Full Expensing for Economic Growth Act of 2003 - Amends the Internal Revenue Code with respect to the special first-year allowance for certain property acquired after September 10, 2001 and before September 11, 2004, to increase such allowance to 100 percent for 18 months from the date of enactment of this Act, if there was no written binding contract in effect before such date, for: (1) the acquisition of such property; or (2) in the case of property manufactured, constructed, or produced for the taxpayer's own use, for the manufacture, construction, or production of such property.

ADA Notification Act - Amends the Americans with Disabilities Act of 1990 to deny jurisdiction to a court in a civil action for remedies unless the complainant has implemented specified notification procedures that include opportunity for correction of the alleged violation. States that, if a complainant fails to provide such an opportunity, the court: (1) shall impose an appropriate sanction upon the attorneys involved (notwithstanding the court's lack of jurisdiction to proceed with the action); and (2) may not allow plaintiff's attorneys' fees or costs (including litigation expenses) even if the notification criteria are subsequently met and the civil action proceeds.

Amateur Radio Spectrum Protection Act of 2003 - Prohibits the Federal Communications Commission (FCC), after July 1, 2003, from reallocating primary allocations of bands of frequencies of the amateur radio and amateur satellite services, diminishing the secondary allocations of such bands to such services, or making additional allocations within such bands that would substantially reduce their utility to the amateur radio or satellite service, unless the FCC provides equivalent replacement spectrum to amateur radio and satellite service.

Small Airport Safety, Security, and Air Service Improvement Act of 2003 - Amends Federal aviation law to make eligible for airport development project funds the construction of an air traffic control tower or the acquisition and installation of air traffic control, communications, and related equipment at a tower under specified terms. Authorizes the Secretary of Transportation under the air traffic control contract program to provide grants to a sponsor of a primary airport or a nonprimary airport from certain airport development and noise compatibility planning program funds for: (1) the construction or improvement of a nonapproach control tower (formerly known as a level I air traffic control tower); (2) the acquisition and installation of air traffic control, communications, and related equipment to be used in that tower; and (3) reimbursement for the cost of tower construction or improvement, and acquisition and installation in the tower of such equipment, if certain requirements are met. Revises eligibility requirements with respect to such grants. Limits the Federal share of cost of construction of a nonapproach control tower to no more $1.1 million. Authorizes the Administrator of the Federal Aviation Administration to enter into a lease agreement or contract agreement with a private entity to provide for construction and operation of a nonapproach control tower. Sets forth certain agreement terms and conditions.

Improved Nutrition and Physical Activity Act (IMPACT Act) - Amends the Public Health Service Act to address issues of overweight and obesity. Modifies an existing grant program funding the training of health profession personnel to include the treatment of overweight and obesity among categories to which the Secretary of Health and Human Services is directed to give special consideration. Creates a grant program to fund the training of health professionals to: (1) treat and prevent obesity; and (2) aid people who are overweight. Creates grant programs at the local level to promote increased physical activity and improved nutrition. Targets partnerships with businesses, schools, senior centers, day care facilities and other institutions. Expands an existing coordinated school health program to include grants for the development of programs which focus on healthy lifestyle, including balanced diet and physical activity. Permits the use of preventive health and health services block grants for community education programs which promote healthy eating and exercise habits. Directs the Secretary to consider geographic diversity in issuing such grants and to ensure that such grants focus on physical activity and food-based research. Creates a Medicare demonstration project to reduce obesity and other chronic disease risks in older Americans. Makes grants available to local healthcare delivery systems for overweight and obesity treatment and prevention demonstration programs. Makes grants available for a national campaign to change children's health behaviors. Promoting Healthy Eating Behaviors in Youth Act - Directs the Secretary, acting through the Director of the Centers for Disease Control and Prevention, to award competitive grants to States, political subdivisions of States, and other entities for the implementation of State and community-based intervention programs to promote good nutrition, including in children and adolescents. Sets forth a sunset date for such grants of five years after the enactment of this Act.

Directs the Secretary of the Interior to study the Rathdrum Prairie/Spokane Valley Aquifer for the purpose of preparing a model of the aquifer and establishing for the States of Idaho and Washington a mutually acceptable understanding of the aquifer as a groundwater resource.

