loan forgiveness , increase college access and success for certain students, and revise accountability measures. Specifically, the bill revises financial aid programs, including to (1) increase the maximum federal Pell Grant award, (2) provide incentives for states to fund public institutions of higher education (IHEs), and (3) increase and make permanent funding for minority-serving IHEs. The bill also revises federal student loan programs, including to (1) replace existing student loan repayment plans with one income-based repayment plan and one fixed repayment plan, (2) allow existing borrowers to lower their payments by switching to the new plans, and (3) expand public service loan forgiveness programs (e.g., TEACH grants) and create appeal processes for denied applications. In addition, the bill increases college access and success for certain students (e.g., students with low-income, children, or the disabled) through investments and practices, such as student support services and accelerated learning opportunities. Finally, the bill revises accountability measures for IHEs (including for-profit IHEs), job training programs, college accrediting agencies, and lenders. In particular, the bill updates the performance goals of the Office of Federal Student Aid and requires the Department of Education to be responsible for the oversight of the office.

National World War II Memorial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the National World War II Memorial in the District of Columbia. The design of the coins shall be emblematic of the memorial and the service and sacrifice of American soldiers and civilians during World War II. All surcharges received from the sale of such coins shall be paid to the Friends of the National World War II Memorial to support the National Park Service in maintaining and repairing the memorial, and for educational and commemorative programs.

Equitable Student Aid Access Act This bill revises certain income requirements for calculating federal student financial aid amounts, and it requires the Department of Education (ED) to publish certain requirements for financial aid offers. Specifically, the bill eliminates the simplified needs test in financial aid applications for families with income below a specified threshold, and it increases the income threshold that automatically qualifies a student for certain financial aid. When determining the total income of an applicant or an applicant's household, ED shall provide for the use of data from the second preceding tax year to simplify applications used for the estimation and determination of financial aid eligibility. ED must also conduct consumer testing to serve as the basis for determining requirements for financial aid offers. A financial aid offer must contain information such as cost of attendance and sources of available financial aid, as well as a standardized quick reference box to enable comparison of information on college costs and financial aid.

Stopping Harmful Interference in Elections for a Lasting Democracy Act or the SHIELD Act This bill establishes a duty to report election interference from foreign entities, applies existing campaign advertising requirements to online advertisements, and generally limits political spending and election interference by foreign entities. Specifically, a political committee must report certain foreign contacts involving an offer of unlawful election assistance to the Federal Bureau of Investigation and the Federal Election Commission. The bill establishes criminal penalties for violations of these requirements. Existing requirements for political advertisements and electioneering communications apply to internet and digital advertisements, including requirements related to disclosures and contributions. Additionally, large online platforms must maintain a public database of certain political advertisements. The bill places limitations on political spending by foreign entities. Specifically, foreign entities may not (1) contribute to campaigns related to ballot initiatives and referenda, or (2) make disbursements for certain internet activity referring to a candidate or a political issue. A candidate is prohibited from offering to share nonpublic campaign information with certain foreign entities. The bill also prohibits (1) the dissemination of false statements regarding federal elections or public endorsement, or (2) the intentional hindering of voting or registering to vote. The bill establishes criminal penalties and a private right of action with respect to these prohibitions.

Suicide Prevention Lifeline Improvement Act of 2019 This bill expands the requirements for the National Suicide Prevention Lifeline Program. Specifically, the Substance Abuse and Mental Health Services Administration must (1) develop a plan to ensure the provision of high quality service, (2) strengthen data-sharing agreements to facilitate the transmission of epidemiological data from the program to the Centers for Disease Control and Prevention, and (3) implement a pilot program focused on using other communications platforms (e.g., social media and texting) for suicide prevention. The bill also directs the Government Accountability Office to study the program.

Veterans' Right to Breathe Act This bill provides a presumption of service connection to burn pit-exposed veterans for certain diseases. Under a presumption of service connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. A burn pit-exposed veteran is a veteran who was supporting a contingency operation on or after January 1, 1990, and was stationed at a location where an open burn pit (an area used for burning solid waste in open air without equipment) was used.

Stop Mental Health Stigma in Our Communities Act This bill requires the Substance Abuse and Mental Health Services Administration to develop and implement an outreach and education strategy regarding behavioral health issues among the Hispanic and Latino populations. The strategy must be designed to promote behavioral and mental health and reduce stigma associated with mental health conditions and substance abuse among such populations.

This bill requires the Department of Veterans Affairs (VA) to establish a policy to end harassment and sexual assault, including sexual and gender-based harassment, at its facilities. The VA must also designate points of contact at each VA facility, Veterans Integrated Service Network, and at the Central Office of the VA to receive reports of harassment and sexual assault.

Public Servants Protection and Fairness Act This bill establishes an alternative formula to calculate Old-Age, Survivors, and Disability Insurance benefits for those who receive pensions for certain non-covered employment. (The existing formula is known as the windfall elimination provision.) The alternative formula adjusts an individual's total lifetime earnings based on the proportion of covered earnings (i.e., earnings subject to Social Security payroll taxes). It applies to individuals who (1) first become eligible for benefits after 2021, (2) have earnings from non-covered service performed after 1977 and (3) have less than 30 years of coverage (i.e., years in which a beneficiary is considered to have contributed a substantial amount into the Social Security trust funds). Beneficiaries receive the higher benefit amount as calculated under the alternative method or the existing formula. In addition, the bill provides rebates for certain beneficiaries currently impacted by the existing formula. The Social Security Administration must include non-covered earnings in Social Security account statements, and the Government Accountability Office must study the availability of certain information related to retirement plans maintained by state and local governments.