Health Care for Filipino World War II Veterans Act - Requires (current law authorizes) the Secretary of Veterans Affairs to furnish hospital and nursing home care and medical services to any individual who is a Commonwealth Army veteran or new Philippine Scout (current law) and who is: (1) residing in the United States; and (2) a U.S. citizen or alien lawfully admitted for permanent residence. Provides a rate of payment equal to the rate provided for active-service veterans and their survivors for: (1) dependency and indemnity compensation for the survivors of Commonwealth Army veterans or new Philippine Scouts; and (2) veterans' disability compensation for new Philippine Scouts residing in the United States. Provides national cemetery burial benefits for new Philippine Scouts.

Veterans Prescription Access Improvement Act - Requires the Secretary of Veterans Affairs to furnish to a veteran such drugs and medicines as may be ordered on prescription of a duly licensed physician in the treatment of any illness or injury of such veteran. (Currently, other requirements must be met before such veterans will be furnished drugs and medicines on private practitioner prescriptions.)

Small Business Health Fairness Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to revise provisions relating to access and choice for small business employers with respect to medical care for their employees. Establishes rules governing association health plans (group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations), including requirements relating to certification, sponsors and boards of trustees, participation, coverage, plan documents, contribution rates, benefit options, applications for certification, notice for voluntary termination, corrective actions, and mandatory termination. Requires association health plans which provide health benefits in addition to health insurance coverage to maintain certain reserves and comply with other solvency provisions. Directs the Secretary of Labor to apply for appointment, and carry out specified duties, as trustee of any such insolvent association health plans which provide health benefits in addition to health insurance coverage. Allows a State to impose a contribution tax on any association health plan commencing operations in such State after the enactment of this Act. Requires association health plans to include in their summary plan descriptions, in connection with each benefit option, a description of the form of any solvency or guarantee fund protection secured under ERISA or applicable State law. Revises provisions relating to treatment of: (1) single employer arrangements; and (2) certain collectively bargained arrangements. Provides for association health plans with respect to: (1) enforcement; (2) cooperation between Federal and State authorities; and (3) treatment of certain existing health benefit programs.

Filipino Veterans Equity Act of 2003 - Deems certain service performed before July 1, 1946, in the organized military forces of the Philippines and the Philippine Scouts as active military service for purposes of eligibility for veterans' benefits through the Department of Veterans Affairs. Repeals certain provisions discounting such service as qualifying service.

Expresses the sense of the House of Representatives that: (1) a commemorative postage stamp should be issued by the United States Postal Service on the subject of autism awareness; and (2) the Citizens' Stamp Advisory Committee should recommend to the Postmaster General that such a postage stamp be issued.

Citizens' Self-Defense Act of 2003 - Declares that a person not prohibited under the Brady Handgun Violence Prevention Act from receiving a firearm shall have the right to obtain firearms for security and to use firearms in defense of: (1) self or family against a reasonably perceived threat of imminent and unlawful infliction of serious bodily injury; (2) self or family in the course of the commission by another person of a violent felony against the person or a member of the person's family; and (3) the person's home in the course of the commission of a felony by another person. Authorizes persons whose rights under this Act have been violated to bring an action in U.S. district court against the United States, any State, or any person for damages, injunctive relief, and such other relief as the court deems appropriate. Sets forth provisions regarding: (1) the award of attorney's fees; and (2) the statute of limitations.

Medicare Fairness for Organ Transplant Recipients Act of 2003 - Amends title XVIII (Medicare) of the Social Security Act to provide for coverage under the Medicare program of immunosuppressive drugs for Medicare beneficiaries who receive an organ transplant without regard to whether Medicare paid for the transplant (or when the transplant was received).

Federal Deposit Insurance Reform Act of 2003 - Mandates the merger of the Bank Insurance Fund and the Savings Association Insurance Fund into the Deposit Insurance Fund. Amends the Federal Deposit Insurance Act (FDIA) and the Federal Credit Union Act to: (1) increase the amount of deposit insurance coverage; (2) couple such increase with an inflation adjustment; and (3) double the amount of deposit insurance for certain retirement accounts. Amends the FDIA to replace assessment guidelines for achieving and maintaining a designated reserve ratio and for independent treatment of deposit insurance funds with a requirement that the Board of Directors of the FDIC set assessments as it determines appropriate, including a maximum base rate for assessments at one basis point for insured depository institutions in the lowest-risk category. Reduces from five years to three years the mandatory assessment recordkeeping period. Replaces the current 1.25 percent statutory reserve ratio used to recapitalize undercapitalized insurance funds with a reserve ratio range of 1.15 to 1.4 percent of estimated insured deposits, subject to specified factors and annual redetermination. Instructs the FDIC to establish a Deposit Insurance Fund Restoration Plan to ensure adequate reserves whenever the actual ratio in the DIF falls below certain criteria.

Back to Work Incentive Act of 2003 - Amends the Workforce Investment Act of 1998 to direct the Secretary of Labor to allot grants to States to allocate funds to local areas to establish personal reemployment accounts for individuals identified as likely to exhaust their unemployment compensation. Provides for such accounts to: (1) accelerate reemployment; (2) promote retention in employment; and (3) give individuals more flexibility, choice, and control in obtaining intensive reemployment, training, and supportive services (as well as assistance in purchasing or leasing an automobile when necessary to allow the recipient to accept a long-term employment offer). Allows such services to be purchased through a one-stop delivery system or other providers. Permits certain amounts in accounts to be used for income support. Provides for reemployment bonuses. Requires States to establish a uniform statewide amount, up to $3,000, for each individual account. Limits the time in which amounts in an account may be used to not more than one year after the account's establishment. Prohibits the establishment of any such account beginning two years after the enactment of this Act.

Children First SCHIP Improvement Act of 2003 - Amends title XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act to provide for: (1) extending the availability through FY 2004 of SCHIP allotments for FY 1998 through 2000; and (2) SCHIP coverage of children whose family income exceeds the Medicaid applicable income level for eligible States.

Amends the Federal Law Enforcement Pay Reform Act of 1990 to revise the special pay adjustments for (percentage differentials payable to) Federal law enforcement officers in specified consolidated metropolitan statistical areas. Includes Capitol Police as law enforcement officers under such Act. Eliminates the limitation on the aggregate of basic pay and premium pay with respect to availability pay for Federal criminal investigators.

Instructional Materials Accessibility Act of 2003 - Directs Secretary of Education to: (1) develop and publish instructional materials accessibility standards for the national electronic file format to be used by publishers of instructional materials in the preparation of electronic files suitable for efficient conversion into specialized formats; (2) establish a National Instructional Materials Accessibility Advisory Committee to provide technical expertise and guidance in creating such national electronic file format; (3) periodically review and amend such standards to reflect technological advances or changes; and (4) establish a National Instructional Materials Access Center. Requires State educational agencies, as a condition for receiving Federal financial assistance under the Individuals with Disabilities Education Act, to develop and implement statewide plans and make contracts with publishers to ensure that instructional materials for classroom use in elementary and secondary schools are made available in specialized formats to individuals who are blind or have other print disabilities at the same time such materials are provided to individuals without such disabilities. Authorizes the Secretary to make grants to eligible entities to provide or improve their capacity to prepare or obtain instructional materials in specialized formats, including the national electronic format. Provides for enforcement of rights of children and parents under this Act.

Family Farm Protection Act - Amends the Internal Revenue Code to exclude from gross income any gain on the sale of a qualified family farm interest to a family member of the taxpayer. Requires the taxpayer (or a member of the taxpayer's family) to have participated materially in the farming business operation during the five years preceding the sale, and requires the family member purchasing the interest to participate materially during the five years following the sale. Provides for recapture of tax foregone because of the exclusion if during the five years following the sale: (1) the interest ceases to be used in a farming business; or (2) the purchasing family member fails to participate materially in the farming business.

Social Security Benefits Tax Relief Act of 2003 - Amends the Internal Revenue Code to repeal the 85 percent (second tier) taxation of Social Security and Railroad Retirement benefits. Appropriates, from the general fund, to the Hospital Insurance Trust Fund amounts equal to the reduction in revenue lost because of the repeal. Requires an annual report concerning the funds transferred from the general fund to the Trust Fund.

National AMBER Alert Network Act of 2003 - Requires the Attorney General to assign an AMBER Alert Coordinator of the Department of Justice to act as the national Coordinator of the AMBER Alert communications network regarding abducted children. Requires the coordinator to: (1) seek to eliminate gaps in the network; (2) work with States to encourage the development of additional network elements and to ensure regional coordination; and (3) act as the nationwide point of contact for network development and for regional coordination of alerts on abducted children through the network. Directs the Coordinator to: (1) notify and consult with the Federal Bureau of Investigation concerning each child abduction for which an AMBER Alert is issued; and (2) establish minimum standards for the issuance of alerts and for the extent of their dissemination (limited to the geographic areas most likely to facilitate the recovery of the abducted child). Requires the Secretary of Transportation to provide grants to States for the development or enhancement of notification or communications systems along highways for alerts and other information for the recovery of abducted children. Includes among permissible activities the development or enhancement of electronic message boards, and the placement of additional signage, along highways. Directs the Attorney General to provide grants to States for the development or enhancement of programs and activities for the support of AMBER Alert communications plans.

Declares that failure to comply with this requirement shall give rise to a point of order in either House of Congress.

Personal Responsibility in Food Consumption Act - Shields the manufacturer, distributor, or seller of a food or non-alcoholic beverage product intended for human consumption from civil liability, relating to consumption of such products, in Federal or State court, unless the plaintiff proves that the product was not in compliance with applicable statutory and regulatory requirements at the time of sale.

National Right-to-Work Act - Amends the National Labor Relations Act and the Railway Labor Act to repeal those provisions that permit employers, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).

National Naval Force Structure Policy Act - States that it is U.S. policy to rebuild as soon as possible the size of the U.S. Navy fleet to no fewer than 375 vessels in active service, including 15 aircraft carrier battle groups and 15 amphibious ready groups.

Liver Research Enhancement Act - Amends the Public Health Service Act to establish the National Center on Liver Disease Research in the National Institute of Diabetes and Digestive and Kidney Diseases. Establishes the Liver Disease Research Advisory Board to help the Director of the Center develop the Liver Disease Research Action Plan identifying scientific opportunities and priorities of liver disease research. Requires the Director to coordinate the Plan's implementation by the national research institutes, which shall allocate adequate funds for same.

Human Cloning Prohibition Act of 2003 - Prohibits any person or entity, in or affecting interstate commerce, from knowingly: (1) performing or attempting to perform human cloning; (2) participating in such an attempt; (3) shipping or receiving an embryo produced by human cloning; or (4) importing such an embryo. Sets forth criminal and civil penalties. Provides that nothing in this Act restricts areas of scientific research not specifically prohibited above, including research in the use of nuclear transfer or other cloning techniques to produce molecules, DNA, cells other than human embryos, tissues, organs, plants, or animals other than humans. Directs the General Accounting Office to assess the need for amendment of such prohibition, including through: (1) a discussion of new developments, the need for somatic cell transfer to produce medical advances, current public attitudes and prevailing ethical views concerning its use, and potential legal implications of somatic cell transfer research; and (2) a review of any technological developments that may require technical changes to such prohibition.

Plant Breeders Equity Act of 2003 - Amends Federal patent law to declare that no plant patent application shall be denied, nor shall any issued plant patent be invalidated, on the grounds that the invention was described in a U.S. or foreign printed publication, unless it was described in such a publication more than ten years before the date of the application for U.S. patent.

Retired Pay Restoration Act of 2003 - Permits retired members of the armed forces with service-connected disabilities to be paid both military retired pay and veterans' disability compensation. Repeals provisions providing for special compensation for certain severely disabled military retirees and certain combat-related disabled uniformed services retirees.

Access to Hospitals Act of 2003 - Amends title XIX (Medicaid) of the Social Security Act to repeal specified reductions after FY 2000 and thereby extend certain modifications to disproportionate share hospital (DSH) allotments provided under the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000. Increases the Medicaid DSH allotment for the District of Columbia.

Inflammatory Bowel Disease Act - Requires the Director of the National Institute of Diabetes and Digestive and Kidney Diseases to expand activities addressing inflammatory bowel disease, emphasizing genetic, animal model, and clinical research. Requires the Director of the Centers for Disease Control and Prevention to establish a national program of prevention and epidemiology concerning such disease, addressing its prevalence and public and professional awareness. Directs the Institute of Medicine of the National Academies of Science to study public and private insurance standards for coverage of inflammatory bowel therapies. Directs the General Accounting Office to study problems inflammatory bowel disease patients have applying for disability insurance benefits under the Social Security Act.

Housing Bond and Credit Modernization and Fairness Act of 2003 - Amends the Internal Revenue Code to: (1) repeal the required use of certain principal repayments on mortgage subsidy bond financings to redeem bonds; (2) modify the purchase price limitation under mortgage subsidy bond rules based on median family income; and (3) define the term "area median gross income" for low-income housing credit projects.

Farm Disaster Emergency Assistance Act of 2003 - Directs the Secretary of Agriculture to provide: (1) emergency financial assistance to agricultural producers who have incurred qualifying 2001 or 2002 crop losses due to weather or related conditions; and (2) payments to livestock producers who have incurred 2001 and 2002 losses in an emergency-designated county, with discretionary set-asides for the American Indian livestock program. Permits producers with qualifying losses in both years to elect to receive payments in either, but not both, of such years. Makes producers ineligible for crop disaster assistance if they did not: (1) get Federal crop insurance for insurable commodities; and (2) file required paperwork and pay related fees for noninsurable commodities. Sets forth waiver provisions. Directs the Secretary to transfer specified Commodity Credit Corporation amounts to a certain account established to encourage domestic consumption and foreign exportation of agricultural commodities.

Farmland Capital Gains Equity Act of 2003 - Amends the Internal Revenue Code to provide an exclusion from gross income of gain from the sale of qualified farm property similar to the exclusion of gain on the sale of a principal residence. Excludes from gross income up to $500,000 ($250,000 in the case of a married individual filing a separate return), reduced by the aggregate amount of gain excluded for all preceding taxable years.

Houses of Worship Free Speech Restoration Act - Amends the Internal Revenue Code to state that churches and other houses of worship shall not lose such designation because of the content, preparation, or presentation of any homily, sermon, teaching, dialectic, or other presentation made during religious services or gatherings. States that such provision shall not affect campaign finance laws under the Federal Election Campaign Act of 1971.

Veterans Prescription Drug Equity Act - Requires the Secretary of Veterans Affairs to furnish prescription drugs ordered by a duly licensed physician or other health-care professional to a veteran if: (1) the veteran has made an appointment to see a Department of Veterans Affairs physician for the sole purpose of obtaining a prescription for the treatment of any illness or injury; and (2) at least 30 days has elapsed without the veteran obtaining the prescription.

Law Enforcement Officers Safety Act of 2003 - Amends the Federal criminal code to authorize qualified law enforcement officers (including certain qualified retired officers) carrying the photographic identification issued by their governmental agency, notwithstanding State or local laws, to carry a concealed firearm. Provides that such authorization shall not supersede State laws that: (1) permit private entities to prohibit the possession of concealed firearms on their property; or (2) prohibit the possession of firearms on State or local government property. Excludes from the definition of "firearm" any machine gun, firearm silencer, or destructive device.

Establishes within the Department of Health and Human Services (HHS) the Office of the Assistant Secretary for Indian Health to facilitate advocacy for the development of appropriate Indian health policy, and to promote consultation on matters related to Indian health, in a manner consistent with the government-to-government relationship between the United States and Indian tribes. Elevates the position of Director of the Indian Health Service to such Assistant Secretary position. Prescribes duties.

Arctic Coastal Plain Domestic Energy Security Act of 2003 - Instructs the Secretary of the Interior to establish and implement a competitive oil and gas leasing program that will result in an environmentally sound program for the exploration, development, and production of the oil and gas resources of the Coastal Plain. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal the prohibition against production of oil and gas from the Arctic National Wildlife Refuge and any leasing or development leading to such production. States that, for purposes of the National Wildlife Refuge System Administration Act of 1966, the Coastal Plain oil and gas leasing program is compatible with the purposes for which the Arctic National Wildlife Refuge was established, and that no further findings or decisions are required to implement this determination. Authorizes the Secretary to: (1) designate a maximum total of Coastal Plain acreage as "Special Areas;" (2) permit oil and gas exploration leasing in such Areas (but prohibit surface occupancy); and (3) permit horizontal drilling technology from lease sites located outside the Special Areas. States that this Act constitutes the Secretary's sole authority to close Coastal Plain lands to oil and gas leasing and to exploration, development, and production. Prescribes procedures for: (1) lease sales; (2) grants of leases; (3) lease terms and conditions; and (4) coastal plain environmental protection. Shields rights-of-way and easements issued by the Secretary for the transportation of oil and gas across the Coastal Plain from Title XI of the Alaska National Interest Lands Conservation Act of 1980. Directs the Secretary to convey: (1) the surface estate of specified lands to the Kaktovik Inupiat Corporation; and (2) the remaining subsurface estate of specified lands to the Arctic Slope Regional Corporation. Establishes the Coastal Plain Local Government Impact Aid Assistance Fund to provide financial assistance to specified entities that are directly impacted by oil and gas production and exploration on the coastal Plain.

Project Exile Safe Streets and Neighborhoods Act of 2003- Amends the Violent Crime Control and Law Enforcement Act of 1994 to direct the Attorney General to provide firearms sentencing incentive grants to eligible States that: (1) demonstrate that they have implemented laws requiring that any person who uses or carries a firearm in any violent crime or serious drug trafficking crime be sentenced to not less than five years in prison (without the possibility of parole) in addition to the punishment provided for such crime, or requiring that any person who possesses a firearm, having at least one prior conviction for a violent crime, be sentenced to five years' imprisonment (without the possibility of parole); or (2) can demonstrate that they have in effect an equivalent Federal prosecution agreement; and (3) demonstrate that they have or will implement a public awareness and community support program that seeks to build support for, and warns potential violators of, such firearms sentencing laws; and (4) provide assurances that they will coordinate with Federal prosecutors and Federal law enforcement agencies and will allocate resources to reduce crime in high-crime areas. Sets forth allowable uses for such grants, including to: (1) support law enforcement agencies, prosecutors, courts, probation officers, correctional officers, the juvenile justice system, the improvement of criminal history records, or case management programs involving the sharing of information about serious offenders; (2) carry out such a public awareness and community support program; and (3) build or expand correctional facilities.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956, and the Revised Statutes of the United States, to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from determining that real estate brokerage activity or real estate management activity is financial in nature, is incidental to any financial activity, or is complementary to a financial activity. (In effect, prohibits financial holding companies and national banks from engaging, directly or indirectly, in real estate brokerage or real estate management activities.) Exempts from such prohibition: (1) activities of a bank holding company (or any affiliate) that directly relate to managing any real property owned by national banks or their affiliates; and (2) the right, power, or ability of any financial holding company to engage in any activity, or acquire or retain the shares of any company engaged in an activity authorized for financial holding companies on December 6, 2001 ("grandfather clause").

Harmful Invasive Weed Control Act - Directs the Secretary of the Interior to establish a program to provide financial assistance through States to eligible weed management entities to control or eradicate harmful, invasive weeds on public and private land. Requires the allocation of certain funds to States and Indian tribes to carry out projects approved by States and Indian tribes for such purposes. Reserves five percent of such funds for allocation to Indian tribes. Prohibits such assistance from being used to carry out projects to control or eradicate animal pests. Allows an Indian tribe, if the funds allocated to tribes are not sufficient to provide such assistance to each weed management entity of a tribe, to seek additional funding by participating as a local stakeholder in the establishment of such an entity. Permits any activity involving real property to be carried out only with the consent of the landowner.

Death Tax Permanency Act of 2003 - Amends title IX (Compliance with Congressional Budget Act) of the Economic Growth and Tax Relief Reconciliation Act of 2001 (P.L. 107-16) to repeal the sunset provisions applicable to title V (Estate, Gift, and Generation-Skipping Transfer Taxes) of such Act. (Makes estate tax repeal permanent.) States that such amendments shall take effect as if included in section 901 of such Act.

Investor Protection, Market Stabilization, and Tax Fairness Restoration Act of 2002 (sic) - Amends the Internal Revenue Code to allow a tax credit for a taxpayer other than a corporation in an amount equal to the shareholder credits determined with respect to dividends received from domestic corporations. Sets a maximum amount for the credit. Prohibits the allotting of credit in certain instances to nonresident aliens. Provides criteria for calculating a shareholder credit for a dividend. Classifies any shareholder credit determined under this Act as a tax paid by the relevant corporation. Includes a taxpayer's shareholder credits in gross income. Permits a corporation to deduct 100 percent of the amount received as dividends from a domestic corporation (presently the Code allows a deduction of 70 percent or 100 percent, depending on the type of dividend). Increases, from 70 to 100 percent, the amount a corporation is allowed to deduct with respect to dividends on certain preferred stock.

Disapproves the rule submitted by the Centers for Medicare & Medicaid Services, Department of Health and Human Services, relating to revisions to payment policies under the Medicare physician fee schedule for calendar year 2003, and the inclusion of registered nurses in the personnel provision of the critical access hospital emergency services requirement for frontier areas and remote locations.

Amends the Public Health Service Act to authorize appropriations for the special diabetes programs for type I diabetes and Indians through FY 2008. Extends until January 1, 2007, the date by which the Secretary of Health and Human Services shall submit a final report to Congress evaluating such programs.
